Poursuivi en justice par une ancienne patiente traumatisée et s'estimant mutilée après qu'il a procédé à l'ablation de ses petites lèvres et de son capuchon clitoridien quand elle avait treize ans, un chirurgien esthétique exerçant à Melbourne est parvenu à un accord financier amiable avec la plaignante.

Le docteur Asarjahu Granot avait été assigné en justice en juin 2021 pour des accusations de négligence, dont une allégation que l'opération effectuée ne concorde pas avec l'intervention chirurgicale à laquelle la mère de l'adolescente avait consenti. L'assignation mentionne également que « l'accusé a quitté le bloc opératoire pour venir montrer à la mère de la plaignante les petits lèvres et le capuchon clitoridien qu'il venait de retirer ».

L'accord entre les parties comprenant une importante compensation financière, que l'ancienne patiente et ses avocats ont accepté le mois dernier, permet donc au Dr Granot d'éviter un procès. La somme exacte fait l'objet d'un accord de confidentialité et sera versée par l'assurance du médecin. L'avocate de la plaignante, Kathryn Footner, a refuser de commenter cette décision.

La plainte contre le chirurgien a provoqué de nouvelles demandes pour un encadrement plus strict de l'industrie de la chirurgie esthétique, de plus en plus populaire dans le pays, et pose la question de la pertinence d'une telle opération sur une adolescente.

La mère de la jeune fille l'avait emmenée consulter le Dr Granot parce que l'adolescente s'inquiétait de l'apparence de sa vulve. Le médecin leur avait alors déclaré que ses petites lèvres étaient malformées, mais que cette anomalie pouvait être corrigée chirurgicalement par une labioplastie.

Cette ancienne patiente, aujourd'hui âgée de 27 ans et étudiante en médecine, raconte à The Age que son corps est irrémédiablement abîmé par l'opération subie dans la clinique de Malvern East en 2008. Elle a déclaré qu'aucune compensation financière ne pourrait jamais compensé la faute commise.

« Je n'ai plus une anatomie normale » dit-elle. « Je n'ai pas de petites lèvres et il a réduit à rien mon capuchon clitoridien, qui ne sert plus à rien. Je ne peux pas avoir de relations amoureuses normales. » La jeune femme, qui a demandé à conserver son anonymat, affirme que le Dr Granot ne l'a jamais informée des risques liés à l'opération. « Les enfants ne peuvent pas comprendre comment une telle opération peut les affecter par la suite. Même si on leur expliquait correctement, ils n'ont pas la maturité pour comprendre. »

Elle avait fait un signalement en 2019 auprès de la AHPRA, l'agence de contrôle des professionnels de santé australienne, qui a jugé en 2020 que le médecin n'était pas en tort. A 72 ans, le chirurgien esthétique continue d'exercer dans la même clinique, qui vante ses 35 ans d'expérience et sa formation sur son site internet. Asarjahu Granot n'a pas répondu à nos demandes d'entretien.

D'après le communiqué en sa défense publié par ses avocats en août dernier, le médecin nie avoir fait preuve de négligence et assure que l'intervention a bien été réalisée pour corriger une anomalie. Il nie également avoir retiré le capuchon clitoridien de la plaignante.

« Il a agit d'une manière qui [à l'époque de l'opération] était largement considérée en Australie par un nombre un important de praticiens respectés dans le domaine  comme une pratique recommandée dans de telles circonstances » retrouve-t-on dans cette déclaration.

Cependant, Mark Ashton, professeur de chirurgie et d'anatomie à l'Université de Melbourne, affirme qu'une labioplastie n'aurait jamais dû être pratiquée sur une enfant de treize ans.

« Quel médecin peut trouver cela raisonnable ? Comment une agence de régulation peut-elle considérer cela comme une pratique acceptable ? » dit-il.

Le professeur confie avoir dû pratiquer des chirurgies réparatrices sur plus de 25 anciens patients du Dr Granot.

« Il y a un flot permanent de patients qui sont continuellement mutilés par quelques chirurgiens dont la formation est au mieux basique et au pire erronée. L'agence de contrôle devrait s'en occuper, mais ils ont l'air de s'être endormis au volant » dit le Dr Ashton, qui est également un ancien président de l'Australian Society of Plastic Surgeons.

Le porte-parolat de l'agence de régulation des professionnels de santé n'a pas voulu s'exprimer sur leur investigation de ce cas de labioplastie par le Dr Granot en 2008, mais a déclaré que l'industrie de la chirurgie esthétique était actuellement le sujet de la rédaction d'un rapport qui devrait se conclure le moins prochain.

« Le rapport concerne la régulation de cette industrie en forte croissance et les éventuelles améliorations nécessaire à une plus grand sécurité des patients. » annonce une porte-parole de l'agence.

Le docteur Granot avait déjà été réprimandé par l'AHPRA en 2015 après avoir déclaré dans un article pour The Sidney Morning Herald avoir pratiqué des liposucions sur trois de ses filles, l'une d'elle ayant seulement dix-sept ans à l'époque. « Vu que je suis chirurgien esthétique, je regarde tout le monde sous cet angle. Si je vais à la plage, je ne vois pas des femmes en bikini, je vois un ensemble de défauts. » disait-il. « Quand je regarde mes filles, je les examine en détail aussi, d'ailleurs j'ai fait des liposucions à trois d'entre elles. Les autres parents aussi font profiter leurs enfants de leurs domaines d'expertise. Le mien, c'est la chirurgie esthétique, pourquoi je ne leur en ferai pas profiter ? »

L'AHPRA avait accusé le chirurgien d'avoir outrepasser « des principes fondamentaux de la bonne pratique médicale » mais ne l'avait pas sanctionné : « Le docteur Granot reçoit un blâme pour avoir pratiqué des liposuccions sur des membres de sa famille dans des circonstances qui ne relevaient pas de l'urgence ni de la nécessité médicale, l'une des patientes étant mineure au moment des faits. » pouvait-on lire dans la déclaration de l'AHPRA en 2015.

I feel like a lot of progressive types aren't pro-choice because they consider pregnancy an extreme crisis, a serious women's rights issue etc. but because they've just adopted a "Idk, let people do whatever I guess" mentality. I keep seeing people be like "How can you be pro-choice but be against cosmetic surgery/etc?". Like I feel like most of these people don't even sympathise with women and how destructive pregnancy and childbirth can be for us, they just shrug at the thought of a woman getting a life-saving abortion the same way they shrug at some random person getting an edgy tattoo. These people will call you a hypocrite for criticising cosmetic surgery or genital surgery because they genuinely can't see how a woman or girl's right to terminate a pregnancy is anything more worthy of being advocated for or sympathised with.

"Hi, my name is Shape. I started identifying as transgender at 22 while still in college. Before that, I was just a feminine gay man.

Being asked about my pronouns led me to research transgender ideology, and pretty quickly I got convinced that I was [a] transgender woman.

I was able to get hormones relatively easily through Fenway Health and was only on them for a year before receiving facial feminization and breast augmentation surgeries at 23.

Taking hormones actually worsened my mental health, but therapists thought that it was because I was stuck in the wrong body. They cleared me for sex-reassignment surgery by diagnosing me with Gender Identity Disorder.

Immediately after SRS, I was super-excited to start a new life. I was happy for a few months while recovering, however soon I realized that my new part wasn't what doctors promised me.

My neo vagina started constricting despite rigorous dilation, which resulted in me developing vaginal stenosis. This left me unable to have penetrative sex, which adversely impacted my mental health. I also lost my sex drive, my motivation to achieve anything, and became brain-fogged and lethargic.

I had multiple unsuccessful revisions attempting to get a few inches of neo vaginal tunnel. I even had colon vaginoplasty. The last revision was at the University of Miami by Dr. Christopher Sargara in 2018, and it left me with a colorectal fistula.

I've been all over the country trying to seek help but I have received none.

Earlier this year after hitting rock bottom with my depression, I reached out to a new therapist. The therapist helped me realize that I have Complex PTSD from a traumatic childhood, and also pointed out that I have body dysmorphia, OCD, borderline personality and bipolar disorders. I also realized I had internalized homophobia.

I realize now that medical transition was sold to me as a hardware fix for software issues.

A few months ago I started detransitioning by taking testosterone, however it is traumatic to be on testosterone without having functional genitals. Moreover, my back hurts every day due to osteoporosis and scoliosis that I developed post-SRS.

I'm now dependent on synthetic hormones for life. I traded my perfectly healthy genitals for an artificial 1-inch tunnel that is sexually non-functional.

I realize that I'm never getting back a functional penis, and full detransition is not really possible in my case. I feel stuck in a surgically created body.

I believe nobody under 18 should be allowed to medically transition. Sex-reassignment surgery should only be allowed in very rare cases after full psych evaluations. Patients should be made aware that what they're really getting is cosmetic surgery, and it's a genital approximation surgery that does not change biological sex.

Any elective surgery that would be required for a transition isn't covered by insurance so either get your facts straight or do some actual research before you start posting stuff out of spite.
