Hey Tennessee fandom people: the ELVIS Act getting ready to go through. It prevents you from using likenesses of Public Figures and their voices. It's Supposed to target AI of musicians and actors but it's written So Broadly that it can effect things like Political News Reporting, Political Parody, AMVs, Fan Edits, and of course Fan Art. It's not limited to Tennessee households either so a Hollywood company can relocate a headquarters or branch to Tennessee and use Tennessee law to sue people outside the state.
If you care about any of that, then look up your county's/district's representatives in the Tennessee Senate and House and start calling. It's headed to General Assembly.
Specifically the bill says - no one can use a famous person's likeness or voice without that actor's permission for the actors life plus 10 years - .
You can see how likeness and voice can be broadly applied and of course fans would never be able to get permission for fan content.
Surely you can see how this would affect amvs and fan edits on places like Instagram.
It would also affect things like Fan Art for Live Action Series.
This would limit free use for things like parody which would effect comedy too.
It's named after Elvis and claims to be for the entertainment industry but it's written so broadly so that it can be used by public figures in general. So Politicians would be covered under it.
Honestly politicians are trying to get this passed in Tennessee to limit the use of their own likenesses for things like memes because it's a fairly easy state to get ultra conservative bullshit passed.
Here's some more info from Real Clear Policy writer Hannah Cox:
"
Right of publicity laws typically include stringent, clear exceptions and only apply to advertising, merchandise, and fundraising purposes. Those exceptions are for “newsworthy” images in content that provides a “public interest,” which encompasses everything from hard news to documentaries, to satire, to celebrity gossip.
This is a fantastic structure that ensures an individual has a right to their own personhood while also upholding the First Amendment, its protections for free expression and freedom of the press, and ensuring the public has easy, fast access to information.
The ELVIS Act doesn’t include these provisions. As currently written, filmmakers would have to obtain permission from nefarious actors like Jeffrey Epstein’s estate in order to make a documentary about him. The producers of Forrest Gump wouldn’t be able to include all those scenes with historic figures.
That’s a really good way to protect powerful people from scrutiny. And it would severely stagnate the flow of information online as even obtaining such permissions could take weeks. Additionally, out of fear, many content creators would simply play it safe out of fear of litigation.
The ELVIS Act also does not limit its reach to those living or dead, nor does it restrict its parameters to those with a Tennessee domicile. This seems like an open plea for people to infiltrate the state with ridiculous lawsuits that wouldn’t make it past the first gate elsewhere. It’s almost like the trial lawyers associations wrote this bill instead of Hollywood unions.
But to be clear, this was brought to the Republican legislature by the music industry associations and Hollywood unions - a peculiar entity for conservative lawmakers to be carrying water for to say the least. What these entities really want is an end to Fair Use practices because they’re bleeding money, and instead of making better products or creating new revenue sources, they’re simply being lazy and attempting to restrict the market.
"
--
When you call: You're a concerned republican worried about how limiting AI can hurt small business and how the law should be written more specifically and Exceptions Should be included To Protect Fair Use for Non-Commercial, News, and Parody use, because all are integral to Free Speech.
The Law is Simply Too Broad the way that it's written now and it limits Facebook campaign support for Republicans if they have to get permission from Liberals to use their likenesses. It limits free speech which is integral to preaching God's good word against his disbelievers in a political setting and you won't stand by a politician that limits your freedoms like that. This is America Land of the Free and you'll be damned if you let someone step on you like that. That its Big Government infringing on your rights as an American instead of sensible small government.
--
If you dont live in Tennesse this will still affect you with the ways it's written. It doesn't take much for companies to set up "official" shop in a new state.
It will also ABSOLUTELY be used as the model for a much worse NATIONAL bill if it gets passed in Tennessee. Because Politicians will see that it already succeeded once and HollyWood and the Music Industry are two lobbies FLUSH with cash for bribes and campaign donations.
Mark my words this will absolutely bleed over into national politics which will be devastating for News Reporting and informing the populace which is ALREADY in awful shape.

THIS WILL NOT ONLY REMOVE ANY CHANCE OF PRIVACY, ENCRYPTION, AND FREE SPEECH, BUT IT WILL GUT THE INTERNET AS WE KNOW IT. THIS WILL NOT PROTECT CHILDREN AT ALL, IT WILL ONLY CENSOR THEM AND GIVE THEM NO SECURITY OR PRIVACY. CALL YOUR SENATORS AND SIGN PETITIONS!!

take action @ badinternetbills.com
send postcards and emails like this:
I oppose all bills that weaken end-to-end encryption, infringe upon teenagers’ constitutional right to free speech on the internet, and enable censorship of valuable online resources for abortion seekers and LGBTQ+ communities. If you truly care about young people’s experience on the internet, you should pass comprehensive data privacy legislation and oppose EARN IT, KOSA, the RESTRICT Act, STOP CSAM, the Cooper Davis Act, and age restrictions on social media.

CALLING ALL US CITZENS, CALL YOUR SENATORS
If you've been here for long enough, you've heard about KOSA. The Kids Online Safety Act is a harmful and horrific bill that would censor content for ALL, all under the name of "protecting kids". This is the same ideology of queer people and people of colour being inappropriate or sexual divants from the 1980s, 1970s going all the way back to the 1920s. Progressive bill my ass.
So we need all hands on deck to help fight!
If you're in the US:
CALL. YOUR. SENATORS.
You can use this resource to help
TELL THEM PEOPLE DON'T WANT THIS BILL AND THAT IT'S CONTROVERSIAL.
If you're not in the US,
Here's a linktree

ATTENTION MINORS
I know you guys have been seeing the posts going around about Earn-It and KOSA and things of the like, and talking about how bad those things are. And you're right, they're really, really bad. But, you're not old enough to help participate in helping out, right, since you're a minor?
WRONG.
Minors out there who are concerned about these issues: YOU CAN HELP US. KOSA and CSAM specifically are acts to create widespread censorship and invasion of privacy to "protect kids," so if anything, your younger voices are stronger than ours!
I've compiled some resources for you guys to help out. Note that if you sound old enough, you do not have to disclose your age if you don't want to. The point is that there is a public outcry, not that you're under 18.
If you don't know what the bills are or what they do, here's a Doc that explains all that with links to different reading material where you can learn all about it there (note: as of posting this, the Restrict Act is not currently updated. Check back in the future for updates to the doc).
The two we really need to worry about right now are KOSA and CSAM.
KOSA is a bill being passed that would effectively let the government censor anything they want online, which can and will include minority voices, LGBTQ content, and anything they deem "unsafe" for kids (such as the suicide hotline).
CSAM is another law that preaches about protecting kids, but would actually be used to spy on everyone. It's a trojan horse.
There are a couple more, which are all covered more in-depth here on this site (scroll down):
Here's a few more resources for you guys, and then I'll get into how you guys can help!
KOSA
CSAM
EARN-It
(Light flash warning for this one, just in case)
youtube
RESTRICT Act
Alright, with all the reading out of the way, let's get into what to do.
How YOU can help!
Minors: you are not helpless. You are not powerless. The point is that there is a public outcry, and the fact that you are so young could be an advantage to stopping bills like KOSA and CSAM.
If your voice can pass as an adult's, YOU CAN CALL. If you don't think your voice can pass, YOU CAN EMAIL, TEXT, SIGN PETITIONS, and honestly, you MAY STILL be able to call.
Here's how calling works. It's gonna be scary the first time around, I know, but you've got this.
First: find out who your representatives are. This website right here makes that very easy. Go to the dropdown for your state and find it, and your two reps should automatically pop up.
Next, see if they're a Republican or a Democrat. This should be in parenthesis next to their names. Here's Michigan's and Mississippi's reps as examples of what that looks like:
Tumblr media Tumblr media
How you phrase your words will differ depending on the party they're in, this is important.
Next, you'll see under their names an address, phone number, and some bibliography. (I kept using the Michigan ones cuz I was already on their page, so if you're from Michigan, here's the numbers right here.)
Tumblr media
Let's get ready to call now.
Now, when I say "call," I don't mean exclusively by phone. You can also fax them or email them.
Here's a website you can use to fax them.
To find their email address, google it. [Name] email, and if they've got one, it should pop up there.
Now, the hard part: actually calling.
Before we go any further, reminder that these people are just that: people. They're not idols, they're not gods, they're not worth any more than you are. Dehumanize them as much as you need to in your head. They're not scary, they're human.
Now, for each bill, you can either make it all separate or keep all your words in one email, as it were. How you want to do this is up to you. But, if you're feeling lost for words, there are also scripts you can use as a base.
Here's an email to a Democrat about KOSA, for example:
And this one has emails for both sides:
The long and short of it goes like this:
Your name and something about you (I'm a retail worker) (I'm a minor) (I go to [name] school)
Explain why you're calling (I urge you to stop [bill])
Explain why the issue matters to YOU. (I am a minor, and pushing this law would do irreparable damage, not help us. Here's a bit of why.)
Ask the representative you're calling to help
Thank them for listening.
Keep it courteous- they'll be more likely to listen to you if you're calm and collected. I know emotions are high right now, and it's okay to let desperation in, but don't yell or scream at them, you'll only drive them away from trying to stop anything.
More than likely, you won't be speaking to that rep directly, but the message should still be clear and reach them.
If you're faxing or emailing, there's more room to go off about issues in more depth, since there isn't someone on the other end of the line. You can say as much as you'd like, but still try to keep it polite.
You guys are powerful, and your young voices can add to this fight. You do not have to be an adult to call something unjust. Stand with us. Together, your voices will make us stronger.

The saddest part is I still love Yandere Simulator’s characters...
TW; Talk of CSAM/CSEM, Manipulation, Predatory behavior (adult [35] taking advantage of a minor [16-17])
Alex Mahan/YandereDev DISGUSTS ME! How could you even begin to support this man?
When I read his WordPress blog posts, I couldn’t believe it! He was using incredibly manipulative and abusive language that would point out that he was a predator. He clearly has zero brains when it comes to being a “public figure”, so maybe this is for the best—he should get offline FOREVER.
The fact that he thought it was fine and dandy to talk SEXUALLY to a 16-17 year old is BEYOND ME! After all of his contraversies, I’m surprised if anyone continues to play this game on YouTube..! Just thinking about what YanDev has done makes my BLOOD BOIL..! He took advantage of a MINOR and GAVE PERMISSION TO THE MINOR TO SEND HIM EXPLICIT PICTURES AND “KEEP IT A SECRET”.
You all supporting him are FUCKING STUPID!
I understand that the game was something he’s known for, but I also wish people would pay more attention to the victims of YandereDev rather than his sexual depictions of fictional schoolgirls that don’t exist. WHERE HAS THE VICTIM GONE?
All I see is people blaming others for enjoying a game about a yandere character (a COMMON anime trope) and how “the characters are in high school.”
Where did the VICTIM go???? Did you all FORGET??? You seem to give more shits about the “development” of his game rather than how horribly he has treated this girl who he is years ahead of!! Before you open your mouth about this situation, give condolences to the victim and support them.
I don’t care how you view fictional media, but—in situations like this—it is INCREDIBLY INAPPROPRIATE to discuss! It takes attention away from what happened! People just think “Oh shit, another YandereDev controversy” rather than “Oh shit, YandereDev GROOMED SOMEONE????!!!”
YouTubers aren’t safe from this criticism either. YOU ALL LIKED AND COMMENTED ON THOSE THINGS!! YOU SUPPORTED PEOPLE TAKING THE SITUATION AND TURNING IT INTO BEING ABOUT YANDERE SIMULATOR!
This doesn’t even INVOLVE the game anymore. This is a REAL PERSON, a REAL CHILD. GROW UP!
Sorry, I’m just disappointed in people...

hey y'all
this link right here gives majority of the information needed about the situation regarding the governments plans to censor sites that host LGBTQ content (for example tiktok, twitter, wattpad)
sites such as tumblr & ao3 could be at huge risk due to their smaller size and more acceptability to taboo subject matters
these bills are supported by the right AND left and will cause more harm than good
it's not artists job to monitor what children do on the internet it's their parents/guardians
i just had to put on my big boy drawers & call a bunch a old folks i do not fuck with
it's that easy

EARN It Act is back, and so are its sibling bills
Tumblr media
The us government is currently trying to destroy privacy and encryption online under the guise of protecting children. These four bills, along with age-gating internet usage will lead to abortion arrests, widespread grooming of children, and loss of all privacy with age verification.
Here are some links to learn more. I don’t expect you to take me at my word. I want you to understand what’s happening.
https://www.badinternetbills.com/ has a summary of each bill and a section for contacting your lawmakers, signing petitions, and even more links with useful information about what exactly these would do to the internet
https://linktr.ee/stopkosa this linktree has a lizzo contact link to let her know, an open letter against KOSA, a call script, petitions, and a link to a discord that is completely focused on fighting all bills and acts listed above
I understand you’re burnt out. I know this is the third time we’ve had to fight Earn it, but they are trying to wear us down, trying to make us weak so they can slip these in and take us down. We can’t let them win.

Please sign petitions and call your representatives. These useless and harmful bills have bipartisan support so its an issue across the board. This site can inform you of all the bills, give you easy access to petitions, and offer scripts for when you call.

Normally, we are not one to make political posts; mostly because our mental health makes it difficult to tread in those waters without being triggered quickly. This however, came to our attention today, and I wanted to say something.
If you are like us, and in a position where you cannot call anyone for any reason at all:
Here is a link to all of the petitions against the currently active bad internet bills.
There is an option to sign them all at once, AND to sign them individually to take further action; it can be signed multiple times.
I highly suggest everyone spread this around as much as possible with everyone that can handle it; raise noise, get loud, and give congress hell. These bills are not going to save or help anyone.

It's like politicians know that the news cycle is SO SLOW now with overstuffed 24 hour news on TV and the mire of disinformation online that they know if they just move fast enough Noone will know or care what they're doing until after it's too late.
And they're taking advantage of it.

Rant. Tw: SA
It makes me so mad when a predator’s wife learns that he has abused children and stays with him anyway. Even with proof she stays. Even though they have small children that he could harm she stays. Part of me feels bad for her because he has probably abused her and she depends on him financially so I’m sure leaving is hard. I think the thing that makes me so mad is that she tries to blame me for what happened while also telling me that I’m just delusional and nothing happened at all. Even though I sent her proof she still tries to deny anything happened. I hope she accepts the truth soon and takes the children away from that creep.

People Don’t Understand...
AI art has most definitely used children in those inappropriate artworks.
It doesn’t matter how much that an AI “art” program wants to deny it. Millions of photos exist within those tags and photos. You don’t know where the AI is GETTING those images.
You just think you’re getting free p0rn, don’t you?
I understand that some people can’t always afford to commission an artist, but why go to a program that is exploiting children since it analyzes photos and art from the Internet?
Who is to say that you didn’t exploit and harm a kid by just generating it?
I know for a FACT that it exploits children. There are some art programs that don’t even block out the word CHILD from their generator.
They are purposefully ignoring it so they can’t claim liability when this type of “art” can exploit children to unknowing individuals without any knowledge of how AI works.
They look through databases and try to “de-fuse” the image from all those random things they found via the prompt provided.
Children might have used some of the words you put in those prompts, so you may come across something you didn’t want to.
~~~~~~~~~~~~~~~
So, what’s your opinion on this?
