75. Kisses meant to distract the other person from whatever they were intently doing
It had already been a long day at the bookshop in Dark Water. Between frequent shoppers buying books for study, children looking to purchase a new story for bedtime, and helping out Sarah with her nefarious projects; Algernon barely had time to do daily tasks. Thankfully, it was close to closing, and all that was left was inventory and cataloging, which the bookkeep was frivolously taking on. 
As he was counting inventory and bringing boxes in from the backroom, Newton popped in from their own tasks to check on him. They walked over to the wooden front desk, smiling as he rounded the corner. “Busy day, huh?” Algernon glanced up at his partner, a soft smile gracing his features, “A very long day dear. Still have a few more things to catch up on though.” Newton rolled their eyes, and took the box from his hands and set it down on the desk. “It’s past closing time, Al. We can finish this all up tomorrow morning since it’ll be Sunday and we rarely get customers.” 
Algernon huffed in feign annoyance, wanting to simply finish now so he didn’t have to worry about it later. He was stubborn in that way where he didn’t like to put off anything and Newton definitely knew this. They were just tired of seeing him overwork himself. 
They moved to wrap their arms around his waist, leaning up and kissing him deeply, effectively grabbing his attention. As they parted, Newt gave him a cheeky little grin, “Now, we are going to close up shop and go home to have supper at a reasonable hour Algernon.” “But--” A kiss. 
“The shop--” Another kiss. 
“There’s still things left undone--” A longer, deeper kiss.  “Fine, fine… We’ll finish everything up tomorrow. But don’t expect to not get the majority of the workload, Newt.”
Another peck, this time on his cheek, “Good, wouldn’t expect anything less.”

Dutch government makes legal transition for transgender people easier • PinkNews
Transgender children in the Netherlands are now able to change their gender on passports before the age of 16, while trans adults can self-identify without a doctor’s statement.
Children seeking to have their gender legally recognised will be able to do so by requesting a court date.
Sander Dekker, the Dutch minister for legal protection, said on Thursday (April 11) that judges will grant such requests only in “extreme circumstances.”
Responding to criticism that children may “change their minds” and revert back to the gender they were assigned at birth, he confirmed that any child who legally transitions will be given only one opportunity to reverse course without a court date.
Netherlands streamlines legal gender change
The path to legal recognition has also been made easier for people aged 16 and above, who can now change their gender marker without a statement from a doctor or psychologist.
Under the new process individuals will be given four weeks to cancel a change in legal gender before it becomes permanent.
LGBT+ groups said that they were “pleased with the abolition of the expert statement,” but argued that the new measures are not far-reaching enough.
Transgender Network Netherlands, COC and NNID released a joint statement which read: “This proposal does not provide any relief to intersex people and violates the right to self-determination of transgender children.”

Intersex and non-binary people in the Netherlands can apply for the gender marker X, but must do so through the courts without any guarantees. Dekker indicated that this process may also be made simpler.
Which countries issue gender-neutral passports?
Leonne Zeegers became the first Dutch person to receive a gender-neutral passport in October 2018, following a two-year legal battle.
Australia, Denmark, Germany, New Zealand and Pakistan, India, Ireland, Canada and Nepal have also introduced (or are introducing) a gender-neutral passport, alongside a handful of US states.
In June 2018 Christie Elan-Cane lost a high court challenge which called on the British government to adopt an X marker.

The Voice of All Things and other One Piece Parallels to Norse Myth
Oda has talked before about how his depictions of pirates are somewhat more like Vikings, and that a Viking TV show was one of his favorites as a kid. It stands to reason that just like Japanese mythology, he also may have studied a good deal of Norse Mythology in crafting his story, which I strongly believe to be the case. In this post I want to organize many thoughts and parallels that I’ve really begun to see:
* **Luffy=Odin**—Or at least an inverted version of him. Both are considered [sovereign individuals,](http://blogs.ubc.ca/hollyonclin/2014/01/28/the-sovereign-individual-in-popular-culture-one-piece-and-monkey-d-luffy-the-pirate-king/) or chiefs of their own made spheres, both started out with two brothers (Ace, Sabo, Vili & Ve.) While Odin just may be the inspiration for Nietzsche’s Ubermensch, both are known for being tapped into the [self-awareness of the world,](https://norse-mythology.org/gods-and-creatures/the-aesir-gods-and-goddesses/odin/) and wearing wide brimmed hats. What has increased the parallel even further as of late is Luffy’s own quest for further knowledge, in this case knowledge of advanced forms of Haki. Like Odin sacrificing an eye to Mimir, [Luffy at least put his at great risk in learning his greater insight from Katakuri.](http://f13.readermanga.com/65/907d7ef79f5a1e/s5.jpg?token=8MJYMU8uSnkrf5DPQqZroQ&expires=1562630399) The second great endeavor for knowledge was to be bound in order to learn the flow of things (chains to learn the Sakura flow in Luffy’s case, ropes for Odin to look at the river flows of energy to discern the runes.)
* **Zoro, or Law=Thor**—Wield a weapon (sword or hammer) alongside a sovereign or in the name of theirs, but only Law has used [an electric attack so far.](https://2.bp.blogspot.com/-eGOL4HclV-Q/WwcVcp6Uc1I/AAAAAAAG-FM/h2PFWm3hjUU7i6pGk8K7AR8fSsAgjdHwACHMYCw/s0/015.png) I admit this is one of the weaker links and I need to get to reading on Thor.
* **Shanks=Tyr**—Tyr was the god of War & Honor, and lost an arm/hand baiting Fenrir into his trap so the latter could not fulfill his fate of killing Odin yet. Just like the man who taught Luffy his sense of honor.
* **Kidd=Loki**—Red haired icons of chaos who take insults too seriously and have relevant links to Odin/Luffy and Thor/Zoro/Law (Killer=Sigyn?.) One important link is the CoC that Luffy and Kidd share, which will become important when comparing CoC to seidr.
* **Bonney=Angrboda**—Jewelry Bonney shares many key traits with the [Dark Mother archetype in mythology;](https://badwitch.es/tag/dark-mother/) She can control not only her age, [taking on three major age forms,](https://paganmeltingpot.wordpress.com/2014/02/15/angrboda-and-the-dark-mother-figure-across-the-cultures/) but also the age of others, turning men to boys as if to overrule their egos. Both she and Kidd are from the South Blue. The question is if South Blue has any connections to Elbaf.
* **Yonko=Rokkr**—Monstrous Beasts that lay on the edge of the civilized world and threaten its destruction. In Norse mythology they were born by Loki and Angrboda. Whoever created such threats is just as much an danger (right?)
* **Big Mom=Hela**—Controllers of death, either lifespan or its realm (Helheim,) while Big Moms use and treatment of her children makes her parallel to the [Death Mother.](https://badwitch.es/tag/death-mother/) Close by to their territory is a master of insight (Katakuri=Mimir, see Luffy’s CoO above.)
* **Kaido=Jormungandr**—Snake bodied beasts holding dominion over or surrounding an isolated land, (Midgard, Wano) there is nowhere they can’t reach. Fated to reach a fatal draw with and die alongside Thor, be it Zoro or Law.
* **Blackbeard=Fenrir**—Dark or black haired, cunning (wolves have been associated with Odin’s knowledge) and fated to fight the known sovereign. While Teach wasn’t the one to take Shanks’ arm, he did leave a near-eye-taking wound with a claw-shaped weapon.
These parallels help set up what advanced CoC may turn out to be capable of. In Viking culture, the shamanic practice of [Seidr involved a death and rebirth](https://norse-mythology.org/concepts/shamanism/) whilst being [impregnated with the energies of the universe,](http://www.ancientpages.com/2018/02/10/god-odin-exiled-asgard-kingdom-gods-no-regrets-breaking-norse-societys-norms/) so as to determine, and if necessary rewrite fate. It was considered very unpopular for men to do such practices, especially chiefs or kings. So much so that partaking in it, as was the third knowledge seeking act by Odin, got him exiled from his tribe and home, the Aesir of Asgard, for ten years. It is safe to say that CoC’s Norse equivalent is Seidr.
Advanced CoC could merely be a boost in power from ones surroundings or something far more sinister. That’s right. The process of binding Sea Kings, Zunisha and other dangerous beings to the will of the user may just be a potential ability of advanced CoC, or using all three. Whether or not this discovery occurs on a territory such as Elbaf or another is uncertain, but said territory is comparable to the mythological home of giants, Jotunheim, which is foretold to provide a good deal of the host challenging Asgard when Ragnarok comes. What happens there could sway who many giants fight alongside in the Final War. Luffy and/or Shanks, if he appears here as Mr Morj has predicted, may debate or be hesitant to use such a technique on potential tools like the Yonko. I do not see Blackbeard or Kidd having such qualms however, if the latter makes it this far though, which I believe is possible. Kidd may require assistance in gaining an opening to do this however, which Bonney has the means and motive to do, both in her age abilities and her hatred of both Blackbeard and the WG.
Why the Yonko, though? I have a feeling that use as such weapons was their original designed purpose, as foreshadowed by Vegapunks interest in both Giants and Dragons, as well as his subsequent capture by the WG for studying the Lineage Factors in similarities to how Ohara was silenced. If the unusual power of those who made it to Yonko status is from some project the WG has long held secret, and the terror they put the world into can be laid at the feet of the WG for blame, what else could cause such doubt in their global legitimacy as Doffy described? This first occurred to me when baby Big Mom seemed way too strong to be born to normal parents, so something fishy was happening.
I know I haven’t touched on everything, I need to read much more Norse legends to fit/match everything, and I could expand on my thoughts, but I need to sleep before work. I’ve just been reading Norse for some time and needed to post my thoughts somewhere. Anyone more knowledgeable is free to add.
**TL:p;DR: Luffy is Odin, Kidd is Loki and they may have a huge debate on whether it’s okay to enslave the Yonko to fight the WG as the WG originally intended to use them. All based on Norse mythology.**

Tell me why I’ve reached my last semester as a journalism major and I hate traditional journalism.
Since 2014, I’ve been a student of journalism (first at College of the Canyons in Valencia and currently at CSUN). Prior to pursuing higher education, I was the singer in a self-managed DIY punk band that toured the country, recorded a few albums, and played more shows than there are stars in the sky. I rarely ever talk about this in journalism classes, but since Professor Grewe mentioned my background in class, I figured it was probably time to contextualize exactly where I’m coming from.
Anybody that’s lived this lifestyle that has a name you don’t recognize will tell you the same thing: you probably shouldn’t count on this being your livelihood. So we put out an album a few people liked, and I decided that was as “on top” as it was going to get. So (and there’s a little crossover in timelines here), in 2018, I decided to quit and go all in on journalism, something that even by that point, I’d grown to hate.

All I’ve ever wanted was to be a writer. I learned about the inverted pyramid, ledes, AP style, and all the other hallmarks of traditional journalism in school, so I know how to write print news. But more specifically, I’ve always wanted to be a storyteller. I don’t have much in the way of original ideas, which is why I’m not looking to write The Great American Novel or even a feature film, but I’m consistently fascinated with the stories of people whose lives aren’t often covered, onscreen, in print, or otherwise.
My emphasis at COC was in broadcast, which wasn’t by choice; COC is a wonderful school, but every class prepared me to step into a world I wasn’t familiar with. I took classes on how to present yourself on camera, how to write features, and how to put together a basic news package while working on a live news show. One of the coolest parts about this was getting to meet new people and find out part of their stories, a couple minutes at a time.
But I hated most of that, too. For every human interest story, there’s a thousand car accidents, town halls, and information-based stories that don’t tell you... well, a STORY.
In the process of learning all of that, though, it turned out that I really liked editing audio and video. The process of editing to a script and making sense of the chaos of every clip felt oddly therapeutic. But becoming just an editor in a news-gathering world that favors being as multi-faceted as possible seems less and less likely with every passing day. 
Panic began to set in as I was planning my next move; what was this all for? Why was I spending all of this time & money on something that was making me completely miserable? Sure, I liked to edit, but news gathering, especially at the pace expected in a 24/7 news cycle, seemed like tethering myself to a tree in which the rope kept getting tighter.

So when I got to CSUN, I took the Sundial class, and at first, I hated that more than I had hated any of the preceding years I’d spent in school. By nature of the course, The Sundial is pure chaos with minimal structure. The actual day to day operations of The Sundial are handled by the actual staff there (AND QUITE WELL, I MIGHT ADD; my problems with the course had nothing to do with the amazing staff, editors, publishers, and so on there); what I’d expected was to be a part of an actual newsroom and learn how to function within it. What actually happened was that I was held at arm’s length, in the middle of the room, and asked what I had to offer.
Maybe this is similar to the real experience of a newsroom, but with no actual guidance, it reminded me why I hated traditional news gathering in the first place. Maybe I’m not cut out for it. I expected to fail the course. So I went for broke and suggested something I cared a little bit more about: 
What if I did a podcast? Not the kind of podcast where it’s three white dudes sitting around a table and talking about Batman; a storytelling podcast where I met people who are, were, and will be students or faculty of CSUN and I figure out what their lives are like. The format would take the basic tenets of what I’d learned from editing broadcast news packages and apply them to a strictly audio format instead.
My idea was reluctantly accepted, on a trial basis. So I immediately started pumping out episodes. I really had no idea what I was doing. I did one episode under broadcast-style restrictions (2.5 minutes long, multiple interviews, an almost overwhelming amount of nat sound) before I decided to give up those restrictions for something that felt more honest to the subject: a narrative track I write, based around interview clips with one subject. And that was it. 
One of the proudest and most awkward moments of my life came a month into doing this project. I walked into class and Arvli Ward (the professor and publisher of The Sundial) immediately put on the episode I did where I interviewed Professor Grewe, and proceeded to play all twelve minutes of it to the class, saying it was a “perfect example of the type of content The Sundial needed.”
I’ve never felt so validated and embarrassed in my life. I really wish I hadn’t been there that day. But in a way, I’m glad I was.
I’m well past the 250 word requirement for this assignment at this point, so I’ll give you the tl;dr here: despite feeling as exposed as I did at that moment, I’d never actually done anything outside of music that really made me feel proud of myself on my own terms. After that day, I was free to do whatever I want with the podcast. Unlike music, I did almost everything by myself, aside from the mastering and some music dubs by PJ Shahamat. 
So that’s what I want to do: I want to be a storyteller. Whether that’s in video, audio, or otherwise, that’s where I want to be. I’m not intensely concerned about whether this is a rational moneymaking dream; I was on tour from 2011-2018 essentially nonstop and am lucky to have ended up practically broken even financially.
If I can be somewhat comfortable while helping others tell their stories... that’s good enough for me.
PS: I’m also really into film history, but that’s basically for fun. :)

Miriam is a graduate of the prestigious Canadian Opera Company Ensemble Studio, the Steans Institute for Young Artists (Ravinia) and the Britten-Bears Young Artist Programme in England. Tenor Jianghai Ho has appeared most recently as tenor soloist in the DePaul Symphonic Choir’s presentation of Rossini’s Stabat Mater, Rinuccio in Puccini’s Gianni Schicchi, Nerone in Monteverdi’s L'incoronazione di Poppea, Orfeo in Monteverdi’s L’Orfeo, Abraham Kaplan in Kurt Weill’s Street Scene, and Dr. Blind in Johann Strauss Jr’s Die Fledermaus with DePaul Opera Theater. He has also performed with the Duke Vespers Ensemble in Dietrich Buxtehude’s rarely-performed Membra Jesu Nostri at the Boston Early Music Festival, as well as the Chicago Symphony Chorus.
Born in Johor Bahru, Malaysia, Jianghai first discovered his passion for opera under the tutelage of Professor Susan Dunn at Duke University, where he graduated with a B.S. in music and biology. He graduated in vocal performance from DePaul University, where he studied with David Alt and Michael Sylvester.
Mark Billy is a lyric baritone and Native American (Choctaw tribe) from Finley, Oklahoma. Mark’s undergraduate studies in voice at the University of Oklahoma were under the mentorship of baritone Richard Anderson. Mark has also had additional study with the legendary mezzo-soprano Marilyn Horne.
Mark made his operatic debut as IlCommendatore in 2012 with OU Opera Theatre's production of Mozart’s “Don Giovanni”. The following season he appeared as Thoas in Gluck's “Iphigénieen Tauride”. In 2014 Mark appeared as Simon in OU’s choreographed production of Haydn’s oratorio “Die Jahreszeiten” and in 2016 Mark was featured as Moralès in “Carmen” with Indiana University.His graduate studies at Indiana were with soprano Carol Vaness.

In the Spring of 2017 Mark placed first in the Oklahoma NATS competition graduate level division. This past summer Mark sang Melisso in Handel’s “Alcina” as well as covering the role of Marcello in “La bohème” for the Red River Lyric Opera Festival. KMPDC living up to its mantra of ensuring quality healthcare for Kenyans  
Established under the Medical Practitioners and Dentists Act (Chapter 253 Laws of Kenya), the Kenya Medical Practitioners and Dentists Council (KMPDC), is mandated to regulate the training and practice of medicine, dentistry and community oral health, as well as regulate all health facilities within the Republic of Kenya.

The Council also serves as an advisory to the National and County Governments and the Ministry of Health.
As a health regulator, KMPDC has been working tirelessly to ensure the health services Kenyans get are top notch.
Among the things the Council continues to work on are amendments to the Medical Practitioners and Dentists Act (Cap 253 Laws of Kenya). The last amendments came into effect on the 17th of May, 2019.

According to KMPDC’s Chief Executive Officer Daniel Yumbya, the amendments have not only given the Council more regulatory and enforcement powers but have also ensured patients’ safety through the introduction of a Professional Indemnity Cover (PIC).
“Something that is also commendable in the Act is that health facilities and practitioners have now been compelled by law to have a Professional Indemnity Cover (PIC) before they renew their yearly licenses,” said Mr. Yumbya. “This cover ensures that in case a practitioner or health facility is found culpable of a malpractice and are asked to pay the complainant for damages, it is covered, and the complainant will be paid without issue.”
Quacks menace
Other than that, the amendments to the Act have taken into consideration the quacks menace in Kenya and in an effort to protect patients, stiffer penalties for anyone masquerading as a doctor, have been introduced.
The penalties set for such persons is a fine not exceeding five million shillings or to imprisonment for a term not exceeding five years or to both.
Health facilities have not been left behind. The Act stipulates that persons in charge of health facilities who hire unlicensed practitioners or quacks or operate health facilities that have not been licensed or registered commits an offence and shall be liable on conviction to a fine not exceeding ten million shillings or imprisonment for a term not exceeding five years or to both.
The Council has gone a step further and updated a register of all licensed practitioners and health facilities on its website www.kmpdc.go.ke to protect unsuspecting Kenyans and ensure patients know if the person treating them is indeed a doctor and if a health facility is licensed to operate.

“Our job is to ensure Kenyans get quality healthcare as we strive to protect patients from fraudulent people. That is why we saw it necessary to share the list of licensed practitioners and health facilities and make them easily available for the public should they need to ascertain the credentials of the person treating them. I encourage Kenyans to be on the lookout for quacks because not everyone calling themselves “doctor” is one,” said Mr. Yumbya.
As a precaution, Mr. yumbya affirms that; “The register furnishes members of the public with a list of all practitioners licensed by the Council to operate within any given year. If one is claiming to be a doctor but their name is not on our register, then you know that they’re either a quack or have not been licensed to operate.
The same applies to health facilities. We encourage members of the public to report to us should they suspect one is either operating without a license as this is illegal, or if one is a quack.”
Lodging a complaint against a doctor or health facility
Another mandate of KMPDC is disciplinary proceedings. Patients can lodge a complaint against a health facility or a doctor, should they feel that they did not receive quality healthcare.

The Council, through the Disciplinary and Ethics Committee (DEC) then conducts inquiries on professional misconduct, medical/dental malpractice, overcharging, patient mismanagement, patient abandonment among others.
Mr. Yumbya says that the Council has cumulatively received a total of 1,257 complaints, since the first case was reported to KMPDC in 1997.  About 1,132 cases have been concluded while only a paltry 125 cases are under investigation.
“Once the Council’s Legal Department receives a complaint from a patient, a patient’s relative or caregiver, the Office of the Ombudsman or even the media, the complaint is shared with the practitioner or health institution being accused, to give them a chance to respond to the allegations. The complaint and the response are then tabled before the Disciplinary and Ethics Committee (DEC) for discussion in their next scheduled meeting,” said Mr. Yumbya.
The Council has moved a step further and made it easier for a complainant to lodge a complaint.
One can now easily download the complaint form from the Council’s website www.kmpdc.go.ke on the “PUBLIC” tab, which also explains the procedure of lodging such complaints.
Once the form is filled, the same can be sent to the Council together with documents indicated in the complaint form to the email, [email protected].
The Council’s Disciplinary and Ethics Committee also has other roles like: conducting Inquiries into complaints submitted to it, regulating professional conduct, ensuring fitness to practice and operate, promoting mediation and arbitration between parties and at its own liberty, recording and adopting mediation agreements or compromise between parties, on the terms agreed among others.
Fight against the Covid-19 pandemic
The Council has also played a very critical role in the fight against the Covid-19 pandemic. In its regulatory and advisory capacity, through the Ministry of Health, KMPDC was mobilised to assist in national coordination, compilation of action and implementation plans to curb the deadly virus as the government continued to review and implement more measures to curtail the pandemic nationally. This saw the council put in charge of quarantine and isolation facilities in the country.
  “Cabinet Secretary, Ministry of Health, Sen. Mutahi Kagwe, constituted a national team of experts under the leadership of our Chairperson Dr. Eva Njenga in July 2020, to provide technical assistance to all 47 counties with a view to enhance the county governments’ pandemic preparedness and response mechanisms. I was the Secretariat Head,” said Mr. Yumbya further adding that KMPDC played a key role in supporting the COVID National Task force and providing vital technical information to inform the government on COVID-19 response strategies.
In collaboration with the County Health Management Teams, the technical experts’ team conducted a countrywide exercise of health facilities in each county, to establish the counties’ capacities to effectively manage the coronavirus cases when presented,” Mr. yumbya reveals.
The team also trained health workers on referral system to health facilities when the need arises, criteria for determining recovery and discharge of patients.
The crew also disseminated and supported the roll out of Home-Based Isolation and Care guidelines to provide an alternative solution in the management of the increasing numbers of asymptomatic or mildly symptomatic patients which will serve to decongest health facilities in the country.
“Our role in COVID-19 mitigation measures cannot be gainsaid. As the regulator in medical and dental practice, KMPDC continues to live up to its mantra, stepping up activities in a bid to guarantee delivery of quality health services in the country despite the pandemic,” he adds.
As we all remember, on the 22nd of March 2020, the Cabinet Secretary of Health issued a directive that abolished self-quarantine and in turn instituted mandatory quarantine for all individuals returning to the country.
This directive came into effect on the same day wherein over 2000 people underwent mandatory preventive quarantine for a duration of fourteen (14) days at several identified quarantine facilities.
Cognisant of this, the Kenyan Government set up the National Coordination Centre for Quarantine and Isolation Facilities domiciled at the Kenya Medical Practitioners and Dentist Council.
This coordination centre was tasked with the specific mandate to coordinate the management of COVID-19 quarantine and isolation centres within Nairobi Metropolitan and beyond.
Following the lock-down and curfew that was put in place by the government, the Council also designed special passes for essential services providers (including doctors) to ensure they deliver services without interruption.
 The pandemic gains
When the first case of COVID-19 was reported in Kenya, the number of people going to health facilities to seek treatment dropped as Kenyans shunned hospitals due to fears of contracting the virus from the said institutions.
This made the Council to move swiftly to respond to this growing concern by looking into ways of ensuring patients still got quality healthcare from their healthcare providers despite the prevailing circumstances.
“We therefore commenced the issuance of provisional approvals for various registered and licensed health institutions to offer virtual medical services. The Council issued approvals to about 20 hospitals to offer telemedicine services in the country by then,” said Mr. Yumbya. “This year, we have increased the scope to give annual licenses to registered and licensed health facilities that want to offer virtual health services.”
The move by the Council to approve the facilities to offer telemedicine is a response to a growing need for the services due to physical distancing rules imposed by the government to curb the spread of COVID-19.
Even before the pandemic hit the country, KMPDC had already developed e-Health guidelines back in 2019, and shared the same with the relevant government authorities for approval and subsequent gazettement. The rules will offer a base for the full roll out of telemedicine services in Kenya.
“The Council works tirelessly to ensure that we are an an efficient, effective and accessible world class health regulatory body. In our efforts to learn best practices and promote the provision of quality healthcare in the country, we are part of international, continental and regional bodies that help promote the above-mentioned practices in the regulation of healthcare,” says the KMPDC CEO.

Urgensi Sentralitas ASEAN dalam Sengketa Laut Cina Selatan
Kerjasama Keamanan di ASEAN | 11 Desember 2020
Sengketa Laut Cina Selatan (LCS) antara ASEAN dan Tiongkok sudah terjadi sejak lama dan tidak kunjung terselesaikan. Dalam perjalanan panjang sengketa ini, terdapat satu peristiwa penting yaitu penandatanganan Declaration on the Conduct of the South China Sea (DoC) antara ASEAN dan Tiongkok pada tahun 2002. DoC menunjukkan komitmen kedua pihak untuk menyelesaikan perselisihan atas LCS secara damai dengan basis penahanan diri atau self-restraint. Keseriusan kedua pihak dalam berkomitmen menyelesaikan sengketa secara damai kemudian terwujud dalam Code of Conduct in the South China Sea (CoC). Negosiasi penyusunan CoC mulai masuk dalam agenda pembahasan pada tahun 2013. CoC ditujukan untuk meregulasi secara lebih komprehensif pihak-pihak terlibat dalam sengketa LCS. Perkembangan awal dari penyusunan CoC kemudian dapat dilihat dari Chairman’s Statement of the 36th ASEAN Summit 2020. Dalam dokumen tersebut, tertulis bahwa draf CoC yang berupa kerangka awal telah sampai pada tahap first reading. Dari kondisi yang telah disampaikan, terdapat satu hal yang menarik untuk disoroti, yakni durasi negosiasi yang memakan waktu cukup lama. Salah satu faktor yang memiliki signifikansi terhadap proses negosiasi adalah tidak seragamnya sikap seluruh negara ASEAN dalam menghadapi Tiongkok dan isu sengketa ini. Realita ini sedikit banyak menghambat negosiasi dalam penyelesaian sengketa khususnya dalam penyusunan CoC, selain adanya sikap Tiongkok yang begitu bersikukuh mempertahankan klaim ‘sembilan garis putus-putus’-nya.
Berangkat dari latar belakang tersebut, esai ini akan membahas pentingnya Sentralitas ASEAN dalam menyelesaikan sengketa LCS. Penyelesaian sengketa yang dimaksud tidak hanya terbatas pada negosiasi penyusunan CoC tetapi juga kondisi dan kemungkinan yang akan terjadi setelah tersusunnya CoC nanti. Pembahasan esai ini akan menggunakan konsep Sentralitas ASEAN dan Teori Kompleksitas Keamanan Kawasan. Sentralitas ASEAN memiliki makna bahwa ASEAN memiliki posisi sebagai inti dari dinamika dan institusi yang ada di kawasan Asia Pasifik, khusunya di Asia Tenggara (Acharya, 2017). Posisi ini bertujuan untuk memenuhi kepentingan strategis dari ASEAN dan ‘memaksa’ pihak eksternal untuk mengikuti aturan main yang ditetapkan oleh ASEAN (Acharya, 2017). Sementara itu, Teori Kompleksitas Keamanan Kawasan menyatakan bahwa negara-negara di suatu kawasan dengan interdependensi keamanan yang erat akan membentuk suatu keamanan kompleks (Buzan & Wæver, 2003). Dalam hal ini, proses sekurititasi satu negara memiliki signifikansi bagi keamanan wilayah tersebut secara keseluruhan. Kompleksitas keamanan kawasan dapat dipengaruhi oleh kekuatan besar global atau dinamika di dalam kawasan yang bersangkutan (Buzan & Wæver, 2003).
Pentingnya Laut Cina Selatan sebagai laut internasional
Laut Cina Selatan merupakan wilayah dengan nilai geopolitik dan ekonomi yang penting bagi komunitas internasional. Artinya, LCS memiliki makna penting tidak hanya bagi satu negara. LCS merupakan wilayah laut dengan ketersediaan sumber daya alam yang cukup melimpah. Wilayah LCS dilaporkan merupakan salah satu wilayah dengan ketersediaan ikan paling banyak di dunia (Tønnesson, 2002). Tidak hanya itu, LCS juga memiliki cadangan minyak bumi dan gas, meskipun belum dapat dipastikan sebesar apa cadangan yang ada (Tønnesson, 2002). Peran LCS yang paling penting sebenarnya adalah perannya sebagai jalur laut internasional. Penggunaan LCS sebagai jalur laut internasional menggunakan basis freedom of navigation dan berlaku pula pada laut ZEE dan teritori laut suatu negara (Tønnesson, 2002). Jalur laut di LCS termasuk dalam jalur laut paling sibuk di dunia. LCS sering digunakan untuk perdagangan ekspor impor berupa pengiriman komoditas berupa minyak dan mineral (Tønnesson, 2002). Filipina, Korea Selatan, dan Jepang merupakan tiga negara yang menggantungkan lebih dari 60% impor minyaknya pada kapal pengangkut minyak yang melalui LCS (Tønnesson, 2002). Selain itu, salah satu jalur pengiriman utara-selatan Australia juga melalui LCS (Tønnesson, 2002).
Dalam hal ini, Sentralitas ASEAN penting untuk menunjukkan peran aktif ASEAN dalam penyelesaian sengketa LCS. Tertulis dalam Chairman’s Statement of 36th ASEAN Summit bahwa ASEAN berkomitmen untuk menggunakan UNCLOS 1982 sebagai basis penyelesaian sengketa. Oleh karena itu, penting bagi ASEAN untuk dapat memastikan bahwa LCS tetap menjadi laut internasional dengan mengikuti regulasi yang tertuang dalam UNCLOS. Perlu untuk diingat pula bahwa LCS merupakan wilayah yang penting baik bagi pihak-pihak eksternal maupun negara-negara Asia Tenggara. LCS merupakan salah satu jalur laut internasional yang dilewati oleh banyak rute perdagangan. Negara-negara Asia Tenggara juga memiliki hak atas ZEE dan laut teritori masing-masing, yang beberapa di antaranya menjadi bagian dari klaim ‘sembilan garis putus-putus’ milik Tiongkok. Selain sebagai bentuk komitmennya, memastikan LCS tetap menjadi laut internasional berarti turut berkontribusi dalam menjaga perdamaian dan kemakmuran dunia. Jika LCS tetap menjadi laut internasional tanpa penguasaan secara sepihak oleh negara tertentu, maka komunitas internasional tetap dapat mendapat manfaat dari LCS.
Relevansi ASEAN dalam menjaga stabilitas kawasan
Terdapat lima negara ASEAN yang wilayah ZEE-nya berbenturan dengan klaim Tiongkok, yaitu Vietnam, Filipina, Malaysia, Brunei Darussalam, dan Indonesia. Dari kelimanya, Vietnam dan Filipina memiliki rekam jejak sengketa paling ‘panas’ dengan Tiongkok. Sengketa antara Vietnam dengan Tiongkok sudah terjadi sejak 1974, ketika militer PKC menduduki Kepulauan Paracel yang sudah diklaim Vietnam sebagai teritorinya pada 1951 (Severino, 2010). Sementara itu, sengketa antara Filipina dan Tiongkok terjadi atas Kepulauan Spratly. Pada 1958 mengklaim Spratly sebagai bagian dari teritorinya yang kemudian ‘dilawan’ oleh klaim Filipina pada 1978 (Severino, 2010). Tumpang tindih klaim terus berlanjut hingga tahun 2010-an. Pada 2011, pengawas maritim Tiongkok memutus kabel eksplorasi minyak dan gas milik kapal Vietnam yang tengah beroperasi di ZEE Vietnam (Zhao, 2013). Filipina dan Tiongkok juga sempat terlibat dalam konfrontasi militer pada 2012 terkait sengketa atas Beting Scarborough atau Pulau Huangyan (Zhao, 2013). Meski tidak berujung pada konflik yang serius, terjadi insiden pada Desember 2019 ketika nelayan Tiongkok melaut di perairan Laut Natuna Utara.
Dalam Deklarasi Bangkok 1967 dan Piagam ASEAN 2007 tertulis bahwa salah satu tujuan dari ASEAN adalah untuk mempromosikan, menciptakan, dan menjaga perdamaian, keamanan, dan stabilitas kawasan. Sengketa antara Tiongkok dan negara-negara pengklaim terbukti dapat mengganggu perdamaian, keamanan, dan stabilitas kawasan. Sengketa yang terjadi nyatanya bukan hanya persoalan tumpeng tindih klaim tetapi dapat pula menciptakan konflik baik kecil maupun besar. Oleh karena itu, penting bagi ASEAN untuk menjaga stabilitas di kawasan Asia Tenggara. Konflik tidak akan pernah sepenuhnya hilang dari kehidupan manusia tetapi manajemen konflik penting untuk dilakukan. Panjangnya rekam jejak konflik dan sengketa atas LCS menunjukkan bahwa ASEAN masih belum berhasil dalam melakukan manajemen konflik atas kasus ini. Segalanya membutuhkan proses mengingat kompleksitas kasus ini tetapi hasil yang tercipta juga tidak kalah penting. Dalam hal ini, dibutuhkan Sentralitas ASEAN untuk mengupayakan manajemen konflik yang efektif. Jika ASEAN tidak mampu menangani sengketa ini dengan baik, ASEAN dapat kehilangan relevansinya di kawasan Asia Tenggara.
Menyeimbangkan rivalitas Tiongkok dan Amerika Serikat
Keunikan dan kompleksitas dari isu ini terletak pada keikutsertaan AS di LCS dengan justifikasi mencegah agresivitas Tiongkok. Pada Oktober 2015, AS melaksanakan operasi Freedom of Navigation (FON) yang pertama dengan memasuki area sekitar 12 mil dari Kepulauan Spratly (Feng & He, 2018). Operasi FON semakin bertambah pada 2016 dengan turut mencakup Kepulauan Paracel (Feng & He, 2018). Selain protes melalui jalur diplomatik, Tiongkok menanggapi persoalan ini dengan mengerahkan misilnya di Pulau Yongxing, Kep. Paracel (Feng & He, 2018). Tidak berhenti sampai di situ, dua jet tempur Tiongkok juga mengintersepsi pesawat pengintai AS di LCS pada Mei 2016 (Feng & He, 2018). Peristiwa-peristiwa tersebut hanyalah sebagian kecil dari manifestasi rivalitas Tiongkok-AS di LCS.
ASEAN tidak sepatutnya membiarkan bagian dari wilayahnya menjadi arena ‘pertandingan’ oleh pihak eksternal mana pun, terutama dua negara besar yang bersitegang seperti Tiongkok dan AS. Jika LCS terus menjadi bagian dari proyeksi rivalitas keduanya, hak ASEAN atas wilayahnya sendiri dapat tergerus. Sesuai dengan konsep Sentralitas ASEAN, ASEAN harus menjadi inti dari dinamika yang ada di LCS. Kawasan Asia Tenggara harus pertama dan utamanya diperuntukkan bagi negara-negara ASEAN. Didirikan dalam konteks rivalitas Perang Dingin, kini ASEAN dihadapkan pada kondisi rivalitas yang serupa tapi tak sama. Dalam menghadapi rivalitas yang semakin kompleks ini, dibutuhkan komtimen dan keinginan kolektif untuk bekerja sama di antara negara-negara ASEAN.
Kesimpulan
Sengketa atas Laut Cina Selatan merupakan isu yang kompleks. Baik Tiongkok dan negara-negara ASEAN pengklaim memegang justifikasi yang kuat atas klaimnya masing-masing. Setiap negara ASEAN juga memiliki kepentingan yang berbeda satu sama lain di LCS sehingga menghasilkan tidak seragamnya sikap mereka terhadap Tiongkok. Oleh karena itu, penyelesaian sengketa lebih baik dilakukan melalui jalur bilateral antara Tiongkok dengan negara-negara yang terlibat. Meski demikian, ASEAN sebagai organisasi kawasan di Asia Tenggara perlu untuk aktif memegang peran dalam manajemen konflik, salah satunya melalui CoC. Ciri khas ASEAN yang lekat dengan metode musyawarah seharusnya bisa menjadi ‘senjata’ yang efektif dalam mencegah konflik tereskalasi. Jika konflik sampai tereskalasi sedemikian tingginya, perdamaian, keamanan, dan stabilitas kawasan dapat terganggu.
Sentralitas ASEAN diperlukan sebagai salah satu instrumen penting untuk dalam melakukan manajemen konflik yang efektif. Terpecahnya sikap negara-negara ASEAN terhadap isu ini dapat memperburuk posisi tawar ASEAN di hadapan Tiongkok, juga AS. Sentralitas ASEAN setidaknya dapat menjadi langkah awal yang baik bagi ASEAN dalam menguatkan posisi tawar mereka di hadapan pihak-pihak eksternal yang berkepentingan di LCS. Dalam konteks CoC, Sentralitas ASEAN dapat memudahkan negosiasi penyusunannya. Setelah CoC tersusun pun, Sentralitas ASEAN tetap perlu dipertahankan jika suatu saat terdapat pelanggaran oleh Tiongkok atas isi CoC. Dengan adanya Sentralitas ASEAN, manajemen konflik LCS yang efektif dan baik setidaknya dapat diharapkan untuk tercipta.

Hello my world!

Hi!!!!! To be honest i don’t know how to greet this tumblr properly again after such a long time!! Huhu
Tentunya banyak banget hal yang udah terjadi di hidup gue dari terakhir gue posting di sini. Sebenenrya gue iseng buka tumblr lagi tuh kemarin terus gue re-read dari post pertama dimana waktu itu gue masih kelas 11 SMA dan look at me now, mahasiswa semester 8 HAHAHAHA. Berarti udah sekitar hampir 5 tahun ya gue bikin tumblr ini. Cool.
Setelah gue baca-baca ulang ada beberapa part penting dalam hidup gue yang gue skip khususnya di tahun 2018. Di tahun itu padahal banyak hal-hal seru dan hal-hal sedih yang terjadi tapi karena mungkin saking menikmati setiap momennya gue sampe ga sempet buat nulis di sini hehehe. Karena takut lupa (gasih gamungkin) gue mau throwback dulu ke tahun 2018. Gapapa kan? Di post selanjutnya mungkin gue akan cerita part yang belum sempet gue ceritain di 2019.
Di 2018, gue semester 4 dan 5. Menjelang semester 5 gue ketemu sama orang baru. Let’s call him, AB karena inisial A udah dibuat untuk orang lain hehe. Gue pernah cerita kan ya di tahun 2017 gue ikut kepanitiaan ospek FE dan tahun 2018 gue ikut lagi tapi di divisi mentor. Nah gue ketemu AB di sini. Dia yang wawancarain gue waktu gue daftar mentor dan dia juga yang jadi coc gue.
Awalnya gara-gara dia reply ig story gue inget banget waktu itu lagi bulan puasa dan udah mulai liburan semester genap. Lagi ngobrol-ngobrol tiba-tiba dia bahas masalah salah satu mentall illness namanya Borderline Personality Disorder (BPD) yang mana dia self diagnose kalo dia ngalamin itu. Long story short kita move chat ke line, sering telfon berjam-jam dan makin intens ditambah kita running di kepanitiaan yang sama dan dia jadi atasan gue. Pas gue ulang tahun dia ngasih gue kado leggo dan potongan-potongan kertas yang dilipet dan di dalemnya ada tulisan-tulisan gitu nanti kapan-kapan gue upload di sini ya. Bukan hal yang gampang ngadepin dia dengan kepribadian dia yang sering ngerasa rendah diri, ngerasa jadi beban buat orang, kadang self harming dan lain-lain yang menjurus ke tanda-tanda mental illness. Tapi gatau kenapa gue ya fine-fine aja sama dia karena dia keliatan lebih baik pas bareng gue dan dia juga mengakui itu. Semuanya lancar-lancar aja sampe gue tahu kalo sebelum deket sama gue sebenernya ada adek tingkat yang naksir dia dan lumayan suka chat. Tapi dia ngakunya dia ga suka tapi bingung kalo disuruh milih. Nah loh. Tapi akhirnya dia milih gue. Gue seneng. Pasti. Tapi namanya suatu hubungan pasti ga selalu baik-baik aja dan people change.Dia juga. Gue mulai deket dari juni 2018 dan selesai di awal desember 2018. Pas di JGTC kita selesain hubungan kita. Kalo gue inget-inget lagi juga gatau alesannya apa selesai kayak susah dijelasin dan kalo temen-temen gue nanya juga gue bingung jelasinnya. Intinya akhir-akhir sebelum itu gue ngerasa AB berubah dan AB juga ngerasain itu, AB bilang dia bingung dia butuh orangnya atau butuh hubungannya. Sebagai orang yang gaenakan gue juga gabisa ngebantah. Yaudah daripada makin lama malah jadi beban. Kita udahan. DImana di semester 6 AB juga bakal transfer ke Aussie. Jadi gue juga gabakal liat di di FE lagi.
I loved him, really. really. Gue beneran sayang sama dia, gue beneran gamau liat dia kesusahan dengan segala overthinkingnya dia, gue pengen dia tau kalo dia ga sendirian dan gue siap buat selalu ada di sampingnya. Tapi, kalo emang ga bisa yaudah buat apa juga dipertahanin. I let him go.... Huhuhu gue jadi kangen.....
Gue selesai di jeget, dimana itu H-7 UAS bayangin aja gimana dropnya gue. Hampir setiap hari gue nangis. Gue gamau pulang ke rumah buru-buru, selalu gue telat-telatin supaya gue punya temen ngobrol di kampus karena kalo udah sampe rumah yang ada gue cuma nangis.
Hubungan gue sama AB sekarang baik-baik aja, masih saling ngucapin ulang tahun,kadang balaes-balesan ig story. Terakhir ketemu dia di jeget. Eh jeget atau pas foto angkatan ya lupa banget. Pokoknya antara itu pas akhir tahun lalu.

UNIVERSITY OF SAN AGUSTIN U-WEEK Celebration: The most awaited big event in the University

University of San Agustin having its long festivity of artistic, religious, and cultural events, it is the centerpiece of University Week from February. The event focused on promoting self confidence, Sportsmanship, creativity skills, and artistic design to every students showing casing their talent in different are of event. The U-week celebration also raise awareness towards CARITAS (chairty) embraces both love of God and love of neighbor,UNITAS (unity) "being” one, and VERITAS (truth) there is community between what a person thinks and what he speaks the event help to develop one mind and one heart to each and everyone. Also in the main part of the event there is also sports games like, basketball boy and women, volleyball boys and women, and soccer. Everyone is required to watch and cheer for their respective departments. During the opening of the week the team members having their parade from whole university going to the gym. But of course the main part of the event is the University wide mass where every student is requesting to attend and have their color coding dress to represent the department.

Brief Analysis of the Major Amendments to Insolvency and Bankruptcy Code, 2016 (
Introduction:
The Insolvency and Bankruptcy Code, 2016 (hereinafter referred to as “IBC”) undergoes to second amendment to ensure enforcement of the provisions of the Code aiming towards the fulfilment of its objective of time-bound resolution process. These amendments will make easier effective implementation and obtain desired results.
Following are the significant amendments introduced in the 2018:
(a)   Home Buyers are recognised as Financial Creditors
In the matter of Jaypee Infratech Limited, the Supreme Court held that, home buyers have now been recognized as “financial creditors” under the IBC. This amendment has been carried out keeping in mind the peculiarity of under construction apartments in India where almost 25% to 30% of the projects face various delays causing suffering to home buyers. Since the monies raised by home buyers are a means of raising finance for construction, and on failure of the project the monies are require to be returned based on the time value of money, it has been decided to treat homebuyers as financial creditors. Accordingly, Section 5(8) of the IBC Code has been amended to clarify that homebuyers are financial creditors and can initiate corporate insolvency resolution process (“CIRP”) against defaulting developers under Section 7 of the IBC code. This also gives them the opportunity to be a part of the Committee of Creditors (“CoC“) and contribute to the decision-making during the CIRP.
(b)   Withdrawal of CIRP Application with the approval of 90% of CoC members
The newly inserted Section 12A of the Code provides for withdrawal of application after admission, if the same is approved by at least 90% of the CoC members. Prior to the Act, withdrawal of application after initiation of CIRP was not permitted, as CIRP once initiated cannot be rolled back. Considering the preference of resolution over liquidation and settlement over resolution, it was realized that there might be a situation wherein the Corporate Debtor agrees to settle the dues with its creditors by way of an out-of-court settlement; and thus, if at least 90% of the CoC gives assent to such withdrawal, the same shall be allowed.
(c)    Extension in the tenure of IRP till the appointment of RP
Once CIRP is initiated, the Board and Management of the Corporate Debtor stands suspended and the control shifts to the hands of the IRP/ RP. Section 16(5), of the Code provides that the tenure of the IRP (Interim resolution professional) shall not exceed beyond thirty days of his appointment, whether or not the RP is appointed. Thus, in situations where the RP was not re-appointed within the tenure, it was considered as expired; the Corporate Debtor was technically left un-administered. Thus, to make up for this lacuna, Section 16(5) of the Code has been amended to provide that the tenure of IRP shall continue till the RP is appointed.
(d)   Requirement of special resolution in self-filing cases under section 10 of IBC
Section 10(3)(c) of the Ordinance provides that in case of self-filing of Application u/s 10 of the Code for initiation of CIRP, a Special Resolution (SR) must be passed by the shareholders of the Corporate Debtor. Prior to this Amendment, filing of such application was decided upon among the directors of the Corporate Debtor themselves. Hence, to rule out chances of maltreatment of this power bestowed upon the directors by the Code and to prevent the BOD (board of directors) of the Corporate Debtor from taking a unilateral decision in this regard, this provision was introduced by way of the Ordinance.
(e)    Reduction in voting percentage for key decisions
As per the Code, for decisions concerning the resolution process, there existed a voting threshold of at-least 75%. However, a voting threshold as high as this was frustrating the essence of the Code. For example, “Resolution over Liquidation”, it was observed that Resolution Plans were not approved by the Committee of Creditors (COC). It was finally in the case of Synergy-Dooray, the NCLT’s Hyderabad Bench passed an order for approval of Resolution Plan with 66% votes in favour. Thus, with a view to effectuate a smoother CIRP, voting thresholds were reduced from 75% to 66% and 51% for serious decisions and routine matters respectively.
(f)     Moratorium under CIRP
Section 14(3) (b) provides that moratorium during CIRP shall not apply to a guarantor in a contract of guarantee to the corporate debtor (guarantees granted by promoter guarantors or other group companies which are not undergoing a CIRP).
·         Creditors can invoke personal or corporate guarantees during the CIRP.
·         Will provide better co-operation from promoters during resolution process.
(g)   Resolution Professional (RP) responsible for on-going legal compliances
Under Section 17(e) provides that RP shall be responsible for complying with requirements under any law for the time being in force on behalf of Corporate Debtor.
·         RP to ensure compliance with all the laws for the time being in force viz. Companies Act 2013, SEBI regulations, factories act, labour related laws, etc. on behalf of the Corporate Debtor.
·         This was already emphasized by IBBI circular dated 3 January 2018.
(h)    Limitation On Insolvency And Bankruptcy Code, 2016: No Phantom Claims Allowed
In the matter of B.K. Educational Services Private Limited v Parag Gupta, the apex court held that, Section 238A provides for the mechanism to apply the the provisions of Limitation Act 1963 to applications made under IBC 2016.
·         Applications for default of time barred debt would be ineligible under IBC.
(i)     Insertion of new section 29A. Persons not eligible to be resolution applicant.
In the case of Essar Steel India Limited, the Supreme Court of India not only interpreted Section 29A of the Insolvency and Bankruptcy Code, 2016 in depth, but also threw light on certain ambiguities relating to its applicability. The following amendments were suggested by the court:-
NPA related disqualifications of resolution applicant u/s 29A (C) :
·         Persons controlling accounts which have remained Non-Performing Assets (NPA) in excess of one year at the time of submission of resolution plan.
·         Disqualification shall not apply to financial entities which are not related parties to Corporate Debtor.
·   This clause is not applicable to a resolution applicant who has acquired a NPA through corporate insolvency resolution process during the last three years before the date of submission of resolution plan.
Disqualification of resolution applicant due to criminal conviction u/s 29A (D):
·         Conviction for two years or more would be ineligible only if the offense relates to certain statutes prescribed in the newly introduced Twelfth Schedule to the IBC
·         Conviction for seven years or more would be ineligible irrespective of statute.
·         Section 29A (d) will not apply if more than two years have elapsed from the date of release from imprisonment.
Reducing the Scope of Connected Person u/s 29A:
The definition of “financial entities” now includes the following additional classes of entities:
(i) Any entity regulated by a foreign central bank or any other financial sector regulator of a jurisdiction outside India; and
(ii) Any investment vehicle, registered foreign institutional investor, registered foreign portfolio investor or a foreign venture capital investor as defined in regulation 2 of the Foreign Exchange Management (Transfer of Issue of Security by a Person Resident outside India) Regulations, 2017.
Affidavit for eligibility u/s 29A:
As per Section 30(1), the resolution applicant shall submit resolution plan along with an affidavit stating they are eligible u/s 29A.
·         Onus shifted to resolution applicant to state its eligibility u/s 29A.
·         RP/CoC may not have to go overboard in investigating 29A compliance from a completeness standpoint.
  (j)     Management of the Corporate Debtor from end of CIRP till approval of Plan
Section 23 Resolution Professional shall continue to manage operations of the Corporate Debtor even after the end of 180 / 270 days period if the Resolution plan is submitted to NCLT.
Implications:
(i)                 Eliminates any ambiguity between the role of RP/ suspended board after the CIRP period.
(ii)               (ii) Ensures preservation of value in the Company until the resolution plan is approved by NCLT.
            (k)   Shareholding by virtue of conversion of loan into equity shall not be treated as Related Party.
Section 21(2) provides that those persons, who became a “related party” solely on account of conversion of any loan or debt into equity, shall be exempted from the prohibition of being a Resolution Applicant. The very rationale behind such exemption is that conversion of loan/ debt into equity after a particular time-period or on happening of any trigger event happens to be a very common clause of several loan/ debt agreements executed between the lender and borrower. Thus the conversion that takes place is only on account of an agreement which was essentially of a debt nature.
  Some Landmark Judgments In The Year 2018:
(i) In B.K. Educational Services Private Limited v. Parag Gupta and Associates, a division bench of SC held that, the Limitation Act, 1963  will apply to applications that are made under s. 7 and s. 9 of the Insolvency and Bankruptcy Code, 2016 (“IBC”) on and from the commencement of IBC on 01.12.2016. The SC has through this judgment clarified that IBC proceedings cannot be initiated based on time barred claims.
(ii) In Binani Industries Limited v/s Bank of Baroda, the NCLAT held that the maximisation of the value assets of Corporate Debtor cannot be ignored and interests of all stakeholders are to be taken into account in the resolution plan. 
(iii) In State Bank of India v. MBL Infrastructures Ltd., the NCLAT held that Section 61 clearly stipulates that an appeal has to be preferred within 30 days from the order of the adjudicating authority but a delay not exceeding 15 days can be condoned in filing the appeal if the appellant is able to satisfy the appellate authority that there was sufficient cause for not filing the appeal within the prescribed period of 30 days.
(iv) In Indiabulls Housing Finance Ltd. v. Shree Ram Urban Infrastructure Ltd., the NCLAT held that such an application would not be maintainable on the ground that the stage of corporate insolvency resolution process is a stage prior to that of liquidation or winding proceedings. Hence, once the second stage proceedings have already initiated, the question of reverting back to the first stage of corporate insolvency resolution process or preparation of resolution plan does not arise.
Conclusion:
The objective of the amendment primarily is to prevent un-scrupulous persons from misusing or vitiating the provisions of the code. The amendment has been designed to fine-tune and streamline the CIRP and deal with many of the contentious issues raised under it. Amendments ensure transparency in the CIRP by imposing strict eligibility criteria for being a resolution applicant and presenting a resolution plan and by introducing multiple layers of safeguard. It also attempts to remove backdoor entry of un-scrupulous promoters. Such wide scope of disqualifications will restrict the number of participants in the CIRP but improves its credibility. Further, the recognition given to the homebuyers shall prove to be a strong deterrent for promoters and real estate developers from raising huge amounts from unsuspecting home-buyers foe real estate projects and defaulting on their commitment. Moreover, it will be intriguing to see how promoters, who have defaulted because of factors beyond their control such as genuine poor business performance and now, are ineligible to submit resolutions plans, choose to react to Amendment act. Overall all amendments have brought about ample clarity qua the leniency extended to Micro, Small & Medium Enterprises (MSME’s) by the code.
