Vedic Roots, Modern Convenience: Exploring Arya Samaj Marriage
Planning your big day? If you're looking for a simple, legal, and culturally rich ceremony, then an Arya Samaj marriage might be the perfect fit for you! After all, planning a wedding is a monumental task, filled with countless decisions and intricate details. This blog explores the unique aspects of getting married through the Arya Samaj route.
Tumblr media
While the term "court marriage" in India usually refers to marriages registered under the Special Marriage Act, Arya Samaj Mandirs conduct weddings that are both legal and steeped in Vedic tradition. As per Arya Samaj, Court marriage in Delhi blends tradition with modernism and is known for its simplicity and affordability. The ceremony is performed in accordance with Vedic rituals and principles by the reformist Hindu sect known as the Arya Samaj. The Arya Samaj Marriage Validation Act of 1937 makes it a legally recognized marriage throughout India.
Key Elements of an Arya Samaj Wedding
Simplicity and Minimalism: The ceremonies are straightforward, focusing on Vedic rituals without the opulence often associated with traditional Indian weddings.
Inclusivity and Equality: Arya Samaj weddings are open to all, regardless of caste, creed, or religion. The rituals highlight equality and mutual respect between the bride and groom.
Vedic Hymns and Rituals: The ceremony includes the chanting of Vedic hymns, performed by a qualified Arya Samaj priest, ensuring the rituals are deeply spiritual and rooted in ancient traditions.
Compared to elaborate weddings, the arya samaj marriage in Delhi focuses on the core aspects of marriage—the union of two souls. This makes it ideal for couples who prefer a more intimate and meaningful ceremony. However, the Arya Samaj Mandir conducts the marriage ceremony on principles that emphasize equality and consent, making it a meaningful experience for couples. Embrace the profound significance of each ritual, and let your wedding day be a true reflection of love, commitment, and spiritual union.

The Arya Samaj marriage ceremony is conducted in accordance with Vedic tradition, and the Hindu Marriage Act of 1955's requirements, along with the Arya Samaj Marriage Validation Act of 1937, give it legal validity. Arya Samajis must follow Hindu marriage laws as well. The Arya Samaj adheres to different protocols for performing marriages than Hindus do since they do not believe in idol worship.

What Is The Process Of Marriage In Indian As Per The Law?
Marriage is regarded as a fundamental aspect of humanity and a global social institution. In order to respect the principles of religious freedom and protect the core practices of the many religions and beliefs that make up India, there is no one legal structure governing the marriage institution. The legalization of a couple's union takes place only after receiving approval from the country's existing laws, sometimes known as marital or marriage laws.
Due to the country's diverse population, India's Marriage law has a distinctive quality that makes it stand apart.
Different Process of Marriage as per the Indian Law
TRADITIONAL MARRIAGE
In India, traditional marriage is a union between two people that follows the customs of the time and is usually done to start a family.
The couple and their family members receive honor and dignity from the traditional marriage ceremony. The pair is responsible for the sight of the people in the community. They have social acceptance and a sense of dignity in society since they are prepared to assume obligations in marriage.
Tumblr media
The legality of the Traditional Marriage
The couple can only show the legal existence of the marriage in court if the customary marriage is registered and they have a Certificate of the Marriage union.
ARYA SAMAJ MARRIAGE
In India, the marriage ceremony in an Arya Samaj begins with the bride and groom reciting sacred Vedic verses. This is followed by the tradition of exchanging garlands, in which the bride wraps the groom first. This represents how well the general population has received their new union.
The legality of the Arya Samaj Marriage
According to the Arya Samaj, Marriage Validation Act of 1937 and the stipulations of the Hindu Marriage Act of 1955, the Arya Samaj marriage ceremony is made in accordance with Vedic traditions and rituals. The duration of an Arya Samaj marriage is one to two hours. It examines the alliance's legitimacy in light of its "social" and "legal" obligations. The Marriage ceremony is done in a first-come, first-served manner after a 48-hour wait time for any alterations, based on the priest's availability, once the fees and paperwork are adequately furnished and accepted.
Eligibility Criteria for the Arya Samaj Marriage
At the time of registration, the bride must be 18, and the groom must be 21 years old.
Arya Samaj regulations permit inter-caste and inter-religious unions, provided that none of the parties to the marriage are Muslim, Christian, Parsi, or Jewish. These religions allow conversion through a procedure known as Shuddhi.
COURT MARRIAGES
In India, court marriages differ from traditional marriages as well as Arya Samaj marriages, which take place in front of a marriage registrar in a court. A court marriage is when a man and woman are legally allowed to marry without considering their caste, religion, or creed in front of a judge, a marriage registrar, and three witnesses.
The legality of the Court Marriage
The Special Marriage Act of 1954 is the prerequisite of a court marriage which should be satisfied. Both parties do not have to be of Indian nationality in order to marry through the procedure of court marriage. In the court, a foreigner and an Indian citizen can get married. Through court marriage, people of two different genders who follow the same or a different religion can also marry each other.
Eligibility Criteria for the Court Marriage
The boy or girl must reach this age in order to get married, per Indian law i.e., 18 and 21, respectively
In this type of marriage union, two people from different castes, religions, or creeds can marry each other.
Importance of Registration of Marriage
The Marriage Registration provides legal recognition to the married couple by providing them with a Marriage Certificate
It offers acceptance and social safety
A marriage certificate is necessary if a couple plans to open a bank account or apply for a passport after the marriage
It helps in aiding in obtaining visas for the couple
The Marriage Certificate is necessary for the partners to travel abroad using a spouse visa because foreign embassies in India and other nations do not recognize traditional marriage

Registration Process Of The Arya Samaj Marriage
Arya Samaj marriages are very simple to execute and the rituals are straight. Couples from different religions who fall under the broad umbrella of Hindus in India can perform Arya Samaj. This is a choice and wiling preference for couples where one person belongs to Buddhism, Jainism or Sikh religion. The ceremony performs adhering to the Vedic rituals in an Arya Samaj temple.
Tumblr media
According to the Arya Samaj mandir in Delhi, the hymns spelt during the ceremony are explained to the bride and groom. Arya Samaj marriage is just like Hindu marriage, where the marriage takes place around the fire. Also, it is legally recognised. In fact, there is the Arya Samaj Marriage Validation Act of 1937 provided under the Hindu Marriage Act, 1955.
Types Of Marriage Registration
1. An Arya Samaj marriage can be registered under the Hindu Marriage Act, 1955, in case both couples have the same principles.
2. If the beliefs differ, then the couple can register under the Special Marriage Act, 1954.
Procedure For Arya Samaj Registration
1. Make an appointment at the sub-divisional magistrate’s office. It takes at least a fortnight. So, it’s advisable to start this procedure before the marriage takes place.
2. Fill the registration form.
3. Submit all the proofs and documents needed.
4. Two passport size photographs of the bride and the groom along with a photograph of the marriage.  Bring the marriage invitation card (optional).
5. Two witnesses who have to be physically present to sign.
6. Attestation of gazette officer is mandatory.
Consequently, after fulfilling all the formalities, the magistrate’s office will grant the marriage certificate, which is legally recognized by the court.
Conclusion
As per the international law, the Arya Samaj marriage certificate is not a valid document. Only a marriage certificate issued by the sub-registrar is a valid one.

Traditionally, weddings are a grand event, because of its importance and power to affect one’s life, and as an event in general. It involves, two adult parties desire to be together to enjoy and explore their love for each other, and taking the necessary steps to certify their decision in the eye of law. Society however, does not look at all the marriage desires in the same way. The desire of becoming together comes with the burden of responsibility and a life-altering event as such must be given much thought before jumping into action. There are varieties of ways by which a marriage ceremony can be performed, and while the marriage ceremony is mostly known to be grand, expensive and lavish, the Arya samaj mandir in Ghaziabad offers its services to those who do not want to commence their wedding in the pure traditional sense, while keeping the marriage ceremony perfectly legal and valid as per the Arya samaj marriage validation act, 1937 with provisions of the Hindu marriage act, 1955.
