Illinois is set to become the first state in the nation to eliminate cash bail after the state Supreme Court ruled Tuesday that a landmark criminal justice reform law did not violate the state’s constitution.

The opinion was released more than six months after the Pretrial Fairness Act was halted by the Justices just hours before it was to go into effect Jan. 1 in response to legal challenges. The high court said the law should now go into effect in September.

In its 5-2 ruling, the court said the state’s constitution “does not mandate that monetary bail is the only means to ensure criminal defendants appear for trials or the only means to protect the public. Our constitution creates a balance between the individual rights of defendants and the individual rights of crime victims. The Act’s pretrial release provisions set forth procedures commensurate with that balance.”

The majority rejected claims that the Legislature had overstepped its authority by eliminating bail through the Act, writing that “the legislature has long regulated the bail system.”

The court’s only two Republican Justices dissented, saying “the legislature’s abolishment of monetary bail is in direct violation of the plain language of our constitution’s bill of rights and, more specifically, the vested rights of crime victims. ... This court has an absolute obligation to declare the pretrial release provisions of the Act to be invalid and unenforceable no matter how beneficial the abolishment of monetary bail may be.”

The bail system overhaul was one of the most controversial provisions of the widely scrutinized SAFE-T Act, a major bill that mandated wide-ranging reforms to policing, court proceedings and victims’ rights in the state.

The court’s ruling stems from a flurry of lawsuits last year brought by roughly 60 sheriffs and state’s attorneys who argued that eliminating cash bail would reduce public safety, put law enforcement in harm’s way and violate the state’s constitution.

In December, Kankakee County Chief Judge Thomas Cunnington agreed with the groups and ruled the cash bail provision unconstitutional, though his ruling would have only applied to counties that had sued.

An appeal by Illinois Attorney General Kwame Raoul sent the matter to the state Supreme Court, and the Justices ordered that the entire Pretrial Fairness Act wouldn’t go into effect until further notice “in order to maintain consistent pretrial procedures throughout Illinois.”

In the ruling Tuesday, Chief Judge Mary Jane Theis said Cunnington’s decision ignored the plain language of the bail clause in the state’s constitution, which never included the term “monetary, so does not cement the practice of monetary bail, however long-standing and prevalent across Illinois, into our constitution.”

Raoul released a statement Tuesday morning saying “someone’s experience with the criminal justice system should not vary based on their income level. The SAFE-T Act was intended to address pervasive inequalities in the criminal justice system, in particular the fact that individuals who are awaiting criminal trials — who have not been convicted of a crime and are presumed innocent — may spend extended periods of time incarcerated because they cannot afford to pay cash bail.”

Cook County State’s Attorney Kim Foxx, who supported the bail reform, said the ruling “is a monumental milestone toward achieving equal justice for all in Cook County and Illinois. ... Ending cash bail is in line with our values and is a critical step toward economic and racial justice in Cook County and Illinois.”

But McHenry County State’s Attorney Patrick Kenneally, an opponent of the bail act, called the ruling “a sad reflection of state of ideological capture in our three branches of government. ... We at the state’s attorney’s office will continue to do everything within our power to ensure that dangerous offenders remain behind bars pre-trial or that other measures, such as electronic monitoring, are in put in place to minimize risk.”

Despite a two-year ramp-up before bail reform was to go into effect, opponents waited until late last year to mount a serious effort to overturn the law, as well as a political pressure campaign before last year’s statewide elections.

In the weeks before the election, opponents derided the SAFE-T Act as a “purge law” and claimed it would make the state — with a particular focus on Chicago — less safe by releasing more violent criminals to prey on the public.

Supporters of the Pretrial Fairness Act said its provisions would simply remove cash bail as a condition that could be set by a judge when considering whether someone was likely to return to court for their hearings or posed a danger to the public.

Studies of jurisdictions that have nearly eliminated cash bail have shown no significant increase in crime generally, nor by defendants released while awaiting trial. In some cases, defendants were more likely to return to court.

The elimination of cash bail does not mean people charged with crimes cannot be held in custody pending trial.

Under the act, the courts will continue to hold detention hearings for people accused of serious crimes to determine whether someone poses a safety risk if released and whether someone is likely to show up for their hearings — the same considerations that now often determine cash bail.

People charged with misdemeanors and other minor offenses will be released without bail or pretrial conditions. In more serious cases that meet standards where a person can be held in custody, prosecutors will be required to request a person be detained and make arguments on public safety and the risk of flight.

In cases where prosecutors seek to hold a person in custody, the defendant’s attorneys will be given more time to prepare for the hearing. The decision on whether a person should continue to be held in custody pretrial can also be revisited by the court at future hearings.

Cook County had planned to move forward with bail reform on Jan. 1 until the Justices halted its implementation. “I feel very confident that we will be ready to go in 60 days,” Pretrial Division Presiding Judge Marubio said Tuesday.

Until Sept. 18, judges will continue to set bail in cases in Cook County, just as they had been doing up until Dec. 31, Marubio said.

DuPage County State’s Attorney Robert Berlin, the lone Republican appointee on a state Senate panel that recommended revisions to the bail reforms in the SAFE-T Act last fall, said changes adopted in the December veto session largely addressed “glaring deficiencies” and expanded judges’ discretion to detain defendants who might pose a danger to the public if released.

Berlin did not join the lawsuit that led to Supreme Court case because of the potential conflict with his role on the panel.

“At this point, I would say (the public) shouldn’t be panicked,” Berlin told the Sun-Times. “With the amendment (passed in December) I am confident that violent criminals are going to be detained.”

Berlin said he expected an influx of defendants seeking hearings when the law takes effect, and that his office will petition judges to hold any person his office deems a threat to public safety.

He also noted that even multimillion-dollar bail amounts are not a guarantee of safety. “I have seen people put up $200,000 and walk out of jail on a $2 million bond,” he said.

Berlin said he and his fellow state’s attorneys planned a conference call Tuesday afternoon to discuss options, but personally he felt that another lawsuit was not likely. “I think we need to move forward with the General Assembly and use the legislative process,” he said. “At this point, I’m not sure legally what else there is to do.”

Berlin said he would advocate for changes that would make the Act resemble bail statutes in New Jersey, which largely did away with cash bail in 2017. New Jersey’s laws allow judges to set a cash bail when prosecutors show “clear and convincing evidence” people are likely to flee, threaten or intimidate others if set free before trial, or otherwise pose a threat to safety.

Harold Krent, a professor at IIT-Kent Law School who has studied the separation of powers, agreed there likely is no path for further challenges in the courts.

“There is no traditional injury they can point to that is going to get them through the doors of federal court,” he said. “This is a case where a state law was found constitutional under the state constitution. I’m not sure what their federal claim would be.”

The bail reforms were just one part of the SAFE-T Act, some of which have already taken effect. Other measures include requiring all police departments to equip officers with body-worn cameras by 2025, expanding services for victims of crimes and changing how people who are incarcerated are counted for redistricting maps.

Many Republican candidates made the SAFE-T Act a focus of law-and-order campaigning last year, but Democrats held off most challengers in what was expected to be a bruising midterm election for the party across the country and even expanded their majority on the state Supreme Court.

The elections of Justices Elizabeth Rochford and Mary Kay O’Brien were believed to be significant to preserving Illinois’ strong abortion protections, as well as the future of the SAFE-T Act. Both Justices sided with the majority of the court.

Justices Lisa Holder White and David Overstreet, the high court’s only Republicans, joined in the dissent.

i'm just surprised about how much of a nothingburger the Awake IL thing ended up being -- my paranoid side makes me think it was killed only after Johnson won the primary with Vallas, whereas it would have been trotted out for Chuy, or maybe Lightfoot if the machine hadn't found her too much of a liability

George Soros is an evil man. In fact, he is one of the most evil men currently shaping American and Western politics, and global events more generally.

To straightforwardly opine in this manner is not to traffick in antisemitism or noxious Jew-baiting. It is simply to share one's perspective about one of the most influential political donors, "philanthropists," and social activists in the world—someone who doles out countless sums to undermine and reshape in his dystopian image entire countries, spreading across at least five separate continents.

It is frankly astounding that this even needs to be said. I am a Jewish columnist, podcaster, and public speaker. As such, I routinely share my opinions as a basic feature of my job. I imagine some of those opinions are provocative—perhaps highly so—for a subset of the population, especially those of a left-of-center bent. Some (very) small percentage of my critics may hate me and hate my opinions because I am Jewish, but it is surely the case that the overwhelming majority of my critics disagree with me on the merits of my ideas and contributions to the public discourse. Unless I have a compelling reason to believe a specific critic is acting out of rank bigotry, I operate from a baseline presumption that the critic is not a Jew-hater, but simply disagrees with my position.

Again, this should be obvious. But for far too many, it is apparently not obvious—at least when it comes to criticism of George Soros.

For years, whenever conservatives, nationalists, and traditionalists have criticized the absolutely sprawling influence of George Soros and his left-wing Open Society Foundations umbrella network, Soros' praetorian guard in the elected official class and corporate press invariably shriek, "That's antisemitism! You can't say that!"

What utter tripe.

Soros directly spent $128.5 million during last fall's U.S. midterm elections, making him that election cycle's single largest individual donor. He has spent $40 million trying to elect radically left-wing "reform prosecutors"—something he has been fully transparent about, defending it under his own byline in a Wall Street Journal op-ed last summer—across the country. He has been dishearteningly successful in that endeavor, successfully electing 75 district attorneys—such as Alvin Bragg in New York City, Chesa Boudin in San Francisco (since mercifully recalled), and Kim Foxx in Chicago—who oversee a decivilizational (and oxymoronic) prosecutorial agenda of not prosecuting violent and property crimes. Simply put, Soros is more responsible than any man in the world for the descent of some of America's most iconic cities into anarchic urban hellholes.

As I alluded to yesterday, ringtones became one of the record industry's strategies for raising profits in a post-Napster world. Two of the songs on today's poll are notable for this reason, with 50 Cent's In da Club becoming the first number one song on the Billboard Ringtone Charts in 2004 (the first song to reach this achievement) and Beyoncé's Crazy in Love becoming the best selling ringtone in the United Kingdom that year.

We're also starting to see the south start to take over the sound of rap in the mainstream. Groups like OutKast, Arrested Development, Three 6 Mafia, and Geto Boys already helped to put the south on people's radars (note: these artists are all from different regions in the south so their music branches off from different styles, so I'm not lumping them together for any of those reasons). But in the early 2000s with the mainstream popularity of crunk, the south was going to define a lot of what rap sounds like to people this decade. With all of the R&B fusion gaining popularity in the genre, crunk helped to serve as an alternative sound. There isn't any crunk on this poll (sadly Get Low by Lil Jon and the East Side Boyz missed eligibility by one slot), but we'll definitely see its presence later on.

Today's chart also features the posthumous release of Aaliyah's Miss You. Aaliyah, singer, actress, "Princess of R&B", was killed in a plane crash in 2001 when she was only 22 years old. For the music video, artists like Jamie Foxx, Queen Latifa, Lil Kim, DMX, and Missy Elliot made appearances to pay tribute to the late artist. The video also opens with DMX reciting a poem he wrote after the news of her passing. During her short life, she helped to define an entire generation of R&B and her influence is still heard and seen today.

🙄 Jussie Smollett gets more time to file appeal, but court says 'no further extension will be granted'

CHICAGO -- A state appeals court on Monday granted a request by Jussie Smollett's defense lawyers for a fifth (5th) extension to file their initial argument, but warned it would be the last time.

"A fifth motion for more time to file an opening brief, particularly by the defendant in a criminal matter, is rare," the three-judge panel of the First District Appellate Court wrote in its order. "Nevertheless, the court grants the motion to serve and file appellant's brief on or before March 1, 2023. After that date, no further extension will be granted."

In their motion last week for yet another extension, Smollett's attorneys said their brief was completed and, at the time, they were still waiting for a ruling on a request to file an oversized brief in the case.

The actor and singer is appealing his conviction for staging a hate crime against himself in Chicago and lying about it. His lawyers have said they needed to file 80 pages instead of the standard maximum of 50. They cited the complexity of the case and previous cases that were brought against the actor after the 2019 hoax first came to light.

Smollett was indicted that year but in a much-criticized reversal, State's Attorney Kim Foxx's office dropped all charges against Smollett in consideration of community service and his agreement to turn over the $10,000 he had posted for bond to the city of Chicago.

That led to Special Prosecutor Dan Webb being appointed to review the decision, and he announced new charges against the actor the following year.

Attorneys for the special prosecutor's office opposed the filing of an oversized brief, noting Smollett's appeal dealt only with the case that led to his 2021 conviction, not earlier cases.

In the ruling Tuesday, the judges allowed Smollett to file an oversized brief but not as large as they had requested. "Instead, Defendant-Appellant may file a brief not to exceed 20,000 words, a 33% increase in the number of words," the court ruled.

A jury convicted Smollett in December 2021 on five counts of felony disorderly conduct and he was sentenced by Judge James Linn to five months in jail. The sentencing hearing ended with the actor yelling that he was not suicidal before being led from the courtroom by sheriff's deputies.

Smollett only served six days in the Cook County Jail before he was released on his own recognizance pending appeal. He will be required to go back and serve the rest of his time if his conviction is not overturned.

His attorneys allege the charges bought by Webb amount to double jeopardy. They have also criticized rulings Linn made before and during the actor's trial.

A Chicago police detective accused of torture. Judges and prosecutors mired in a tangle of conflicts of interests.

But in a surprise move nearly a year later, the special prosecutors assigned to cases connected to former CPD Detective Kriston Kato are taking aim at a 15-year-old statute enacted in the wake of allegations surrounding notorious ex-CPD Detective Jon Burge that created a torture commission to investigate claims of police abuse.

The special prosecutors have filed a motion in at least two cases related to Kato, arguing that the torture commission, which referred the cases for a court hearing, is unconstitutional. The commission was formed in 2009 by the Illinois Torture Inquiry and Relief Commission Act and has played a role in a number of overturned convictions in the past decade. The commission reviews torture claims and refers those it finds credible to judges for a hearing.

The Cook County state's attorney's office on Tuesday said judges have vacated seven murder convictions connected to a retired Chicago police detective accused of framing others who were sent to prison. CBS Chicago reports it is believed to be the largest mass-exoneration for murder in U.S. history.

An eighth cases remains, pending further court proceedings.

State's Attorney Kim Foxx told reporters that her office no longer will oppose post-conviction litigation in the eight cases following a 2019 review of cases related to allegations of police misconduct involving Reynaldo Guevara.

"We no longer believe in the validity of these convictions or the credibility of the evidence of these convictions," Foxx said.

The seven cases dismissed Tuesday involved slayings committed between 1989 and 1994.

Five defendants already have completed prison sentences and are no longer in custody. Two others are expected to be released, while one remains in custody pending further court proceedings.

Two dozen cases already have been vacated and action on three additional cases is expected in the coming weeks.

Guevara's victims are now experiencing freedom – some for the first time in decades. CBS Chicago talked with one of them – Alfredo "Freddie" Gonzalez, who served his sentence at Stateville Correctional Center in Crest Hill.

Gonzalez said, "I'm free!" as he tearfully embraced his daughter, Maria.

Gonzalez spent 32 of his 64 years behind bars – three decades of a life sentence for a murder he didn't commit.

"I had a broken heart, because I wasn't attentive," Gonzalez said.

Also exonerated Tuesday was Nelson Gonzalez, who spent 21 years in prison for a murder he didn't commit. He did not mince words about who he thinks is to blame.

"This was a conspiracy created by Mr. Guevara and other agents, and I'm asking Kim Foxx to press charges," Gonzalez said.

Guevara - a former member of a police department dogged by decades of scandal, cover-ups and brutality - has never been charged with a crime. Foxx said her office is reviewing possible charges against Guevara, who retired in 2005 and is receiving a city police pension and a Chicago Park District pension.

He helped inmates win freedom by repeatedly invoking his constitutional right against self-incrimination or insisting that he couldn't remember facts, thus forcing prosecutors to dismiss charges in several cases.

In one case, after he was granted immunity by prosecutors, he answered repeatedly that he didn't remember confessions that he elicited from two men ultimately convicted of murder. The judge characterized his comments as "bald-faced lies" and threw out the confessions.

"Could we try these cases again today without the work of Detective Guevara?" Foxx said Tuesday. "Based on our review, we are not able to retry these cases."

She added that additional investigations could be conducted "to see if, in fact, someone else committed these crimes."

Last September, Chicago's City Council agreed to pay $20.5 million to two of at least a dozen men whose murder convictions were dismissed after allegedly being framed by Guevara.

The lawsuits were filed on behalf of Armando Serrano and Jose Montanez who spent 23 years in prison before they were released in 2016. A key witness in their case admitted that he had lied about hearing them confess because Guevara had threatened to beat him if he didn't.

In 2009, a jury awarded $21 million to a man who spent 11 years in prison before he was retried and acquitted because witnesses testified that Guevara intimidated them into falsely identifying the man as the killer. The city later agreed to pay $16.4 million.

Another jury awarded $17 million in 2018 to a man who made similar allegations.

Foxx said Tuesday that she would not discount the impact each case had on the defendants and their families.

"While we focused on the allegations of misconduct, we did not want to lose sight that lives were lost and the impact that our decision could have on the families of victims who believed that justice had been served by these convictions," she added. "We looked at these cases with a careful lens to ensure that we got it right."
