आज यानि 26 ज��लाई 2019 की सुनवाई के सार सबसे पहले आज सारे अन्य केस दूसरी बेंच ट्रांसफर होने की नोटिस मिली और आज बेंच सिर्फ हमारा केस सुनने बैठी ये समझ सकते है।गणेश सर सुबह से उपस्थित थे। सबसे पहले सरकार की तरफ से अतिरिक्त महाधिवक्ता जी ने बोलना शुरू किया उन्होंने कोर्ट जो 3 सवाल पूछे थे उसका उत्तर बिंदु वार दिया फिर उसके उपरांत

कोर्ट को समझाए और सारी बाते रखी काउंटर मे  लिखी बिंदुवार । उन्होंने ये भी ��ंगित किया कि वो किसकी तरफ से पक्ष रख रहे है और किस याचिका implead है और नंबर नोट करवाया। फिर उन्होंने लोकल dialect और mother tongue पर संविधान में रखी बाते और कोठारी आयोग में दिए महत्व को दर्शाया और उसके उपरांत census 2011 की रिपोर्ट के पॉइंट और बातें नोट करवाई।लोकल भाषा या dialect को ले कर और लोकल वाणी या बोली पर उसके बाद उन्होंने ये नियम सरकार अमेंड कर चुकी है और ये नियम रद्द नही कर सकती इसकी बातें समझाई कोर्ट को कुछ सुप्रीम कोर्ट के आदेश को दिखाते हुए की पीछे से नियम रद्द न कर सकते ।जो होगा आगे से होगा और सरकार ने परिवर्तन कर लिया है। एक मानव चंद रेड्डी का आदेश रिकॉर्ड पर रखा और गौरव भाटी का आदेश जो ऐसी ही डबल बेंच का है वो रखा । और फिर सारे पेपर्स रिकॉर्ड पर ला के बातें विराम दिए। फिर जज सर बोले कि अब इसके आलावा किसी के पास कुछ है तो रखे। तो उपेंद्र मिश्रा ने 10 मिनट का समय मांगा और आपनी बहस को तीन भाग में रखा उन्होंने पहले 2011 और 2012 कि बीटीसी ट्रेनिंग समझाई और किस नियम से हुई कितनी सीट हुआ करती थी और क्या चयन का मानक था ट्रेनिंग का। फिर उन्होंने एक शार्ट complilation फ़ाइल की जिसमे उन्हीने कुछ सुप्रीम कोर्ट के आर्डर लगाए जहाँ उन्होंने restrospective और prospective नियम और कहाँ कैसे लग सकता है ये स्पष्ट किया। फिर उन्होंने गोरखनाथ वाले आर्डर पर जो review आदेश हुआ था फुल बेंच 13 जज पीठ का केशवनंदभर्ती और केरल सरकार के केस क्या नई फाइंडिंग दी थी उसको थोड़ा स्पष्ट किया। और ये भी बोला कि आप अगर रूल ultravirus घोषित करते है तो ये 1981 से लेकर अभी तक सब भर्ती पर affect डालेगा और 1981 का नियुक्त शिक्षक या तो 26 जुलाई 2019 आज या तो रिटायर हो गया होगा या फिर दुनिया मे न होगा तो उसके ऊपर कैसे ये आदेश लागू होगा। ये नियम 14 1 a जब से नियामवली बानी है तब से है आपने जन्म के समय से और ये 1981 नियम 1972 नियम का रिफाइंड वर्शन है। उसपर ही बेस है।  उनकी बहस पूर्ण हो गयी और सुप्पलीमेंट्री पेपर्स रिकॉर्ड पर टेबल कर दिए दो याचिका में सौरभ वाली और ओमप्रकाश वाली मे अपना काउंटर।और ये भी बताया कि दोनो याचिका और ओमप्रकाश और सौरभ की processs और counselling होने के बाद फ़ाइल हुई है चयन processs शुरू हो गया था संदीप dixit  और पंडित जी  खड़े हुए तो  जज ने बोला आप किसके व्यू के साथ है तो दोनों ने डॉ मिश्रा और  उपेन्द्र जी बातों की समर्थन के अलावा कुछ बोलना हो तो बोले तो उन्होंने आपनी व्यू बताये किसके साथ का व्यू है। संदीप dixit ने मिश्रा जी साथ सहमति दी और पंडित जी ने आर्टिकल 15( 3) पावर के बारे मे पक्ष रखा और गौरव राठी और मनीष विकल का आदेश कोर्ट के रेकॉर्ड पर लाया और सरकार की बातें जो पब्लिक नोटिस के बारे मे थी उसपर शिखा सिंह केस का ऑर्डद्र और सुप्रीम कोर्ट के आदेश के क्रम मे सचिव बेसिक परिषद की पब्लिक नोटिस कोर्ट मे रिकॉर्ड पर लायी।और ओम प्रकाश की याचिका 10131 27 oct को फ़ाइल हुई थी और 15000 भर्ती की पहली counselling 26 nov huyi सचिव का लैटर दिया कोर्ट मे 10 oct वाला। फिर तिवारी फिर खड़े हुए और मिश्रा जी बहस को नकारने का प्रयाश किया और 10 मिनट और बोले  conclusing आर्गुमेंट।और फिर जज ने आर्डर resrved कर  लिया और लंच के लिए उठ गए। बाकी बातों का सबूत आप सब को आर्डर के बाद ही मिलेगा कुछ लोगो को मेरी बातें समझ मे आएंगी कुछ को न अच्छी लग सकती है। और बाकी चीजे आर्डर आने के बाद स्पष्ट हो जाएंगी रिट allow होती है या डिसमिस इसका सबूत आर्डर मे होगा । बाकी खुद जो देखा लिख दिया और फिर मानबहादुर भैया और ओमकार सिंह से उनके चैम्बर मे और बात की और पंडित ने बधाई भी दी। कुछ गलत लिखा हो तो सौरभ सिंह या फिर 0 जनपद के कुछ साथी अंदर थे उनसे पूछ लें। या फिर संजय पाल से भी अंदर थे क्रॉस चेक कर ले। मेरे लिए ये सबसे खुशी की बात है कि हमको अब कोर्ट मे न परेशान होना न दौड़ भाग करनी न cl बर्बाद होगी। और न भाग के lko आना पड़ेगा। आर्डर आने के बाद कुछ लोगो का प्रेम मिलेगा और जिनको न पसंद हम गाली देयेंगे। सभी का आपना स्वविवेक है। और कोई साक्ष्य चाहिए तो सवाल के साथ इनबॉक्स संदेश या कॉल कर ले। आर्डर कब तक आएगा इसकी जानकारी जज के बाद किसी को नही तो हमारे पास इसका उत्तर नही है। जब भी आएगा जो आएगा सूचित कर दूंगा। ये अपडेट अच्छी लगे तो ठीक वरना काम का सबूत आदेश से दे पाऊंगा। बाकी कुछ वाट्स एप्प ग्रुप मैं लाइव अपडेट भी डाली थी उनसे क्रॉस चेक कर सकते या पूछ लें। मेरे लिए आज का मतलब आदेश reserved  और अब आर्डर आने तक एक दम आराम और पढ़ाई। बाकी कोई अनुमान न पूछे क्योंकि 326 का दर्द झेला है जब तक आर्डर देख न ले तब तक कोई टिपण्णी न दूँगा। बाकी जिनको हम पर भरोसा है उनका विश्वश टूटेगा नही ये  पूरी जिम्मेदारी से sure हु। भरोसा एक दिन न बनता पर टूटने मे एक पल लगता है इस नियम को आगे रख के मेहन्नत
