Regulatory agencies and county governments use public tax dollars to operate but have effectively no enforcement power. The only enforcement mechanism they can use is bringing a civil suit against a violator to at most fine them, which isn’t enforcing anything, it’s only a redistribution of wealth back and forth between regulatory agencies and corporations. Many of the suits brought by regulatory agencies lose because they are unconstitutional as most of what these regulatory agencies are supposed to do would require constitutional violations. They are effectively for profit unconstitutional corporations with no authority committing tax fraud and violations of the Federal Tort Claims Act on a daily basis. Russian and Chinese governments have been aware of this and have been taking advantage of it for quite some time, and it’s literally become a national security concern, which nothing can be done about, because national security agencies are apart of the same unconstitutional paradigm. This effectively makes these organizations constitutional traitors and liable for treason charges, which they can be convicted of if it is brought to their attention that what they are doing is unconstitutional and they decide to keep doing it anyway.

OpenAI’s Meteoric Rise and Valuation
OpenAI hailed as the leading startup in the world and a pioneer in generative AI, has achieved unprecedented success, setting the stage for the AI explosion with the launch of ChatGPT in November 2022. The company’s valuation has soared to an estimated $86 billion, fueled in part by Microsoft’s multiyear, multibillion-dollar investment, giving the tech giant a substantial 49% stake in OpenAI’s for-profit subsidiary.
Legal Troubles Mounting
However, OpenAI’s success has not shielded it from legal challenges. Co-founder Elon Musk, last week, filed a lawsuit against the company, alleging a breach of contract. Musk contends that OpenAI violated its founding agreement by using its technology for the benefit of its for-profit arm rather than humanity. The Tesla CEO seeks to make all OpenAI technologies public and prevent any monetary gain for Microsoft, a major user of OpenAI’s models.
The New York Times has also initiated legal action against OpenAI and Microsoft, claiming the unauthorized use of its copyrighted material. The Times demands the destruction of content trained using its materials. Other media companies, including The Intercept, Raw Story, and AlterNet, are suing OpenAI, asserting the unauthorized use of their data for training models.
Regulatory Scrutiny on Multiple Fronts
OpenAI is not only facing legal battles but also regulatory scrutiny both in the US and abroad. The Securities and Exchange Commission (SEC) is investigating whether OpenAI misled investors, particularly following the firing and subsequent rehiring of CEO Sam Altman. The Federal Trade Commission (FTC) is examining OpenAI’s dealings with Microsoft, along with those of its rivals, focusing on the impact of major cloud providers investing heavily in generative AI companies.
Internationally, the UK’s Competition and Markets Authority and the European Commission are also evaluating the OpenAI-Microsoft deal, considering its implications for competition in the market.
Intensifying Competition
Amidst these challenges, OpenAI faces growing competition. Anthropic has unveiled its Claude 3 family of large language models, positioning itself as a contender against OpenAI’s GPT offerings. Google is also entering the arena with its Gemini family of models, aiming to rival OpenAI. Apple, under Tim Cook’s leadership, is investing heavily in generative AI, potentially introducing on-device capabilities that could divert attention from OpenAI’s offerings.
Despite these challenges, OpenAI’s immediate danger seems remote, given the lengthy nature of legal proceedings and its substantial financial backing from Microsoft. However, as the AI leader, OpenAI will undoubtedly encounter more hurdles in the evolving landscape of artificial intelligence.

FDA - Medical Devices Advisory Committee

The U.S. Food and Drug Administration (FDA) has 31 advisory committees responsible for the evaluation and regulation of drugs, medical devices, and biologics.
The advisory committee protects and promotes public health while meeting the requirements established in the Federal Advisory Committee Act.
Committees are either mandated by statute or established at the discretion of the Department of Health and Human Services.
The advisory committee has multiple roles in developing and evaluating New Drugs, Biologics, and Medical Devices.
Their primary goal lies in assisting the FDA to evaluate applications for Pre-Market Approvals (PMAs) of medical devices, New Drug Applications (NDAs), and Product Licensing Agreements (PLAs) for biologics. The committees include chairperson, members, a consumer, industry and sometimes a patient representative.
Medical Devices Advisory Committee
Medical Devices Advisory Committee supports the FDA to protect and promote public health. The committee consists of 18 panels with a maximum of 159 standing members.
The selection of members is carried out by the Commissioner or designee from among authorities in Clinical and Administrative Medicine, Engineering, Biological, and Physical Sciences, etc.
The panel advises the FDA on the safety and efficacy of the medical devices except for the Medical Device Dispute Resolution Panel.
According to the respective specialty area, the panel advises the commissioner of Food and Drugs regarding recommended classification or reclassification of devices into one of three regulatory categories.
For recommendations of medical devices with respect to regulatory aspects, the committee reviews and evaluates the issues related to clinical study designs on the safety and effectiveness of marketed and investigational medical devices.
Overall, the 17 panels except for the Dispute Resolution Panel (DRP) of the medical device advisory committee, advise the Commissioner in accomplishing the constraints in assuring the safety and effectiveness of the medical devices in accordance with their specialty ****area and authorization.
The advisory committee also plays a major supportive role to agency professionals and influence agency decisions. FDA calls meetings with the committee or with the advisory panel as necessary. Generally, each of the panels meet once a year or as per the requirements by the FDA and important regulatory decisions or discussions are carried out in these meetings.
It is important that Manufacturers have a regulatory and quality team that stays abreast of decisions concerning their products and any such decisions or discussions are preemptively taken into account for a speedy FDA clearance, approval or compliance activities.
