Esurance Property & Casualty Insurance Company (Esurance) appealed the trial court's order granting summary disposition in favor of Nationwide Mutual Fire Insurance Company (Nationwide), and denying Esurance's request for summary disposition. In Nationwide Mutual Fire Insurance Company v. Esurance Property & Casualty Insurance Company, and Derek Allen Gregory and Blair Gregory, No. 361298, Court of Appeals of Michigan (June 15, 2023) Esurance alleged its insured defrauded it when it acquired the policy and it was entitled to rescind the policy regardless of the trial court's balancing the equities.
PERTINENT FACTS
In 2015, Derek Gregory (Derek) was driving a truck insured by Esurance and co-owned with his wife, Blair Gregory (Blair). The truck collided with Daniel Moore (Moore), who was riding a bicycle. Moore was injured in the accident. Moore was uninsured, and his claim for personal protection insurance ("PIP" ) benefits was assigned to Nationwide via the Michigan Automobile Insurance Placement Facility (MAIPF). Nationwide paid a total of $454,871.09 in medical expenses on behalf of Moore.
Nationwide subsequently filed this lawsuit against Moore and Esurance seeking to recover the PIP benefits it paid on Moore's behalf. Nationwide alleged that Esurance, as the insurer of the truck was in a higher priority position and was required to reimburse Nationwide.
The Bases for Rescission
Esurance subsequently filed a third-party complaint against Nationwide and the Gregorys, alleging that Blair had failed to disclose several material facts in her application for the insurance policy, including that she was married, that Derek occasionally drove the truck, that Derek had been in prior accidents involving alcohol, that Blair had been involved in prior accidents, and that Blair had filed prior claims with other insurance providers. Esurance argued that Blair's misrepresentations in her insurance application constituted fraud, warranted rescission of the policy, and prohibited Nationwide from recovering from Esurance as a higher-priority insurer.
After a hearing on Nationwide's motion, the trial court issued a written opinion granting summary disposition in favor of Nationwide. The trial court noted that rescission is not automatically applicable in the face of fraud. The trial court held that Esurance had failed to show that rescission was warranted, and that Nationwide could stand in Moore's shoes and recover from Esurance on the basis of equitable subrogation
RESCISSION
Esurance argued that the trial court erred by granting summary disposition in Nationwide's favor. Specifically, Esurance contended that the trial court abused its discretion in concluding that the balance of the equities weighed against rescission.
Equitable subrogation is a flexible, elastic doctrine of equity that is decided on a case-by-case basis. Equitable subrogation is the mode which equity adopts to compel the ultimate payment of a debt by one who in justice, equity, and good conscience ought to pay it.
The Michigan Supreme Court has held that the plain language of the no-fault act does not preclude or otherwise limit an insurer's ability to rescind a policy on the basis of fraud.
Although PIP benefits are mandated by statute, the no-fault act neither prohibits an insurer from invoking the common-law defense of fraud nor limits or narrows the remedy of rescission.
However, the presence of fraud by the insured does not automatically entitle an insured to rescission. When innocent parties are affected, rescission is left to the trial court's discretion. Rescission should not be granted in cases where the result thus obtained would be unjust or inequitable or in cases where the circumstances of the challenged transaction make rescission infeasible.
There is no dispute that Esurance is an innocent insurer, and that Moore is an innocent third party.
Caselaw clearly demonstrates that the equities must be balanced between the injured person and the party seeking rescission. The Michigan Supreme Court already rejected Esurance's arguments and held that such insurers may be reimbursed via equitable subrogation for PIP benefits paid on behalf of an uninsured person.
There was no evidence presented demonstrating that Esurance knew about this fraud before Moore was injured, and there was no showing of how Esurance could have been more diligent in reviewing the insurance application or in detecting the fraud.
A determination of whether policy enforcement only serves to relieve the fraudulent insured of what would otherwise be the fraudulent insured's personal liability to the innocent third party.
In totality, the court of appeal concluded that the trial court abused its discretion by holding that Esurance had failed to show that rescission was warranted. The ultimate issue in innocent-third-party cases is which innocent party should bear the ultimate burden of the insured's fraud. In this case, Moore has already recovered benefits from an alternate source, and rescission will have no effect on that coverage. In other words, if the policy is rescinded, neither Esurance nor Moore would, in practical terms, bear the burden of Blair's fraud. Under these circumstances, the trial court's decision to deny rescission fell outside the range of principled outcomes.
The trial court was ordered to enter an order granting summary disposition in favor of Esurance.
ZALMA OPINION
No one should profit from fraud. Not even an innocent insurer that paid benefits under a no-fault insurance scheme since it would have had to pay even if there was no insurance on the other side. Esurance was entitled to rescind because it would never have insured the Gregorys but for the fraud in the inception.

Chapter 9: The Wedding
A/N: Only one chapter left after this! And an epilogue but I haven't even started writing that. 
Pairing: Jake Seresin/Reader (nicknamed Pip)

Summary:  Javy gets married to Phoenix's sister.

You tried to keep your eyes on the bride and groom, after all they looked beautiful, but your gaze kept slipping to Jake. His eyes were always meeting yours, and you weren’t sure if what you were feeling was real or imaginary. Lately you felt like there might be something between you and Jake. The lingering looks and gentle touches were setting your imagination on fire. You wanted it to be real and something was telling you that after today you would know for sure. 
Jake was the best man and Natasha was the maid of honor for her sister so you ended up spending much of the day with the dagger squad while Jake was busy. Bradley had loudly declared your table the fun table and all through the dinner you had been glancing up at Jake sitting at the head table. 
“When they asked about the adultery I just told them I thought it was don’t ask, don’t tell.” Mickey pipes up to the groans and laughter of the others. “I just played dumb.” 
“Played?” Reuben asks, laughing when Mickey shoves him good naturedly. You sip at the glass of wine you had been poured. Between your work and the busy schedules of the aviators, this was the first chance you had to hang out with Jake's teammates. The group was among the louder of the tables, frequently clinking their glasses to urge the bride and groom to kiss. 
When the first dance was announced you all rose and made your way to watch Javy lead his bride out on the dance floor. After a few minutes of dancing alone, the rest of the wedding party joined the couple on the floor signaling other guests to join in. You watch Jake smoothly move about the floor with Natasha as jealousy gnaws at your stomach. 
“Wanna dance?” Bradley asked as you tried to slink back to the table. “I could trade you off with Jake.” 
You shake your head. “No thanks, I'm not much of a dancer.” You quickly move away from the dance floor and try to ignore the look of disappointment on Bradley’s face feeling a little guilty. He was probably really looking forward to switching with Jake. It was best for his toes if he just waited his turn, rather than drag you out on the floor. 
You spend most of your evening holding down the table. Jake is able to stop by and chat occasionally but is frequently called away to run interference between some of the bride and groom's families. The wine bottles provided for the toasts have long since been empty and you make frequent trips to the bar for a cold drink in the rapidly warming room. 
“We should dance.” Jake appears at your elbow and you start. “We never danced at our wedding.” 
“We never had a wedding, Jake.” You roll your eyes at him. “I believe the first thing we did after we married was finalize our plans for insurance fraud.”
“Yeah,” Jake murmurs in agreement and he almost sounds disappointed. “Come on!” Jake, both arms now cast free, abruptly grabs your hand and you stumble after him. Your heart starts pounding as he leads you to the dance floor. You half heartedly try to pull away without making a scene, but Jake is insistent. 
When Jake finally pulls you onto the dance floor you feel your face heat in embarrassment. You had never learned to dance. Jake takes your hand in one of his and uses the other to pull you closer. You stare at his chest, unable to meet his eyes as he tries to lead you in a two step. 
You stumble in embarrassment. Your body is unable to relax as you move stiffly in Jake's arms, unable to match his steps. “I’m sorry,” you mumble before briefly meeting his gaze. At the laughter you see in his eyes the humiliation quickly overwhelms you, and you pull out of Jake's arms before swiftly leaving the dance floor and exiting the banquet hall. 
You blink back tears as you quickly walk to the elevators. You and Jake had booked a room in the hotel for the night and you plan to hole up for the rest of the wedding. Your inability to dance has always been a secret shame of yours. There had never been anyone to teach you growing up and you had never possessed the confidence to go out and ask someone for help.
Now you wish you had, at least that way you wouldn't have made a fool of yourself in front of Jake. You curl into yourself after you hit the up button wishing Jake had never asked you to dance.
“Pip!” 
At the sound of Jake's voice you close your eyes. Relieved that the tears are no longer lingering in your eyes. You open them and turn to Jake, relieved to see his smile is kind and not mocking. 
“Where are you going?” he asks softly. His hand coming up to cup your cheek, his thumb running gently over your cheekbone. 
You lean into his touch as his other hand rests on your waist, before moving to gently squeeze your hip. You sway forward and slide your arms around his neck. 
“To our room,” your voice comes out in a whisper and you watch his eyes flick to your lips. You are sure you are not imagining the look of hunger in his eyes and your stomach clenches. A nervous energy floods your body at the heat of his gaze and you rise up and press your lips to his.
The kiss starts chaste but quickly turns heated as Jake’s hand slides into your hair. When you flick your tongue against the seam of his lips he abruptly pulls back. “Fuck, Pip, I can’t do this.”
At his words you step back and out of his arms. “Yeah,” you try to keep your breathing steady, “probably a good call.” You hear the ding of the elevator and stumble back into the open door. “I think I’m wedding-ed out,” you say, trying to adopt a carefree response. “I’ll see you in the morning.” you say as the doors close on Jake's wrecked expression. 
Once the door closes the tears fall silently down your face.

Jake can’t keep his eyes off you. All through the night he has been watching you. He nearly missed the point in the ceremony when he was to give Javy the rings because he was staring at you. 
When he leads Phoenix onto the dance floor he loses you in the crowd. He scans the faces while he easily leads her through the steps. 
“How long have you been in love with your wife?” His eyes snap to Phoenix’s face. His mouth drops open, unable to form a reply. He can't deny it, nor does he want to but if Phoenix can tell he is sure you can too. You know him better than anyone. 
Jake gives her a questioning look. “You can always tell how couples are doing by looking at them when they are at a wedding,” she explains. “I once called my one cousin's divorce six months before it happened when I saw him at another cousin's wedding.” Phoenix continues. “You’ve been looking for her all night with this dopey, lovesick look on your face.”
Jake sighs and hangs his head before giving a reluctant nod of acknowledgement. “Are you going to tell her you love her?” Phoenix asks.
“Are you going to tell Rooster you like him?” Jake counters and his suspicions are confirmed when Phoenix’s lips thin. 
“It’s complicated.” Phoenix says, unwilling to elaborate. 
“Tell me about it.” Jake agrees and they finish their dance in silence. Jake’s mind fixed on you.
Throughout the night Jake keeps trying to get to you. All he wants is to dance with you, hold you in his arms one time and dance at a wedding. Wishing he could have danced with you at your own wedding. Your dress isn’t white but he thinks if he had you in his arms he could pretend. 
It was a new mindset that had come from therapy. Rather than stress and bemoan your inevitable leaving he had decided to enjoy every moment he could with you. To lie in bed with you in the morning, to touch you every chance he had. To make you laugh and watch you smile. He was going to enjoy every minute with you before he had to let you go. 
At his third attempt to ask you to dance he was beginning to resent Javy’s great aunt and the bride's grandmother. Jake could only watch you laughing with the others as he one again went to rescue the bride and groom from their persnickety relatives. He watched you head to the bar again and come back with another drink. It had to be a gin and tonic, they were your go to. 
He is finally able to pull you to the dance floor. Grinning to himself at being able to hold you in his arms. He tries to lead you through the dance but all your drinks have caught up with you and you keep stumbling in his arms. 
His smile quickly turns to a look of confusion when you pull away with a muttered apology and flee the hall. He catches you at the elevator and can't stop himself from pulling you to him. His heart stutters when you wrap your arms around his neck. 
The warmth and feel of your soft curves overwhelms him. He stares at your lips, he could watch your lips move all night. 
He is abruptly pulled out of his thoughts of kissing your lips by the very real feeling of your lips on his. The kiss is everything. Your lips are soft, and your hair is silky in fingers when he pulls you closer. When your tongue tentatively moves against his lips it takes all his will power to pull away from you. 
He can’t kiss you like this when you are drunk. When you agree and back into the elevator his heart sinks. He wishes you had been sober. He licks his lips and can taste the lime of your drink lingering there. Jake heads back to the hall and ends up pacing the entrance area. Unable to rejoin the party, his mind filled with the feel of you in his arms and the taste of you on his lips. 
“Where’s Pip?” Javy’s voice pulls him out of his mind. 
“She went to bed,” Jake drops his hands from where they have been running through his hair. He turns to look at Javy and knows without him saying anything that Javy knows the truth.
“She’s never going to love me like I love her.” It is the first time he has said the words aloud, he hasn't even told his therapist, and immediately feels guilty telling Javy this at his wedding. Javy rolls his eyes and motions to the couches outside the hall and Jake follows, collapsing onto a sofa. 
“That’s the dumbest thing you have ever said.” Jake scoffs at his answer, but Javy ignores him and continues, “Why would she stay married to your dumb ass if she didn’t love you?”
“Duty,” Jake says in defeat. “She promised she would be there for me if I ever needed her when we got married. She thinks she has to stay because I’m a mess.” 
“Duty or not, Pip would have divorced your mopey ass years ago if she didn’t love you. She can support you just as well as a friend as she can a wife.” Jake feels a traitorous spark of hope in his chest, and quickly squashes it. 
“I don’t deserve her.” His mother would have said Javy’s eyes would get stuck if he kept rolling them like that. 
“I’m really glad that stupid idea you had a minute ago has found a friend in that dumb statement.” Javy’s sarcastic response has Jake letting out a bitter laugh. “I wouldn't want your dumbassery to get lonely.”
When Jake doesn’t stop him, Javy continues. “She gets to decide what she deserves and even if you think you don’t deserve her, you have let her make up her own mind.” Javy holds up his ring finger. “Speaking as an honest married man, you have to either let her go or tell her the truth and let her decide.” Javy claps Jake on the shoulder as he rises and heads back to the party. 
Jake stays on the couch mulling over what Javy told him. Could you love him in the way he loved you? He didn’t want to hope. It would hurt less to just let you go than nurture something that wasn’t there. He replays every interaction he has ever had with you. 
You are always the same. The same kind, compassionate Pip. He thinks about the way you always melt into his arms, at your soft little smiles, and how you go out of your way to do things for him without him even asking. 
His thoughts are interrupted by Fanboy falling drunkenly onto the couch across from him. “Hangmaaan!” He slurs with an absent minded grin.
“Jesus,” Jake chuckles, “you're drunker than Pip.”
Fanboy blinks at him in confusion, eyes slipping in and out of focus. “Pip wasn't drinking, she’s as sober as a… sober person.” 
Jake’s breath catches and his brain stops at the information. “She kept going to the bar.”
“Yeah, and she would bitch every time she did because the bartender kept giving her little tiny glasses of 7Up.” He holds his hand up with his fingers about an inch apart to emphasize the size of the drink you were drinking. 
Jake stands and runs to the elevator, jamming the up buttons and ignoring Fanboys questioning shouts behind him. If you weren’t drinking that means you were sober when you kissed him and that means what Javy said might be true. 
He sprints down the hall to the room, fumbling with the key card before finally getting it open. He calls your name and rushes into the room. He finds you passed out on the bed. The bedside table is covered in a collection of mini alcohol bottles from the minibar. Your beautiful dress is in a pile on the floor and you are wearing one of his t-shirts that had migrated into your pajama drawer. 
Jake kneels on the floor beside you pushing your hair out of your face. There are mascara tear marks around your eyes and his heart breaks. He wets the makeup cloth you brought and gently cleans your face, wiping away the tears that have dried on your cheeks. He can't think of a time he has ever seen you cry. He did this to you. 
Jake hangs up your dress, knowing how much you liked it and not wanting it to get ruined, before stripping to his boxers and crawling into bed behind you. He wraps his arms around your sleeping form before whispering into your hair. “I’m in love with you, Pip, and I'm going to tell you everything.”

Hey, I know a load of us are broke so you can't donate, but even sharing this would mean a lot to me.
Our puppy Yenn (yes, she's named after The Witcher, they're my fiancée's favourite games) needs multiple surgeries to improve her quality of life (and hopefully her lifespan) and the insurance is refusing to pay out.
We've nearly lost her to pneumonia three times this year, and the most urgent surgery (BOA, to fix her throat,) should dramatically decrease the chances of that happening again. The total for future surgeries is going to be between £5400 and £7000, but if we can get her throat sorted, which will be £2650-£4150, the chances of her making it through so that we can save for the others are much greater. (We're trying to get her booked in for the initial investigation, which is part of the price listed above, so that we can get a more accurate estimate for how much it will cost.) (EDIT: the investigation is on Monday. Fingers crossed it goes well.)
Yenn is just over a year old and an absolute sweetheart. It's been difficult to find ways to train her due to her health issues, but honestly she's trained herself. You can set food down and leave the room and she won't touch it, and she would do anything for my fiancée. I've never seen a dog as devoted to her mum.
Her favourite activities are people watching out of the window, playing with her mum or other dogs, and cuddling with our cat Pip. She's a wonderful girl and she deserves to grow up.

No one will question is, having seen you both sitting together talking. Just assume its some father daughter road trip.
When you wake up you'll be in a cabin in the woods. It will be a Long time before you are good enough to be allowed outside. You'll follow your Daddy on a trip to the market, he's promised to let you pick out some flowers for your room. When you finally meet the first person a tear will roll down you check when they speak. You won't realise why but some part deep deep down inside you will realise that you never stood a chance. That all the time you had thought you were in the local woods and could run and quickly find a road, you had been so wrong. Bucky smiles and replied back in perfect Russian.

So far consensus on my Conditioning post is that Pip needs a neurology workup to rule out various spinal conditions and that there seems to be something undiagnosed happening.
It makes sense and I've got the ball rolling already, I have my eye on ANOTHER specialist center and this should be covered by insurance as well. Just getting a referral squared away before I pull the trigger and schedule.
I'm so tired yall I just want to be able to have fun with my dog.

The Ongoing Situation, updated and revised with new developments:
my kid is type 1 diabetic. she uses a constant glucose monitor. this involves a small sensor attached to her arm that lasts for about two weeks that we scan with a reader. she has insurance coverage, but the cost of the sensors have been creeping up each time we refill, around $40 for two (so far), and that’s a monthly purchase if they don’t break or fall off or what have you - then it’s twice in one month. the reader has decided that test strips are for other people, so we had to purchase a separate finger-stick tester for when we need to double-check her sensor readings.
the other reality is the cost of insulin. she takes two kinds, a rapid-acting for meals and to correct highs, and a slow-release at night. each of these comes in a pack of 5, and with insurance each of those packs costs ~$75. the rapid-acting disappears faster bc we have to send one to school with her - she’s not allowed to carry it back and forth. so that’s two pens in active use at the same time.
her dad, my partner, is also t1d, and requires all the same supplies she does (sans the sensors/monitor). so they draw from the same pool of alcohol swabs, pen needles, etc, but he has his own test strips he has to purchase, ~$25/50, and we've been having to buy them more often thanks to the aforementioned fuckery with kiddo's reader. he also has to buy his own insulin, which is ~$50/5 pens (since he can thankfully use the knockoff walmart kind), x2 because he also needs a long-lasting dose for overnight. kiddo also has her own stash of supplies at school - a pack of test strips, syringe heads, alcohol swabs, etc - and her dad has one at work. this necessary doubling-up of supplies adds up. school is starting back, so we have to replenish her school kit as well.
so just sitting here and doing the math, sensors + test strips + insulin for them both = $315. and that’s before swabs and glucose tabs and what have you. insulin-dependent diabetic care in the united states is a fucking racket.
this wall of text is to say: helping us buy medical supplies for them both would be a huge weight off our shoulders. ways to do this include:
amazon list, to buy supplies directly. (needles are no longer on here, because for whatever reason amazon has stopped shipping them to our address. I don't know if this is true for everyone or just us, but we're now reliant on the walmart pharmacy and the pip website for needles.)

I will leave discussions about the Ku Klux Klan to those with more knowledge on the subject.
A mendicant is someone who generally takes a vow of poverty and relies on charity to survive - such as a wandering preacher. Pip if this question is invasive Please Ignore It. But I feel like I remember you saying you've had top surgery and well, did you have to go on hormones to do so? Because I would love to have top surgery but I don't want hormones or to really do anything else with my transition and I live in the US and that seems like such an impossibility, as somebody who is not binary trans. Both in finding a surgeon who would do it, costwise, and the social aftermath if that makes sense 😭
I found my surgeon on a list of surgeons willing to do top surgery for nonbinary ppl without hormones etc... it was so long ago I don't have the list any more tho 8( anyone else have a link to an updated version of that or something?
It did require a letter from a counselor but just being like "yeah this person is Gender and this surgery would be good for them"
Cost stuff... varies sooo much unfortunately has a ton to do with your specific insurance 8( lots of times they will make you pay upfront and then apply to be reimbursed. Which... is less than ideal. God I hate health insurance

Accused of Fraud Failed to Promptly File Dispositive Motion

Plaintiffs Hartford Accident and Indemnity Company, Property & Casualty Ins. Company of Hartford, Trumbull Insurance Company, and Twin City Fire Insurance Company (together, “Hartford”) claim that Defendant Greater Lakes Ambulatory Surgical Center LLC submitted fraudulent claims for no-fault benefits for treatment of individuals who were in auto accidents. Hartford asserts claims of fraud, silent fraud, and unjust enrichment.
In Hartford Accident And Indemnity Company, et al. v. Greater Lakes Ambulatory Surgical Center LLC, No. 18-cv-13579, United States District Court, E.D. Michigan, Southern Division (May 26, 2022) Greater Lakes moved for leave to file a motion for judgment on the pleadings under Federal Rule of Civil Procedure 12(c), arguing that Hartford’s tort claims must be dismissed because the parties’ relationship is governed by contract.
Analysis
The scheduling order, entered in July 2019, set a dispositive motion deadline of March 20, 2020. Hartford moved for summary judgment the day before that deadline, and a hearing on that motion was scheduled for September 24, 2020. But a week before the hearing-six months after the dispositive motion deadline-Greater Lakes moved for leave to file a motion for judgment on the pleadings.
The Court has the ability to modify the schedule to allow Greater Lakes to file a dispositive motion, but only for good cause. Fed.R.Civ.P. 16(b)(4). Although district courts enjoy wide discretion under Rule 16(b)(4), leave to amend a schedule should be denied when evidence of diligence is lacking. [In re Nat’l Prescription Opiate Litig., 956 F.3d 838, 843 (6th Cir. 2020).]
Greater Lakes showed neither that it could not have filed its dispositive motion despite its diligence nor that the delay was because of excusable neglect. Instead, it alleges that it retained new counsel in September 2020 who concluded that Hartford failed to state a claim. Attorney Shereef Akeel did first appear here in September 2020. But attorney Lukasz Wietrzynski represented Greater Lakes from the beginning of this litigation until October 2021.
Wietrzynski either made an intentional decision not file a dispositive motion by the deadline or he made an error in failing to do so. Either way, Wietrzynski’s failure to timely file a dispositive motion does not provide Greater Lakes with good cause or excusable neglect.
The Court rejected Greater Lakes manifest injustice argument because its proposed motion for judgment on the pleadings lacks merit. In deciding whether a plaintiff has set forth a “plausible” claim, the Court must construe the complaint in the light most favorable to the plaintiff and accept as true all well-pleaded factual allegations.
Greater Lakes contends that Hartford’s tort claims must be dismissed because the parties’ relationship is governed by the no-fault policies. Greater Lakes maintains that those policies required it to provide proof of loss before Hartford became obligated to pay the insurance claims. Thus, Greater Lakes argues that the allegation that it submitted fraudulent proof of loss relates to its performance under the policies and “sound[s] in contract” rather than tort law.
Under Michigan law, nonperformance of a contractual obligation gives rise to a breach of contract claim but generally not to tort liability. An exception to this “contract-only” rule is that tort liability may exist if the complaint alleges breach of a legal duty separate and distinct from a defendant’s contractual obligations. For example, claims of fraud in the inducement and “fraud ‘extraneous to the contract’ are permissible, whereas ‘fraud interwoven with the breach of contract’ cannot support an independent claim.”
Here, the complaint does not allege the existence of a contract between Hartford and Greater Lakes. Although Greater Lakes argues that the no-fault policies govern this dispute, it was not a party to those policies.
The contract-only rule does not bar tort claims when no contract exists. Greater Lakes insists, without supporting precedent, that the no-fault policies govern because healthcare providers can “step into the shoes” of insureds to obtain payment under the policies-meaning there is a contractual relationship between providers and insurers.
Even if there were a contract between Hartford and Greater Lakes, the Michigan Supreme Court has held that insureds may bring separate claims for fraud and recovery of no-fault benefits.
Unlike a no-fault claim, a fraud claim does not arise from an insurer’s mere omission to perform a contractual or statutory obligation, such as its failure to pay all the PIP benefits to which its insureds are entitled. Rather, it arises from the insurer’s breach of its separate and independent duty not to deceive the insureds, which duty is imposed by law as a function of the relationship of the parties.
The court also rejected the theory that the no-fault act preempted the fraud claim. The court acknowledged the contract-only rule, noting that “where, as here, the breach of separate and independent duties [is] alleged, [the insureds] should be allowed an opportunity to prove” their tort claims. Since “misrepresenting material facts and deceiving their insureds” involved the breach of an independent duty, the fraud claim survived.
Greater Lakes argued that whether the no-fault act preempted the tort claims but not whether the plaintiffs could assert concurrent breach-of-contract and fraud claims. Greater Lakes is wrong on both counts. Since actions for payment of no-fault benefits are often asserted as breach-of-contract claims,
Conclusion
Greater Lakes showed neither good cause nor excusable neglect for its motion for leave to file a dispositive motion six months after the deadline, and its claim of manifest injustice lacked merit. The Court denied Greater Lakes’ motion for leave to file a motion for judgment on the pleadings.
ZALMA OPINION
Hartford, probably frustrated by the failure of the state to prosecute fraud perpetrators, acted proactively sued the providers of health care for insureds that it claimed were fraudulent. Greater Lakes, faced with a motion for summary judgment it thought it would lose, filed a belated motion for a Judgment on the Pleadings and lost its request to file a late dispositive motion that the USDC’s Magistrate Judge found was impotent. It is an act of “chutzpah” or unmitigated gall to bring this motion but it did succeed in slowing the opportunity of Hartford to obtain a summary judgment.

You roll your shoulders and send off the final few texts and emails of the day, checking the time you sign off at 5:00PM. Being a virtual assistant had its perks. You got to wear yoga pants all day and there was no commute, but the biggest perk was the fact you were able to work two jobs. 
One was a fairly involved executive assistant position at a growing company that took up most of your time. The other was as a glorified Google Calendar, keeping your extremely ADHD boss from missing deadlines, meetings, and anything else important. 
The downside was a large L-shaped desk with three monitors set up in your bedroom. You had a business degree but when the opportunity evolved out of your part time administrative assistant job, you had taken it. When you had found yourself with a couple hours of down time during your work day you had subtly asked around and had gotten a second job managing your other bosses emails and calendar.
You walked into the kitchen you would be sharing with Sami until the end of the month. After over five years of it being the two of you she had finally decided to move in with her boyfriend of two years. You were happy for her but unsure of your own future. Should you renew your lease? Find a smaller, cheaper, single bedroom place? Get a roommate? You didn’t know what you wanted to do and time was running out.
That was a lie, you know what you wanted to do but it was impossible. You wanted to move in with your husband, drop everything and move across the country to be with him. But it’s not that kind of marriage, you tell yourself for what feels like the millionth time. It has never been.
Jake had been your teenage crush. Your best friend's handsome big brother, nothing would ever come of it. But when you needed him, he had married you, he had even called you almost daily to keep up the pretense that your marriage was real. 
With every phone call you had fallen further and further in love with your husband. He was sweet, funny, caring, and supportive. You’ve never told anyone of your feelings but sometimes you think Sami suspects it. 
You knew Jake went on dates and hooked up with women. You have tried going on dates, and one night stands, but could never get over the guilt. The feeling that you were cheating on Jake. 
You again consider divorcing him. It would be easier. You could date and start a real relationship. You knew how this train of thought would end. You would have yourself convinced you were going to call it quits and then Jake would call and say ‘hello’ in a tone of voice that told you he was smiling and you would be sucked right back in.
He would sign the divorce papers the minute you asked but you kept torturing your heart. You knew you couldn’t keep waiting forever, knew that eventually you would have to move on but you couldn’t. Not yet, anyway.

You hear keys in the lock and the door open and glance at the time, it’s 12:30 AM, “You're past curfew.” You can hear Sami chuckle as she walks in and drops two envelopes on your head. 
“I get your mail for you and all I get is sass.” She flops down on the couch beside you. “Are you watching Downton Abbey again?” she groans as you just shrug. 
“I want your final month here to be exactly the same as the past five years of us living together.” You grin at her rolling eyes. “You going out and having fun, and me staying in, watching a period drama.” 
“Goodnight, Dork.” You can hear the fondness in her voice as she gets up and heads to bed. You look at the envelopes, one is a reminder to renew your car insurance, the other has the NCIS emblem. Frowning you open it and your jaw drops as you read the letter inside. It has come to our attention… marriage under contract… opening an investigation…. 
“Shit.”
You scramble and grab your phone, quickly calling Jake, when he doesn't answer you try him again. You are taken aback by a woman's voice answering and feel a twinge of jealousy and guilt. You had always told yourself that you would never negatively impact Jake's life while married to him and you hope you didn’t ruin something by calling him like this.
After rambling at the woman on the phone you hang up and stare at your reflection on the black screen. You are so lost in thought that you jump when Jake's face pops up with an incoming call.
“Pip? What's wrong? Are you hurt?” His sounds worried and, despite this, you immediately relax at the sound of his voice. 
“I’m ok, I’m sorry!” You are talking in a rush. “I didn't mean to ruin your date.” 
“I’m not on a date.” You sag in relief at his response. Happy you didn’t ruin his date or happy he is not on a date, you’re not sure.
“I got a letter,” You stare at the paper in your hand. “Jake, someone reported our marriage.”
“Shit.”
“That's what I said.” You reread bits of the letter to him, giving Jake a moment to process. “It says they are going to be interviewing people who know us,” you pause, ”Jake, I haven't told anyone about us.” Running your hand through your hair, you bite your lip in nerves. “I don’t have a lot of friends or share personal details.”
“I’ll tell the squad.” You can hear it in his voice when he shifts into protector mode. “Rooster owes me his life so he’ll lie for us.” His voice is tense when he says that, bitter in the way he always gets when he talks about the things he never speaks of. “And don't forget the fake marriage plans. No one can say we don’t have a relationship.”
“Yeah,” you agree. “I’ll scan the letter and email it to you.” 
“Thanks, I’m going to head home. I’ll call you when I get there.” You agree and go to hang up but Jake stops you. “It’s going to be alright, you planned for this.” You agree softly. “I love you, Pip. We got this.”
“I love you too,” your reply is quiet and automatic as you hang up the phone, rising to go scan the letter. Jake always said he loved you. It had started as a cover when the two of you were together at a military event, that as his wife, you couldn’t avoid. He had urged you to do the same jokingly.
“I love you, Pip.” His cheeky grin melted and hardened your heart.  “Now tell me you love me too, and make sure I believe it.” 
 After years of saying it you were sure he meant it, in his own way, Just not in the same way you meant it every time the words crossed your lips.

Jake rubs his head as he stares at his teammates, he had been up late last night talking to Pip. He had asked them to meet him in the parking lot after training where they could not be overheard. “I need to tell you guys something that if anyone asks you’ve always known.”  
The faces around him show a variety of emotions. Coyote is resigned, but then again, he already knows. Rooster and Fanboy look giddy with excitement, like little kids about to be told a secret. Phoenix’s eyes are narrowed in suspicion. Only Payback and Bob have mastered a look of polite interest. 
“Pip, the woman on the phone, she’s my wife.” 
Jake registers the feeling of his head jerking to the side a millisecond before the pain of the slap hits him and causes his left cheek to bloom red. “Jesus Christ Phoenix!” Jake raises his hand to his cheek, shock on his face. “What the fuck was that?”
Phoenix is subtly flexing her hand to shake out the pain from the slap. “You go home with a different woman every night you can!” Rage is clouding her eyes. “You’re telling me you have been cheating on some poor woman all this time?” Rooster moves forward and places himself between Jake and Phoenix.
“Ow! No!” Jake’s cheek feels hot. “It’s a fucking marriage of convenience!” He runs his tongue on the inside of his cheek, searching for the telltale metallic taste of blood, but it's not there. “She was sick and needed health care so I married her when I was still in flight school.”
“Is she better?” Trust Bob to do the decent thing and be concerned with the health of a stranger.
“You know, Phoenix, you should listen to your Wizzo more.” Jake says, gingerly feeling the warmth of his cheek. “Ask questions first, instead of slapping.”
“You’ve had it coming on some level,” Phoenix says without remorse before repeating Bob's question. “Is she better Hangman?”
“She's fine, it's been over five years.” 
“Why’d you stay married?” Payback asks. He’s the only other married member of the squad.
Jake shrugs, “the money, and the spousal benefits helped her.” He knows that's not the truth. At least not the whole truth but he doesn’t want to get into the hollow little feeling in his chest every time he thinks about ending the charade. 
“How’d you meet?” Roster asks. 
“She’s my baby sister's best friend.” Jake waits for Rooster to do the math. Rooster and Sami had crossed paths before and Jake had warned Rooster to stay away from his younger sister.
“Jesus, Hangman, was she a child bride?” 
“No!” Jake rubs his face in defeat. “She was eighteen, and it's not that type of marriage, it's just a piece of paper.”
“So why are you telling us this now?” Phoenix crosses her arms and looks at Jake expectantly. 
“Pip got a letter.” Jake sighs. “Someone reported our marriage as fake and now we are being investigated.”
“Shit,” Fanboy muses, “do they have a case?” Jake looks at him in exasperation. Fanboy was brilliant at his job, but some days Jake suspected all other available mental real estate was taken up with nerd trivia leaving no space for common sense.
“Yes Fanboy, they do have a case.” Jake rolls his eyes before continuing. “We talk on the phone and have a joint bank account but we’ve never lived together, most of it can be explained away through health, deployments, and her university.”
“So what do you need us to do?” Payback asks.
“Just pretend you have always known I was married.” Jake looks around at everyone nodding. “Pip hasn’t told anyone so you will have to prove that it wasn’t a secret. Coyote was a witness so he has legal proof of knowing.”
“Don’t worry man.” Rooster claps him on the shoulder. “We've got your back.”
“Thank you.” Jake says sincerely. “I’m diving to Austin at the end of the month. Pip’s lease with my sister is up and she’s going to move in with me to make it look real.”
Coyote nods. “That makes sense, this is the first long term posting you’ve had since she finished University.”
“Sooo, yeah,” Jake spreads his arms out helplessly. “In conclusion, I’ve been married to Pip for six years and you have always known. Any questions?”
“Why do you call her Pip?” Fanboy asks, “What's her real name?”
Jake tells them your name. “She always looked so short next to my sister so I called her Pipsqueak. Pip for short.”
After a few more questions everyone walks to their cars and leaves. Phoenix hangs back until it is just her and Jake. “You did the right thing marrying her.” She motions to the red that has not faded from his cheek. “I feel a little bad that I hit you so hard.”
“You could have not hit me at all.”
“Don’t push your luck Hangman.” She walks to her car before turning around. “Rooster’s right though, we’ve got your back.”
