Schuyler County to receive $116K Opioid Settlement
A major drug distributor and its subsidiaries will pay Schuyler County up to $116,000 to settle claims it contributed to the ongoing opioid crisis in that county, under a resolution approved by the Schuyler County Legislature at a special meeting.  Meeting on Monday (January 23), the legislature voted unanimously to accept the settlement and authorized Schuyler County Attorney Steven Getman to execute the necessary legal documents.    According to the resolution, distributor Teva Pharmaceutical Industries Ltd. and its subsidiaries (Teva Pharmaceuticals USA, Inc., the Actavis Generic Entities, and Anda, Inc.),  agreed to the settlement with the county in exchange for being released from a pending lawsuit filed by the county, as well as later claims brought by the New York State Attorney General’s office.   The agreement calls for Teva to pay the county over seventeen annual installments, with payments expected to begin later this year, Getman said.    According to Getman, the settlement funds can be used for a variety of purposes.  “Potential uses include supporting  police and  first  responders, treating opioid  addiction,  funding social services and similar anti-drug efforts,” Getman explained.  The agreement also commits Teva to critical injunctive relief, Getman noted, including: 
• A ban on high-dose opioids and prescription savings programs; 
• Prohibitions on marketing opioids and funding third parties that promote opioids; 
• Restrictions on political lobbying; and 
• Disclosure of Teva opioid product clinical data.  The motion authorizing Getman to accept the settlement was made by County Legislator Phil Barnes (R, Watkins Glen) and seconded by Legislator Michael Lausell (D, Hector).  The Teva agreement is the latest opioid settlement Schuyler County has been a part of in the past five years.  In 2021, the county legislature authorized Getman to accept up to $121,000 from Johnson & Johnson and up to $546,000  from distributors McKesson Corporation, Cardinal Health Inc. and Amerisource Bergen Drug Corporation to treat, reduce and prevent opioid use through a court settlement with the opioid maker.  A similar agreement, for $41,000, was obtained from defendant Actavis, Inc. in early 2022.  Like the Teva agreement, payments to the county are scheduled to be made over time.  The settlements stem from a 2018 lawsuit the county filed against approximately thirty defendants, including some of the biggest names in the pharmaceutical industry. The lawsuit alleged the defendants had long known that opioids were addictive and subject to abuse, particularly when used long-term for chronic non-cancer pain, and should not be used except as a last-resort. However, the lawsuit stated, the defendants spent hundreds of millions of dollars disseminating scientific materials and advertising that misrepresented the risks of opioids’ long-term use.  Schuyler County was one of many local governments that filed lawsuits against the manufacturers and distributors of opioid pain killers. At least 14 counties across New York sued the pharmaceutical companies for fraudulent marketing practices.  After the counties sued, in March 2019, the New York State Attorney General’s office brought its own lawsuit on behalf of the state.  In November, 2022, Attorney General Letitia James announced a tentative deal with Teva that will deliver up to $523 million to New York state to combat the opioid epidemic.    In October 2017, the U.S. Department of Health and Human Services declared a public health emergency due to the consequences of the opioid crisis facing the nation. That year, more than 70,000 individuals nationally and nearly 4,000 New Yorkers lost their lives to a drug overdose.  Schuyler County’s lawsuit against a number of other defendants remains pending, Getman said, with the possibility of more settlements and additional funding to the county still to come.     Said Getman: “One cannot put a price on lives lost and families torn apart, but with the more than $824,000 expected to be delivered to Schuyler County from these lawsuits, we can provide the County with financial assistance to continue this battle and hold these companies responsible for their role in the opioid epidemic.”  County Administrator Fonda Chronis agreed: "County officials have expended significant resources to help its residents battle opioid addiction and prevent further deaths. By voting to go forward with this settlement, the County Legislature hopes to lessen the burden to taxpayers for expenses related to the opioid crisis."  Schuyler County’s latest salvo in the fight against opioid companies comes shortly after the New York State Department of Health released its Quarterly Opioid Report for January 2023, showing a 14% increase in 2021 overdose deaths involving opioids compared to 2020. That report, comparing state totals for 2021 to 2020 data, noted a 14% increase in overdose deaths involving opioids, with 4,766 deaths statewide in 2021.   The report notes that fentanyl has contributed to an increase in opioid overdose deaths in recent years, is 50 to 100 times stronger than heroin, and is now involved in the majority of overdose deaths in New York State.  In November, Teva issued a statement describing the settlement  as "enabling us to put these cases behind us and continue to focus on the patients we serve every day.”  A complete copy of Schuyler County’s lawsuit can be found here A copy of the county’s resolution approving the settlement can be found here.

"I Am Queen Of The Most Powerful Nation And My Entire Family Is Gone!"  -- Queen Ramonda (Angela Bassett)
The Marvel Cinematic Universe has had an inconsistent run throughout Phase Four as part of its Multiverse Saga. Following up on what will likely be a one-time event that the world bought into with Avengers: Infinity War and Avengers: Endgame is a hard act to follow. 
Phase Four has been plagued by an overabundance of content. With several shows on Disney Plus and a film release schedule of three to four movies per year, the fan base feels overwhelmed. Some of the films have been met with critical and fan criticism, such as The Eternals and Thor: Love and Thunder. The primary exception is 2021s Spider-Man: No Way Home. Much like the previous Avengers films, No Way Home relied on the theatre experience. 
The last film in Phase Four and the 30th film in the MCU, Black Panther: Wakanda Forever, has its faults but, for the most part, succeeds in providing fans of the Marvel universe with a satisfying sequel. 
2018s Black Panther is one of Marvel's most significant success stories. The film was nominated for an Academy Award in the Best Picture category and is the sixth-highest-grossing domestic film of all time. The cultural impact of the film having an African- American director in Ryan Coogler and a predominantly African American cast heavily weighed on the cultural zeitgeist at the time. 
However, due to the film mainly being overly praised, four years later, the film finds itself being somewhat underrated. The accolades Black Panther received as one of the best comic book or superhero films of all time were based more on the excitement surrounding the movie at the time of its release rather than its quality. Any comparisons to Sam Raimi's Spider-Man films or Christopher Nolan's The Dark Knight were hyperbole at best. Black Panther was good but didn't come close to being great. 
The labeling of Black Panther as a great film put immense expectations on Wakanda Forever. The tragic passing of its lead star Chadwick Boseman in 2020 was another large hurdle those behind the camera had to overcome. It will be debated for years how Marvel Studios should have handled the future of the Black Panther character after Boseman's death. Whether you believe they should have recast the T'Challa character or moved forward by having another character take on the Black Panther mantle, Wakanda Forever handles its choice surprisingly well. 
The film immediately begins with the death of T'Challa. It uses elements of the real-life situation of Boseman with his death coming at the hands of an unknown illness. Much of the film feels like a form of mourning and grief not just for the character of T'Challa, but for Boseman as well. 
With T'Challa gone, the side characters of the first Black Panther are put in the forefront. Shuri (Letitia Wright), Nakia (Lupita Nyong'o), Okoye (Danai Gurira), and Queen Ramonda (Angela Bassett) carry the weight of the film. Angela Bassett's performance, in particular, is a standout. She has numerous memorable lines that are delivered with gravitas. 
The film picks up at T'Challa's death with Wakanda in a vulnerable state as the country is now open to the world. Wakanda is no longer secretly the most technologically advanced in the world due to its abundance of Vibranium. 
One of the main plots of the movie is based on other countries attempting to discover Vibranium. The conflict's catalyst is a newly invented machine that can track the element worldwide. The film's antagonists are introduced during this plot with Namor (Tenoch Huerta), the leader and king of the below-water civilization of Talokan. As is the case with numerous comic book adaptations, Namor is altered from his origins into the Mayan Mesoamerican culture. At times, Namor isn't a black-and-white character; he can be kind and empathetic. Other times he can be cruel and ruthless, as his priority is protecting his people. 
Some of the best antagonists are those that believe that what they are doing is right. The audience can understand their perspective and sometimes even agree with them. 
Wakanda Forever's most significant detraction falls in its length closing in at almost three hours. There is more positive than negative throughout the runtime. But the Marvel formula of having everything connected or setting up the next show or movie is to the film's detriment. 
During the film's second act, the film brings back CIA agent Everett Ross (Martin Freeman), who was in the first Black Panther, and Valentina Fontaine (Julia Louis-Dreyfus). Their inclusion feels forced and only for the sake of setting up more Disney Plus shows. The film introduces a new character Riri Williams (Dominique Thorne), serving as the story's McGuffin, with her being at the center of the dissension between Namor and Wakanda. To the film's credit, the usage of comedy throughout isn't overused and doesn't undercut the emotional moments. However, with the knowledge that there will be a Disney Plus series featuring Riri Williams as Ironheart, much like Ross and Fontaine, her inclusion feels studio mandated rather than the choice of Coogler and his team. 
One notable criticism toward 2018s Black Panther was the poor CGI. Wakanda Forever improves upon its usage of CGI and has significantly better action sequences, including one-on-one confrontations and large action set pieces. 
While T'Challa's death is continually felt in the movie, during an attack on Wakanda by Namor, Queen Ramonda (Angela Bassett) is killed by the underwater king. This death is arguably the most significant of a non-main character in the MCU since Yondu's death in 2017s Guardians of the Galaxy Volume 2. Namor and his country's underwater capabilities to travel in and out of almost any destination make them dangerous. 
Although the action choreography and CGI are improved, the film's third act, much like its predecessor, is the weakest part of the movie. As the new Black Panther, Shuri has a somewhat illogical plan of battling Namor and his people on the water. During the final battle between Shuri and Namor, they fight on a beach. For the underwater God who has the ability to fly, not to take the fight back to the water where he has the advantage is a bit convenient. Regardless, the action isn't the main focal point of the story. It isn't treated with the same manner of importance as the development of the characters. 
Along with Guardians of the Galaxy Volume 2 and Doctor Strange in the Multiverse of Madness, Wakanda Forever is one of the best-looking movies in the MCU. Cinematographer Autumn Darald Arkapaw uses a wide array of colors rather than the typical gray color palette in most Marvel films. The score is once again handled by Swedish composer Ludwig Goransson and separates itself from other movies in the universe. 
Wakanda Forever would have significantly benefited from a shorter runtime and more focus on allowing Coogler to tell his own singular story. In many ways, it improves upon the original, but it's merely just pretty good rather than spectacular.

Venus vs Mars (web series and tv show) was a lighthearted British romantic comedy following Venus, a 20 something Accountant, played by Letitia Hector. Chief executive Victor Adebodun and writer Baby Isako said that the show was a response not just to the lack of diversity on British television, but also to the negative roles that existed for many BAME actors.
“Baby’s script is a light-hearted romantic comedy in essence. It’s got a predominantly ethnic cast, but there’s no stereotypes in the show,” said Adebodun, while Isako said that with no formal scriptwriting background, she saw her chances of telling her story on TV as much slimmer than making a project for YouTube.

This new adaptation of Hans Christian Andersen’s magical adventure follows inseparable friends Kai and Gerda. When Gerda awakes on her sister Karen’s 13th birthday, she discovers that Karen has become mean and cold-spirited – a spell that The Snow Queen puts on all children when they reach the age of thirteen to ensure that everyone is as hateful as she is. After the heartless Snow Queen steals Kai to help rebuild her broken treasure, can Gerda rescue him in time before she plunges the world into an eternal winter? With the help of an unlikely band of companions, Gerda travels to the Kingdom of Ice to confront the Snow Queen and rescue her friend.
From the creative team behind last year’s Pinocchio and in partnership with the highly acclaimed Birmingham Ormiston Academy, The Snow Queen is an in-house production complete a modern story, some great computer effects, an original score and some catchy songs by Steve Allan Jones. Several of the cast play multiple roles and their own instruments and a large part of the cast, particularly in the ensemble, are made up of local talent.
The show comprises of a small but incredible principal cast. Letitia Hector absolutely owns the stage in the title role of The Snow Queen, lit up in hundreds of LED’s, riding a chopper motorbike and bewitching the audience with her fabulous vocal ability and presence. There is a fantastic chemistry between Gerda (Christina Harris) and Kai (Tom Sturgess), Harris is as charming as she is confident. Charlie Keable is hilarious with fantastic comic timing and multi-talented in the role of Hader – the Snow Queen’s chief supporter – and subsequent roles of Olaf the Woodcutter and Robber Queen, even playing the violin. Alexandra Dasewski has a wonderful voice in the role of Karen, Gerda’s sister.
In a nod to Hans Christian Andersen, Set and Costume Designer Amy Carroll’s costumes are a clever combination of traditional Danish dress and modern attire, and props and sets are simple but, combined with the lighting (designed by Will Monks), and use of mirrors from the ensemble cast, they are effectively used. The show also cleverly includes British Sign Language as part of its choreography.
With audience interaction, lots of laughs and the underlying message of what makes us different can only make us stronger, The Snow Queen is a show full of Christmas magic, plenty of fun and more than a pinch of seasonal joy from some of the best in the West Midlands!

Google Is Fined $170 Million for Violating Children’s Privacy on YouTube
YouTube, which is owned by Google, illegally gathered children’s data — including identification codes used to track web browsing over time — without their parents’ consent and sold the information to advertisers in violation of the federal Children’s Online Privacy Protection Act. If you were the government enforcer would you: (1) only fine YouTube or (2) also hold company company executives personally accountable for illegal mining of children’s data and, if so, how? Why? What are the ethics underlying your decision?
Google agreed on Wednesday to pay a record $170 million fine and make changes to protect children’s privacy on YouTube, as regulators said the video site had knowingly and illegally harvested personal information from children and used it to profit by targeting them with ads.
Critics denounced the agreement, dismissing the fine as paltry and the required changes as inadequate for protecting children’s privacy.
The penalty and changes were part of a settlement with the Federal Trade Commission and New York’s attorney general, which had accused YouTube of violating the federal Children’s Online Privacy Protection Act, or COPPA.
Regulators said that YouTube, which is owned by Google, had illegally gathered children’s data — including identification codes used to track web browsing over time — without their parents’ consent.
The site also marketed itself to advertisers as a top destination for young children, even as it told some advertising firms that they did not have to comply with the children’s privacy law because YouTube did not have viewers under 13. YouTube then made millions of dollars by using the information harvested from children to target them with ads, regulators said.
To settle the charges, YouTube agreed to the $170 million penalty, with $136 million going to the trade commission and $34 million to New York State. It is the largest civil penalty ever obtained by the commission in a children’s privacy case, dwarfing the previous record fine of $5.7 million against the owner of the social video-sharing app TikTok this year.
Under the settlement, which the F.T.C. approved in a 3-to-2 vote, YouTube also agreed to create a system that asks video channel owners to identify the children’s content they post so that targeted ads are not placed in such videos. YouTube must also obtain consent from parents before collecting or sharing personal details like a child’s name or photos, regulators said.
The move is the latest enforcement action taken by regulators in the United States against technology companies for violating users’ privacy, indicating the Trump administration’s willingness to aggressively pursue the powerful corporations. It follows a $5 billion privacy settlement between the trade commission and Facebook in July over how the company collected and handled user data.
But critics of the settlement, including Senator Edward J. Markey, Democrat of Massachusetts, described the $170 million penalty as a slap on the wrist for one of the world’s richest companies.
“The F.T.C. let Google off the hook with a drop-in-the-bucket fine and a set of new requirements that fall well short of what is needed to turn YouTube into a safe and healthy place for kids,” Mr. Markey said in a statement.
Children’s advocates who lodged their own privacy complaint against YouTube with the F.T.C. last year said that Google had simply agreed to abide by a children’s privacy law it was already obligated to comply with. COPPA prohibits operators of online services from collecting personal data, like home addresses, from children under 13 without a parent’s verifiable permission.
“Merely requiring Google to follow the law, that’s a meaningless sanction,” said Jeffrey Chester, the executive director of the Center for Digital Democracy, a nonprofit group whose efforts in the 1990s helped lead to the passage of the children’s privacy law. “It’s the equivalent of a cop pulling somebody over for speeding at 110 miles an hour, and they get off with a warning.”
The agreement split the trade commission along partisan lines, with the agency’s three Republican commissioners voting to approve it and the two Democratic commissioners dissenting.
In a statement, two of the Republican commissioners, Joseph J. Simons, the agency’s chairman, and Christine S. Wilson, said that the settlement “achieves a significant victory for the millions of parents whose children watch child-directed content on YouTube.” They said it was the first time a platform would have to ask its content producers to identify themselves as creators of children’s material.
The agreement, they added, “sends a strong message to children’s content providers and to platforms about their obligation to comply with the COPPA rule.”
Although the settlement prohibits YouTube and Google from using or sharing children’s data they have already obtained, Rohit Chopra, a Democratic commissioner, said that it did not hold company executives personally accountable for illegal mining of children’s data. The other Democratic commissioner, Rebecca Kelly Slaughter, said that the agreement did not go far enough by requiring YouTube itself to proactively identify children’s videos on its platform.
“No individual accountability, insufficient remedies to address the company’s financial incentives and a fine that still allows the company to profit from its lawbreaking,” Mr. Chopra wrote in his dissent. “The terms of the settlement were not even significant enough to make Google issue a warning to its investors.”
COPPA, the strongest federal consumer privacy statute in the United States, gives the trade commission the authority to level fines of up to $42,530 for each violation.
Noah Phillips, a Republican member of the commission, argued that Congress should give the agency more guidance about how to levy fines.
In a blog post on Wednesday about the settlement, YouTube’s chief executive, Susan Wojcicki, said that “nothing is more important than protecting kids and their privacy.” She added, “From its earliest days, YouTube has been a site for people over 13, but with a boom in family content and the rise of shared devices, the likelihood of children watching without supervision has increased.”
YouTube said that not only had it agreed to stop placing targeted ads on children’s videos, it would also stop gathering personal data about anyone who watched such videos, even if the company believed that the viewer was an adult. The company also said it would eliminate features on children’s videos, like comments and notifications, that involved the use of personal data.
In addition to relying on reports from video creators, Ms. Wojcicki said that YouTube planned to use artificial intelligence to try to identify content that targeted young audiences, like videos featuring children’s toys, games or characters.
Under the settlement, YouTube must adopt the changes by early next year.
The privacy case against YouTube began in 2016 after the New York attorney general’s office, which has been active in enforcing the federal children’s privacy law in the state, notified the trade commission about apparent violations of the law on the site.
“Google and YouTube knowingly and illegally monitored, tracked and served targeted ads to young children just to keep advertising dollars rolling in,” Letitia James, New York’s attorney general, said in a statement on Wednesday. “These companies put children at risk and abused their power.”
Google has been forced to deal with privacy violations repeatedly in recent years. The company is subject to a 20-year federal consent order signed in 2011 for deceptive data-mining related to Buzz, a now-defunct social network. The order required Google to establish a comprehensive privacy program and prohibited it from misrepresenting how it handles personal data.
In 2012, Google agreed to pay $22.5 million to settle trade commission charges that it had violated the 2011 order by deceiving users of Apple’s Safari browser about its data-mining practices.
The company is also the subject of a lawsuit brought by Hector Balderas, New Mexico’s attorney general, over accusations that it violated children’s privacy. The suit says the company failed to ensure that children’s apps available through its Google Play store complied with the children’s privacy law. Google has asked that the case be dismissed.
The settlement on Wednesday is likely to have implications beyond YouTube. The changes required under the agreement could limit how much video makers earn on the platform because while they still make money on some kinds of ads on children’s videos, they no longer be able to profit from ads targeted at children.
To offset some of the expected losses, YouTube said it would funnel $100 million to creators of children’s content over the next three years. It said it would also heavily promote YouTube Kids, its child-focused app, to shift parents away from using the main YouTube app when allowing their children to watch videos.
The crackdown on creators of children’s content could make it financially difficult to produce such videos, said Maureen Ohlhausen, a former acting chairwoman of the trade commission.
“There is a lot of free content available for children,” she said. “You want to be sure that you don’t kill the goose that lays the golden egg.”
