An indictment to preserve the rule of law.

          A Miami federal grand jury issued an indictment against former president Donald Trump on June 8, 2023. According to early reporting, the indictment includes seven counts, including willful retention of national defense documents, making false statements, conspiracy, and obstruction of justice (possibly for witness tampering). Trump claims he will appear in federal court in Miami next Tuesday to enter a plea.
          Indicting Trump is the right result. Indeed, it was necessary to protect the rule of law and preserve the Constitution. Trump is entitled to the presumption of innocence (in court) and a fair trial, but the publicly known facts strongly suggest that Trump is guilty. Failing to indict Trump would have undermined public trust in fairness, justice, and equality under the law in the US.
          The indictment of Trump is no cause for celebration, but it is cause for relief and gratification that the organs of justice in the United States are up to the task of holding a former president to account. As Larry Tribe and Dennis Aftergut wrote in The Bulwark, “The long-anticipated charging of the former president shows a Justice Department worthy of its name.”
          It was not a foregone conclusion that special counsel Jack Smith would seek an indictment or that a grand jury would issue one despite substantial evidence to support probable cause. Others before Jack Smith walked to the precipice of holding Trump to account and blinked. Smith did not. And Merrick Garland did not exercise his right to overrule Smith’s decision to seek an indictment. For that, we should be grateful.
          It is sobering and disappointing to know that a former president of the United States would stoop to obstruction of justice, lies, conspiracy, and unlawful retention of defense secrets because he believed (wrongly) that he was above the law. Trump is not the first president to abuse his power or break the law, but Trump’s indictment will dissuade future presidents tempted to do so. That is the point. If we do not enforce the law when the facts demand it, the law is a mockery.
          The June 8th indictment should also provide all Americans with hope that Trump will be indicted for his attempted coup and incitement of the insurrection on January 6th. Though the charges regarding retention of defense secrets are serious, those charges are subject to confusion and false equivalency because Vice President Pence and President Biden both inadvertently retained classified documents when they completed their respective terms as vice president. Although those cases are easily distinguishable, nuance is not a strong suit of viewers of Fox News (an insight that is critical to Fox’s success).   
          Prosecuting Trump will be an ordeal for the nation. So be it. The only thing worse for the nation than prosecuting Trump is not prosecuting Trump. Failing to prosecute Trump would be a dereliction of duty from which the nation would not recover. So, as we endure Trump's effort to turn his prosecution into a spectacle that is equal parts circus and cage match, we should be confident that the ordeal is worth the effort. America is bigger than Trump and will abide long after Trump becomes the American icon for corruption.
          We will hear dozens of times over the next year that Trump is “entitled to a presumption of innocence.” That is a true statement but applies to the jury that weighs the evidence of his guilt. See Manual of Model Jury Instructions, 1.2 The Charge—Presumption of Innocence | Model Jury Instructions. But we are not jurors and are entitled to form opinions based on facts known to the public. The issuance of the indictment does not strip us of our First Amendment Rights or our ability to make reasoned judgments. The evidence strongly suggests that Donald Trump is guilty of unlawful retention of national defense documents—a felony for which others in his position have been sentenced to three years in prison.
          Jack Smith’s selection of Miami as the venue for Trump's trial suggests that Smith’s objective is to obtain a conviction that will be upheld on appeal and result in a prison sentence for Trump. The details regarding the selection of Miami as a venue are complicated and not worth explication at this point. Smith has made his choice of venue, a choice that signals his intent to obtain a conviction that will stick.
          An underreported detail is that five sealed cases were filed in Miami federal court within minutes of one another on Thursday. See Anna Bower on Twitter (attaching a copy of the PACER listing for Southern District of Florida). One sealed case is presumably against Trump; it is reasonable to infer that the other four sealed cases are against Trump's co-conspirators. If true, the filing of five cases by Jack Smith suggests that he is serious about prosecuting everyone who violated the law.
          After I reviewed the above paragraphs with my Managing Editor/wife, she said, “That’s fine, but you haven’t told your readers how you feel about the indictment.” Since my Managing Editor’s advice is unerring, here is how I feel about the indictment:
          For the last four years, I have felt frustrated, upset to the point of anger, and incredulous that Trump has managed to escape accountability despite his public, manifest corruption. Those feelings have been exacerbated by the gleeful, bad-faith defense of Trump by his GOP minions who were more interested in “owning the libs” than in “protecting the Constitution.” It was revolting. Indeed, there is a universal human revulsion to being placed in an unfair situation where everyone knows the situation is unfair but there is no remedy to the unfairness. That is how I have felt over the last four years—a feeling shared by tens of millions of Americans.
          Tonight, I feel a sense of relief and vindication. I want Trump to be held accountable after a fair trial. He deserves to be convicted. He deserves to be sent to prison. Indeed, if he were anyone other than a former president, he would already be in prison (or in jail as he awaits his trial date without benefit of bail). I am disgusted that the media has already turned to the question of “What are the political implications of the indictment?” To be sure, that is a serious question worthy of discussion. But the fact that a former president has been indicted under the Espionage Act is more than a set up for speculation about 2024.
          I am gratified that the tide has turned against Trump. He will be indicted in Georgia for election interference. He will stand trial in Manhattan in March 2024. And the odds are that he will be indicted for attempting a coup and inciting an insurrection. He deserves all that and more. And he will continually incriminate himself—as he did during the CNN townhall and his post on Truth Social on Thursday evening. The knowledge that every word he utters makes his conviction more certain will make the next two years more bearable.
          But my overwhelming feeling on Thursday night is that the center has held—as I believed it would. My faith in the Constitution and the rule of law has been rewarded. None of this means that I will let down my guard or assume victory. But a win every once in a while, especially on important matters, can renew our faith and reinvigorate our will to win.
          That’s how I feel tonight. Speaking of “securing a win every once in a while,” read on!
Supreme Court rules that Alabama racial gerrymandering violated Section 2 of Voting Rights Acts.
          In a surprise to Court watchers, the US Supreme Court ruled 5-4 that racial gerrymandering by the Alabama legislature violated Section 2 of the 1965 Voting Rights Act. John Roberts and Brett Kavanaugh joined the Court’s three liberal justices to preserve the last remaining section of the Act that was gutted by John Roberts in Shelby County v. Holder.

The Supreme Court’s 5–4 decision in Allen v. Milligan on Thursday, which found that Alabama’s congressional map violates the Voting Rights Act’s ban on racial vote dilution, sends two clear messages. First, a bare majority of the court—Chief Justice John Roberts, Justice Brett Kavanaugh, and the three liberals—believes that the VRA still plays a meaningful role in maintaining a multiracial democracy (or is willing to defer to Congress’ judgment on the matter). Second, that same majority of the court does not look kindly upon red states’ race to shred decades of precedent in an effort to wipe out the voting power of Black Americans.
          The good news is that the decision means that Alabama must create a second congressional district in which the voting power of Black voters is not diluted by gerrymandering. It is likely that Alabama will add a second Black Democratic representative to its congressional delegation.
          The even better news is that the holding in Allen v. Milligan will likely boost the prospects for plaintiffs in cases across the nation challenging racial gerrymandering by GOP legislatures. Milligan is a net gain of six Democratic seats in the House in 2024.
          Why did John Roberts and Brett Kavanaugh switch sides to join with the liberal justices? One theory (with which I agree), is that Roberts and Kavanaugh understand that their ruling in Dobbs has inflicted a grievous wound on the Court’s legitimacy and they are attempting to limit the damage. Whatever the reason, the ruling is a major victory for advocates for voting rights. As I said above, a win every once in a while, especially on important matters, can renew our faith and reinvigorate our will to win. We should all feel good tonight!

The House January 6 select committee is considering a criminal referral to the justice department against Donald Trump for obstruction of an official proceeding of Congress and conspiracy to defraud the United States on the recommendation of a special subcommittee, according to sources familiar with the matter.
The recommendations on the former president – made by the subcommittee examining referrals – were based on renewed examinations of the evidence that indicated Trump’s attempts to impede the certification of the 2020 election results amounted to potential crimes.
The select committee could pursue additional criminal referrals for Trump and others, given the subcommittee raised the obstruction of an official proceeding and conspiracy to defraud statutes among a range of options, including insurrection, and discussions about referrals continued on Thursday, said the sources.
The referrals could also largely be symbolic since Congress has no ability to compel prosecutions by the justice department, which has increasingly ramped up its own investigations into Trump’s efforts to overturn the 2020 election and subpoenaed top aides to appear before federal grand juries.
The recommendations presage a moment of high political drama next Monday, when the full panel will vote publicly to adopt its final report and formally decide on making referrals, and increase pressure on the attorney general, Merrick Garland, to seek charges over January 6.
Trump could be referred for obstruction of an official proceeding, the subcommittee is said to have concluded, because he attempted to impede the certification and did so with a “consciousness of wrongdoing” – as the panel has previously interpreted the intent threshold.
The former president was seen to have met the elements of the offense since he relentlessly pressured Mike Pence to refuse to count electoral college votes for Joe Biden, despite knowing he had lost the election and had been told the plan was illegal.
Trump could also be referred for conspiracy to defraud the United States, the subcommittee suggested, arguing the former president violated the statute that prohibits entering into an agreement to obstruct a lawful function of government by dishonest means.
The conspiracy charge was seen to be broadly applicable because Trump’s agreement with key lawyers – and potentially even the rioters – did not need to be overt, while the plan to have Pence reject Biden slates of electors with Trump slates that did not exist was deceitful.
The discussions about referring Trump for obstruction of an official proceeding and conspiracy to defraud appeared to build upon the major win for the panel in May, when a federal judge found that Trump and the lawyer John Eastman likely engaged in felonies in trying to subvert the 2020 election.
In the ruling, US district court judge David Carter in California ruled that Trump and Eastman had concocted a “coup in search of a legal theory” and ordered Eastman to turn over his most sensitive emails to the investigation, citing the crime-fraud exception to attorney-client privilege.
The emails later showed that Eastman had admitted that he knew that having Pence interrupt the January 6 certification was illegal – and yet urged Pence’s counsel Greg Jacob that the then-vice president should move ahead with the plot anyway.
The panel may not adopt all of the options presented by the subcommittee – it also suggested civil referrals to the House ethics committee for GOP congressmen and the disbarment of some Trump lawyers, among a number of options, though a witness tampering referral for Trump is no longer under consideration.
But members on the select committee have resolved to suggest criminal and civil charges to some degree, and any referral letters would be accompanied by supporting evidence not dissimilar to prosecution memorandums that are routinely drawn up by the justice department, one of the sources said. A spokesman for the select committee declined to comment. Regardless of how the panel proceeds against Trump, the intention to make criminal referrals against the former president has been practically an open secret for months as its members have used the issue of potential criminality to reinforce the seriousness of Trump’s conduct.
The recommendations from the subcommittee – led by congressman Jamie Raskin and comprised of vice-chair Liz Cheney, Adam Schiff and Zoe Lofgren, all members with a legal background – follow internal discussions for nearly a year that Trump committed crimes in seeking to nullify his defeat. Even before the select committee filed its civil suit to Carter, Cheney read aloud parts of the the obstruction statute at a public business meeting last December. And then throughout public hearings in the summer, the panel detailed their findings like prosecutors, treating the public like a jury at trial. If the members decide to move forward with criminal referrals against Trump in particular – essentially a letter informing the justice department they uncovered evidence of crimes – they would be creating a roadmap for a prosecution put together by the select committee’s top lawyers. The select committee’s investigation has been principally driven by color-coded teams of investigative lawyers, many of whom have previously worked as federal prosecutors, conducting more than 1,000 witness interviews and reviewing documents and communications from Trump’s confidantes. Still, the justice department has no obligation to take up any criminal referrals and, at this stage, could have a better perspective about the strength of criminal charges as it escalates its own January 6 inquiries with an investigative arsenal far more potent than possessed by Congress.
In recent months, an increasing number of top Trump advisors and election officials in states where Trump tried to nullify his defeat have been subpoenaed to testify before an increasing number of federal grand juries in Washington hearing evidence about events connected to the Capitol attack. The recent subpoenas to election officials have demanded any and all communications involving Trump and the Trump campaign from June 2020 to January 2021, as part of the investigations into Trump’s so-called fake electors scheme, according to two subpoenas reviewed by the Guardian.

The rusty wheels of American justice have been freshly oiled, and are finally starting to turn. They are now bearing down upon one DONALD JOHN TRUMP, hot on the heels of his indictment in the Stormy Daniels hush money case. He has been found guilty of the sexual assault and defamation of writer E. JEAN CARROLL.
The day after the verdict, the FORMER GUY doubled down on his disparaging comments in his now-infamous CNN Town Hall – thereby proving once again that PRECEDENT TRUMPERY is an arrogant, insolent, self-entitled fool, with no regard for decency. As a result, Carroll has been granted the right to seek further punitive damages, totalling $10 million.
According to the latest news, Trump was also warned on May 23 to follow certain guidelines set by the New York judge in the Stormy Daniels case. This, however, did not deter the CRIMINAL DEFENDANT from complaining about that judge on social media shortly afterward. More significantly, later that day he actually defamed E. Jean Carroll once more, in another post.
This bizarre behavior raises troubling questions. Is DON VETO deliberately attempting to provoke a CONTEMPT OF COURT charge? Is he perversely hoping this tactic will actually goad one of his judges into giving him some JAIL TIME? Such a strategy is not as far-fetched as it sounds, because he could easily use it to gaslight his deranged MAGA-GOP cult even further – reinforcing the idiotic notion that he is the ultimate POLITICAL MARTYR.
Despite such shenanigans, Carroll's legal victory nevertheless hopefully marks the beginning of an avalanche of unprecedented guilty verdicts, unfolding over the next several months. The SLANDERER IN CHIEF could be charged for crimes ranging from election fraud, witness tampering, and obstruction of justice, to fomenting an insurrection, threatening judges, and stealing classified documents.
In some ways, the most troubling aspect of the Carroll case came during the aforementioned CLOWN HALL. I'm referring to the sickening laughter of many in the audience, when the UNREPENTANT SEX PEST mocked and re-defamed his victim. Sadly, however, I have also been reminded that this sort of cavalier attitude toward sexual assault is not solely confined to those who perpetuate traditional right-wing sexism.
I was recently scrolling through one of the many anti-Trump Facebook group pages, and came across a disturbing meme. It showed Trump behind bars, frowning. A word balloon showed him saying "MAGA: MY ASS GONNA ACHE." Standing close behind him was a black man; he was scowling, so this was clearly not a prelude to romance. I felt compelled to call this out, with the following comment:
"I see nothing funny about PRISON RAPE jokes. Anti-Trump people, one would hope, are progressive folks – who rightly despise The Don for his sexual assaults. Why then are some of the anti-MAGA groups allowing these sleazy kinds of memes? Totally hypocritical! I've seen at least a dozen of these atrocities on other FB pages, and every one of them showed Trump being paired with black men. So clearly, they are perpetuating RACIST stereotypes. And in this case, the meme has evidently been posted by the group's moderator. You should be ASHAMED."

Whatever else I could say about the Carroll case pales in comparison to the following brilliant polemic, which appeared May 13 on a Facebook page called DONALD TRUMP FREAKSHOW. Author Mitchell Smith introduced it with this comment: "I had to write this, after Trump defamed E. Jean on the [CNN] Town Hall." Here it is, in its eloquent entirety:
Greasy-sleazy foundation covered menace of the masses. A flopping, lying snake in the grass – with limbs flailing like a whirling dervish demon. A petulant, grabbing psychotic mess of humanity, only fit for the most slovenly ignorant of humans.
He speaks out of the sides of his grotesque mouth as he watches you with eyes of a swine, considering his next words while you are still speaking. He doesn't hear you. He never wants to hear you.
The savagely dyed hair that falls all over his scalp, leaving just enough to cover his ears – as he makes facial contortions to show his unapproval for anyone that speaks. He fidgets about in his cranky old man pants, three sizes too large for his clumsy frame.
He calls you disgusting, fake news, wacko, accuser, liar – and he doesn't know you. He never saw you, even though pictures show him with you – but he thinks you're his wife? His confusion comes from a lifetime of lies – and he can no longer differentiate the truth from falsehood.
He's a false prophet, a dilettante in training – a wreckless, accusing maniacal farce of a human being. He believes his star status enables his desires, and allows for his lusting to be reciprocated. In some cases, for the ones who know not well, he gets his way.
In the end, his cantankerous, shallow, self-serving, soulless existence is only understood by those who understand real evil. He will eventually meet his evil self, and he won't be very satisfied about it. He will have an awakening; his awful misguided heart will eventually explode – and he will expire.
And we will celebrate the end of a horrific time in our existence. We will dance, and be joyous – because the evil has perished. We will heal and move on. No more discourse to put up with – only real joy.

A member of the House panel investigating the January 6 insurrection at the US Capitol on Wednesday accused former President Donald Trump of tampering with witnesses by vowing to pardon those involved in the riots if reelected in 2024.
Trump's comments over the weekend added fresh urgency to the committee's work as the prospect of Republican control of Congress in 2023 and a potential reelection bid by Trump threaten to derail the investigation into the riot.
"Absolutely," Rep. Pete Aguilar of California told CNN's Brianna Keilar on "New Day" when asked if Trump was tampering with witnesses by dangling pardons in front of January 6 defendants. "And I think the question is more from my colleagues on the other side of the aisle, you know where -- where are they? Do they support this? When is enough enough?"
The comments from Aguilar, a Democrat, come as the House panel continues to hone it's investigation as it speaks with former members of the Trump administration and obtain documents related to the riots.
During a rally on Saturday, Trump complained that those charged in connection with the January 6 attack at the US Capitol are being treated unfairly and said: "If I run and if I win, we will treat those people from January 6 fairly."
"And if it requires pardons, we will give them pardons. Because they are being treated so unfairly," the former President said.
Trump also reiterated his vow to pardon the rioters on Tuesday night, saying in an interview that aired on Newsmax: "I would absolutely give them a pardon if things don't work out fairly."
The comments from the former President have garnered criticism among Republicans, including South Carolina Sen. Lindsey Graham, while some Trump allies have lamented that the rioters should be pardoned. Senate Minority Leader Mitch McConnell, a Republican, also disagreed with the former President's sentiments. 
Robert Jenkins, who is an attorney for several January 6 riot defendants, including Anthony Antonio, said Wednesday his clients are aware of Trump's offers for potential pardons and that the former President's offers could impact the defendants' cooperation. Jenkins also said he is not sure Trump's comments rise to the level of witness tampering but said the former President is putting his "fingers on the scales."
"This is not a situation where I think he's offering something of value to someone who is necessarily a witness but a potential defendant or an actual defendant," Jenkins told CNN's John Berman on "New Day." 
"So, I don't think this would qualify as witness tampering. But he is certainly putting his fingers on the scales. I'll say that."

Remember when Trump dangled pardons in front of people like his 2016 campaign manager Paul Manafort and his long-time ally Roger Stone, to encourage them and others to defy investigations about him? And remember when, after they were convicted for their refusal to cooperate, Trump did in fact pardon them on his way out the White House door after Biden won the 2020 election?
Trump's playbook hasn't changed much:
"Another thing we'll do, and so many people have been asking me about it, if I run and if I win, we will treat those people from Jan. 6 fairly. We will treat them fairly. And if it requires pardons we will give them pardons. Because they are being treated so unfairly."
Yes, promising in advance to pardon a material witness is the federal crime of obstruction of justice and witness tampering, just like last time. (18 U.S.C. § 1512(b).) And no doubt Trump will be prosecuted for it immediately, just like last time.

I maintain that based on the public reporting, we have proof beyond a reasonable doubt, right, which is the mother of all burdens of proof. And, yes, I would love to see some really captivating, public hearings put on by Congress, by the House select committee.But I really want to see all of this evidence tested in the crucible of a public criminal trial because whether that changes minds or not is almost beside the point. If we have high government officials who abuse their authority and committed crimes against the United States, federal crimes, they need to be held accountable. And the dangling of pardons to domestic terrorists, J-6 defendants is the latest example.Now, let me say, can we charge that criminally? We can probably roll it into a speaking indictment, a narrative of a conspiracy to commit crimes against the United States, what we call it 371 Conspiracy. But let me take on the dangling of pardons directly. Because as a former career prosecutors, some might accuse me of wanting to find crimes under every rock and around every corner, when he says, you know what, if I`m elected, if I become president, I will consider giving pardons to the J-6 defendants who are treated unfairly. I don`t know that that can directly be charged as witness tampering, again.But I went and I reread the insurrection statute and it says, if you engage in insurrection or provide aid or comfort to those who do, I think those statements by Donald Trump may make an appearance in court in the insurrection cases and give aid and comfort to the insurrectionists.So I think there is a viable legal argument that Donald Trump, by dangling pardons to those domestic terrorists, actually gave aid and comfort to the insurrectionists.

Trump's growing recklessness is a ticking time bomb
(CNN)Rep. Pete Aguilar of California, a Democrat who is a member of the House select committee investigating the January 6 attack, accused former President Donald Trump of tampering with witnesses by floating the possibility of pardoning those who took part in the insurrection.
Trump, who spoke of the potential pardons during a rally in Texas on Saturday, sank to new lows by dangling the promise of impunity and calling for massive protests if prosecutors investigating him and his business "do anything wrong or illegal." It's clear that Trump is trying to rile up his followers while threatening to unleash them on anyone who stands in his way. His comments also reinforce his false narrative that those who took part in the January 6 attack were patriots who acted righteously to defend American democracy, rather than insurrectionists who sought to destroy it.

The long-time Republican strategist and dirty trickster, who has a tattoo of Richard Nixon on his back, lied about contacts with WikiLeaks during the 2016 election regarding emails hacked from Democratic party accounts.
In turn, special counsel Robert Mueller and the Senate intelligence committee suspected Trump lied when he said he could not recall discussing the leaks with Stone.
Stone did not turn on Trump and had his sentence reduced on the recommendation of attorney general William Barr. But he still faced prison before Trump acted. His conviction stands.
Both men were in Nevada on Saturday, Trump holding campaign events while Stone sought to raise money for himself. He outlined his advice to Trump should he lose in a call to conspiracy theorist Alex Jones’s Infowars online show, on Thursday.
Citing widely debunked claims of fraud around early voting, absentee balloting and voting by mail, Stone said Trump should consider invoking the Insurrection Act and arresting the Clintons, former Senate majority leader Harry Reid, Mark Zuckerberg of Facebook, Tim Cook of Apple and “anybody else who can be proven to be involved in illegal activity”.
Stone also said: “The ballots in Nevada on election night should be seized by federal marshals and taken from the state. They are completely corrupted. No votes should be counted from the state of Nevada if that turns out to be the provable case. Send federal marshals to the Clark county board of elections, Mr President!”
Nevada has not gone to a Republican since 2004 but is shaping up to be a crucial contest this year. Biden leads there, but polls have tightened.
Trump’s own rhetoric was not far removed from that of the man he spared prison. The president continued on Saturday to make unsubstantiated claims about voter fraud. He and his campaign have also consistently claimed without evidence that “antifa”, or anti-fascist, activists represent a deadly threat to suburban voters that will be unleashed should Biden win.
Commenting on a Daily Beast report about leftwing activist groups planning what to do “if the election ends without a clear outcome or with a Biden win that Trump refuses to recognize”, Stone told Jones the website should be shut down.
“If the Daily Beast is involved in provably seditious and illegal activities,��� he said, “their entire staff can be taken into custody and their office can be shut down. They wanna play war, this is war.”
Stone also advocated “forming an election day operation using the FBI, federal marshals and Republican state officials across the country to be prepared to file legal objections [to results] and if necessary to physically stand in the way of criminal activity”.
In an interview broadcast on Saturday night, Trump told Fox News he would happily “put down” any leftwing protests.
“We’ll put them down very quickly if they do that,” he told Jeannine Pirro.
“We have the right to do that. We have the power to do that if we want. Look, it’s called insurrection. We just send in and we, we do it very easy. I mean, it’s very easy. I’d rather not do that, because there’s no reason for it, but if we had to, we’d do that and put it down within minutes, within minutes.”
The Insurrection Act of 1807 allows the president to use federal troops to enforce federal law. Last used in 1992, it was much discussed this summer, amid protests over racism and police brutality arising from the killing of George Floyd by officers in Minneapolis.
