5. do you respond to comments?
Yes, absolutely. That's my favorite part about writing fic—being able to interact with readers. Sometimes I'm slow in replying, but I promise I always will.
6. What is the fic you wrote with the angstiest ending?
I have a few stories with unhappy endings, but I think this one is the most gut-wrenching read: Just a Dream (Labyrinth, Jareth/Adult Sarah) He can have her in their shared dreams, but is it enough? Obsession can be a dangerous thing. [1,644 words]
7. What’s the fic you wrote with the happiest ending?
I tend to mostly write happy endings—at least for stories that have a proper ending. I think there would be too many to list here.
8. Do you get hate on fics?
It's happened infrequently. I just delete the comments. I'm too old and tired for that kind of manufactured drama.
9. Do you write smut? If so, what kind?
No, not really. I mean I have a few—very few—M-rated stories, but it's pretty much all feelings with pretty words and metaphors. The tension is my favorite part. When it comes to resolving it, I tend to be a "pan to the sky" writer.
10. Do you write crossovers? What’s the craziest one you’ve written?
I have written a couple. The zaniest? When Fairy Tale Meets Mythology (OUAT, Captain Swan; MCU, Loki/Jane Foster) While searching for Henry, Emma and Hook happen upon a strange couple in Neverland. [1,209 words]
11. Have you ever had a fic stolen?
Not that I know of.
12. Have you ever had a fic translated?
I was asked once, but I don't know if they followed through. I have had someone turn one of my stories into a podfic, though.
13. Have you ever co-written a fic before?
Yep. I'm a fandom old. I hail from the days of doing fic Round Robins and fandom Big Bangs.
14. What’s your all time favorite ship?
The USS Enterprise NCC 1701 D, though the Jolly Roger comes in as a close second.
15. What’s a WIP you want to finish but doubt you ever will?
The companion fic to Three Months on Vulcan where we follow the escapades of Soval and Amanda Cole as she works as his assistant. I was going to call it Lost in Translation. But my drive to write it has fizzled out over the years. I just don't have it in me.
16. What are your writing strengths?
Fleshed out characters, humor, pretty prose, banter.
17. What are your writing weaknesses?
F I N I S H I N G. Seriously, that's my goal for 2024: to finish at least 3 of my languishing multi-chapter fics. Also, I want to improve my longfic game. I tend to rush through the plot.
18. Thoughts on writing dialogue in another language in fic?
I've done it, though I try not to overdo it. And I try to make it easy for the reader to understand from context so they don't have to constantly jump to end notes for the translations. I've been super fortunate to have a native-speaking fandom friend help me with Norwegian for some of my MCU stories. I've used Google Translate for Icelandic, and the Vulcan Language Database. Trying to write in Quenya is the worst, though. Never again! *gives Tolkien a side-eye*

It was the middle of the night and most, if not nearly all the crew of the U.S.S Enterprise, (NCC-1701) the pride and joy of Starfleet were asleep.
The only ones awake were a handful of the engineering and medical crews, and her Captain, Captain Christopher Pike.
Some nights he'd stay up late reading and reviewing reports, catching up on correspondence from Starfleet high command, back at HQ on Earth.
Whilst he did miss home from time to time, serving as a Starfleet captain was his life's greatest honour and accomplishment.
But tonight he had another reason for being up so late, tonight was the night he planned to ask his girlfriend, the love of his life, Emma to marry him.
An Ensign in the science division, assisting in the research of new life forms, Emma had a bright future in Starfleet, one Pike hoped to share with her, that was if she said yes to his proposal.
He went to the room they shared together, where Emma was sleeping soundly.
He chuckled softly to himself seeing her lying there, on her side of the bed, pillows pulled partway down. There were many things he loved about her, her quirky sleeping habits being one of them.
Approaching he slowly he gently shook her
"Sweetheart, darling?"
"Mmh..what is it? What's happening?" She mumbled slowly opening her brown eyes to look at him
"Well I was hoping you'd come up to the bridge with me, there's a great view of a beautIful nebula I want you see." He partially lied
For this was all part of his plan to ask her to marry him.
"Let me get dressed then." She told him sitting up.
”No, no it’s ok. No need to change. Come.”
He offered his hand out to her and she took it, following him out of their quarters, down the corridor and into the turbo lift.
Inside the turbo lift, he asked her told her to close her eyes, she did so trustingly knowing her Captain and lover knew what he was doing.
It did not take them long to reach the bridge and once there he guided over to the captain's chair.
This was it, no going back now.
Taking a deep breath to steady his nerves, he knelt before her, pulling the ring he’d picked out for her on their last shore leave together.
"You can open your eyes now" he prompted her
"So where's this amazing....nebula..." She began, her voice trailing off when she realised what was actually happening.
She cupped her mouth with her hands as she stared at Christopher kneeling there, on one knee with a stunning diamond ring between his fingers
”Chris...”
”Emma I love you more than I can ever put into words. There is nothing I wouldn't do for you. Una maybe my number one in terms of the chain of command on this ship, but you are the number one woman in my life. I would be the happiest captain in Starfleet if you did me the extraordinary honour of becoming my wife. Will you marry me, Emma?” He asked.
”Yes, yes, of course, I will.” She cried throwing her arms around him
Relief washed over him like a tidal wave, as he slipped the ring on her finger.
She then stood and the two of them sealed their love and engagement with a deep and passionate kiss.
They then pulled away for air and leant their heads against the other, savouring the moment, for in the morning it would be back to business as usual as Starfleet officers on board the U.S.S Enterprise and its five-year mission...

Can you write a NCC fic where they drive one of Max's cars and stay a few places along the way when they all move to CA and they realize there are actually a lot of things /stories/habits they don't know about each other yet and some are surprising or endearing while others are irksome /annoying? I just think it would be a cute newlywed bonding story. 😊

It hadn’t been C.C.’s first choice for a honeymoon. Nileshad suggested staying somewhere away from the house (and the Sheffields andtheir new little ones) for a while, but when it had become clear that he wasn’tthinking they should jet off to Hawaii or somewhere exotic like that, shehadn’t been convinced it would be that much fun. The Babcock family rarely tookactual vacations in the state where they lived (trips upstate hardly counted inher mother’s eyes), but Niles had insisted that she might enjoy herself if shejust gave it a try. So, she’d agreed to go along with it, and when Maxwell hadeventually (reluctantly) agreed to let them take his rarely-used Range Rover,the whole plan had ended up evolving into a small road trip.
As it so happened, it hadn’t been a bad trip so far – itmight’ve only been the first day, but they’d had a fun time out in Los Angelesto start things off, and then drive along the coast had been gorgeous. The FourSeasons in Santa Barbara had been a wonderful choice of overnight stay, as well.Not that she was going to tell her newly lawfully wedded husband that – it’dall been his idea, and she was still trying to pretend that she’d seen betterplaces.
Though the smug look he was giving her across theirdinner table suggested he’d already figured out she was having more fun than she’dimagined she would.
“Is there something my dearest darling wife wishes to sharewith me?” he asked, propping his elbow on the table and resting his chin in hispalm. “A word or two informing me of her enjoyment, perhaps?”
“No,” she replied, just as playful but also just asdetermined to win. “Though I would quite like to tell my most wonderful husbandto get his elbow off the table, because those of us brought up in politesociety were clearly taught manners that certain servants weren’t.”
She punctuated that last part with a sip of her water (herbody had been an alcohol-free zone since finding out they were going to have alittle one), and Niles matched her countenance as he lifted his arm away fromthe table.
“Forgive me, my love; I was so caught up in your presencethat I just couldn’t help but get closer,” he rested his hand over his heartand gave a romantic sigh practically dripping with sap.
Letting a small chuckle loose but also rolling her eyes,C.C. held her hand out across the table for him to take, “Alright, you’reforgiven. This time.”
Niles grinned, and tickled the palm of her hand with hisfingertips before taking her hand fully and lacing their fingers together, “I’llmake up for my behaviour later, I promise.”
“You’d better,” C.C. squeezed his hand, and then stroked hisindex finger with her own. “If this is our honeymoon, I want every overnightstop to be worth it, Hazel.”
He looked back at her in a way which said exactly how worthit each new hotel room was going to be. He then used the hand not holdinghers to pick up his own glass. In an act of solidarity, he’d also chosen tostick with water.
“Is this really the first trip you’ve ever done like this?”he asked, taking a sip.
C.C. blinked at him, “Yeah, why?”
Her husband shrugged a little in return, “It just seemssurprising to me – there’s so much to see in every state, I can’t imagine whyyour family never took you on a tour of your own when you were growing up.”
Frowning, theatre-turned-television producer let her eyeswander to the table. She knew exactly why she’d never had a trip like the onethey were currently on – it was, to some extent, the reason she hadn’t thoughtmuch of taking a vacation closer to home in the first place.
“Well, my parents were always trying to one-up each other. Andmy father always had the company to run, so expensive vacations were mymother’s way of scoring extra points,” she explained. “A trip to Buffalo to seeNiagara Falls will never compare to a trip to Paris, in her worldview.”
She glanced up when she felt Niles squeeze her handcomfortingly.
“I suppose I’d never thought of that,” he said. “I should’verealised that the Grand High Witch might want to take her daughter to visitforeign covens.”
C.C. bit down on the inside of her cheek to stop herselffrom laughing, but she couldn’t prevent the smile she knew was spreading acrossher face. If there was one thing she loved more than bantering with Niles, itwas watching him take down her mother and her snobbish attitude.
“It’s alright,” she said, finally trusting herself torelease her cheek. “What about your family? Where did you take vacations?”
Suddenly Niles looked slightly uncomfortable.
“We didn’t…actually really have any of our own,” he answered,eyes cast down to his lap like he was ashamed. “When we went on holiday, wewere going because the Sheffield family were going. It was hardly time off for myparents, and the older I got, the more I was roped in as well. On the rareoccasions we did get time for family trips, it would only be to somewhere local– a museum or a castle, or perhaps the beach if it was good weather and we leftin plenty of time.”
That struck C.C. more than realising why she’d never takenvacations closer to home. Of course Niles hadn’t had the opportunity to go anywherefar away that the Sheffields hadn’t, when he was growing up. His parentsprobably had to work most of the time, or if one didn’t the other might have hadto, and getting more than a little time off was probably nigh-on impossible!
At one time in her life, she wouldn’t have even cared.Servants were…well, her mother would’ve said “beneath her family”. But C.C. hadlong since come to realise that that wasn’t true, and now the whole road tripidea made a little more sense.
It was closer to what Niles was used to, in terms of familyvacations. And it was something he clearly wanted to share with her.
She had enjoyed their first day a lot – she could certainly tryto enjoy the others as well, and see where that took them.
“Oh…well, now I guess I understand why you wanted to make atrip like this,” she said.
The comforting tone made her husband look up, and he manageda small smile.
“A little family tradition,” he said. “Though even this isexpanded.”
“True,” C.C. replied. She could’ve said something sweetthen, but the opportunity for a zinger was just too good. “Seems like thetrip’s changed to match your waistline.”
Niles’ small smile became a feigned unimpressed look rightthen. He looked like he was about to say something back, but their food arrivedbefore he could, and conversation swiftly turned to what they were about toeat.
They had to let go of each other’s hands to do so, but theydidn’t mind; this was only their first night away.
They still had plenty of time for that and more.

Their next hotel stay in the next designated location waslonger. Staying a few days in San Francisco made more sense than making it anovernight stop. There was too much to do there to practically drive straightthrough it without seeing as much as possible.
And Niles had been more than enthusiastic about getting acouple of photos of C.C. with the Redwoods at one of the state parks on thedrive there. His face was all beaming smiles as he checked his camera aftershe’d posed for one by him.
“You’re a perfect Kim Novak, my sweet,” he crooned, comingover to hold her hands. “Every bit as glamorous and mysterious. And any regularJames Stewart couldn’t help but find you completely alluring.”
C.C. smiled a little awkwardly in return. She was sure whathe was saying would’ve been a wonderful compliment, if she’d had any idea whatthe hell he was talking about.
Her husband must’ve realised just that, too, because hetried again, “Kim Novak and James Stewart? From Alfred Hitchcock’s criticallyacclaimed film Vertigo?”
Oh…well, that made more sense in a way. There was still a tinylittle problem, however.
“I…haven’t actually seen Vertigo,” she admitted.
Niles looked at her like another head had just sprung out ofthe joint between her neck and her shoulder, “You haven’t seen one of thegreatest movies of the last century?!”
She shrugged, and released his hands to start walking backdown the path, “I haven’t seen a lot of Hitchcock movies – I’ve just never hadthe time to sit down and watch, it’s no big deal.”
C.C. heard her husband hurrying to catch up, his shoespounding against the soft forest floor. She smiled to herself – the sunlightcoming through the trees made the place look beautiful, and she could imaginetaking their little one (and probably more little ones) in the future…
“No, I know – I’m just really surprised that you haven’t!” Nilesat last fell in line beside her, bringing her thoughts back to theirconversation. “I mean, which ones have you seen? The whole way through, as well.”
The producer thought about it aloud, “Uh…Rebecca, and TheLady Vanishes?”
That only seemed to shock Niles more, and he dramaticallyput his hand over his heart, to which C.C. rolled her eyes.
“My God, Babs, you have a lot of catching up to do!” hedeclared, putting his arm around her back. “When we get home, we’re going tohave a movie marathon, and you’re going to get an education in some ofHitchcock’s finer works. Vertigo, Rear Window, North by Northwest…”
He slowed them to a halt, wrapping his arms completelyaround her and murmuring softly into her ear.
“If you can handle all of those, we can get stuck into TheBirds and Psycho.”
Again, C.C. could only roll her eyes, but she added a shakeof the head to accompany it, “How incredibly romantic…!”
“I’ll have you know, at least three of those films featureprominent romances. And the suspense is so palpable, sometimes you just have tograb hold of the person next to you,” Niles squeezed her gently, and wiggledhis eyebrows. “I’ll even give you my best Cary Grant impression.”
His reaction had sort of annoyed C.C. at first, but she had to soften up at his enthusiasm. It actually made her laugh softly - he wasn’t being a snob about it, he must have just truly been surprised that she hadn’t seen all the movies he’d seen! Granted, she didn’thave to see them if she didn’t want to, but it was like agreeing to the wholetrip in the first place – Niles clearly wanted to share them with her.
And she was more than curious as to what his Cary Grantimpression looked like!
She rested her forehead against his.
“Hm. Sounds like I don’t have much of a choice,” she saidquietly.
Her husband rubbed their noses together, “You’ll get achoice – if it turns out you don’t like one of them, then we won’t watch anymore of them.”
“Well, I’m glad I’m allowed that in the least!” the producerjoked in return, wrapping her arms around his neck. “Alright, I’ll go alongwith your movie plan, as long as I get to pick what we do tomorrow.”
“Keane Gallery and lunch down by the Bay?” Niles suggested.
She pulled away a little to look at him curiously, “How didyou know that’s what I wanna do?”
The butler gave her a knowing (and loving) smile in return.
“Let’s just say that I might not have known that you’ve neverseen Vertigo,” he said, tucking some of her hair behind her ear. “But there aresome things I certainly do know about you.”
Well, that was certainly true. They both knew each otherbetter than anyone else, inside and out, and that was exactly how they likedit.
Smiling, C.C. closed the gap between them so that their lipswould meet in a kiss, and neither one of them pulled away until they neededair. They then held each other there for a few minutes, just enjoying thesilence, before deciding to head back to the car.
When that finally happened, the producer had a questionprepared, “So, you can do impressions as well?”
Niles tilted his head from side to side, “A few. I only tendto bring them out at family Christmases, after one too many glasses of mulledwine…”
That made C.C. grin mischievously, and she pulled him alonga little more eagerly as they made their way back through the park to the entrance.She already knew that their next hotel room had a minibar, and even though shecouldn’t have anything to drink, the same rule didn’t have to apply to Niles.
There was no way on God’s Earth that she was gonna waituntil Christmas to see him do an impression!

The last night of the trip came around far too soon. Thathad to be the reason C.C. was unable to fall asleep, no matter how much shetried. Her own body was working against her, trying to make the time last alittle longer because they were making the journey back to Beverly Hills from Sacramento in the morning.
The time she and Niles had been away had been one of – if notthe best – vacation of her life. They’d been sightseeing all over the place (completewith embarrassing touristy photos and videos), gone shopping for souvenirs (theidea of gifting her mother a Keane waif just to see her reaction had been sotempting, but they’d held off), and just…well, they’d had an amazing time ingeneral! They’d learned new things about each other, both good and bad, and it had brought them closer together as a couple.
She couldn’t believe the time had gone so quickly!
She was so busy thinking about it and staring up at theceiling that when Niles spoke, it startled her.
“You’re still awake, aren’t you?” he asked, voice stillthick with sleep. He waited for her grunt of confirmation before rolling ontohis side and reaching out to place one of his hands on her stomach. “What’s thematter?”
C.C. took her hand in his, and they cradled her belly together.She had a long way to go before she was huge, but even the feeling of Niles’ palmagainst the bump that was just starting to appear was comforting.
“Nothing,” she told him with a sigh. “I was just…thinking, Iguess.”
“What about?”
Even in the darkness of the room, her eyes went straight towardswhere she knew her husband’s face would be, “No zinger about how, for me,thinking’s a dangerous occupation?”
Niles feigned a noise of disappointment.
“Drat, I must still be half asleep – it didn’t occur to me,”he said jokingly, rubbing her stomach gently. “But, seeing as by saying it yourselfyou’ve done the job for me, you might as well tell me what you’ve been thinkingabout that’s kept you up.”
As much fun as it had been to keep him guessing at dinner onthe first night, C.C. didn’t quite feel in the mood that was needed to keep itup.
“I just…can’t believe we’re going back home tomorrow,” sheexplained.
Niles was soft with her in return, “You had a lot of fun onthis trip, didn’t you?”
He’d hit the nail right on the head, of course.
“I did,” she turned her eyes back towards the ceiling,wiping her eyes. They were starting to feel a little tired and itchy. “Evenwhen we went to Alcatraz and you told the tour guide to lock me in the cell on theend of the row, because it was the one I “did time in”.”
Even without seeing his face, Niles sounded like he wassmiling, “Well, Babs, you know what this means, don’t you?”
“That I’m still gonna have to get you back somehow,” shegrumbled, laying her entire free forearm over her eyes.
She only removed it when she felt her husband snuggle upcompletely against her, arms around her entire torso as he murmured into her ear.
“Hm, I was thinking something more along the lines of comingback, and doing it all again.”
C.C. lifted her arm off her eyes, and looked in his directionagain. She hadn’t said a word about how much she was enjoying herself, but shesupposed it had to have been obvious. At least, it would’ve been to Niles.
She began to think aloud, “I really did end up enjoying itall…I was even thinking about all the places we could bring kids, in the future…”
She knew that would delight him, even if she couldn’t quitesee his face in the dark. He caressed her sides, and only moved enough to letC.C. turn over in his direction once she’d decided to.
“As I said before, a family tradition,” he said. “Even if itis more than a little bit expanded.”
C.C. smiled, and rested her head against his shoulder withher arm across his middle, “We’re clearly planning on making this thing ourown, Butler Boy.”
“Maybe so,” Niles replied, managing to plant a kiss on herforehead. “And if you’re still upset about this time ending, we could alwaystake a few more days out?”
“Hm?” the producer blinked up towards his face.
“We didn’t get to go south of Los Angeles, down to SanDiego,” her husband explained. “That would add at least another day or two…”
The thought was tempting, but she knew they’d planned their trippractically to the hour – tomorrow had to be the day that they headed home.
“No, we can’t. We told Maxwell when we’d be back, remember?”she reminded him, rubbing his forearm.
“Oh,” that made Niles disappointed. But he didn’t stay thatway for long. “Well, I suppose it saves us something to do for next time, doesn’tit?”
C.C. smiled, “That it does, Dust Buster.”
Niles rubbed her back, and kissed her forehead again, “Loveyou.”
“Love you too,” the producer closed her eyes, feeling morerelaxed after their talk. “Now, get some sleep – we’ve got another long drivetomorrow.”
“As you wish, dear,” Niles chuckled. “Goodnight.”
“‘Night,” she replied, happy at last to be able to sleep.
It didn’t take long for her to go off either, dreaming aboutthe next road trip vacation that their little family would be taking.

Lesbian, gay, bisexual, queer, and asexual (LGBQA+) individuals who were born or raised in cults may have dealt with a litany of constructs regarding what a healthy relationship looks like and how they were to live their lives while in their respective cults. These constructs could include mandates such as "Only heterosexual relationships are allowed," "Sex is only for marriage," "Sex is only for procreation," "Masturbation will turn you gay," and "Wives, submit to your husbands including whenever they want sex," along with a myriad of other constructs and beliefs. They may have been punished/rewarded by leaders/members requiring reparative therapy, public and private confessions, doctrinal lessons, marrying a person of the other gender, etc. This discussion will focus on how these constructs and mandates may have led to unhealthy expectations and outcomes in current and past relationships. Presenters will also discuss how healing can occur by re-evaluating and redefining what constitutes a healthy relationship, and ways LGBQA+ can re-imagine, explore, and reconstruct their present and future relationships.
Cyndi Matthews, PhD, LPC-S, NCC, is an experienced Counseling Clinician (15+ yrs.) working in Private Practice and as an Associate Professor in the Counseling (CMHC) program at The Chicago School of Professional Psychology (Dallas). She has earned a Ph.D. in Counseling and Counselor Education, a Masters in Counseling, and a Masters in Business - Organizational Behavior. Her passion for social justice and advocacy is exemplified in her counseling practice and research, both of which focus on effective counseling interventions for marginalized populations, such as cult survivors, domestic violence survivors, and LGBTQ+ populations. Based on her scholarship and clinical expertise she has researched and developed theory for counseling with second and multi-generation adult cult survivors.
Ashlen Hilliard (she/her), MSc, is the Director of Events for the International Cultic Studies Association (ICSA). Her MSc research focused on the relationship between reproductive coercion, psychologically abusive environments, and the extent of group identity in a sample of those who have left cultic groups. Before ICSA, she worked as a case manager in Salt Lake City, Utah helping individuals leaving polygamist groups out west. Ashlen relocated to Portland, Oregon in 2020 and is a co-organizer for the local Spiritual Abuse Forum for Education (SAFE) Meetups for survivors of cultic and spiritual abuse. She has presented at multiple ICSA conferences on a variety of topics and has been interviewed on podcasts and media programs. She published an article in ICSA Today 10.2 / 2019 on, “The Genesis, Text, and Implications of Utah House Bill 214: Office for Victims of Crime Amendments.” Ashlen enjoys living in Portland, Oregon with her partner Ryan, their blind dog Hamilton, and their cat Ferguson.

#6 BALICDANG, MILDRED
Rights may be waived, unless the waiver is contrary to law, public order, public
policy, morals, or good customs or prejudicial to a third person with a right
recognized by law. (4a)
Waiver Defined
 It is the relinquishment or refusal of a known right with both knowledge of its
existence and an intention to relinquish it.
When there is a waiver.
 In practice, it is required of everyone to take advantage of his rights at a proper
time; and neglecting to do so will be considered as a waiver. Thus, failure of
counsel, either in brief or oral argument, to allude to an assignment of error, is a
waiver thereof.
 In contracts, if after knowledge of a supposed fraud, surprise, or mis- take, a
party performs the agreement in part, he will be considered as having waived the
objection.
 The right of the accused to a preliminary investigation is a personal one and may
be waived, expressly or by implication. The right of the accused to be present at
certain stages of the proceedings may be waived; so also may his right to the
assistance of counsel.
Scope of waiver.
 The right of waiver while extending to almost all descriptions of contractual,
statutory, and constitutional privileges is nevertheless subject to control of public
policy, which cannot be contravened by any conduct or agreement of the parties.
Waiver distinguished from ratification.
 Waiver is the renunciation of some rule which invalidates the contract, but which,
having been introduced, for the benefit of the contracting party, may be
dispensed with at his pleasure while ratification is the adoption of a contract
made on one’s behalf by someone whom he did not authorize, which relates
back to the execution of the contract and renders it obligatory from the outset.
Note: Thus, if a minor enters into a contract, the same can be ratified by the
parents or guardians. Such act of the parents or guardians shall cleanse the
contract of its defect from the commencement of the contract of the minor. (Art.
1396, NCC).
General rule and exceptions on waiver of rights.
 The general rule is that rights may be waived. But this rule is not absolute. It
admits of two exceptions, such as:
a) When the waiver is contrary to law, public order, public policy, morals, good
customs; and
b) When the waiver is prejudicial to a third person with a right recognized by law.
 Future inheritance and political rights cannot be waived, for it is contrary to law.

Sanchez, et al. v. Ca, et., G.R. No. 108947
Facts:
◦ The petitioners are the illegitimate heirs of Juan C. Sanchez while the respondent
Rosalia S. Lugod is the legitimate child of sps. Juan Sanchez and Maria
Villafranca Sanchez (Sps Sanchez), and the other respondents are the children
of Rosalia S. Lugod.
◦ When Juan C. Sanchez died a petition for intestate proceedings was filed by the
petitioners, but they later entered into a compromise agreement with the
respondents to settle their respective inheritance in the estate of Juan C.
Sanchez.
◦ In the said compromise, the petitioners waive their hereditary right to properties
belonging to the decedent’s estate which were not included in the inventory of
the estate’s properties and the properties originally belonging to Sps Sanchez
which have been transferred to other persons.
Issue:
◦ Whether or not the waver is valid.
Ruling:
◦ The waiver is valid because the parties waived a known and existing interest-
their hereditary right which was already vested in them by reason of the death of
their father It is valid even if the extent of such share is not determined until the
subsequent liquidation of the estate What is void is waiver of future inheritance.

Article 7. Laws are repealed only by subsequent ones, and their violation or non-observance shall not be excused b disuse, or custom or practice to the contrary.
When the court declares a law to be inconsistent with the Constitution, the former shall be void and the latter shall govern.
Administrative or executive acts, orders and regulations shall be valid only when they are not contrary to the laws or the Constitution (5a)

Repealing Acts
The repeal of a statute shall not affect or impair any act done, right vested, duly imposed, penalty accrued or proceeding commenced before the taking effect of the repealing act.
Kinds of Repeal
1. Express-when it is contained in the subsequent act.
2. Implied- when the subsequent law is inconsistent with the former.

G.R. No. L-19628 December 4, 1922
LICHAUCO & COMPANY, INC., petitioner, vs. SILVERIO APOSTOL, as Director of Agriculture, and RAFAEL CORPUS, as Secretary of Agriculture and Natural Resources, respondents.
STREET, J.
Facts
Petitioner, a corporation duly organized under the Phil. laws, engaged for several years in the business of importing carabao and other draft animals, and was desirous of importing, from Pnom-Pehn, a shipment of draft cattle and bovine cattle for the manufacture of serum. However, respondent Director of Agriculture refused to admit said cattle except upon condition that drafts be immunized. Petitioner however contends that the respondent has no authority over the matter, invoking section 1762 of the Administrative Code, as amended by Act No. 3052. On the other hand, relying upon section 1770 of the Administrative Code, Admin. Order No. 21 of the Bureau of Agriculture, and Dept. Order No. 6 of the Secretary of Agriculture and Natural Resources, respondent maintained its decision. Hence, the issue.
Issue
Whether or not section 1770 (and other similar acts) has been repealed by implication by Act 3052 and hence cannot be applied with the case at bar?
Ruling
The decision of the Court is No. The Court ruled that the contention of the petitioner is untenable for the reason that the invoked section 1762, as amended, is obviously of a general nature while 1770 is a particular one. Section 1770 is therefore not inconsistent with section 1762 and instead be considered a special qualification of the latter provision. Moreover, the court emphasized that “specific legislation upon a particular subject is not affected by a general law upon a same subject unless it clearly appears that the provision of the two laws are so repugnant. The special act and the general law must stand together, the one as the law of the particular subject and the other as the general law of the land.” Therefore, Section 1770 of the Administrative Code remains in effect and serves as a supplementary provision to section 1762, as amended.
Summary of Article 7
1.Laws are repealed by subsequent ones. Congress cannot make a law that can NEVER be repealed.
2.When an express REPEAL is repealed, there is no revival- except when the repealing law provides.
3. When an IMPLIED repeal is repealed, there is automatic revival - except when the repealing law provides otherwise.
4. The Constitution is the Supreme law of the land.
5. An unconstitutional law is a VOID LAW and the exception is the Doctrine of Operative Fact.

Judicial decisions applying and interpreting the laws or the Constitution shall form a part of the legal system of the Philippines.
Contemporaneous interpretations – of laws form part of the law as of the time of their enactment. They assume the authority as the statutes themselves. They are what the laws mean.
The principle of contemporaneous construction of a statutes by the executive officers of the government, whose duty is to execute it, is entitled to great respect.
Administrative interpretation of laws – Administrative regulations adopted under a legislative authority by a particular department must be in harmony with the law and should be for the sole purpose of carrying into effect its general provision.
Intention of law is formed in its spirit – The study of law is not an exact science with definite fields of black and white and unbending rules and rigid dogmas. The beauty of this discipline is the “penumbra” shading gradually from one extreme to another that gives rise to those honest differences of opinion among the brotherhood as to its correct interpretation.
Legislative Intent is important – It must also be stated that in the interpretation of a statute, legislative intent must be ascertained from a consideration of the statute as a whole.
Whenever the Supreme lays down a principle, it becomes part of the law forming part of the contemporaneous interpretation of the law as of the time of its enactment.
Kinds of Interpretation:
Ø CLOSE – Interpretation is adopted is just reasons connected with the character and formation of the text induce us to take the words in their narrowest meaning. This species of interpretation also generally called “literal”.
Ø EXTENSIVE – Interpretation called also “liberal” interpretation, adopts a more comprehensive signification of the words.
Ø EXTRAVAGANT – Interpretation is that which substitute a meaning evidently beyond the true one. It is therefore not genuine interpretation.
Ø FREE – Or unrestricted, interpretation proceeds simply in the general principles of interpretation in good faith, not bound by any specific or superior principle.
Ø LIMITED – Or restricted, interpretation is when we are influenced by other principles than the strictly hermeneutic ones.
Ø PREDESTINED – Interpretation takes place if the interpreter, labouring under a strong bias of mind, makes the text subservient to his preconceived views or desires.
Interpretation – the office of the judiciary – As between the three departments of government, the office of construing and interpreting the written laws belongs to the judiciary ultimately, although the executive and legislative departments may be required, by necessity, to put their own construction upon the laws in advance of their exposition by the courts.
Decision or judgement defined – A judgement is the law’s last word in the judicial controversy. It is the conclusion of the law upon the matters contained in the record, or the application of the law to the pleadings and to the facts, as they appear from the evidence in the cases and as found by the court, admitted by the parties or as deemed to exist upon their default in a course of judicial proceedings.
Presumption against injustice – It is presumed that the Congress never intends to do injustice. Rather it is presumed that it shall do right and give justice.
FLORESCA VS. PHILEX MINING
G.R. NO. L-30642 APRIL 30, 1985
MACASIAR, J.:
FACTS:
Petitioners are the heirs of the deceased employees of Philex Mining Corporation (hereinafter referred to as Philex), who, while working at its copper mines underground operations at Tuba, Benguet on June 28,1967, died as a result of the cave-in that buried them in the runnels... of the mine. Specifically, the complaint alleges that Philex, in violation of government rules and regulations, negligently and deliberately failed to take the required precautions for the protection of the lives of its men working underground.
The defendant PHILEX, with gross and reckless negligence and imprudence and deliberate failure to take the required precautions for the due protection of the lives of its men working underground at the time, and in utter... violation of the laws and the rules and regulations duly promulgated by the Government pursuant thereto, allowed great amount of water and mud to accumulate in an open pit area at the mine above Block 43-S-l which seeped through and saturated the 600 ft. column of broken ore and... rock below it, thereby exerting tremendous pressure on the working spaces at its 4300 level, with the result that, on the said date, at about 4 o'clock in the afternoon, with the collapse of all underground supports due to such enormous pressure, approximately 500,000 cubic feet... of broken ores, rocks, mud and water, accompanied by surface boulders, blasted through the runnels and flowed out and filled in, in a matter of approximately five (5) minutes, the underground workings, ripped timber supports and carried off materials; machines and equipment which blocked all avenues of exit, thereby trapping within its tunnels all of its men above referred to, including those named in the next preceding paragraph represented by the plaintiffs herein;
That out of the 48 mine workers who were then working at defendant PHILEX's mine on the said date, five (5) were able to escape from the terrifying holocaust; 22 were rescued within the next 7 days; and the rest, 21 in number, were left mercilessly to their fate, notwithstanding the fact that up to then, a great many of them were still alive, entombed in the tunnels of the mine, but were not rescued due to defendant PHELEX's decision to abandon rescue operations, in utter disregard of its bounden legal and moral duties in the premises;
ISSUE:
Does CFI (RTC) have jurisdiction over the complaint?
RULING:
Yes. Under the law, Floresca et al could only do either one. If they filed for benefits under the WCA then they will be estopped from proceeding with a civil case before the regular courts. Conversely, if they sued before the civil courts then they would also be estopped from claiming benefits under the WCA.
Pursuant to Article 8 of the Civil Code, it argues that the application or interpretation placed by the Court upon a law is part of the law as of the date of the enactment of the said law since the Court’s application or interpretation merely establishes the contemporaneous legislative intent that the construed law purports to carry into effect. Yet, the Court argues that the Court can legislate, pursuant to Article 9 of the New Civil Code. However, even the legislator himself recognizes that in certain instances, the court “do and must legislate” to fill in the gaps in the law; because the mind of the legislator, like all human beings, is finite and therefore cannot envisage all possible cases to which the law may apply. (HOWEVER, the Supreme Court ruled that Floresca et al are excused from this deficiency due to ignorance of the fact. Had they been aware of such then they may have not availed of such a remedy. But, if in case they’ll win in the lower court whatever award may be granted, the amount given to them under the WCA should be deducted. The Supreme Court emphasized that if they would go strictly by the book in this case then the purpose of the law may be defeated. Idolatrous reverence for the letter of the law sacrifices the human being. The spirit of the law insures man’s survival and ennobles him)
Article 9.
#9 VILLAMIL, JOHN KERBY
No judge or court shall decline to render judgement by reason of the silence, obscurity or insufficiency of the laws.
A judge should not refrain from rendering a judgement just because there is no law that governs a particular case. In the absence however of a law, the customs, and traditions of the place can be applied, but they must be proved as facts according to the rules of evidence. The rule however is inapplicable to criminal cases, for if there is no law that penalizes an act, the same is not punishable under the maxim nullum crimen nulla poena sine lege. Even if the law is obscure, it can still be applied and the rules of statutory construction can aid the court.
How about if the law is unjust? The rule is dura lex sed lex. It is the duty of the court to apply it and not tamper with it. The court cannot adopt a policy different from that of the law. What the law grants, the court cannot deny. But if the law is unjust or harsh the court may apply a soft hand in recommending executive clemency to an accused who was convicted. But it cannot refrain from applying the law. If the court tampers with the law and refuses to apply the policy it laid down, then, it is usurping the power of the congress in declaring what the law is. In essence, it would be violating the principle of separation of power.

Facts:
On the afternoon of June 26, 1913, a match was held in the cockpit of the municipality of Tabaco, Albay, between two cocks belonging to the plaintiff and to the defendant respectively. Each of said persons had put up a wager of P160; and as the referee of the cockpit had declared the defendant's cock the winner in the bout, the plaintiff brought suit against the defendant in the justice of the peace court of the said pueblo, asking that his own rooster be declared the winner. The justice of the peace court decided that the bout was a draw. From this judgment the defendant appealed to the Court of First Instance of the province.
The defendant denied each and all of the allegations of the complaint and moved to dismiss with the costs against the plaintiff. On September 11, 1913, the said Court of First Instance rendered judgment dismissing the appeal without special finding as to costs. The defendant excepted to this judgment as well as to an order dictated by the same court on November 8th of the same year, on the plaintiff's motion, ordering the provincial treasurer of Albay and, if necessary, the municipal treasurer of Tabaco of the same province, to release the deposit of P160 and return it to its owner, the plaintiff Chinaman, Chu Jan. These proceedings have come before us on appeal by means of the proper bill of exceptions.
Issue:
Whether the dismissal of the case on grounds of not knowing the rules governing cock fighting and not knowing what laws should be applied in the particular case is justifiable.
Held:
No. The ignorance of the court or his lack of knowledge regarding the law applicable to a case submitted to him for decision, the fact that the court does not know the rules applicable to a certain matter that is the subject of an appeal which must be decided by him and his not knowing where to find the law relative to the case, are not reasons that can serve to excuse the court for terminating the proceedings by dismissing them without deciding the issues. Such an excuse is the less acceptable because, foreseeing that a case might arise to which no law would be exactly applicable, the Civil Code, in the second paragraph of article 6, provides that the customs of the place shall be observed, and, in the absence thereof, the general principles of law.

Cesario Ursua was asked by his lawyer Atty Palmores to get the copy of the complaint against him on the Ombudsman’s office since the messenger, Mr. Oscar Cruz was not around
Before entering the office of the Ombudsman Mr. Ursua signed the name Oscar Cruz on the logbook.
Upon receiving the letter he used also Oscar Cruz.
While going out he encountered Ms. Amparo and recognized him as Cesario Ursua.
5. Ursua was charged with the R.A. No. 6085, otherwise known as "An Act to Regulate the Use of Aliases".
Issue: Whether or not RA no. 6085 otherwise known as "An Act to Regulate the Use of Aliases" was applicable to Mr. Ursua
Decision: No, RA no. 6085 is not applicable to the case of Ursua. The questioned decision of the Court of Appeals affirming that of the Regional Trial Court of Davao City is REVERSED and SET ASIDE and petitioner CESARIO URSUA is ACQUITTED of the crime charged.
Reason:
1. C.A. No. 142 - was made primarily to curb the common practice among the Chinese of adopting scores of different names and aliases which created tremendous confusion in the field of trade.
2. The confusion and fraud in business transactions that the anti-alias law and its related statutes seek to prevent are not present here as the circumstances are peculiar and distinct from those contemplated by the legislature in enacting C.A. No. 142 as amended.
