Tolerance is Extinction -Part 1: What an excellent episode! This show continues to blow my mind. Everything about it was perfect.
The ‘family is a choice’ arc with Jean, Scott and Cable; the kickass Wolverine, the beautiful swords-dance from Nighcrawler, the sickening image of collared Magneto and the attention to his prison number from Auschwitz, AND the absolutely insane monologue from Valerie Cooper.

The X-Men take a break from the Danger Room training session when they received a call from Beast. He tells the X-Men about the news of Dazzler's abduction at the hands of the mutant-hating group, the Friends of Humanity. Hearing the news, Jubilee is in dismay because she had been waiting to go to Dazzler's concert. Everyone (except Jean Grey and Beast) leave the X-Mansion for the rescue mission. Jean Grey is forced to stay behind for her pregnancy while Beast is busy repairing Bishop's time travel device. Meanwhile, Gambit and Rogue are on a shopping trip when they received a call from Storm to aid their team in a mission.
Just as the X-Men arrive at the Friends of Humanity's hideout, they see Rogue and Gambit had already at the hideout where they are kicking the bigots' asses. The X-Men are fighting the mutant haters while Jubilee managed to locate Dazzler and rescue her. Just then, the authorities led by Valerie Cooper, arrive at the hideout where they arrest the Friends of Humanity goons. During the arrest, one of the Friends of Humanity goons sneer at the FBI agents for siding with the mutants but the scarred agent forces him to keep his mouth shut as he promised him that he would go free if he cooperates. While Valerie Cooper is talking to the X-Men, Wolverine sniffs out a familiar scent among the agents or the Friends of Humanity but he could not tell which one of them is the familiar enemy. Little did the X-Men know that the familiar enemy is actually Carl Denti, the FBI agent with scars on his face, he is the one who became X-Cutioner in one episode of X-Men 97 cartoon.

Oh I love this one! Had a couple of thoughts since the episode aired, but didn’t have the time to write them down. 
I’ve already seen a couple of takes online: as usual, mostly on the extremes; either people who refuse to acknowledge that Magneto is capable of horrific things or people who jump at any chance to completely vilify him - and both do the character a big disfavor.

Short answer: yes, I believe his actions can be seen as a declaration of war. Both Logan and Morph were completely right in that scene and they are voicing out the two major interpretations of the events. Magneto did save all the mutants, he also declared war - one doesn’t negate the other. And I’ll try my best to explain:
Least relevant part are probably the human sentinels. During the EMP attack each and every one of them powered off. IF that means they are dead and not just powered off it can be used against him as a crime against humanity. Remember how in the scene with Roberto and Jubilee they were shown as standing down and keeping appearances in front of other people? So if it comes down to the argument of self-defense there are a couple of ways to paint these guys as just ‘protectors of humanity.’ Unlike the metal ones, these were humans, they were someone’s loved one.
Now… well… the consequences of the EMP attack: we saw the entire world go dark. That alone opens up the possibility for millions of deaths (humans and mutants) in countries across the globe. The few scenes we got were enough to paint a picture and leave it to the audience to fill in the gaps: turning off power plants can lead to catastrophic events (they showed a nuclear power plant for a reason); we saw threats that are now released to cause damage at large (Omega Red); the cameos from Spider-Man and Silver Samurai were not random picks either - cities engulfed in darkness will soon turn to chaos. And so many other things in between (hospitals, cars and planes, communication and defenses, all down). So yeah I am inclined to believe that his actions would result in a heavy loss of lives.
Magneto effectively saved the lives of so many mutants that were attacked by sentinels, but at the cost of many others. Damned if you do, damned if you don’t.
But why can it be seen as a declaration of war and not just an act of terrorism? (And again this show proves to be SO insanely good and planned to the smallest detail.) At this point Magneto is not just some terrorist. He went through trials in front of the world and got absolved; Genosha got recognized as a fully self-governing nation and Magneto was, at the moment of the attack, the de-facto leader of a nation. His actions are now the actions of the entire mutant nation. He didn’t do it to declare war, that was not the purpose, BUT a direct attack on a country is just that: a declaration of war.
I’ve seen the argument that he didn’t start it, that Genosha was a declaration of war. But Bastion played all his cards right - not one nation was officially responsible for the attack on Genosha - there was no proof to connect the genocide to a world power. The robots wore no flags, they were not the creation of one country. Yes, various nations ARE behind the Genosha genocide, but their hands were not the ones holding the proverbial weapons, merely providing the support for building them (sound familiar to anyone?)
That is the game Bastion is playing and Magneto is one of the most important pieces. ‘You were born for this’. Bastion orchestrated everything to the very last detail. Magneto had to be given a chance to be the face of Genosha, and most importantly the world had to see him truly believe in Genosha as a world nation among the rest, so than when he breaks, the world can see how dangerous mutants are, and how it’s a mistake to treat them as equals. It’s a vile and disgusting plan which makes Bastion an exceptional villain.
It’s why Cooper got concerned when Magneto announced he would be ruling Genosha in a partnership: while Magneto’s psychological profile was well documented and easy to break, him and Rogue posed a real problem to Bastion’s plan because they would have been able to provide a balanced form of government. They could have turned Genosha from an ideal to a functional nation. But he was stripped of all of that, of a peaceful future for mutantkind. Magneto knows each and every face and voice that was behind the attack on Genosha. But he is the only one. And, sculpted by Bastion, he is now a broken man with no consideration for consequences, only his and his people’s survival. Which, ironically, might be the final push to ensure that Bastion’s future comes to pass.

The Uncanny X-Men #183 - He'll Never Make Me Cry
Xavier's School for Gifted Youngsters
Peter and Kitty discuss their relationship. Peter says he met someone on the Beyonder's planet where the Secret Wars took place and fell in love with her (see the Secret Wars issues). Because of this, he breaks up with Kitty. He says he hopes they can remain friends. She says they are X-Men which is a bond that nothing can break. Kitty goes back to her room and cries. Illyana comforts her.
Rogue is practicing in the Danger Room, but it's a super difficult scenario and Storm shuts it down just before a Danger Room robot moves in to kill Rogue. Storm asks why Rogue would set up such a dangerous exercise and Rogue gets all angry and runs off saying she wants to be left alone. Storm expects that Rogue's attitude has something to do with what happened with Rossi (last ish).
Logan checks in with Peter and says it's time they have a talk. They get in a car and start driving away from the mansion, and Kurt teleports into the car. He wants to come too. Saturdays are for the boys!

Kitty tells Storm she is going away to visit her parents and she doesn't know when she'll come back. Storm asks if this is goodbye and Kitty says she wants it to be. Storm comforts Kitty as she cries.
Dallas, Texas
Dr. Valerie Cooper of the National Security Council and Raven Darkholme of the Defense Advanced Research Planning Agency leave the airport together and they discuss Senator Kelly's Mutant Affairs Bill. Dr. Cooper reiterates her idea to use mutants to fight enemies like the Soviets before those enemies do that to the US. Darkholme says mutants are born, and you can't rush that. Cooper agrees, and says there are other ways to fight enemies, and that's why they're on their way to visit a man named Forge...
Manhattan
The boys arrive at a bar downtown. Logan says Peter needs to apologize to Kitty. Peter says it's not a crime to fall in love with someone else and that he can't lie to Kitty and say he still has feelings for her. Suddenly Wolverine picks up a familiar scent. It's Cain Marko aka Juggernaut. And Peter accidentally spills his beer on Marko. It's on.

Juggernaut throws Peter outside, and all the bar patrons start running and screaming. Peter transforms into Colossus and there's punches, throws, everything gets destroyed - walls, the bar, tables, chairs, annnnd the entire building collapses. Colossus is buried in the rubble. Juggernaut asks Wolverine and Nightcrawler if they're going to join in. Nope. Juggernaut leaves. Colossus digs out of the rubble. Wolverine says he would've helped in the fight, but didn't because of how Colossus treated Kitty.
A woman who was watching the Colossus/Juggernaut fight steps out of the shadows on top of a nearby building. The man she was with at the bar is dead and looks almost mummified. The woman says the man should feel blessed for giving his life for "the goddess incarnate." The woman says she has returned to earth following a 2,000 year exile. Her name is Selene.
