The Onondaga claim that the United States violated a 1794 treaty, signed by George Washington, that guaranteed 2.5 million acres in central New York to them. The case, filed in 2014, is the second brought by an American Indian nation against the United States in an international human rights body; a finding is expected as soon as this year.
Even if the Onondaga are successful, the result will mostly be symbolic. The entity, the Inter-American Commission on Human Rights, has no power to enforce a finding or settlement, and the United States has said that it does not consider the commission’s recommendations to be binding.
“We could win against them, but that doesn’t mean that they have to abide by whatever,” Mr. Hill said in an interview.
The 2.5 million acres have long since been transformed by highways and utility lines, shopping malls, universities, airports and roller rinks.
The territory encompasses the cities of Binghamton and Syracuse, as well as more than 30 state forests, dozens of lakes and countless streams and tributaries. It is also home to 24 Superfund sites, the environmental detritus of the powerhouse economy that helped central New York thrive during the beginning and middle half of the 20th century.
Most notorious of these is Lake Onondaga, which once held the dubious title of America’s most polluted lake.
Industrial waste has left its mark on Onondaga territory, leaving the nation unable to fish from its streams and rivers. The history of environmental degradation is part of what motivates the Onondaga, who consider it their sacred responsibility to protect their land.
One of their chief objectives in filing the petition is a seat at the table on environmental decisions across the original territory. The other is an acknowledgment that New York, even if only in principle, owes them 2.5 million acres.[...]
Some Native nations have been willing to drop land claims in exchange for licenses to operate casinos. But the Onondaga say they are not interested in cash. Nor are they interested in licenses to sell cannabis or operate a casino — which they consider socially irresponsible and a threat to their tribal sovereignty.
There’s really just one thing that Mr. Hill says would be an acceptable form of payment: land.
The Onondaga insist they are not looking to displace anyone. Instead they hope the state might turn over a tract of unspoiled land for the nation to hunt, fish, preserve or develop as it sees fit. One such repatriation effort is underway: the return of 1,000 acres as a part of a federal settlement with Honeywell International for the contamination of Onondaga Lake. The United States has not contested the Onondaga's account of how the nation lost its land. Indeed, the lawyers representing the United States in the Onondaga case have centered their argument on legal precedence, noting that courts at every level — including the U.S. Supreme Court — rejected the Onondaga’s claims as too old and most remedies too disruptive to the region’s current inhabitants.
To the Onondaga, the logic required to square these contentions seems unfair. Why should the United States be allowed to steal their land and face no obligation to give some back?[...]
In New York, [...] Native people were not considered to have standing to sue on their own behalf until 1987.[...]
In 2005, the Onondaga filed a version of their current claim in Federal District Court in the Northern District of New York, naming as defendants the State of New York, its governor, Onondaga County, the City of Syracuse and a handful of the companies responsible for the environmental degradation over the past centuries. A similar case filed by the Oneida Nation was, at the time, pending before the Supreme Court.
But just 18 days after the Onondaga filed their petition, the Supreme Court rejected the Oneidas’ case. The decision referenced an colonial-era legal theory known as the Doctrine of Discovery, which holds in part that Indigenous property claims were nullified by the “discovery” of that land by Christians.
The “long lapse of time” and “the attendant dramatic changes in the character” precluded the Oneida nation from the “disruptive remedy” it sought, Justice Ruth Bader Ginsburg wrote in the majority decision.[...]
[L]awyers for the Onondaga used the rejection as the premise for a new argument. They contended that the U.S. court system’s refusal to find in their favor proved that they could not find justice in the United States.
The petition filed before the international commission amounts to the most direct challenge of the United States’ treatment of Indigenous people to date in terms of human rights — and the first to apply the lens of colonialism.
“What the Onondaga litigation is doing right now is to force a political dialogue with the colonial occupier,” said Andrew Reid, a lawyer representing the Onondaga, adding that a favorable finding could prompt a political conversation about the United States’s treatment of native people on the world stage.
Representatives for the State Department declined to be interviewed and did not respond to requests for comment. But in legal documents, the United States contended that the Onondaga’s central claims have been rejected in prior cases; that they have had “abundant opportunity” for their case to be heard; and that they are merely unhappy with the outcome. It also contended that the commission has no jurisdiction, given that the bulk of the nation’s losses took place two centuries before it was established.
“The judicial process functioned as it should have in this matter,” the United States wrote in legal papers.

In a rare moment of return for East Coast Native Americans, the Onondaga Nation has had 1,023 acres of ancestral land in New York state returned to them.
The land in the Tully Valley includes the headwaters of Onondaga Creek, more than 45 acres of wetland and floodplains, and approximately 980 acres of forests and fields.
The agreement is a result of the March 2018 Natural Resource Damage Assessment and Restoration (NRDAR) settlement between the Natural Resource Trustees and Honeywell International, Inc.
Honeywell, manufactures of household appliances like air conditioners, were found to have been polluting Onondaga Lake in the Tully Valley, Central New York, for almost 100 years, and it had begun to spill into neighboring Onondaga lands.
They have settled on orders to pay $5 million dollars to the Natural Resource Trustees, give the 1,023 acres of land over to the Onondaga, restore several hundred acres of polluted area, and construct 18 projects related to conservation and recreation, of which 7 have been completed.
“It is with great joy that the Onondaga Nation welcomes the return of the first substantial acreage of its ancestral homelands. The Nation can now renew its stewardship obligations to restore these lands and waters and to preserve them for the future generations yet to come,” said Onondaga Nation Chief Tadodaho Sidney Hill.
For the Onondaga people, Onondaga Lake and Onondaga Creek are sacred. They are considered living relatives, central to the Onondaga worldview and spirituality, the tribe detailed in a statement.
Secularly, the cold waters of Onondaga Creek support a small population of brook trout, a population which may be fully restored with proper stewardship. The wetlands, floodplains, forests and fields are home to wildlife such as great blue heron, songbirds, waterfowl, hawks, bald eagles, frogs, bats, and other mammals including white-tailed deer.
“We look forward to drawing upon the Onondaga Nation’s expertise and Indigenous knowledge in helping manage the area’s valuable wildlife and habitat,” said Sect. of the Interior, Deb Haaland.
It’s more common now than ever that tribal nations are recovering rights to use their ancestral lands as they always had, but for tribes in the super-developed Mid-Atlantic region, these opportunities are rare.
However as the Onondaga point out, recent world-wide land surveys have shown that 80% of the world’s biodiversity is currently located in areas stewarded by indigenous peoples, or lands contested as such, despite the fact this amounts to less than half the land of the planet.
As such, they are keen to show what indigenous stewardship can bring to the biodiversity of America’s East Coast, and the current plan with state officials is to turn the Onondaga Lake and Tully Valley into a wildlife sanctuary, but one with ample opportunities for recreation, as Honeywell were ordered to construct many boat launching sites along the lake and rivers.

21. What are 2-3 songs that your Dark Urge would relate to?
You are a hero to me for asking this hahaha I already answered it but this is the perfect excuse to ramble on about more songs 😌 When theorizing or writing about durge!Aune, I choose to characterize the Dark Urge as a mostly seperate entity that exists within her. (I love how there are so many different ways for different players to envision the Urge itself, whether it's an external being or synonymous with your character.) Since waking on the beach, Aune is pretty damn traumatized by her violent thoughts and desires. Her method of coping with it is to seperate her conscious thought from this entity. (Of course, that comes with a whole host of problems as well.) She spends the journey constantly questioning if there really is this malign force inside of her, or if it's just been her the entire time. When she's really lost in the sauce (so to speak lol; sauce in this case being blood), the two internal voices merge together as one. It's interesting because it seems "healthier" in a lot of ways; there's less discord and disconnect going on in her brain, at least until the ecstasy of the moment wears off. (An interesting conversation to be had about responsibility & guilt & exactly how much Durge is bound to their darker desires.) ANYWAAAYS here are some songs that I think encapsulate the above very well:
Honeywell by Clem Turner is what I imagine the Urge telling Aune soon after waking; an introduction of sorts, and a seductive pleading to let the Urge fully integrate with Aune. The Culling by Chelsea Wolfe is when the border between Aune and the Urge are less discernible; I picture this as a conversation between the two except you don't know who is talking at any given time. (It's also a pretty good representation of how the Urge talks about/to Astarion.) All Things Devour by aeseaes is Aune reflecting on the destruction the Urge leaves in its wake. Drying, dusty / Heart beside me Dead streets carving / Bitter bright wings Worms and spiders / Spin inside her Like the story / Make me holy This thing all things devours This thing all things devours Devours This thing, taker / Pollinator Starving flowers / Hear them howling (Yes, this song references Gollum's riddle on time!) I really like this one because it speaks on the inevitability of time, of death and decay — forces that are significant to Aune as a spore druid. But there's an ominous or gloomy quality to the song (to me, anyway). The repetition of "devours"; the significance of "taker"; the mention of "pollinator" is perhaps uplifting, but it is immediately replaced by the image of "'starving' flowers 'howling'". Aune is a servant to life, death, decay, and rebirth, meaning she has a unique outlook on things that others might find upsetting. But the Urge takes and takes and takes and gives nothing in return. There is no rebirth. It's unnatural and disruptive. She doesn't want to be the champion of wanton violence or the bringer of perverse death.
22. What first impression does your Dark Urge give off to strangers?
Scary, off-putting, intimidating, dark, sad. She's always wearing dark, muted colors, if not an outfit of all black. Aune's neutral expression is a scowl or a frown and she doesn't smile or laugh in public (at first, because she doesn't remember how; later, because she thinks it's too vulnerable). She's also got an aura about her that is just straight up unsettling (it's the spores). Most people are either intimidated or frightened of her, but if you move past that and spend five minutes around her, it doesn't take much to realize she's just a sad person/clearly suffering through something. (Aune is our precious little edgelord who is not really an edgelord; she doesn't know how to deal with her BIG feelings is all.)
30. What are your Dark Urge’s intentions/goals after the end of the game?
I'm still in Act Two so I have no idea! 😅 Hopefully there's some peace and happiness in her future...

Thanks for thinking of me, @melsie-sims! I think my posts count as 'Gameplay', with maybe a bit of 'Story' thrown in?
My 'hood is pretty large, and I play each family in (not very strict) rotation, so I've needed a lot of housing for my Sims!
Some homes I've built myself from scratch: the Crawfords' beach house; Cassandra's Victorian semi; Marmaduke and Henrietta's townhouse; the retirement community; the Bennets' Victorian villa; Erasmus and Edward's, and Clara and Daniel's, compact residences; or the studio apartments for recent graduates).
I love building, but find it very time consuming, as I'm such a perfectionist and everything has to be just so! So, I'm always happy to find - preferably - CC-free/low-CC lots that fit my general aesthetic (compact, with a more European feel), which I can then customise as required.
Hence, I'm using quite a few residential lots that I've downloaded, many from my favourite builders @kayleigh-83 (Eleanor and Esther's chalet, apartments for new graduates), @deedee-sims (the family homes of the Eltons, Martins, Morlands, Wickhams and Willoughbys, Anna and Bennet's townhouse, Miles and Robert's bungalow, Jasper and Georgiana's house) and @honeywell-mts (most of the original family homes, including those of the Bertrams, Bingleys, Churchills, Darcys, Dashwoods, Knightleys, Smiths, Steeles, Tilneys and Wentworths).
I almost always make some modifications though, from simple switches of walls/floors/windows/doors/fences, right up to tweaking the footprint or completely revamping the internal floor plan, to better suit the family I have in mind. I'd say the split is about 50/50, between residential lots I've built myself (I'm just not using many of these yet), and those I've downloaded and modified. I don't use any money cheats, so if my Sims don't have the funds to decorate, furnish or expand, then the house stays as it is and they have to make do - hence my Sims' homes can look quite bare! As they go through life, and accumulate some savings, I start personalising their homes. But, I try to avoid completely remodelling the structure of a house while Sims are living in it, as I like to have a 'clean' copy of every lot (stored in the catalog), so that I can easily replace them if they become glitched, without having to rebuild from scratch. More often, I will just move a family to a more suitable home, if their circumstances change.

Henry Dreyfuss: Groundbreaking UI Designer Part Two
This is the second in a two-part series on designer Henry Dreyfuss. Read part one.
World War II and a Move to California
Henry Dreyfuss, Raymond Loewy, and Walter Dorwin Teague designed a series of strategy rooms for the United States Joint Chiefs of Staff at the beginning of World War II. Dreyfuss’s contribution was “four 13-foot rotating globes, one each for Roosevelt, Stalin, Churchill, and the Joint Chiefs” (1).
In February 1944, when The Society of Industrial Designers (SID) was founded Walter Dorwin Teague was its first president, and Dreyfuss served as the organization’s first vice-president. After the War, Dreyfuss moved his family to Pasadena, California, and “opened a second office near his home” (2). In 1946, William F. H. Purcell and Robert Hose became partners in the firm. (1)

In the early 1950s, Dreyfuss designed two steamships, SS Independence and SS Constitution for American Export Lines. (3) For these ships, he developed aluminum deck chairs to replace the heavier wooden deck chairs. (5) Although his firm had done consulting work for Honeywell since the late 1930s, it wasn’t until 1953, Dreyfuss designed the most important product for that firm, the round Honeywell thermostat, “which allowed it to fit cleanly on a wall whether it was askew or not, unlike rectangular ones which frequently appeared crooked”(4).

During this time Dreyfuss continued working with Bell Laboratories. “In 1949 Dreyfuss updated Bell’s Model 300 telephone with the model 500, which would become the first phone to be offered in a color other than black beginning in 1954. It would ultimately go on to be the most popular phone ever made”(4). An updated version of the wall telephone and the Princess phone were introduced during this decade.

The 1950s also saw Dreyfuss publish his seminal design book, Designing for People. “The book illustrated his ethical and aesthetic principles, [and] included design case studies, many anecdotes” (5), along with anthropometric charts. A second book dealing with ergonomics, The Measure of Man, was published in 1960. (1)
Dreyfuss’s Late Career
During the 1960s Henry Dreyfuss Associates clients included American Safety Razor Company and Polaroid Land Company, which introduced his design for the model 100 camera in 1963. Also during this time, his firm was responsible for the rebranding of American Airlines and continued to collaborate with its long-time client Deere & Company designing four new tractor models during the decade. In 1965 several professional design organizations, including The Society of Industrial Designers, merged to form the Industrial Designers Society of America (IDSA). Dreyfuss was its first president. (7)
Henry Dreyfuss retired from the design firm that bore his name in 1969, but remained working “with top management of several clients to analyze and improve their contact with customers”(3). In 1972 Dreyfuss, along with his wife Doris, worked on Symbol Sourcebook: An Authoritative Guide to International Graphic Symbols, a reference guide “of over 20,000 symbols [that] continues to provide a standard for industrial designers around the world”(4).

The Tragic Deaths of Henry and Doris Dreyfuss
In 1972 Henry and Doris Dreyfuss had been happily married for 42 years, but Doris was suffering from terminal cancer. At one point the pain became too much for Doris to bear.  On October 5 of that year, the Dreyfusses went into the garage of their home at “500 Columbia Street in South Pasadena, California”(3), got into their car, and turned on the engine. “Within a few minutes they both died. They had lived their life together and ended it together”(7). “Authorities reported the cause of death as carbon monoxide poisoning”(3). The couple was survived by their son and two daughters.
Henry Dreyfuss Associates
The firm that Henry Dreyfuss founded in 1929, continued as Henry Dreyfuss Associates for over four decades after his death”(4). “After Dreyfuss’s retirement, Donald M. Genaro served as president of the company until 1994. In the 1970s, Henry Dreyfuss Associates was responsible for designing the “interiors of nuclear-powered Trident missile submarines”(3). In the next decade, the company “added a major new client in Falcon Jet Company”(3), and was averaging about 50 new products a year. (2)
When Genaro stepped down as president in 1994, a team of several partners took control of the firm. During the 1990s a new utility vehicle was designed for long-time client John Deere, and the company designed the interiors of a line of business jets for the Astra Jet company. Projects for AT&T in 1992 included a notebook computer and a smartphone “which featured an onscreen keyboard”(2).

The Legacy of Henry Dreyfuss
In 1963, “Henry Dreyfuss became a trustee of Caltech,… though he had been a faculty member of the engineering division for many years, and had annually lectured on industrial design to students in Business Economics”(5).
In 1996 a major retrospective of the work of Henry Dreyfuss appeared at the Cooper-Hewitt National Design Museum in New York, the same year a book on his work was published. The Industrial Designers Society of America posthumously awarded Dreyfuss the Individual Achievement Award in 2004. (2) The Henry Dreyfuss Archives are located in the Cooper-Hewitt National Design Museum.
A second retrospective of Dreyfuss’s work was held in 2020 at the Figge Art Museum in Davenport, Iowa. Currently the Cooper-Hewitt celebrates the 50th anniversary of Symbol Sourcebook: An Authoritative Guide to International Graphic Symbols with a special exhibition that runs through Spring 2024.
Henry Dreyfuss’s genius spans product design, graphic design, user interface design, as well as business and marketing. His greatest contribution to design is emphasizing the importance of the utility and usability of a product as well as its style.

Honeywell to pay about $200 mln to settle U.S., Brazilian bribery charges

U.S.-based manufacturer Honeywell International Inc (HON.O) on Monday said it has agreed to pay about $200 million to settle criminal and civil corruption investigations in the United States and Brazil.
The U.S. Justice Department and U.S. Securities and Exchange Commission (SEC) each announced the resolution of parallel investigations relating to bribes that Honeywell paid between 2010 and 2014 to a high-ranking official at Brazil's state-owned oil company Petrobras (PETR4.SA) to secure business.
The SEC charges also relate to payments Honeywell's Belgian subsidiary made to an Algerian government official in 2011. Those bribes involved Monaco-based oil consultancy Unaoil, which has previously been charged by global authorities over a 17-year scheme to pay bribes to officials in nine countries.
Honeywell Chairman and Chief Executive Officer Darius Adamczyk said the company is "pleased" to have the matter behind it, noting that it had received full cooperation credit.

Astronomers now know how far the Earth is from 200 galaxies
On July 11, 2022, the very first image taken by the James Webb Space Telescope (JWST) was released to the general public. It's called Webb's First Deep Field, centered on a cluster of galaxies named SMACS 0723 and containing no less than 7,000 galaxies.
This image has proven to be an important target for the study of galaxy evolution as it contains a large number of very distant galaxies which shed light on how galaxies formed and evolved in the early universe.
Until now, however, there has been a lack of accurate and comprehensive distance measurements to galaxies in this field.
A team of Canadian and international astronomers led by Dr. Gaël Noirot, a postdoctoral researcher at Saint Mary's University in Halifax, has now carefully inspected and analyzed Webb's First Deep Field. Their study is published in the Monthly Notices of the Royal Astronomical Society.
Members of the Canadian NIRISS Unbiased Cluster Survey (CANUCS), the scientists used the Canadian NIRISS (Near Infra-Red Imager and Slitless Spectrograph) instrument onboard the JWST to collect spectra from galaxy targets in the image. These spectra are a type of scientific data created by breaking down the light of an object to reveal additional information such as the object's age or distance.
Charting the 'redshifts'
Using JWST's made-in-Canada NIRISS instrument, the team measured the "redshifts" (shifts in the spectra of very distant galaxies toward longer wavelengths) of nearly 200 galaxies whose distances from Earth were previously unknown. "NIRISS is perfect for doing this because it can measure the redshifts of hundreds of galaxies at once," said Noirot, the study's lead author.
"Redshift" is a precise measurement of a galaxy's distance based on the unique chemical signatures seen in its spectra. Because the universe is expanding, the light emitted from distant objects such as galaxies is being stretched, and their spectral features are seen at longer (i.e., redder) wavelengths than originally emitted. This redshift, which is the difference between an object's observed and emitted color, reveals its distance from Earth.
"Our work on SMACS 0723, Webb's First Deep Field and first science image ever released by JWST, has produced the largest JWST spectroscopic catalog of its kind with reliable redshift measurements," said co-author Marcin Sawicki, a professor and Canada Research Chair at Saint Mary's. "Our recently published study will be a valuable resource for the astronomical community and open up new avenues of research," added Noirot.
From this redshift catalog, the researchers have uncovered many new galaxies in the SMACS 0723 cluster whose light has taken more than 4 billion years to reach us. Clusters, which are huge groups of galaxies held together by the force of gravity, can contain up to thousands of galaxies.
The new study brings better understanding of how galaxies evolve in some of the most extreme environments in the universe and gives a glimpse into the distribution of dark matter and the evolution of structures.
"As members of a Canadian-led project, we are even more excited that this significant improvement, compared to previous studies of SMACS 0723, was enabled by the spectroscopic capabilities of the Canadian-made instrument NIRISS on board JWST," said the National Research Council's Chris Willott, who leads the CANUCS team.
'Using it to its full potential'
"This Canada-made technology is letting us use JWST to its fullest potential," added Université de Montréal professor René Doyon, director of the Trottier Institute for Research on Exoplanets and principal investigator behind the NIRISS instrument. NIRISS designed, built, and tested in Ontario by Honeywell Aerospace, at its facilities in Ottawa and Cambridge. UdeM contributed key optical components, as well.
Within their huge collection of galaxy redshifts, the researchers identified three other galaxy overdensities at much greater distances than SMACS 0723 that had not been seen previously in this field. These galaxy overdensities are potentially newly discovered galaxy clusters located eight to 10 billion light years away.
Capturing these galaxy overdensities at different cosmic times is like watching a time-lapse movie of these clusters' growth, from their infancy in a young universe to the present day.
The clusters represent ideal targets for future studies to better understand how galaxies and the clusters they inhabit have evolved from their state in the very early universe into what they look like today, including our own galaxy, the Milky Way, the scientists say.
The amazing 'Sparkler'
Already, the CANUCS team has made an amazing find within one of these clusters: the magnificent Sparkler galaxy. Discovered in September 2022, it's a highly magnified galaxy, some 9 billion light years away, bursting with what appears to be the oldest star clusters to have formed after the Big Bang.
What the team's new NIRISS redshift catalogue now reveals is that the Sparkler is not an isolated galaxy, but resides in one of the newly discovered galaxy overdensities.
"The fact that the Sparkler does not live alone but is a member of a family of galaxies has important implications for how first star clusters formed after the Big Bang," said Sawicki, a co-author of the earlier study.
The CANUCS astronomers will be able improve upon their galaxy redshift catalog during Webb's second year of scientific operations, now underway, as they have been granted time to re-observe Webb's First Deep Field in even greater detail with the NIRISS instrument.
"The astronomy community clearly recognized the value of our first NIRISS redshift catalog and wants us to do another, even better version," says Noirot, the principal Investigator of this observation program.
Several independent teams of scientists have used the catalog and the results of the new study to pursue their work on Webb's First Deep Field, and additional research stemming from the CANUCS advances is expected into the formation of galaxies, the distribution of dark matter, and the evolution of the universe.
