The fight for claim for Gou Ai: Who is the real composer of it?

On July 22nd, 2020 when R Chord released his new version of Gou Ai 2.0 on his YouTube channel to the world, he claimed his song as his own to which the real composer Shu Chen comes forth to tackle the copyright claims. The original composer Xiu responds saying that R Chord should have negotiated with our party about authorization.

Xiu found out about R Chord’s version two weeks later but as soon as he did, he took matters in his own hands as leader of his ex-band Dong Cheng Wei and did a LIVE broadcast on FB stating the facts against copyrights and mentioned that he had only learned about it on July 29. He pointed out that R Chord’s uploading action had been infringing, and still showed goodwill and was willing to negotiate with the other party for authorization. But it seemed that R Chord had some other ways of dealing with kindness.

The next day he sent a message to Xiu which Xiu read on his FB as "R Chord believes he’s the composer of the song "Enough Love", so he has made a new version now, and now he wants to talk about licensing. I want to ask which company handles my copyright." Xiu didn’t say much on this expect that the current copyright is still handled by "Comic Productions" and he must consult with Comics for the ownership rights .

As for R Chord’s claim that he was the composer of "Enough Love", Chen De Xiu reluctantly said, "I have said in my statement before that I arranged he melody (of Gou Ai), the company finds someone to fill in the words, that’s all.” He also emphasized many times that he was willing to authorize this matter from beginning to end. He believed that this song combines the efforts of many people in that year to make it successful. He wants to solve this matter with proper satisfaction and negotiation, instead of a turmoil.

R Chord replies him by uploading a photo of the contract he did with Comics for Gou Ai, and sarcastically says “Comics made the song! Comics made a lot of money from this song, except for the fact that I participated in the creation. May I ask which other song is popular?! #The new version of the arrangement and production costs are all paid by me”

To which Xiu says that people spend only a couple of time with a record label, so giving ownership to Comic is useless. It was Dong Cheng Wei who arranged the song. He adds: “I personally have never seen a record label that wants to talk about authorization, and there is a contract with such content... Give it to me or the copyright label”. Even though Xiu did his best to explain but what came next from R Chord was inappropriate. He started mocking Xiu for his skills and incompetence!

R Chord replies "You must insist that you wrote the song "Enough Love". I really want to doubt your skill. After so many years, I still stick to rock and roll style.” Along with this he also forwarded Chen De Xiu's new song "For you", directly criticizing that "the chorus has no memory point at all." However, he later deleted this article. He questions Xiu’s new style of song in For You saying how different it is from Gou Ai and conclude he couldn’t have possibly written that song. (Cheap trick R Chord, I say everybody music styles changes over a course of time. Whether its rock metal or jam or jazz or simply romantic, you are no one to decide that on basis of past song -__-)

Later, R Chord wrote again, "To tell you the truth, I really can't hear any song that can surpass "Enough Love". I mean, all the artists and musicians are produced by Comics. I was able to pay a tribute to Song Yueting’s lyrics before, and I also paid a license fee for myself to use it forever. I really don’t know who is unprofessional.” Both sides continued to say different things. It seems that there is still no consensus.

Later on, R Chord’s lawyer talks to Taiwan's famous website “Apple Daily” proving herself for claims but the people’s comments booed Apple Daily for only working on one-sided story and not asking Xiu and Comics sidestory. Xiu smartly takes over Apple’s incomplete homework and gave his response again on his FB “Apple News is exaggerating. I gave my song lyrics to Comics who after reading had R Chord just to sing the song. Don’t get the order wrong. Don't forget that Comics gave you (R Chord) a place for exposure and singing. (Basically Xiu says he wrote Gou Ai and R Chord’s voice was just use to ‘sing’ it) He further says” That's EXACTLY what I'm saying. Back then, I didn't get any authority for all the use of my songs in the drama (logically unreasonable, of course, but sometimes some acquisitions weren't written in contract)” He reveals how Comic didn’t gave him the money that was supposed to by performing the songs in KO Series and talks about a song which was about 10 million but since comic didn’t have the fee to pay for it’s authorization, it only payed its singers DCW, R Chord and Jiro Wang with only “an opportunity”. Xiu reveals: “The company was paid to produce songs, the company was asked to write those plots, and the company gave us the opportunity to do these characters. (This is what is NOT written in the contract to get: “an opportunity”) So even if I didn't pick up any authorized fees, I'm ok because we were all given the opportunity to shine and show our talent at the time. At the moment, everyone can choose whether or not they want this opportunity ~I chose it myself (over the money). You chose for yourself~ Do you think the company was sorry at the time? Don't forget the great opportunity given by Comics... Don't forget. Even though I had been unhappy with my former company because of other things. But I've always been grateful for the opportunity given at the time of Comic Production. Please don't stain Comic production and everyone's efforts at that beginning. Don't spoil everyone's good memories of the ultimate series. Everyone can judge for themselves ~ “Tears Later” “Far Away” “The last scene” “The Day you left” (all DCW’s songs) There are many other songs. I believe this simple logic is easy to understand. The lies are self-defeating.”

Trong cuộc biểu tình ngày 21/7 tại Hồng Kông, một nhóm “đàn ông mặc áo trắng” đã tấn công và làm bị thương nhiều người biểu tình tại ga tàu điện ngầm Yuen Long.

Một số nhà bình luận tin rằng những người đàn ông mặc áo trắng này có gốc gác của tổ chức tội phạm ngầm (underworld system) và họ có liên kết với hệ thống đảng cộng sản Trung quốc (CSTQ), cũng có đặc điểm của “thế giới tội phạm ngầm”.

Wang Yun, phóng viên của Đài Á châu tự do, đã mời ông Wei Jingsheng (Ngụy Kinh Sinh) đại diện cho phong trào dân chủ Trung quốc, và ông He Pin, chủ tịch của tổ chức Mirror group ở New York, để thảo luận về vấn đề này.

Phóng viên: Trong các cuộc biểu tình ở Hồng Kông hôm qua, có một hiện tượng được gọi là “đàn ông mặc áo trắng” (người của thế giới tội phạm) đuổi theo thường dân. Dư luận nhanh chóng liên hệ họ với đảng CSTQ. Theo ông He, tại sao dư luận có định hướng như vậy?

He Pin: Từ các video và hình ảnh chúng tôi có được bây giờ, các cuộc tấn công này rõ ràng rất có tổ chức.

Nói về “thế giới tội phạm ngầm” của Hồng Kông, trước khi Anh quốc bàn giao chủ quyền của Hồng Kông vào năm 1997, ông Tao Siju, bộ trưởng bộ công an của đảng CSTQ, đã trao đổi rộng rãi với thế giới tội phạm ngầm ở Hồng Kông và thậm chí còn nói: “Nguời của thế giới tội phạm ngầm cũng yêu nước”. Phóng viên: Khi ông nói về các video và hình ảnh tại chỗ, ông có thể đánh giá họ đến từ thế giới tội phạm ngầm, chỉ dựa vào những bức ảnh này không?

He Pin: Họ cũng có thể là cư dân địa phương. Hồng Kông được chia thành ba vùng, với một vùng được gọi là New territories (Lãnh thổ mới), nơi sinh sống của một nhóm người gốc nông dân. Họ duy trì phong tục sống và cấu trúc tài sản truyền thống. Wei Jingsheng: Từ những năm 1990s, việc đảng CSTQ kiểm soát thế giới tội phạm ngầm là điều rất phổ biến. Khi Bạc Hy Lai (Bo Xilai) bắt đầu tấn công thế giới tội phạm ngầm (tại Trùng Khánh), ngay cả phó giám đốc điều hành của văn phòng công an thành phố cũng là trụ cột của thế giới tội phạm ngầm ở đó. Mọi người đều có thể biết rằng các quan chức, cảnh sát của đảng CSTQ v.v… sử dụng thế giới tội phạm ngầm để tiến hành các hoạt động như tống tiền, bao gồm cả việc loại bỏ các đối thủ của họ.

Điều tương tự như vậy cũng đúng với Hồng Kông. Thành thật mà nói, các lợi ích của thế giới tội phạm ngầm ở Hồng Kông phần lớn liên quan đến Trung quốc đại lục, đặc biệt là ở Quảng Đông và Thâm Quyến. Trên thực tế, ngay từ những ngày đầu, ma túy, mại dâm và các hoạt động kinh doanh khác của họ đã bị cảnh sát ở đại lục kiểm soát. Do đó, họ phải thỏa hiệp với cảnh sát đại lục để giúp họ làm những việc độc ác và thiếu đạo đức.

Phóng viên: Dư luận lần này có nhiều người tin rằng chính đảng CSTQ có những đặc điểm của thế giới tội phạm ngầm trong tổ chức của họ. Ông He, ý kiến của ông là gì?

He Pin: Tất nhiên đây là trường hợp điển hình. Như tôi đã nhận xét trước đây về các hoạt động chống buôn lậu và triệt hạ các hoạt động của thế giới tội phạm ngầm hiện nay ở đại lục, trên thực tế là để tấn công vào chính cảnh sát, bởi vì ngoài cảnh sát, ai có thể kiêu ngạo và làm bất cứ điều gì họ muốn trong khu vực địa phương? Bây giờ có rất nhiều cảnh sát trong hệ thống đó, và lợi nhuận rất là vĩ đại. Trên thực tế, cảnh sát địa phương từ lâu đã là băng đảng của thế giới tội phạm ngầm.

Về Hồng Kông, các video và hình ảnh hiện tại cho thấy cảnh sát có mối quan hệ nhất định với những “người đàn ông mặc áo trắng” này. Do đó, dư luận chung ở Hồng Kông hiện nay, trong cơ bản, tin rằng lần này ngay cả khi thế giới tội phạm ngầm không có mối quan hệ trực tiếp với Bắc Kinh, thì nó cũng có mối quan hệ không thể tách rời với phe cộng sản địa phương và phe thân Bắc Kinh. Mối liên hệ với thế giới tội phạm ngầm đã khiến giám đốc điều hành Hong Kong Carrie Lam Cheng Yuet-ngor và chính phủ Hồng Kông phải xấu hổ hơn vì họ thậm chí ít có khả năng trốn tránh trách nhiệm này.

Phóng viên: Ông He chủ yếu giải thích về mối quan hệ giữa cảnh sát và thế giới tội phạm ngầm. Tôi muốn hỏi ông Wei là đảng CSTQ có những đặc điểm của thế giới tội phạm ngầm trong cách tổ chức của nó hay không?

Nó đã là chuẩn mực cho các phe phái khác nhau trong đảng CSTQ để kiểm soát một số bộ phận của thế giới tội phạm ngầm hoặc sử dụng một số nguời của thế giới tội phạm ngầm.

Điều này không hoàn toàn giống như những ngày đầu của đảng CSTQ. Vào thời kỳ đầu, đảng CSTQ chỉ được tổ chức theo nguyên tắc bí mật, mà bây giờ nó là điều lệ đảng. Nhưng điều lệ này của đảng CSTQ nằm ngoài luật pháp của đất nước, vì vậy bây giờ thật dễ dàng để họ tiến hành “Shuanggui” (luật “Song quy” tức đối tượng tình nghi có thể bất ngờ bị bắt bí mật), luật này có quy định kép về “thời gian và địa điểm được chỉ định” để bắt người một cách tuỳ tiện, nằm ngoài luật pháp. Và nó được thực hiện một cách áp đặt.

Việc chế độ CSTQ sử dụng thế giới tội phạm ngầm là một vấn đề rất đáng quan tâm, đặc biệt là ở Hồng Kông. Bởi vì nếu chế độ cộng sản sử dụng quân đội ở Hồng Kông, sẽ gây ra áp lực ngoại giao rất lớn. Với tiền đề là quân đội không thể được sử dụng ở Hong Kong, nên họ sử dụng thế giới tội phạm ngầm để đe dọa và đàn áp người dân. Đảng CSTQ sẽ nói rằng họ không biết. Họ có thể tránh né hoàn toàn trách nhiệm. Dĩ nhiên, bây giờ chúng ta không có những bằng chứng chắc chắn, trừ khi chúng ta bắt được những “người đàn ông mặc áo trắng” đó.

Faraday Future boss Jia Yueting no longer owns the company, sources say

Before taking over as CEO of electric car startup Faraday Future earlier this month, LeEco founder Jia Yueting was known as the company’s main financial backer and majority shareholder. But Jia is no longer the largest shareholder, according to three people with knowledge of the company’s finances, because he transferred his controlling shares in Faraday Future’s holding company to his nephew, Jiawei Wang, earlier this year.

Wang was named as the company’s chief financial officer in documents filed earlier this year with the California secretary of state, and as treasurer in documents filed in 2016 with the Nevada secretary of state. He does not list Faraday Future as a place of employment on his public LinkedIn profile, but he has been...

95% of China’s Electric Vehicle Startups Face Wipeout

Chinas electric-vehicle industry, with 200 -plus companies backed by a raft of billionaires, verges on a massive shakeout as the government enforces stricter technology criteria on fledgling manufacturers and considers limiting their number to merely 10.

Any kerbs would be aimed at weeding out the weak, said a senior executive with the state-backed auto producers association, and they may pushing as many as 90 percent of EV startups toward extinction, a government-linked newspaper said. So far, only two ventures have obtained acceptance to construct automobiles, based on a review of National Development and Reform Commission documents. Three others say they plan to apply for permits.

Jack Ma, Terry Gou, Li Ka-shing and Jia Yueting are among the investors whove poured at the least$ 2 billion into building alternative-energy vehicles as China tries to combat the smog choking its cities. Generous subsidies helped cultivate a gold-rush mentality, prompting concerns the industry is plagued by too many companies lacking the technical know-how to stimulate electric or hybrid automobiles that measure up to those from Tesla Motors Inc. or General Motor Co.

There are too many entrants in key sectors, and some of them are just speculators, said Yin Chengliang, a professor at Shanghai Jiao Tong Universitys Institute of Automotive Engineering. The government has to raise the threshold. Its bad to see irrational investments in projects with low technology levels.

Overcapacity Concerns

The potential cap on EV startups goes as the worlds biggest auto industry grapples with overcapacity and high inventories. Carmakers are find pressure on their profit margins with the spread of cheap models, while stringent fuel-economy and emissions targets are set to raise costs.

China outdid the U.S. last year to become the worlds biggest market for new-energy vehicles — comprising electric vehicles, plug-in hybrids and fuel-cell automobiles. Domestic automakers sold 331,092 units in 2015, according to the China Association of Automobile Manufacturers.

The governments marketings target is 3 million units a year by 2025 — a 10 -fold increase — and its offering subsidies that can total 60 percent of an electric-cars sticker price. There currently are about 4,000 new-energy vehicle, or NEV, models in development.

Its true were underscoring support to develop new-energy vehicles, but should we let everyone to go ahead? said Dong Yang, executive vice chairman of vehicle manufacturers association.

10 Permits

The Ministry of Industry and Information Technology is considering curtailing the number of startup EV makers to a maximum of 10, said Dong, who are regularly with its officials. That count wont include traditional carmakers such as SAIC Motor Corp. and BYD Co. that are developing NEVs.

The MIIT didnt respond to a faxed request for comment.

Yet even those startups getting permits have more mandates to meet before switching on their assembly lines, as the government introduces stricter quality-control measures.

In a draft policy document posted for public feedback this month, the MIIT listed 17 technologies that companies intending to sell electric cars must possess in order to secure healthy development of the industry. Those include a control system that determines the performance and stability of the NEV, an information system that tracks the sources and conditions of key proportions, and a process for recycling or reusing batteries.

Meeting Standards

The Economic Daily, an official newspaper run by the State Council, said 90 percent of the companies currently developing EV platforms still wont meet the standards in two years. The report quoth unnamed industry analysts.

One successful applicant is Beijing Electric Vehicle Co ., which is controlled by BAIC Group, the state-owned producer for Hyundai Motor Co. and Daimler AGs Mercedes-Benz. It will build a factory in the capital city thats capable of building 70,000 EVs a year.

The other is Hangzhou Changjiang Passenger Vehicle Co ., which counts Hong Kong-traded FDG Electric Vehicles Ltd. as a major shareholder.

Once on the verge of elimination, the former state-owned bus maker was resurrected by an infusion from FDG, which counts Lis foundation as a minority investor. Li has an estimated net worth of $31.2 billion, according to the Bloomberg Billionaires Index.

Huge Problem

The speed at which theyre granting permission is worry, said Zhang Zhiyong, a Beijing-based independent auto analyst. Many companies are constructing their manufacturing facilities, but theyre blocked at the door from getting the licenses. This is a huge problem.

The NDRC didnt respond to a faxed request for comment.

The startups intending to apply for manufacturing permits include Wanxiang Group Corp ., owner of Karma Automotive LLC, which announced a hybrid that uses solar power and costs more than $115,000. Its $375 million mill is planned for Hangzhou.

Another is Jias LeEco, said Huang Hao, a Beijing-based spokesman. LeEco will invest 6 billion yuan in a factory with initial capability for 200,000 automobiles a year, the company said Aug. 10.

The third is WM Motor, which said Aug. 17 it raised$ 1 billion in an initial fundraising round with plans to introduce its first model in 2018. The company was founded last year by Freeman Shen, a former executive at Volvo Cars owner Zhejiang Geely Holding Group Co.

Chaotic Situation

Its right for MIIT to send out the signal that not everyone can get the permit, Shen said. The current situation is a little bit chaotic with too many unqualified companies, such as low-speed EV makers and auto-parts companies, joining in the competition.

The government also plans to phase out subsidies after 2020, removing an incentive for startups depending on them to attain profitability. Last year, the average EV maker rendered about 3,000 automobiles, far below the scale required to ensure returns on investment, said Wang Cheng, an official at the China Automotive Technology and Research Center.

Some companies and local authorities invested in building NEVs and batteries even though they lack the necessary technology, and that worsened overcapacity, Wang said last month.

Theres definitely a bubble, said Yale Zhang, a managing director at researcher Autoforesight Shanghai Co. If you dont own the core technology and cant build up the brand, its game over very quickly once you burn through the cash.
