What are legal steps to resolving an auto insurance claim?

Allstate was supposed to compensate me for X amount of damage done to my car by the driver who had insurance upto 5 grand. Notice that I did not have insurance with AllState but that because the driver was at fault, and had coverage of upto $5000, AllState has agreed to pay me a portion of that 5 grand. However, the problem is the driver who was at fault is not agreeing to this and demands more in loss from AllState. Whereas, although, I myself deserve more in damage since the car was worth more than the amount I am being compenstated for, I have still decided to settle for less. Now because the driver is delaying the decision to accept the remaining amount out of 5 grand, this case/claim has not resolved SINCE 2010. They wouldn't send me check yet only because the driver needs to accept the offer also. My theory is that whether or not the driver finds the offer fair, is none of my problem. This is an answer I got about owning a car with no insurance and if my license would be suspended even if I turn in the tag and registration. It makes no sense as a lot of people have licenses for ID only and do not have a car (because they aren't allowed or can't drive): By law if you have a driver's license you are supposed to carry insurance whether you own a vehicle or not. It's usually called non-owner's liability coverage. Because of this law they would be able to suspend your license if your company cannot provide proof that you have coverage. This answer makes no sense. I won't say who provided it/they don't allow me to answer them though.

So I got pulled over in may and had expired car insurance of about 10 months. I had presented my expired car insurance document and the cop had my car towed to a nearby car shop, where i got it back a few days later. The cop called another cop to drive me back to my university since my car was towed. I was talking to the cop who drove me back and asked what I can do and he told me to just plead not guilty on my ticket and get new insurance and bring it to the court. I don't understand, how can I plead not guilty? It was his advice and he knew my insurance expired. How can getting new insurance do anything for my cause? Any help appreciated, thanks.

Hello Yesterday, I passed my driving test and am, of course, really looking forward to driving. I spotted a Renault Clio I liked with a 1.1 litre engine. It's nothing special, just a first car (which would mean the world to me) I was always aware insurance was going to be a struggle. I insured myself with Provisional Marmalade while I was still learning, so I could drive my mum and dad's car as additional practice. Prov. Marm. have another part to their company, Young Marmalade for newly passed drivers, apparently giving you the best quotes, however I couldn't find anything under 3000! I am a 17 year old boy living in the Northeast of Scotland, one of the most common places for a collision in the whole of the UK. However, I am not in anyway a dangerous driver. My dad has been driving for 50 years and told me he feels very safe while driving with me as a learner, and I always stay within the speed limit, with the exception of if I don't realise I'm doing over the limit. My mum and dad have been saving some money for me for about 10 years, but it's only about 1300, and I don't have any more money apart from that. It's not going to be enough and I have really been let down by the insurance, because that Clio I saw was 600. My car caught on fire due to some electrical wiring, im fully comp, and have never claimed before. But sneaky as they are, they have told me that they do not cover electrical wiring faults, which has caused the fire. But the AA who towed my car in has catergorised it as fire damage. Surely they must cover the fire damage. I took it to a repair centre near me, and have asked them to have a quick check, and they also say its fire damage and what not, this has been procrastinated for so long by the insurance company, (claims company rather) that i can't remember what the repair centre has stated. Surely, fully comp covers something like this? THEIR engineers have said that there was no further damage to the rest of the car, but can i trust THEIR engineers? A full check up costs a lot, as they would have to take apart the car ( i believe? ) When i rang up the lady at the claims centre, she had no idea what case i was on, she literally said 'give me a moment to read up on your case' for me, thats a bit pathetic. While speaking on the phone with her not only was she rude, almost shouting at me (as i pressed on further ) . She told me she would send the company policy booklet to show that electrical wiring is not covered, and a letter stating the case was closed and in detail what the whole case is about. A week and a half has gone by (she said couple of days) This is the most annoying thing. She was rude, unhelpful, unwilling to help, and just taking the pee with the whole thing. I just find it sketchy that the letter has not been made, and no further actions or anything has happened (i have also opened another case about another incident - no info .. still) . I think they are just hoping i'd give this up as they are so unwilling to pay out. This is the reason I have insurance. Whats the point otherwise? Sorry for the long read. I have no idea what to do now, can i take it to a small claims court or talk to someone in the city council to further my case? Thanks""
