my library has a page where you can request titles to be added to the catalogue, and my requests have never, never been turned down

like, obscure book on irish mythology? added! cookbook written by a robot? hell yeah! just season 3 of a 1970s detective series, on DVD? sure, why not!

I don't know if it's that a librarian has decided to humor me, or if my library is particularly well-funded (I hope so; I love my library), but no matter what I request, they buy a copy and add it to the catalogue.

...so now, as I type in a suggestion for a queer romance with a pretty boy on the cover, I can only hope that luck is still with me

Hardy Boys and the Public Domain

So I've seen some things concerning the Hardy Boys going into the public domain soon (or maybe already have entered). And I just wanna clear things up, cause I'm seeing things that aren't fully true.

The Hardy Boys as we know them are not going into the public domain. The Hardy Boys going into the public domain will be the first couple of books originally published in 1927. For those who don't know, those Hardy Boys are very different from the ones we have now, the versions we think of as our Hardy Boys come from the rewrites in the late 1950s (with whatever relevant modernization to whatever time period).

When it comes to characters of pop culture that have the longevity that they do, their relationship with the public domain is kinda complicated. Especially if they are trademarked.

Superman is a good example of this because of his powers. His powers have changed and evolved over the years, basically whenever the writers felt like it. So in 2033 when Action Comics #1 becomes public domain, Superman can be used but only as he appeared in the comics. Even using the name Superman will be tricky. This Quora post has a pretty good explanation.

Also yeah, it's technically the works themselves that becoming public domain. Not the characters. But in reference to the characters specifically, it is the 16-year-old Frank Hardy and the 15-year-old Joe Hardy from the books published in 1927 that are public domain.

So even though the Hardy Boys are entering/have entered the public domain. It is only under very specific circumstances, and they still have trademarks and difficult copyright attached to them

TL;DR: Hardy Boys books are entering the public domain, but the Hardy Boys themselves aren't. The Hardy Boys within those books are different from the ones most of us are familiar with and can only be used under specific circumstances. Public domain, copyright, and trademarks are complicated
