5 Major Changes to Tennessee Industrial Hemp Pilot Program
Earlier this year, the Tennessee Department of Agriculture released industrial hemp pilot program regulations that went into effect on October 29, 2018. Below are 5 major changes to the program. The complete revised regulations can be found at https://publications.tnsosfiles.com/rules_filings/07-20-18.pdf.
(1) Processors are no longer required to have a license to process industrial hemp or industrial hemp products.
Processors of industrial hemp and industrial hemp products are no longer required to apply for a license to process industrial hemp and industrial hemp products in Tennessee. Beginning October 29, 2018, processors are only required to register with the Department every year at no cost to the processor. However, all regulations of the industrial hemp pilot program still apply to processors and the Department has authority to enter any processing facility during normal business for inspection.
(2) There is a new application and testing fee structure.
Under the new regulations, all persons applying for a grow permit will pay a flat fee depending upon the size of the grow area. A person applying for a license for a grow area that is less than 5 acres will pay a $250 application fee per location. A person applying for a license for a grow area that is 5 to 20 acres will pay a $300 application fee per location. A person applying for a license for a grow area that is more than 20 acres will pay a $350 application fee per location. Each licensee will be responsible for paying a $150 fee for testing for each sample collected by the Department. This new fee structure is intended to keep costs low and predictable for growers.
(3) Growers are now responsible for getting their own seed.
Gone are the days of hoping the Department provides seed in enough time to put them in the ground before fall. Yay! (Almost - see number 4). For the past growing seasons, growers could only purchase hemp seed directly from the Department. Beginning October 28, 2018, growers will be responsible for getting their own hemp seed or propagules. Prior to purchasing the material, the grower must get permission from the Department by submitting a seed acquisition request to the Department detailing the material the grower wants to acquire. Seed or propagules may be purchased from a university, a state’s agriculture department industrial hemp pilot program, or a lawful hemp vendor. Currently, the Department has certified 7 hemp seed providers. The list can be found at https://www.tnhia.org/seed-acquisition.
(4) Non-certified seed provider growers are prohibited from growing hemp within 10 miles of a certified seed provider’s grow area.
The Department will not issue a cultivation license for a grow area that is within 10 miles of a certified seed provider’s grow area. Unfortunately, the Department declined to “grandfather” existing growers in under the old regulations. That means that a grower can be selected to receive a certified seed provider license and force anyone else growing hemp within 10 miles of their farm out of business, even if the hemp farm was in business before the certified seed provider.
(5) Felons with drug-related felony convictions may apply for a license to grow hemp under the pilot program.
This is a win for persons who are being systematically shut out from participating in the legal hemp industry because of their status as a felon convicted of drug-related offenses. Under the old regulations, anyone who had been convicted of a drug-related felony offense was banned from growing hemp in Tennessee. Under the new regulations, the ban is limited to people who have been convicted of a drug-related offense within the past 10 years. So if you got convicted of growing a few plants in your garage 20 years ago, you can now grow away.

The purpose of this hearing is to receive public comment on the department’s proposed rules that affect Retail Food Store Sanitation, Food Manufacturers and Warehouses, Hemp, Hemp Producers, Manufacturing and Distribution of Hemp-derived Cannabinoid Products, and Retail Sale of Hemp-derived Cannabinoid Products.
The hearing will take place on Feb. 6, 2024 at 10 a.m. CDT in the Porter Building at Ellington Agricultural Center, located at 436 Hogan Road in Nashville, Tenn.
