An update on this. The artist Fernanda Diaz has specifically stated she doesn’t want people reposting her work.

so another reason why this falls under plagiarism.

DO NOT HARASS OR BE AN ASS, BE KIND AND LEARN FROM OTHERS MISTAKES.

My lengthy comment that I made to them I know there are errors in them Grammarly wasn't working and I had dark mode on. end me

"Hey, this is plagiarizing. You can't say teaser trailer even if it's unofficial because this is not your work. This isn't even storyboarding either. I see someone defend this as AMV in which I will have to disagree with them since AMV is falling under Fair Use in parody or entertainment law. These are not your characters nor work. The creators can't copyright claim because Youtube only support videos format and not artist format. This also makes it difficult for the artists to claim sections as well since they can (from my understanding) only claim one section of a video but again that is only for video purposes and not artist. The fact that you said, "learned a lot about animation and how to do it! anyway enjoy :D" is stating that you made this in which you also stated you are not claiming the animations but you are by stating what was said previously. This is not okay. Even if you change the title to fanmade, your true attention isn't really fanmade content but to use their (the artists) works as for your own gain. Which mind you, is frown upon in the artist community. I suggest you delete this and actually make a storyboard. You can have it in private and use it as a reference and guide of what you want but keeping it uploaded for 6 months even when many have told you it's wrong is horrible. Because this is not your work and you are already giving yourself a bad name and soon, maybe, many artist will try to avoid you because you are at this moment, keeping this video up, plagiarizing two artist works right now."

Now how does this fall under plagiarism?

This isn't their work. Even if they credit the artist in the description their true intention is to make a storyboard and use the artist's characters as a guide of that storyboard... but here is the thing.

This does not fall under fair use. Because fair use is either a parody or entertainment (and other things in which this "artist" (that really hurt me to do that to them because they just sadly don't understand what they are doing is wrong) intentions is to make a teaser trailer... a fake one for their own series)

If they made this in private that would have been fine. YEAH, I KNOW IT'S NOT BUT LISTEN. you wouldn't have known, I wouldn't have known, it wouldn't have existed in the first place and only one person would have known about this. The person that made it.

So how is AMV different from this?

AMV (that stands for Anime Music Videos) falls under fair use because it is more of a parody or entertainment. The creator's intention behind those AMVs is to make something entertaining (that isn't always comedy).

This creator's intention is to "make a storyboard." the reason why I put that in quotes is because...

one. this is not a storyboard.

two. going back and saying this is a teaser trailer (unofficial teaser trailer) in which even if they put fanmade their intention is using the artist's works for their own gain.

this is really an innocent mistake because honestly they probably don't know what they are doing is frowned upon in the art community. They probably thought they made something innocent when in reality they are actually plagiarizing.

SO ONCE AGAIN, DO NOT HARASS OR BE AN ASS, BE KIND AND LEARN FROM OTHERS MISTAKES. DON'T BE SMART WITH ME AND DO SOMETHING HORRIBLE OR I SWEAR I WILL KILL YOU. BE KIND DAMN IT
