A Florida prosecutor suspended by Ron DeSantis for defying a new 15-week abortion law says a federal judge’s decision to send his reinstatement appeal to trial means a reckoning is coming for the state’s Republican governor.
Andrew Warren, a Democrat, was removed as Hillsborough county state attorney on 4 August after saying he would not enforce the abortion ban or prosecute providers of gender transition treatment for young people.
DeSantis cited Warren’s alleged “woke agenda” in reasons for his decision.
At a hearing in Tallahassee on Monday, Judge Robert Hinkle denied motions from DeSantis to dismiss Warren’s lawsuit, and another by Warren seeking an immediate return to office, instead requesting their differences be settled at a trial in the coming weeks.
“The Governor now has to answer it to a court of law where facts matter and where you have to tell the truth,” Warren said in an interview with The Guardian.
“It’s a victory for the truth. A federal judge has ruled that the Governor has to come into court to explain the reasons behind my suspension, to show that it wasn’t political, to show that it wasn’t in violation of my free speech rights, to show that it wasn’t in violation of the voters’ rights to have the state attorney of their choice.”
The closely watched case is expected to give clarity to DeSantis’s power to purge elected officials who disagree with him. In recent weeks, the Governor has also removed four members of a school board in Broward county that defied him over COVID-19 mask mandates.
“The Governor is entrusted by the people of Florida to utilize his constitutional powers and may suspend elected officials in Florida who refuse to enforce the law,” DeSantis’s office said in a statement following Monday’s hearing.
Critics, however, have accused the governor of selective application of the principle. The Orlando Sentinel noted that DeSantis has taken no action against so-called “constitutional” sheriffs who say they won’t enforce certain gun laws.
But he did act in 2019, suspending the Broward county sheriff, Scott Israel, a Democrat, for “neglect of duty.”
Warren said he believed a trial, which could begin as early as next month, would cut through any political posturing.
“This has always been a fight for democracy, and rule of law, and for elections,” he said.
“This is our fight for the truth. And now the people will get the truth because the Governor is being forced to explain himself. Ultimately, he may be called to testify in court. The court was pretty clear that it wants to hear from the Governor in terms of the explanations about the suspension to make sure that the reasons why I was suspended are consistent with Florida law, and with federal law.”
Warren said his reinstatement was not the sole objective of his lawsuit.
“I would have liked to be back in office already but there’s more at stake than just my job,” he said.
“Regardless of what party you belong to, or who you vote for, yours always matters. No elected official has the right to throw out anyone’s vote. And the Governor here has tried to throw out the votes of hundreds of thousands of Floridians and overturn an election. If he gets away with it, what’s left of our democracy? What’s the point of having elections?”
Warren ran as a progressive when he unseated long-term incumbent Republican Mark Ober as Hillsborough county state attorney in 2016, and was re-elected with 53% of the vote four years later.
He immediately set about enacting policies that upset conservatives, the Tampa Bay Times reported, including a pledge to introduce programs to rehabilitate convicts and prevent recidivism.
According to Tampa’s Fox13, Susan Lopez, whom DeSantis appointed in Warren’s place, has already reversed several of his policies, including the reinstatement of a controversial law enforcement “bike-stop” measure that critics say unfairly targets minorities.

Republicans threaten to withdraw funding for an entire district if Memphis council reinstates Justin Pearson
MEMPHIS, Tenn. - A Shelby County commissioner told FOX13 on Friday that state leaders in Nashville are threatening to take away funding from Memphis and other Shelby County projects if the county commission decides to reinstate expelled state Rep. Justin J. Pearson.
Pearson (D-Memphis) and Justin Jones (D-Nashville) both were voted out of the Tennessee House of Representatives on Thursday.
The decision came a week after hundreds of protestors gathered at the Tennessee State Capitol to speak out against what they viewed as lax gun laws in the wake of a mass shooting at The Covenant School in Nashville that left three 9-year-olds and three adults dead.
As protestors gathered outside of the House walls, Pearson and Jones took part in a demonstration of their own on the House floor, using a bullhorn and political signs to speak out against lax gun laws. That demonstration prompted the votes which resulted in the two Democrats being expelled from the House.

Everything we know from Tyre Nichols' autopsy | News | fox13memphis.com
MEMPHIS, Tenn. - An official autopsy report from the medical examiner’s office not only confirms Tyre Nichols’s brutal beating, but it also goes into detail of how bad that damage was.
 The report ruled Nichols' death a homicide due to blunt force injuries to the head.
"The decedent was a 29-year-old man who was struck multiple times during a law enforcement encounter," the autopsy reads.  This is the full autopsy for Tyre Nichols.
Nichols died at 1:41 p.m. on Jan. 10, 2023, in police custody, three days after video captured five now former Memphis Police officers beating him with his hands held behind his back. 
According to the autopsy, the 29-year-old Nichols had blunt force injuries to the head and neck, including bruises on the brain tissue.
The report also states that Nichols had rotational/torsional injury of the brain, meaning that Nichols' brain suffered injuries from a rapid change of the rotational velocity of the head - something that can occur from taking a direct hit to the skull. 
While at the hospital, Nichols' brain was found to be bleeding, one brain hemorrhage, and he developed acute kidney injury and liver failure, the autopsy states  
There was also subscapular and subgaleal hemorrhages or bleeding in the space between Nichols skull and scalp, the report shows. 
Attorneys Ben Crump and Antonio Romanucci, representing Nichols' family, released the following statement after the report was made public. 
"Video of this killing stunned the world, and we are once again stunned to see it put into words by the medical examiner. Tyre suffered blunt force injuries to the head, neck, torso, and extremities by Memphis Police. The utter brutality of the deadly beating that Tyre suffered is once again highlighted in these official autopsy results - no part of this young man was spared as he was tortured to death by these officers." 
In an exclusive interview with FOX13, attorney Ben Crump told us why this report only strengthens the case for trial.
“The findings of the autopsy confirm what we saw in the video of Tyre Nichols being savagely beaten and brutalized by the MPD officers,” said Crump.
“It further underscores why we must have accountability because the tragedy to many in the community is how many instances of this brutality happened and they were not captured on video?”
Crump said these findings are the same as what his team saw from an independent autopsy done back in January.

Crump said for Nichols’ family, four months later, it’s still a tough pill to swallow: “This is something you’ll never get over – your child taken from this earth and this savage manner, the fact that he was so close to home, the fact that his last words were calling out for his mama, saying ‘I just wanna get home, I just wanna go home’, those are the words that will haunt everyone that saw that video forever.”
Nichols also suffered intramuscular hemorrhages to the head and neck. The report notes "extensive hemorrhage of the right temporo-parieto-occipital scalp".
The 29-year-old was taken to the hospital 27 minutes after emergency medical technicians arrived at the scene. 
Nichols' toxicology report shows that his BAC was 0.049 (less than the legal limit to drive in the State of Tennessee) and he had THC in his system. Other drugs, administered at the hospital, were also found. 
Other injuries Nichols suffered included blunt force injuries of the torso and other extremities as well as injuries from status post cardiopulmonary arrest and resuscitation, the autopsy shows. 
Tyre Nichols right eye is described in the report as being severely swelled and purple. Both eyes were reported to have bleeding underneath them. 
Cuts of different lengths were noted on Nichols' cheeks and lips. 
The report also noted bruising on the brain tissue in the regions of Tyre Nichols' brain which are considered a key areas for language comprehension and production, cognitive process of decision-making. 
Tyre Nichols suffered more bruising and cuts over his body, including to his neck, shoulders, buttocks, pectoral muscles, forearms, upper arms, knees and thighs. 
The autopsy noted "extensive ischemic necrosis" of the liver, a condition which can be caused by blunt force trauma. 
Nichols' body is described in the report as being "well-developed (and) well-nourished" with no track marks on his arms and no scars on his wrists. 
Five former Memphis Police officers have been charged with aggravated kidnapping and second-degree murder, among other charges, in Nichols' death.

Five former Memphis Police Department officers who authorities charged are responsible in the beating death of 29-year-old Tyre Nichols on Jan. 7 - a case that emotionally jolted the Memphis community and the nation - make their initial court appearance this morning.
Another officer, Preston Hemphill, was fired after an internal investigation by MPD but was not charged criminally in Nichols' death. 
A lieutenant present at the scene that night retired prior to his internal hearing. 
Three Memphis Fire Department employees were fired after an internal investigation into their actions on the night of Nichols' death. 
Crump said he wants legislation to go just beyond Memphis, even on a national scale.
So far, Memphis city council has passed six ordinances that are aimed towards police reform.

A Kroger distribution center employee has died on the job in Memphis amid hot working conditions, adding to a national debate in the US over the risk to workers during heatwaves. The worker was identified as Tony Rufus, members from his union announced. Leaders from Teamsters 667, the local labor union, said Rufus was trying to cool off in the produce section after becoming overheated on Friday night. Rufus worked in the salvage department, a part of the facility that did not have air conditioning. The Memphis police department found Rufus dead at 8.13pm. “Guys said he was dripping with sweat, asking for water,” union leader Maurice Wiggins told Fox13. Wiggins said Rufus died on a dock in front of his co-workers. His death comes after his union had been asking the company for more breaks, cooler temperatures and drinks other than just water.

A Seattle store worker turned the tables on an armed suspect during an attempted robbery on Monday, shooting and killing the would-be thief in an exchange of gunfire, authorities said.
The shooting happened around 4 p.m. at the King Smoke Shop in Seattle’s Ballard neighborhood, the Seattle Police Department said.
The 29-year-old male suspect attempted to rob the business at gunpoint and shot at the 38-year-old male employee, according to police.
The victim returned fire, according to authorities, forcing the suspect to flee from the store.
The victim was shot multiple times, FOX13 Seattle reported.
Police said he had non-life-threatening gunshot wounds and was rushed to Harborview Medical Center. No update on his condition was immediately available.
The suspect was found dead with gunshot wounds outside the business.
Police have yet to release the identities of the suspect and victim.
Community members had helped to provide medical care prior to the officers’ arrival.
Detectives are continuing to investigate the shooting.

Lola Mitchell, AKA Gangsta Boo a former member of Three 6 Mafia and a pioneer of female rap has died.

Lola Mitchell, 43, otherwise known as “Gangsta Boo” was found dead at approximately 4 p.m.
Gangsta Boo was the second woman member of the Memphis hip-hop group “Three 6 Mafia”.
FOX13 confirmed the news with 3 independent sources.
The cause of her death is still unknown at this time.
Fellow Three 6 Mafia member DJ Paul, posted on Instagram that Gangsta Boo died on Sunday (January 1) at the age of 43. 
DJ Paul didn’t write anything in his caption. Instead, he simply shared a photo of Gangsta Boo doing what she loved to do most—music. 
RIP Queen.
