Washington Post: Four key Republicans could vote against Puzder for labor secretary

Andrew Puzder, the fast-food executive whom President Trump nominated to be labor secretary, emerged Monday as Democrats’ last, best hope of defeating one of Trump’s Cabinet choices as four key Republicans are on the fence about his nomination.

The unenthusiastic reception from the Republican lawmakers comes after weeks of intense criticism from Democrats and liberal groups over workplace violations at Puzder’s restaurants Hardee’s and Carl’s Jr., sexually suggestive ads featuring bikini-clad models eating burgers, and his opposition to wage regulations. Puzder has also been accused of domestic abuse — an accusation that was later recanted — and has acknowledged hiring an undocumented worker for his home.

Puzder, 66, has faced the most early skepticism of any nominee besides Secretary of State Rex Tillerson and Education Secretary Betsy DeVos, who won confirmation. The Republican senators who were noncommittal about Puzder’s nomination on Monday — Susan Collins (Maine), Johnny Isakson (Ga.), Lisa Murkowski (Alaska) and Tim Scott (S.C.) — sit on the committee that will hold his confirmation hearing Thursday. If they oppose him, his nomination is all but certainly dead.

Even if Puzder makes it out of committee, his final status may come down to a tiebreaker vote from Vice President Mike Pence similar to what happened last week for Education Secretary Betsy DeVos. It is the latest reminder of the paradox of Trump’s Cabinet nominees — they have struggled for confirmation more than the nominees of any other administration in recent history, but criticism that might have in the past doomed a candidate’s chances may no longer prove decisive.

Some Republicans say they are willing to overlook issues related to undocumented workers or unpaid taxes for the opportunity to have a business-minded leader in the Labor Department. But the racy ads and domestic violence allegations may test some conservatives and women’s groups.

Collins said Monday that she has reviewed footage of an “Oprah Winfrey Show” interview with Puzder’s ex-wife, Lisa Fierstein, who once appeared in disguise on the program to discuss the multiple times, she says, that Puzder physically assaulted her in the 1980s. Fierstein retracted the allegations, and he has always denied that he abused her.

“I’m going to wait until the issues that have arisen are fully explored at his hearing,” Collins told reporters. “I am reviewing the other information that has come to light, and I’m sure all of this will be explored thoroughly,” she added, without specifying what information is of concern.

Collins’s revelation that senators have seen footage of Fierstein’s interview with Winfrey is notable, because Democrats and other organizations have been desperately seeking the footage for weeks in hopes of airing it and derailing Puzder’s nomination.

Sen. Lamar Alexander (R-Tenn.), who chairs the health committee, told reporters Monday that he worked with Sen. Patty Murray (Wash.), the committee’s top Democrat, to arrange for senators to view a tape of the episode. Alexander said he has not seen the segment himself but he does plan to vote to approve Puzder’s nomination.

“His former wife has said it was all not true,” Alexander said. “She has reiterated that in a heartfelt letter to members of the committee and has been willing to talk to members of the committee, so I don’t think that’s an issue.”

Puzder’s personal wealth has also earned scrutiny that has delayed his nomination for several weeks. Federal disclosure forms delivered to the Senate last week show that most of his wealth is tied to CKE Restaurants and that he plans to divest those holdings within six months if he is confirmed to lead the Labor Department.

The White House is standing by Puzder, declaring last week that he would be confirmed. Senate Majority Leader Mitch McConnell (R-Ky.) told reporters that he is “enthusiastically” supporting the nominee.

Some business groups are also joining top Republicans in fighting the criticism by urging senators to back the nomination. A coalition of trade groups, including the International Franchise Association, the National Restaurant Association and the National Retail Federation, sent a letter to senators Monday praising Puzder’s “business experience and policy acumen.” Statewide restaurant associations in Maine and Alaska sent separate letters to Collins and Murkowski asking for their support.

If confirmed, Puzder would be the first labor secretary since the Reagan era to come to the role without any public-service experience.

Puzder got his start in the fast-food industry working as a personal attorney for Carl Karcher, the founder of the Carl’s Jr. restaurant chain. He helped Karcher avoid bankruptcy and in 1997 became executive vice president and general counsel for CKE. He then became president and chief executive of CKE in 2000, and he currently oversees 75,000 workers in 3,750 locations.

Puzder has spent much of his career promoting the idea that businesses thrive better when the government doesn’t interfere. In interviews, speeches and op-eds, he has long argued that rules substantially increasing the minimum wage or expanding the number of people who qualify for overtime pay, for example, could drive up the cost of labor and decrease the number of jobs.

In an opinion piece for Forbes, he said that the Obama administration’s overtime rule would force employers to cut costs elsewhere and limit some workers’ schedules. During a Business Insider interview last year, Puzder said that because of rising labor costs, he would consider investing in machines to replace some workers, because “they never take a vacation, they never show up late, there’s never a slip-and-fall, or an age, sex, or race discrimination case.”

Labor groups and other critics say they are concerned about Puzder’s pure capitalist mind-set, noting that if confirmed, he may end up tilting the scales in favor of corporations.

But George Thompson, a spokesman for Puzder, said that if confirmed, Puzder would recuse himself from any business related to CKE and would remain impartial when it comes to rulemaking and enforcement.

Opponents also cite stories from employees at Hardee’s and Carl’s Jr. who allege they have had to work through breaks, not been paid for sick leave or been harassed on the job.

“He’s going to be essentially responsible for enforcing the same laws that he’s been breaking for years,” said Kendall Fells, national organizing director of the Fight for $15, a group advocating for a higher minimum wage that organized lunchtime protests Monday at CKE offices in St. Louis and Anaheim, Calif., as well as restaurant locations throughout the country.

Women’s groups, such as the National Women’s Law Center, and labor advocates question whether he will defend female workers, citing what they say are demeaning ads that feature models eating burgers in skimpy outfits. Puzder, however, has defended the campaign as “American” and characterized it as a strategy for luring “young, hungry guys.”

On Tuesday, the Campaign for Accountability, a nonprofit watchdog, will head to a Missouri state court for a status update on its efforts to unseal Puzder’s divorce records, arguing that the domestic violence allegations “raise serious concerns about his fitness” to be labor secretary.

Yet some businesses and Republicans say they look forward to having someone in the Labor Department who understands that regulations can force businesses to make tough calls.

“We don’t want our workers to feel like they’re not being paid a fair wage, but we want people to understand the ramifications of it,” said Peter Riggs, president of Pita Pit USA, a quick-service sandwich chain with about 600 locations in the United States and Canada. “He understands what we’re going through.”

Puzder’s fate will ultimately depend on whether his opponents can sway more than two Senate Republicans to vote against him.

The Republicans hesitating to publicly support him said they will make up their minds after the hearing.

“No real story here,” said a spokeswoman for Scott, noting that the senator hasn’t been commenting on nominees “until their confirmation hearing,” with the exception of fellow South Carolina Republicans Nikki Haley, nominated to serve as United Nations ambassador, and Rep. Mick Mulvaney, nominated to lead the Office of Management and Budget.

Consistent with his policy on other nominees, “Senator Isakson will make a final decision after Mr. Puzder’s confirmation hearing on Thursday,” a spokeswoman said via email.

Murkowski said she “will be working to learn more about Mr. Puzder leading up to and during the upcoming hearing, as well as through additional one-on-one conversations with him,” a spokeswoman said.

Tell the U.S. Senate: Oppose and resist anti-worker Puzder nomination.

Donald Trump’s nominee for labor secretary, Andrew Puzder, is a longtime sexist with an utter disdain for working people – a whole lot like Trump himself.1 And with his nomination hearing coming up soon, we’re running out of time to stop him.

Puzder hates the minimum wage and President Obama’s reforms to increase overtime pay. As CEO of CKE Restaurants, which includes Carl’s Jr. and Hardee’s, he has faced lawsuits for discrimination and for not paying employees what they are owed, known as wage theft. He is a former anti-abortion activist who is most famous for his company’s sexist commercials featuring bikini-clad women.2

Putting Puzder in charge of the Department of Labor is like making an arsonist fire chief. We need to make sure Republicans know there is a price to pay for supporting this radical of a candidate, and that Democrats do everything they can to oppose this nomination.

Tell the Senate: Oppose and resist anti-worker Puzder nomination.

Puzder is just about the opposite of what you want in a labor secretary:

Hates the minimum wage. Puzder is a longtime opponent of the minimum wage, even threatening to replace workers with robots if wages go up. He’s a CEO in a fast food industry that features far worse pay than other industries, even though his own salary is roughly 300 times the minimum wage.3

Accused of stealing from, mistreating and putting workers at risk. Puzder and his companies have faced – and settled – repeated lawsuits from workers, including claims of wage theft, discrimination, failure to provide breaks and dangerous workplace environments.4

Long history of sexism and anti-abortion activism. Puzder called his company’s sexist advertisements showing scantily clad women, some of which were too outlandish for TV, a reflection of his own personality. The ads are infamous, but Puzder’s leadership in the anti-abortion movement, including writing a restrictive, anti-abortion law in Missouri, is far more troubling.5

Opposes overtime pay. The last two administrations, Republican and Democrat, have both raised the overtime salary threshold to keep it up-to-date with expenses. But Puzder has promised to seek to deny millions raises by opposing the Obama administration’s overtime pay reforms. No surprise, coming from a man whose companies have been accused of denying employees earned overtime pay.6

Few Americans want a cruelly out-of-touch CEO looking out for them as labor secretary. We need to make Puzder as toxic as possible by speaking up loudly right now.

Tell the Senate: Oppose and resist anti-worker Puzder nomination.

The Department of Labor is supposed to protect working people, including taking action against companies that deny pay and put workers at risk. Puzder’s job will be to regulate the same fast-food industry that he just left – yet another blatant conflict of interest in the Trump administration.

Donald Trump is the most unpopular president-elect in modern history. We need to remind Republicans that his massive popular vote loss leaves him without any mandate to pick right-wing cronies and monsters from the same swamp he claims to want to drain. Even though the lack of filibuster means Democrats will have trouble blocking his nominations, if Democrats utilize any and all tactics to mount a fierce and uncompromising resistance to Puzder, it will help expose Trump’s radical right-wing agenda and further undermine his already meager support.

Washington (SIB) -Setelah melalui sidang dengar pendapat yang panjang, pencalonan Menteri Tenaga Kerja yang diajukan Presiden Donald Trump akhirnya dibatalkan. Andrew Puzder kehilangan dukungan sejumlah senator Partai Republik setelah ia mengaku mempekerjakan pendatang gelap sebagai pembantu di rumahnya. Sang miliarder makanan cepat saji itu juga dikecam atas ucapan-ucapan yang melecehkan sejumlah perempuan dan karyawan di restorannya. Ia menjadi calon menteri Trump pertama yang gagal memperoleh persetujuan senat. Dampak perceraian pada tahun 1980 juga merecokinya. (CNN)Andrew Puzder has withdrawn as President Donald Trump’s choice for labor secretary, a dramatic decision caused by a GOP revolt that claimed the first Cabinet nominee of the new administration.

Puzder, the CEO of the company that owns the Hardee’s and Carl’s Jr. fast food chains, faced fierce opposition mostly from Democrats in part related to his position on labor issues as well as the fact that he employed an undocumented immigrant housekeeper.

But Republicans too had grown weary of the range of liabilities facing Puzder, and senior GOP officials informed the White House Tuesday night and Wednesday that Puzder lacked a viable path for confirmation.

“After careful consideration and discussions with my family, I am withdrawing my nomination for Secretary of Labor,” Puzder said in a statement Wednesday afternoon. “I am honored to have been considered by President Donald Trump to lead the Department of Labor and put America’s workers and businesses back on a path to sustainable prosperity.

“I also thank my family and my many supporters — employees, businesses, friends and people who have voiced their praise and hopeful optimism for the policies and new thinking I would have brought to America as Secretary of Labor. While I won’t be serving in the administration, I fully support the President and his highly qualified team.”

The decision came as Senate Republicans told the White House he was losing support, a senior GOP source said, adding there were four firm Republican no votes and possibly up to 12.

Sen. Tim Scott, of South Carolina, was one of those Republicans who planned to vote against Puzder, saying he was worried about revelations involving Puzder paying employees in cash and the nominee’s comments about some of the American workforce.

In a statement Wednesday afternoon, Scott said he shared those concerns with Senate leadership and Tennessee’s Lamar Alexander, chairman of the HELP Committee.

“I look forward to meeting with a new nominee to lead the Department of Labor,” Scott said in a statement.

Sen. Johnny Isakson, a Republican from Georgia who was one of the firm “no” votes on Puzder, offered a briefer statement. “I respect Mr. Puzder’s decision.”

A third senator in the group, Alaska’s Lisa Murkowski, said she respects Puzder’s decision to withdraw. “This has been a difficult process for him and his family,” she said.

Alexander said he was still planning to vote in favor of Puzder before he dropped out. Asked if he felt any of the concerns raised about Puzder were warranted, Alexendar appeared to address Puzder’s hiring of the undocumented immigrant.

“He made a mistake,” Alexander said. “And in my view, he discovered it, he reported it, he took responsibility for it. He corrected it. And that’s about all you can do with a mistake. So I evaluate him and his whole life’s work, so I didn’t think that mistake should disqualify him from being a cabinet member.”

His team subsequently began to pull back from all their plans for the confirmation process. Puzder was scheduled to do extensive preparation Wednesday afternoon for his confirmation hearing before the Senate on Thursday, but canceled the so-called “murder board” after top Republicans spoke to the White House, a source close to Puzder told CNN.

Around the same time, sources on Capitol Hill were told Puzder was expected to cancel his confirmation hearing. And Puzder’s team told the White House that he did not want to go forward with the nomination if there was no clear path forward.

White House press secretary Sean Spicer confirmed Puzder’s decision, telling reporters simply, “he withdrew.”

Senate Democratic Leader Chuck Schumer fanned the flames behind the opposition to Puzder in a statement Wednesday afternoon.

“No matter how you cut it, there is no worse pick for labor secretary than Andrew Puzder, and I’m encouraged my Republican colleagues are starting to agree,” the New York Democrat said. “He does not belong anywhere near the Labor Department, let alone at the head of it. Puzder’s disdain for the American worker, the very people he would be responsible for protecting, is second to none.”

Fingerpointing among Republicans

The fingerpointing has already begun among Republicans.

GOP sources are privately pointing the finger at business groups for not giving political cover to Republicans. They say that they were swamped by labor groups and progressive forces looking to derail Puzder, while the business community sat on the sidelines.

A source said the unions have eaten “their lunch.”

“They literally were raising money in like $5,000 increments when millions were being spent against them,” one top GOP source says. “His entire support network made one TV ad that looked like a welcome video for new Hardee’s employees, which referred to “her” and “she” while praising the boss who hired them. Everyone knew he was in trouble weeks ago and even his strongest supporters and biggest beneficiaries of his point of view as labor nominee would not open their wallets.”

Ran into problems immediately

Puzder faced intense criticism since his appointment on December 8. Current and former employees spoke out against him from the start, and Democrats and labor activists attacked his record on worker rights.

The fast food executive has a long history of fighting against government regulation, a $15 minimum wage and the Affordable Care Act.

Decades ago, Puzder’s ex-wife, Lisa Fierstein, levied charges of domestic abuse against him, which she later dropped. She also appeared in disguise on Oprah Winfrey’s TV show to talk about domestic violence in 1990. In advance of Puzder’s scheduled hearing, senators privately reviewed the tape.

During the episode, Fierstein said Puzder told her, “I will see you in the gutter. This will never be over. You will pay for this,” according to Politico.

Senators were shown the video in the lead up to Puzder’s nomination fight.

In a letter to senators obtained by CNN, Fierstein said she regretted accusing Puzder of abuse during a rocky marriage.

Puzder has denied he abused his wife.

That hasn’t been the only issue. Last week, he admitted to having employed an undocumented immigrant as a housekeeper. He later said that he and his wife let the housekeeper go when they learned of her immigration status, and he said they paid back taxes on the employee and offered her help getting legal status.

Puzder’s own employees were some of the first to cry foul when he was nominated.

Last month, current and former workers at Hardee’s and Carl’s Jr. announced that they had filed 33 state and federal complaints against their employers. Charges include wage theft, manipulated overtime, sexual harassment and unfair labor practices.

All the complaints pertained to franchised locations that are independently operated. But the workers said they reflected poorly on a chief executive who hoped to lead the Labor Department.

A spokesman for CKE Restaurants said the company does not comment on pending litigation. The company also declined to comment on whether Puzder will stay on as CEO now that he has rescinded his nomination.

Puzder once called some of his Hardee’s employees “the worst of the worst,” according to reporting by CNN’s KFile. He was also criticized for past statements in support of replacing workers with robots.

“They’re always polite, they always upsell, they never take a vacation, they never show up late, there’s never a slip-and-fall, or an age, sex, or race discrimination case,” Puzder told Business Insider in March 2016.

It took weeks for senators to get Puzder’s financial disclosure information. He had promised to step down as CEO of the company, CKE Restaurants, if confirmed, and to divest his stake in 200 companies and funds.

Four Republicans withhold support for Puzder to head Labor

(Bloomberg) — At least four Senate Republicans, including Susan Collins of Maine, are withholding their support for Andy Puzder to run the U.S. Department of Labor.

President Donald Trump’s pick of Puzder, a fast-food executive, has run into resistance on Capitol Hill over his admission that he employed an undocumented housekeeper, among other issues.

“No, I haven’t,” Collins said when asked Monday if she had decided to back Puzder, whose confirmation hearing is scheduled for Thursday. “I’m going to wait until the issues that have arisen are fully explored at his hearing.”

Lisa Murkowski of Alaska, Tim Scott of South Carolina, and Johnny Isakson of Georgia are also withholding their backing for Puzder, saying they are waiting for the confirmation hearing. In the 52-48 Senate, three Republican defections would doom Puzder if all 48 Democrats vote to deny him.

The senators could still end up voting for Puzder.

The uncertainty over Puzder — head of the fast food conglomerate CKE Restaurants Inc. that includes Carl’s Jr. and Hardee’s — comes after a week that saw party-line confirmations in the Senate and a tie-breaking vote cast by Vice President Mike Pence for Education Secretary Betsy DeVos. That 51-50 tally was the first time a vice president has ever broken a tie on a cabinet nomination.

Tight votes

The Senate voted 52-47 last week to approve Attorney General Jeff Sessions, after a bitter day-long debate that saw Senate Majority leader Mitch McConnell silence Democrat Elizabeth Warren of Massachusetts. Days later, the Senate again split 52-47 in approving Rep. Tom Price to head the U.S. Department of Health and Human Services in a fight that stretched until 2:30 a.m.

McConnell, a Kentucky Republican, said allegations of hiring undocumented workers have at times sunk cabinet nominees, but not always.

“We’re always looking for nominees who have never made a mistake,” McConnell told reporters last week. “Frequently it’s impossible to find nominees who have never made a mistake. He realized the mistake. He fixed it and I think is eminently qualified for the job, and for myself, I’m enthusiastically in his camp.”

Puzder has agreed to divest an ownership stake worth as much as $50 million in the fast-food chain if he’s confirmed as the next labor secretary, according to his federal financial disclosure and ethics agreement. The agreement broke a logjam that had delayed four previously scheduled hearings.

Divorce records

In another issue for Puzder, a Missouri judge is slated to rule Tuesday — two days before his Senate confirmation hearing — on a liberal group’s motion to unseal records from Puzder’s 1987 divorce.

Opponents have seized on multiple news reports that Puzder had been accused by Lisa Fierstein, his first wife, of domestic abuse. Puzder has denied the allegations. Fierstein, in a Jan. 18 letter to lawmakers, said that she had made such allegations against Puzder but later withdrew them, saying “Andy is not and was not abusive or violent.”

Collins said she has since viewed an episode of Oprah Winfrey’s talk show dealing with domestic violence in which Fierstein appeared. “I am reviewing the other information that has come to light and I’m sure all of this has been explored thoroughly.”

Senate Minority Leader Chuck Schumer, a New York Democrat, on Monday called on Trump to withdraw the Puzder nomination.

Puzder “is so anti-working people that it’s appalling,” Schumer said. “Tonight there’s even consternation on the Republican side about his moving forward and I would urge President Trump to withdraw the nomination of Mr. Puzder for labor secretary.”

Warren, the Massachusetts Democrat, again emerged as a speed bump for Trump’s nominees, when she sent a 28-page letter Monday asking Puzder 83 questions about personal and business conflicts. Among other areas, she inquired whether he would be able to properly oversee businesses tied to Trump and also asked about Puzder’s stance against workplace protections that include health and safety standards and gender-and race-based discrimination.

“You’ve made your fortune by squeezing the very workers you’d be charged with protecting as labor secretary out of wages and benefits,” Warren wrote. “Your company’s record of prolific labor law abuses and discrimination suits — the most of any major burger chain — gives me great pause given that as labor secretary you’d be charged with enforcing these very laws.
