Spyware Maker NSO Promises Reform but Keeps Snooping
MUMBAI, India — Bela Bhatia, a human rights lawyer in the Indian state of Chhattisgarh, is accustomed to surveillance. She works in a region prone to both guerrilla violence and government reprisals, and the authorities do not like many of her clients.
Still, Ms. Bhatia said she was shocked to learn her phone had been infected with invasive spyware delivered through missed video calls on WhatsApp, a messaging service that is used by about 400 million people in India, WhatsApp’s biggest market.
“You are carrying the spy in the pocket with you everywhere you go,” she said. “It is much more than one had imagined that the Indian state could do.”
Ms. Bhatia is one of more than a hundred Indians who learned in recent months that every keystroke, call and GPS location on their phones had probably been recorded by the surveillance software, which is sold by the NSO Group, an Israeli firm.
NSO says its technology is licensed only to governments for combating terrorism and fighting crime. It also promises it won’t sell to governments with records of human rights abuses.
But the revelations from India over the last two weeks show that even countries with decent scores on global human rights indexes will use NSO technology to track journalists, critics and dissidents, digital rights activists said.
“This attack is a window into what happens when you give governments extralegal access to people’s communications,” said John Scott-Railton, a security researcher at the Citizen Lab, which worked closely with WhatsApp to uncover the attacks and notify the targets. “These tools will be used for all kinds of unaccountable espionage. The temptation for abuse is just too great.”
WhatsApp and its parent company, Facebook, filed a federal lawsuit against NSO last week seeking to block the Israeli firm from using their services. The suit says NSO abused WhatsApp by piggybacking on it to hack into the phones of 1,400 of its users around the world. More than 100 of the targets were human rights activists, journalists, religious leaders and dissidents.
The case is the latest in an avalanche of claims of abuse to emerge in recent years from the multibillion-dollar commercial spyware market, where governments — instead of protecting the privacy of consumers — are the paying clients.
At the center of these claims is NSO, which had pledged to move past its record of abetting human rights abuses and be in full compliance with the United Nations Guiding Principles on Business and Human Rights by October. That month, WhatsApp informed the 1,400 victims, which also included diplomats and senior government officials, that NSO had used its service to attack their phones.
The recent revelations offer a counternarrative to NSO’s stated support for transparency and human rights. The WhatsApp lawsuit contends that NSO’s spyware was used against dissidents and journalists in the United Arab Emirates and Mexico, two governments previously caught abusing NSO spyware. It also cites NSO’s use in Bahrain, a country where the human rights situation was deemed “dire” by Human Rights Watch.
In India, 121 WhatsApp users were targeted with NSO spyware, the messaging service said in a recent letter to the government. Of those, at least 22 were human rights activists, journalists and civil rights lawyers, according to a tally by the news site Scroll.in. A spokesman for the Indian National Congress, a leading opposition party, told reporters last weekend that WhatsApp had informed one of its top leaders, Priyanka Gandhi Vadra, that she was among the targets.
It’s not clear which government agencies in India purchased NSO’s spyware. The central government, led by Prime Minister Narendra Modi, has repeatedly criticized WhatsApp — not NSO or its clients — for the breach, but has declined to support calls by opposition parties for a full investigation into who bought and used the spyware.
Two clusters of Indians stood out on the target list. One group is active in working for human rights in Chhattisgarh, where the government has battled a Maoist insurgency for decades. The other has connections to left-leaning activists whom the government has accused of plotting to kill the prime minister and of inciting violence in Bhima Koregaon, near Mumbai, in 2017.
Ankit Grewal, a lawyer for Sudha Bharadwaj, who was arrested in the Bhima Koregaon case, said he started missing calls on WhatsApp last fall. In October, he learned that calls had infected his phone with NSO’s spyware even though he never picked them up.
“Now I see a pattern,” he said. “Other lawyers who were defending activists related to Bhima Koregaon and Chhattisgarh were being targeted. Who else but the government would do it, as we were targeted after the arrests of the activists?”
Santosh Bhartiya, a former member of Parliament and the editor in chief of the Hindi-language news site Chauthi Duniya, was more mystified as to why he was targeted. Although his news site is critical of the government, Mr. Bhartiya said, he is also well known to top government officials. “I am a journalist, but I am not that kind of journalist that people will do surveillance on,” he said.
Another target, Shu Choudhary, a former BBC journalist who has been active in Chhattisgarh peace talks, said he had become resigned to government surveillance. What disturbed him most was just how invasive and “vicious” NSO’s spyware proved to be.
“This is an illegal attack on our fundamental rights, but it’s nothing new,” Mr. Choudhary said. “It’s just that the scope of surveillance is much higher than anything we’ve experienced before.”
When asked about the targets in India, NSO repeated the statement it made when the WhatsApp lawsuit was announced: Its technology is used to fight crime and terrorism and is not licensed for spying on human rights activists and journalists.
Last June, the United Nations Special Rapporteur David Kaye called for an immediate moratorium on the sale of surveillance technology until rigorous human rights safeguards could be put in place.
But since the U.N. has no power to enforce a moratorium, spyware sales continued unabated. In September, NSO published new human rights and whistleblower policies that included a renewed commitment to due diligence and to contractually obligating its customers to restrict the use of NSO’s products to the investigation of crime and terrorism.
In response to NSO’s new policies, Mr. Kaye wrote a letter in October questioning how exactly the company planned to hold its clients to account when its spyware had been so readily misused and when it had no direct way of monitoring how governments deploy its products.
“The industry is incredibly opaque and the users are opaque,” Mr. Kaye said. “On both sides, the opacity makes it impossible to understand what’s going on in this space.”
Mr. Kaye and others said the WhatsApp lawsuit filed last week could be the beginning of checks in an industry that has had none. The lawsuit is the first case of a technology company holding another to account for exploiting its products for surveillance.
Although the Computer Fraud and Abuse Act, which was cited in the suit, does not apply to “lawfully authorized investigative, protective, or intelligence activity” by the government, there is no exception for private actors, like NSO.
“I imagine NSO Group is pretty worried about that,” Mr. Kaye said.
In a demonstration of how seriously it takes the case, Facebook started blocking NSO employees from their personal Facebook, WhatsApp and Instagram accounts last week, according to NSO employees’ posts in public web forums.
The people targeted with NSO’s technology said they do not expect the lawsuits to change their reality of being under near-constant government surveillance.
“In an ideal world, everything would be done legally, but we live in dangerous times,” said Mr. Choudhary. “We need to try to protect ourselves as much as we can.”

La Times: Appeals court declines to reinstate Trump's travel ban as his administration copes with its first major setback
President Trump grappled Saturday with the first major setback to his young administration, appearing to question the constitutional checks on his power after a judge’s order reopened the flow of travelers from seven mostly Muslim nations covered by his controversial travel ban.
The Department of Homeland Security said Saturday that it had suspended “any and all actions” related to Trump’s executive action after federal Judge James Robart issued a temporary restraining order, effective nationwide, in response to a lawsuit filed by the states of Washington and Minnesota. The suit argued that the president’s moves had amounted to religious discrimination against Muslims in violation of the U.S. Constitution.
On Saturday night, the Justice Department said it would appeal the order by Robart, an appointee of President George W. Bush who is now senior judge of the U.S. District for the Western District of Washington.
Early Sunday the 9th Circuit denied the request to immediately reinstate Trump’s travel ban, asking both sides to file arguments by Monday.
The issue may eventually end up at the Supreme Court. Several other federal courts have also issued emergency stays against portions of the executive order as dozens of lawsuits proceed against it.
In response to Robart’s restraining order, the State Department, which had “provisionally revoked” 60,000 visas since the president signed his Jan. 27 order, said Saturday that it had started reaccepting those visas from people in the countries affected.
Some travelers in countries affected by the suspension already were being allowed to board planes headed to the U.S., as foreign airlines started telling passengers Saturday that the immigration ban had been lifted. Many rushed to catch flights, worried that the window to travel might soon be closed again by courts.
At the airport in Boston, crowds had gathered at international arrivals to welcome those from the restricted countries. They held signs saying, “Refugees are welcome in the U.S.A,” “Christians build bridges, not walls” and “I am home and so are you.”
“We had more than 40 mostly Iranian nationals land and clear customs today. We’ve had Tunisians and Syrians too, all flying from Germany on Lufthansa,” said Kerry Doyle, an attorney with the American Immigration Lawyers Assn. who was posted at the airport.
Many visa holders had changed their plans to fly to Massachusetts even if it wasn’t their final destination because of an earlier Boston federal judge’s temporary order against Trump’s ban that was being applied locally when the national order came down from Seattle.
“It’s a whole different feeling at the airport than last week,” Doyle said.
Trump’s executive order, which also includes a temporary ban on most refugee admissions and indefinitely for Syrians, was one of several the president has signed since taking office as part of a White House strategy designed to begin implementing his governing vision with maximum impact.
But the torrid pace of action sparked an equally fierce public response that continued Saturday, including protests in Los Angeles and other cities. One march neared the gates of the Palm Beach, Fla., estate being branded as the “Winter White House” where Trump was spending the third weekend of his presidency.
Trump and his advisors had largely downplayed the confusion his order sparked and insisted it was on solid legal ground, even though on Monday he dismissed the acting attorney general who had told Justice Department attorneys to cease defending it in court.
Trump began Saturday with a series of tweets against Robart in which he blasted the “so-called judge” for a “ridiculous” opinion.
“What is our country coming to when a judge can halt a Homeland Security travel ban and anyone, even with bad intentions, can come into U.S.?” he asked later in another Twitter message.
Activists and state officials opposed to Trump’s order celebrated. “The law is a powerful thing. It has the ability to hold everyone accountable to it, and that includes the president of the United States,” Washington state Atty. Gen. Bob Ferguson said at a news conference after the court decision.
Democrats seized on Trump’s criticism of the judge as an opening in the emerging Senate confirmation battle over the president’s Supreme Court nominee.
Senate Minority Leader Charles E. Schumer of New York said Trump’s attack “shows a disdain for an independent judiciary that doesn’t always bend to his wishes.”
With every outburst, Schumer said, Trump just “raises the bar even higher” for federal Judge Neil Gorsuch’s nomination.
Democrats were quick to remind that this was not the first time Trump has singled out a judge, comparing it to his attacks during the campaign on American-born Judge Gonzalo Curiel of San Diego, who Trump said could not be impartial because of his Mexican heritage.
“Now he is attempting to bully and disparage yet another federal judge — this one appointed by a Republican president and confirmed by a Republican Senate — for having the audacity to do his job and apply the rule of the law,” said Sen. Patrick Leahy of Vermont, a Democrat and former chairman of the Senate Judiciary Committee. “The president’s hostility toward the rule of law is not just embarrassing, it is dangerous.”
Trump’s Republican allies in Congress remained largely silent over the court’s stay, and GOP leaders declined to respond to the president’s attacks on the judge.
Congressional leaders have been furious after being cut out of the White House’s planning and execution of the travel ban, and they continued Saturday scrambling to repair the chaotic rollout. Many lawmakers have been fielding frantic requests from constituents calling their offices and pleading for help for family members, students and others ensnared in the travel ban.
Some of the confusion surrounding Trump’s early moves has been attributed to a tight circle of decision-making in the White House, centered around senior policy advisor Stephen Miller and chief strategist Stephen K. Bannon.
But James Carafano, who oversaw national security planning during Trump’s transition, described a more deliberate approach that flowed from Trump’s own view of a security threat.
“People are kind of in shock and awe of the phenomenon so they’re running around coming up for explanations for it,” said Carafano, a national security and foreign policy analyst for the Heritage Foundation, a conservative think tank. “The notion that somehow they could have waited and done more vetting and talked to more people — and what? It would have been less controversial? Give me a break.
“They understood there was going to be some friction, but those things could be worked through,” he said. “And as a matter of fact, you’ve seen them working through this pretty quickly.”
After civil rights groups filed lawsuits on behalf of those who had green cards designating them as permanent legal residents, the Trump administration clarified that green-card holders would be exempt from the travel ban. Government officials also reversed a prior position this week and said that dual citizens who held citizenship from one nation that was not on the restricted list would be exempt, even if they also were citizens of a country on the list.

“We had more than 40 mostly Iranian nationals land and clear customs today. We’ve had Tunisians and Syrians too, all flying from Germany on Lufthansa,” said Kerry Doyle, an attorney with the American Immigration Lawyers Assn. who was posted at the airport.
Many visa holders had changed their plans to fly to Massachusetts even if it wasn’t their final destination because of an earlier Boston federal judge’s temporary order against Trump’s ban that was being applied locally when the national order came down from Seattle.
“It’s a whole different feeling at the airport than last week,” Doyle said.
Trump’s executive order, which also includes a temporary ban on most refugee admissions and indefinitely for Syrians, was one of several the president has signed since taking office as part of a White House strategy designed to begin implementing his governing vision with maximum impact.
But the torrid pace of action sparked an equally fierce public response that continued Saturday, including protests in Los Angeles and other cities. One march neared the gates of the Palm Beach, Fla., estate being branded as the “Winter White House” where Trump was spending the third weekend of his presidency.
Trump and his advisors had largely downplayed the confusion his order sparked and insisted it was on solid legal ground, even though on Monday he dismissed the acting attorney general who had told Justice Department attorneys to cease defending it in court.

“What is our country coming to when a judge can halt a Homeland Security travel ban and anyone, even with bad intentions, can come into U.S.?” he asked later in another Twitter message.
Activists and state officials opposed to Trump’s order celebrated. “The law is a powerful thing. It has the ability to hold everyone accountable to it, and that includes the president of the United States,” Washington state Atty. Gen. Bob Ferguson said at a news conference after the court decision.
Democrats seized on Trump’s criticism of the judge as an opening in the emerging Senate confirmation battle over the president’s Supreme Court nominee.
Senate Minority Leader Charles E. Schumer of New York said Trump’s attack “shows a disdain for an independent judiciary that doesn’t always bend to his wishes.”
With every outburst, Schumer said, Trump just “raises the bar even higher” for federal Judge Neil Gorsuch’s nomination.
Democrats were quick to remind that this was not the first time Trump has singled out a judge, comparing it to his attacks during the campaign on American-born Judge Gonzalo Curiel of San Diego, who Trump said could not be impartial because of his Mexican heritage.
“Now he is attempting to bully and disparage yet another federal judge — this one appointed by a Republican president and confirmed by a Republican Senate — for having the audacity to do his job and apply the rule of the law,” said Sen. Patrick Leahy of Vermont, a Democrat and former chairman of the Senate Judiciary Committee. “The president’s hostility toward the rule of law is not just embarrassing, it is dangerous.”
Trump’s Republican allies in Congress remained largely silent over the court’s stay, and GOP leaders declined to respond to the president’s attacks on the judge.
Congressional leaders have been furious after being cut out of the White House’s planning and execution of the travel ban, and they continued Saturday scrambling to repair the chaotic rollout. Many lawmakers have been fielding frantic requests from constituents calling their offices and pleading for help for family members, students and others ensnared in the travel ban.

After civil rights groups filed lawsuits on behalf of those who had green cards designating them as permanent legal residents, the Trump administration clarified that green-card holders would be exempt from the travel ban. Government officials also reversed a prior position this week and said that dual citizens who held citizenship from one nation that was not on the restricted list would be exempt, even if they also were citizens of a country on the list.

Some of the confusion surrounding Trump’s early moves has been attributed to a tight circle of decision-making in the White House, centered around senior policy advisor Stephen Miller and chief strategist Stephen K. Bannon.
But James Carafano, who oversaw national security planning during Trump’s transition, described a more deliberate approach that flowed from Trump’s own view of a security threat.
“People are kind of in shock and awe of the phenomenon so they’re running around coming up for explanations for it,” said Carafano, a national security and foreign policy analyst for the Heritage Foundation, a conservative think tank. “The notion that somehow they could have waited and done more vetting and talked to more people — and what? It would have been less controversial? Give me a break.
“They understood there was going to be some friction, but those things could be worked through,” he said. “And as a matter of fact, you’ve seen them working through this pretty quickly.”
After civil rights groups filed lawsuits on behalf of those who had green cards designating them as permanent legal residents, the Trump administration clarified that green-card holders would be exempt from the travel ban. Government officials also reversed a prior position this week and said that dual citizens who held citizenship from one nation that was not on the restricted list would be exempt, even if they also were citizens of a country on the list.

La Times: Trump's shock-and-awe strategy produces his first major setback
President Trump grappled Saturday with the first major setback to his young administration, appearing to question the constitutional checks on his power after a judge’s order reopened the flow of travelers from seven mostly Muslim nations covered by his controversial travel ban.
The Department of Homeland Security said Saturday that it had suspended “any and all actions” related to Trump’s executive action after federal Judge James Robart issued a temporary restraining order, effective nationwide, in response to a lawsuit filed by the states of Washington and Minnesota. The suit argued that the president’s moves had amounted to religious discrimination against Muslims in violation of the U.S. Constitution.
On Saturday night, the Justice Department said it would appeal the order by Robart, an appointee of President George W. Bush who is now senior judge of the U.S. District for the Western District of Washington. The case heads next to the 9th Circuit Court of Appeals in California and perhaps eventually the Supreme Court to decide whether Robart’s temporary restraining order should remain in effect. Several other federal courts have also issued emergency stays against portions of the executive order as dozens of lawsuits proceed against it.
In response to Robart’s restraining order, the State Department, which had “provisionally revoked” 60,000 visas since the president signed his Jan. 27 order, said Saturday that it had started reaccepting those visas from people in the countries affected.
Some travelers in countries affected by the suspension already were being allowed to board planes headed to the U.S., as foreign airlines started telling passengers Saturday that the immigration ban had been lifted. Many rushed to catch flights, worried that the window to travel might soon be closed again by courts.
At the airport in Boston, crowds had gathered at international arrivals to welcome those from the restricted countries. They held signs saying, “Refugees are welcome in the U.S.A,” “Christians build bridges, not walls” and “I am home and so are you.”
“We had more than 40 mostly Iranian nationals land and clear customs today. We’ve had Tunisians and Syrians too, all flying from Germany on Lufthansa,” said Kerry Doyle, an attorney with the American Immigration Lawyers Assn. who was posted at the airport.
Many visa holders had changed their plans to fly to Massachusetts even if it wasn’t their final destination because of an earlier Boston federal judge’s temporary order against Trump’s ban that was being applied locally when the national order came down from Seattle.
“It’s a whole different feeling at the airport than last week,” Doyle said.
Trump’s executive order, which also includes a temporary ban on most refugee admissions and indefinitely for Syrians, was one of several the president has signed since taking office as part of a White House strategy designed to begin implementing his governing vision with maximum impact.
But the torrid pace of action sparked an equally fierce public response that continued Saturday, including protests in Los Angeles and other cities. One march neared the gates of the Palm Beach, Fla., estate being branded as the “Winter White House” where Trump was spending the third weekend of his presidency.
Trump and his advisors had largely downplayed the confusion his order sparked and insisted it was on solid legal ground, even though on Monday he dismissed the acting attorney general who had told Justice Department attorneys to cease defending it in court.
Trump began Saturday with a series of tweets against Robart in which he blasted the “so-called judge” for a “ridiculous” opinion.
“What is our country coming to when a judge can halt a Homeland Security travel ban and anyone, even with bad intentions, can come into U.S.?” he asked later in another Twitter message.
Activists and state officials opposed to Trump’s order celebrated. “The law is a powerful thing. It has the ability to hold everyone accountable to it, and that includes the president of the United States,” Washington state Atty. Gen. Bob Ferguson said at a news conference after the court decision.
Democrats seized on Trump’s criticism of the judge as an opening in the emerging Senate confirmation battle over the president’s Supreme Court nominee.
Senate Minority Leader Charles E. Schumer of New York said Trump’s attack “shows a disdain for an independent judiciary that doesn’t always bend to his wishes.”
With every outburst, Schumer said, Trump just “raises the bar even higher” for federal Judge Neil Gorsuch’s nomination.
Democrats were quick to remind that this was not the first time Trump has singled out a judge, comparing it to his attacks during the campaign on American-born Judge Gonzalo Curiel of San Diego, who Trump said could not be impartial because of his Mexican heritage.
“Now he is attempting to bully and disparage yet another federal judge — this one appointed by a Republican president and confirmed by a Republican Senate — for having the audacity to do his job and apply the rule of the law,” said Sen.
