Judge Humberto Flores

This blog post concerns administrative law judge Humberto Flores (California Bar No. 84799). The opinions expressed are solely my own.
I allege that administrative law judge Humberto Flores crafted a Lanterman Act Fair Hearing [https://www.dds.ca.gov/general/appeals-complaints-comments/fair-hearings-complaint-process/] decision (No. 2015030338) which was biased in favor of the San Gabriel Pomona Regional Center [https://www.sgprc.org/]. The ultimate result of Judge Flores’ decision was the decompensation of my son Cavan Argila’s life. This included loss of employment, homelessness [https://sgprc.tumblr.com/post/160104975670/how-to-become-homeless-on-10000-a-month] and ultimately conservatorship by the State of California [https://sgprc.tumblr.com/post/667770604157616128/britney-spears-is-free-cavan-is-not].
In this blog post I document various aspects of this case in an attempt to seek justice for my son. I hope that my efforts will be of benefit for those who seek to create a more just system for our developmentally disabled children.
Background
As documented on this blog, my son Cavan, an intellectually disabled Deaf man, lived independently, in his own apartment, working as a truck unloader at WalMart. All of this changed on February 1, 2015 when the SGPRC terminated fourteen years of family provided services for Cavan. The SGPRC was unable to resume providing services for Cavan, with their own vendor, for nearly six weeks.
The failure of the SGPRC to provide services for my son for nearly six weeks became the issue of a fair hearing complaint filed by me. First, I wanted an administrative law judge to rule that a regional center could not simply stop providing services for a client without providing alternative services; this is a matter of clients’ health and safety. Second, I hoped that a judge would grant our family reimbursement for the limited services that we were able to provide over this transition period.
Judge Flores Decision
The face-to-face hearing was straight forward. The SGPRC and I agreed to the hearing issues. At the time the hearing ended the agreed to issues were:

I was stunned when I read Judge Flores decision and learned that he had changed the agreed to issues after the case was submitted. Judge Flores’ revised issues were:

Judge Flores then wrote a decision, based on his rewritten issues, which favored the San Gabriel Pomona Regional Center.
The Role of Judith Enright
I represented my son Cavan at this hearing. The SGPRC was represented by their long time attorney Judith Enright. I allege that Ms. Enright made false statements at this hearing. In fact, I subsequently filed a complaint with the California Bar Association [https://sgprc.tumblr.com/post/672870836065222656/who-is-judith-enright-and-why-should-you-care].
The Role of Disability Rights California
Early on in this process I contacted our Clients’ Rights Advocate, Aimee Delgado of Disability Rights California. Ms. Delgado came to my son’s apartment, accompanied by her assistant and an American Sign Language (ASL) interpreter. Sadly Ms. Delgado could not understand the sense of desperation in Cavan’s “voice” as he pleaded, through the ASL interpreter, for help so that he could keep his family provided services. Ms. Delgado told Cavan that she was unable to take on his case and that he should “cooperate with the regional center.”
Ultimately Disability Rights California filed a class action law suit against the Department of Developmental Services on behalf of all Deaf regional center clients, including Cavan [https://sgprc.tumblr.com/post/617780793210716160/dds-target-of-class-action-law-suit].
Lessons Learned
Regional centers are not government agencies and their workers are not government employees. If regional centers satisfy their contractual obligations under the Lanterman Act it is because they choose to do so. If regional centers fail to meet their obligations under the Lanterman Act they can use tax payer funds to thwart accountability. Most aggrieved parents will never have the resources to find justice for their children in this one-sided system.
Another lesson learned is that those appointed to protect our children’s rights, such as Disability Rights California, may choose, at their discretion, to not “get involved.”
Today my son, Cavan Argila, resides in a group home. Cavan is not employed. His days are spent being bussed to various parks and shopping malls – they call it his “day program.” The State of California is his conservator. His life as an independent Deaf man is over. I will continue to do what I can to bring justice to my son’s life.

Aimee era una pequeña niña rubia de 11 años, esta estaba en Freddy's fazbear Pizza con su mejor amiga Mary Jo, una alocada chica regordeta con el pelo suelto y muy ruidosa, a Aimee no le gustaba el ruido y preferia estar a solas leyendo en su casa, pero Mary Jo era muy mandona y siempre hacian lo que querian. Aimee a veces pensaba que le gustaria dejar de ser su amiga, pero no podia, demasiado gente le habia dado la patada, segun su madre, los padres de Mary Jo se casaron muy jovenes, haciendo que antes de que Mary Jo naciera su padre las dejara, su madre intento cuidarla lo mejor que puro, pero cuando la niña tuvo 5 años la abandono, desde entonces Mary Jo ha estado en 5 casas de acogida distinta. Aimee incluso les pidio a sus padres que la adoptaran mas de una vez, tenian una situacion economica mas que estable, sin embargo, no tenian los "recursos" suficientes, siendo estos no el dinero, sino la paciencia. Una vez acabararon de comer Mary Jo propuso ir al Hiding Maze, tambien conocido como Freddy's Hiding Maze, una atraccion bastante desconocida y divertida de Freddy's, para entrar habia que meterse en un ducto de ventilacion color arcoiris, esto eran un monton de tuneles interconectados por toooooda la pizzeria y repleta de cubiculos donde los niños podian esconderse, estos estaban decorados como un bosque, habiendo decoracion de arboles, ramitas, incluso un olor a Pino, las puertas de los cubiculos eran de madera y recordaban a casitas de Elfos, y habian sonidos de ambiente de lluvia y viento, era como ir a otro mundo. Mientras iban al Hiding Maze Aimee se fijo como habia un hombre extraño, muy delgado, con pelo largo, ojos palidos, y con una sonrisa aterradora que mostraba sus dientes amarillos, esto asusto a Aimee, mientras Mary Jo, ruidosa como siempre le gritaba diciendo que era un perturbado, el hombre se fue. El Hiding Maze era un juego para dos personas: El jugador 1 y el Jugador 2, y habia una partida en proceso, asi que les tocaba esperar, Aimee siempre queria ser el jugador 2 para esconderse y leer un libro tranquila mientras Mary Jo le buscaba, pero esta vez Mary Jo propuso que ella sea la jugador 1, por lo que Aimee debia buscarla. El juego empezo, las niñas registraron sus nombres y mientras Aimee esperaba, Mary Jo iba a los tuneles a esconderse, las reglas eran sencillas, cuando el jugador 2 entraba en un cubiculo, la mitad de las puertas se cerraban y las otras se abrian, cada vez que el jugador abria una puerta las puertas se intercambiaban siendo que la mitad abierta se cerraba y viceversa. Cada puerta tenia un cristal con un vidrio especial, quien estaba dentro del cubiculo podia ver el otro lado, mientras quien veia fuera solo veia su propio reflejo, Aimee empezo a jugar, notando la suciedad de los tuneles, esta claro que no hacian mantenimiento aqui pues seguramente ni los empleados recordaban el lugar, habia calcetines, tenedores de plastico, incluso Aimee una vez perdio alli la pulsera de la amistad que Mary Jo le hizo. Tras un rato buscando, Aimee se sintio mal y decidio ir a la entrada para pulsar el boton de rendirse que daba la victoria al jugador 2 y abria todas las compuertas, pero al asomarse vio a aquel hombre extraño, Aimee huyo y dejo a Mary Jo, estaria a salvo en su escondite. *** Han pasado 10 años, es el aniversario de la desaparicion de Mary Jo, y Aimee como siempre tiene pesadillas con ello, esta esta a punto de acabar los examenes de la universidad y va a volver a su antigua ciudad a confrontar a Emmet Tucker, el hombre que vio aquella vez. El dia que Mary Jo desaparecio, ese mismo hombre fue arrestado por intento de secuestro, pero no habia pruebas de que el se llevara a Mary Jo, aunque Aimee sabia que era el, este habia sido liberado ahora por buena conducta y eso ponia a Aimee enferma. Greta, la rica nueva mejor amiga de Aimee de ojos verdes y pelo rojizo con dos coletas (Si, parece Eleanor, lo se, pero no es ella) , y una practicante en psicologia le insistia en que no se culpe por ello, que debia pasar pagina, pero Aimee no se iba a rendir, iba a honrar la memoria de su amiga. Tras una investigacion Aimee encontro a Tucker en una cafeteria que frecuentaba, ahora con el pelo rapado al cero, unas cicatrices en la mejilla y faltandole algunos dientes. Aimee lo siguio hasta su casa, una casa movil, esta lo confronto y le pidio que le contara lo que le hizo a su amiga, este le pidio que se sentara en el porche y le contaria todo: El las vio, pero el nunca se llevo a Mary Jo, el estaba buscando a su hija Lilly para llevarsela, pues su exmujer tenia la custodia, de ahi el intento de secuestro, pero Aimee no creia eso y intento a atacar a Emmet con su taser, esto le enfurecio y encerro a Aimee en su baño mientras llamaba a la policia. Aimee escapo por la ventanilla del baño y huyo de la escena, si Emmet no iba a confesar buscaria pruebas en el lugar donde Mary Jo fue vista por ultima vez. *** Aimee fue a Freddy's el local cerro al mes despues de desaparecer Mary Jo, y al parecer fue comprado por unos granjeros que abrieron su propio restaurante de tematica vacuna, con suelo verde, paredes decorada como una granja, su nombre era Flo's Fabulous Eatery. Aimee entro y fue atendida por una mujer llamada Mary, una cruel broma del destino, Aimee pidio una cola y se marcho al baño, intentando recordar donde deberia estar el Hiding Maze, este estaba en un armario de suministros, una vez dentro se dirigio a la pantalla del juego y para su sorpresa, por 10 años nadie mas habia jugado, ellas eran las ultimas. Aimee activo el boton de give up el cual dio error, aunque por suerte las luces de los tuneles se encendieron, Aimee gateo y gateo por los tuneles hasta que le parecio ver un reflejo en un cubiculo, al entrar vio que era la pulsera de la amistad que perdio hace años, pero de repente su cubiculo se cerro. La voz de freddy sono: "El jugador 2 ha encontrado un escondite, jugador 1 encuentra al jugador 2" La mitad de las puertas se abrieron, y alli, Aimee descubrio el destino de Mary Jo, desde la ventana, en el cubiculo delante del suyo pudo verlo, el cadaver momificado de Mary Jo, abrazando fuertemente su mochila, ella nunca fue secuestrada, estuvo alli por unos largos 10 años, muerta. Aimee intento salir dando patadas, pero la puerta no cedia, y el espacio era muy pequeño para hacer un impulso con las piernas, Aimee grito y grito, esperando que alguien la oyera, porque sino ella acabaria como su antigua amiga. *** Mary observo como la mesa seguia vacia, la cola ya tenia el hielo derretido y perdio el gas, la mujer debe de haberse marchado, asi que limpio la mesa y decidio atender a sus siguientes clientes. Desde la ventilacion de los baños podian oirse un sonido, eran los gritos de Aimee pidiendo auxilio, pero eran muy flojos para ser escuchados, y la musica del local lo tapaba... nadie iba a oirla...

Biography:

As long as Aileen could remember, her parents had been nothing but cruel to her and to each other. There seemed to be utterly no love lost between them and they fought all the time. Apart from fighting with each other though, the couple had the habit of also taking their anger out on her, as well as the other kids they fostered. She grew up in fear, scared that any moment her mother could lose her temper or her dad would raise his hand. There was little her uncles and aunts could do to help but they did their very best. As she grew up, her fear of her parents turned into hate and as soon as she was eighteen, she ran away from home not returning to Wakefield till a few years ago when she filed a case against them and outed how they treated the kids they took in. Now that both her parents were dead (her mother a few years ago and now her father) she has come back home to take back the life which they stole from her.
