Page 2. ---- Roused at End of Line, Man Wouldn't Get Off, Court Told ---- NEEDED 5 STITCHES ---- "A" Police Court, at City Hall, Magistrate Browne Fourteen days in jail was the penalty given George A. Rowan, after he pleaded guilty of assaulting R. Herron, a T.T.C. operator.
Complainant said accused was on his street car yesterday afternoon. "I aroused haim at the end of the Danforth line. He would not get off. On the way hack I got a constable and as the accused was getting off he struck me in the eye. Five stitches were required to close the wound," said Mr. Herron.
"Citizens have a right to protection from drunks or anyone else," said the court.
ROBS MOTHER, JAILED There is something wrong when a mother comes here and testifies against her son." remarked Magistrate Browne to Donald Mackay, after he admitted stealing $12 from his mother. The mother said her son would not do what he was told. "He stays out nights and is keeping bad company. He took the $12 from the house. His father is in the navy," she said.
"I would like a chance," pleaded MacKay.
"You do not deserve a chance," replied court, imposing a term of three months definite and three indefinite.
As the result of an accident on Queen St. at Waverley Rd., the evening of Aug 5, when Mrs. W. Burke, her husband, and others were knocked down, and fatal injuries were received by Mr. and Mrs. Burke, George Middleton faces a charge of manslaughter. He elected trial by jury and was committed.
Duke Watson said he was leaving a theatre and was crossing the street. "I heard a crash and saw four people knocked down. The auto continued east," he stated.
Albert Blackman said he was with Middleton. He admitted that he saw the car strike down two or more people. "We continued east and turned south and east, and the car stalled. I told Middleton that we should go back." he said.
Blackman said that just prior to the accident they were in a beer parlor drinking beer.
HAD WRONG CARD ---- County Police Court, County Buildings, Magistrate Keith. Sapper George A. Steele, listed as absent without leave from the army since April, was today convicted by Magistrate Keith of possession of a national registration card issued to another person. He was fined $5 and costs, or five days, and will be turned over to military authorities.
"There is no explanation as to how you came by this card or why you have it," said his worship. Steele and two other youth, Miles Morgan and Edward Wood originally arrested by York county police and charged with theft of a saddle from Diamond F Ranch. All three were up for judgment.
Steele was acquitted today on the theft accusation. The other two were convicted and fined $23 plus costs, or 10 days each.
"This is another case where a driver needing tires can't get them, so he takes them from somebody else." Crown Counsel George Gard- home said, when Nelson Arnold, 27, of Enderby Rd., was convicted of theft of three used Ures. Arnold was fined $25 and costs, or 15 days.
Detective Harold Speight of East York said the tires were taken as they lay outside the residence of Mrs. E Cook, Lumsden Ave. He added he had searched Arnold's molds the time from his cellar and a third on Arnold's car.
Paul Hinds, defence counsel, pleaded for leniency, stating that accused was a married man and had been working steady at his present job for a year a half.
YOUTH TAKES BLAME --- "B" Police Court, City Hall. Magistrate Gullen. When Kenneth Killins and Edward Bell, two youths who last week pleaded guilty guilty to three charges of housebreaking appeared for sentence today, Killins asked to be allowed to make a statement. "I just want to say that I led Bell and the girl into this wrongdoing." said Killins. "Bell, this is a serious matter and it is not a case for suspended sentence," said his worship. "You will be sentenced to three months definite and three months indefinite. Killins, you were in trouble last year. You will be sentenced to 18 months imprisonment."
"This is your first offence and I believe you have had a difficult time, in life," said his worship to the young woman who appeared for sentence on a charge of receiving some jewelry taken from the three houses by Bell and Killins. "You will be given suspended sentence and probation for one year."
At hearing of her case the young woman stated she had tried to dissuade Killins from his actions.
Appearing for sentence on a charge of false pretences and two charges of theft, Francis A. Cornfoat, who admitted a record, got nine months definite and three months indefinite.
"You will be sentenced to four months definite and three months indefinite," the court told Egor Motelanez, appearing for sentence for having a registration card other than his own and for two charges of theft of clothing and jewelry. "You are no longer wanted in the air force," added his worship.
HIT WIFE, FINED $25 ---- "C" and "D" Courts, at City Hall, Magistrate Pritchard. "He poked me in the chest with his elbow and struck me twice on the right arm. Then he hit me on the right arm. Then he hit me on the head with his fist,' said Mrs. A. Sykes, testifying against her husband David Edward Sykes, who pleaded not guilty of assaulting and beating a female.
Mrs. Sykes said that on Aug. 20 Sykes came home. He had been drinking, she stated. They quarrelled and accused struck her. "I didn't strike her I caught her by the arm. She easily bruises," said Sykes. He admitted poking complainant with his elbow, but pleaded his wife was always nagging him.
"You don't deserve much sympathy," remarked his worship fining secured $20 and costs or one month.
Willard H. Stone charged with auto theft, war committed for trial.
John Nesbitt testified the car he drives for his employer had been stolen from Simcoe St. where he had parked it. He identified a sweater as one which he had left in the car.
Acting Detective Donland stated he had arrested accused after a chase in which the stolen car had crashed into a pole. Accused was wearing the sweater, said witness.

Page 2. ---- Frederick Oeser, Bowmanville Fugitive, Offers No Resistance at Belleville --- CARRIED 4 KNIVES ---- The vigilance of the C.N.R. yardman in the Belleville train yards today brought about the capture of Frederich Oeser, German prisoner who escaped from an internment camp yesterday. Oeser is being held in the Belleville police station where he is described as "an amiable guy" and made no fuss either at the time of his arrest or since.
According to police, the yardman, Lawrence Amo of Belleville, noticed a man hiding in the gondola of a freight train filled with war materials. He asked him for his registration certificate and the man replied he didn't have one. but said he was going on to Brockville.
"You had better come with me." Amos is quoted as saying and the German went with him to the train office. He was turned over to Special Agent Hendrick of the C.N.R., Sergt. Arthur Boothe and Constable F. Campbell of the Belleville police.
When he was searched, Oeser had on him 13 five cent chocolate bars and three large chocolate bars weighing about a pound. He also had on him part of a bologna loaf and four knives, one of which was a dinner knife and had been notched to make a saw. Also on him was. a German-English dictionary.
Prisoner Looked "Very Young" "He was sitting there dozing and he didn't look more than 18 years old., said a woman who sat across from Eberhard Wildermutch, picked up first in the general waiting-room at the Union station. "He looked very young."
She described him as being "fairly short" and of fair complexion. "He was all by himself, and he acted as if he couldn't keep his eyes open. He kept nodding. I think he was wearing a windbreaker, and he had a sort of little knapsack with him. I didn't really pay any attention to him until the soldiers walked up to him and said. 'Come along with us. He didn't put up a struggle, he just went along."
She said she didn't know how long the man had been there, but long the man had been there, but that she had noticed him only a few minutes before.
Gateman George Billings rushed to the telephone to call R.C.M.P. as soon as Wildermutch admitted he was the escaped prisoner. Lance-Corp. Frank Ingram took him to the military police office in the station, where he was held pending the arrival of R.C.M.P. Det.-Sergt. John Nimmo, who captured Lieut. Commander Gunther Kray of the Ger- man navy in November, 1940. at the Union station after he escaped from Gravenhurst camp, rushed to the station with Detective Edmund Tong. They formed part of the guard to take the Nazi to the nearby headquarters of the R.C.M.P.
A train was not scheduled to leave until shortly after 1 p.m.
Wanted to Be Caught "He seemed to me as though he wanted to be caught," remarked Billings.
Certain He Was Prisoner It was in the Oak room at the west of the Union Station that Lance Corpl. Ingram first caught glimpse of Wildermutch.
"He was sitting back in the corner," he said. "I almost passed. Then I caught a glimpse of him. He started to walk away. I took a look around to see where his partner was. I was certain then he was one of the escaped prisoners."
The lance corporal produced the article and two pictures of the escaped men from The Star. He had been an observer overseas in the great war. attached to the observation corps of the Canadian Corps.
Finally. Ingram said, he went over to the German and questioned him.
"He said he came from Boston and that his accent was Norwegian. I asked him for his papers. He produced some papers from his inside coat pocket. but I had enough experience in the R.C.M.P. at Windsor customs to know these were not the right papers. I asked him for his registration card and he did not have one. I took him down to the military police office in the station." Finally Wildermutch said: "I know who you think I am." Ingram said: 'I told him. You're an escaped German prisoner. 'All right. You've got me, said the German." Ingram was stationed at a prison camp in Northern Ontario, from March to September, 1941. The lance-corporal knew his Germans, he said. Send Them Up North Oeser will be brought to R.C.M.P. headquarters in Toronto and both men, it is reported. will be transferred to another camp in Northern Ontario.
The prisoners escaped yesterday in a packing case. Preparations were being made to move prisoners., from the camp because of overcrowding. Both men are just five feet four and a quarter inches in height, and are said to be the by smallest in the camp. The crates were taken out Wednesday night and loaded on a baggage car. The prisoners hammered their way out during the night.
