Holy shit yes. I read a lot as a kid. I went through so many books that I started reading my parents sci fi novels when I ran out of my own stuff to read. Their books were absolutely not intended for kids and my parents didn't realize I was reading them. Some of the content in those books was so abusive and misogynistic that it would be shocking to read even as an adult (my parents were horrified when they found out I had read them). There were no warnings beforehand; no author note letting you know what pages to skip and where to come back in if need be. Current fanfic etiquette that provides these warnings is an absolute improvement. If you heed content warnings and tags, for the most part you can curate a good experience for yourself.
That last part is key though; for YOURSELF. It is up to you to identify what content you want to engage in. The person next to you may have an entirely different comfort level than you and that's not a bad thing. Insisting that no one should have access to content you personally don't want to engage with? Yeah, that's the bad part. You don't get to say what other people should create, read or like based solely on your tastes. Especially content that is provided for free. Find yourself in a fic you suddenly don't like? Hit that back button and move on to the next one.
after seeing yet another huge post where young people rail against AO3 and older people have to explain that censorship is bad actually, I gotta say that as someone who reads a fuck ton of books a year, these younger people could really benefit from doing the same for a little perspective. fucked up content is not just a fanfic thing, and with books, you don't get any warnings! you just turn the page and gaze upon the most fucked up scene of your life! these people do not know how good they've got it tbh just filter tags my lieges

I got into comics because of Tim Drake. His struggles with school/friends/building self confidence were so relateable to me at the time. That he could struggle and also be a hero saving people was really inspiring.
This new layer to Tim Drake does not detract from the character I so deeply resonated with; it builds upon it. I hope more readers resonate with his character/story and find hope and inspiration like I did.
Not the best at colour but felt I needed to commemorate today

Tumblr is NOT saying it is legal to monetize fanworks. Tumblr IS saying do what you want at your own damn risk and we aren't going to help you if you get into legal trouble.
some very important info re: paid accounts~
I am not a lawyer, but I can decently interpret legalese and, being as I also suffer from tl;dr syndrome and assume others may as well, I took one for the team and went through the updated TOS for the post+ accounts and highlighted (what I understand to be) the most pertinent information, which ultimately comes down to this:
You cannot monetize copyrighted works (aka charge and earn money from fanfic, fanworks, etc) and if you do decide to put your fanworks behind a paywall via Tumblr, when you are inevitably sued, Tumblr will not protect you and will not defend you and you alone, personally, will be responsible for whatever monetary damages said lawsuit results in.
If anyone is a lawyer and knows I've gotten any of this wrong, please do not hesitate to correct me/this post.
Screenshots taken from Tumblr's TOS (updated 7-21-21), Stripe's Account Agreement, and the post+ FAQs.
1. Your paid account will not be hosted by tumblr; it is routed through a 3rd party.
Tumblr media
2. By signing up for a paid account, you're entering into an agreement with Stripe, so in addition to Tumblr's TOS, you are also bound to Stripe's TOS.
Tumblr media
3. Stripe, like Tumblr, will not defend you or protect you against any lawsuits.
Tumblr media
4. Furthermore, you may end up owing Stripe money (indemnify = compensate)
Tumblr media
5. Tumblr's TOS specifically states that you can't put any content on your post+ account that violates any laws, including laws that protect intellectual property rights of others. This is super important, because Tumblr's post+ FAQ also states that you can post anything that you would regularly post on tumblr, which I'm sure many will take to mean that gifsets, fanworks, etc are fair game, since all of that stuff can be posted on tumblr now. However, the difference is, you're not making money from the fanworks you're posting or reblogging now. Once money enters the equation, the game changes.
Tumblr media Tumblr media
Tumblr is making it seem like any and all content goes for post+ accounts, knowing 90% of this site is fanworks. This is not true and you'll be opening yourself up for lawsuits if you charge for fanworks.
6. Tumblr further disclaims any and all liability in any legal issues.
Tumblr media
tl;dr: Please do not make a post+ account, bc you will be opening yourself to lawsuits and if that happens, Tumblr's response will be not our problem, you agreed to all the terms which said you couldn't do that, sorry not sorry. Please protect yourself.

This is wild. I remember the days when every fanfic (including my own) started with a disclaimer that the author did not own the characters, but was merely 'playing in the sandbox' as it were. Many went further to state they were receiving no compensation for their works. And all you could do after that was keep your fingers crossed that the actual IP owner didn't notice/sue you.
But now we're trying to monetize it? I'm sure nothing can go wrong there.
Please please please refrain from paywalling any sort of fanfic. The lack of monetary gain from fanfiction is one of the core reasons we are legally allowed to create/share/read it.
Fair Use doesn't entirely hinge on whether or not we are earning money, but it is one of the biggest factors a court will consider.
The OTW (company responsible for our ability to legally create fanfic; also owns Ao3) already does so much for us legally, and we absolutely do not need to make their job any harder.

The house next door is for sale and I've been watching the potential buyers come through all weekend. I wonder which lucky couple/family I'll be awkwardly waving at or ducking into my car to avoid conversing with until one or both us moves or dies.
