Sacred Song (Post 101) 8-12-15

Natalie and I have continued our game of YouTube tag throughout the last several weeks. It passed the time nicely on our Maryland excursion, but we have also found that it is pretty fun to play on short expeditions as well. The pop music stations that Natalie prefers become drearily repetitious when we don’t break things up, although it is entertaining to listen to her accompany the artist as a background singer. Sometimes Nicholas sings along to his music as well, but I probably shouldn’t disclose that. Playing music on YouTube instead means that I can intertwine songs that I like in between the sandwich ends of inevitable Taylor Swift anthems.

One night last week we carried the game of tune tit-for-tat that we were playing on our phone into the house, across the kitchen and to the breakfast table where my mother was getting ready to serve my father his supper. Curious and knowing that he likes all things Gaelic, I pulled up a video of a scene from the movie Empire of the Sun in which a young British lad stands at attention and salutes through the barbed wire fence of a Japanese internment camp singing the Welsh lullaby Suo Gan as zeros takeoff into the sun. For me Suo Gan is a particularly haunting song because the melody is the same as the hymn Christ Before Us which I first encountered on my Emmaus weekend nearly two years ago. Hearing a particular hymn at a peculiarly emotional time can add a spiritual impact to a song for a specific person that it may not have for other people. Morning Has Broken can similarly bring tears to my eyes, because it was sung at Pam’s funeral service.

As it turned out my father’s love of Gaelic music did not include any special feelings towards the Welsh classic, but we did share some memories about walking into an English church in some town that I could not recall where we arrived just in time for an afternoon rehearsal of the parish boys’ choir. They were very talented. The idea of pulling up hymns on YouTube did intrigue my father, surprisingly. He asked me to play Jesus I Come for him, which, he explained, was the hymn they were playing at the Tremont Baptist Church when he entered there for the first time. My mother had evidently invited him to her church when they were dating. My father agreed; he would have also probably agreed to try bungee jumping had my mother suggested it and that particular form of stupidity existed anywhere else other than in the Australian outback at the time of their 1960’s courtship. Instead of the Sunday morning’s boredom that my father probably expected, he experienced a powerful intervention by the Holy Spirit into his life through the gateway of a beautiful hymn sung by a talented choir.

So I searched his request, queued up the hymn, hit play and passed him his favorite sacred music on the little midget screen of the IPhone5 that I most often use for scrolling Facebook. Although the music didn’t sound special to me, it caught my 78 year old father like fly-paper. He sat transfixed at the breakfast table totally oblivious to me and to the usual bustle of my family interacting about our kitchen at dinner time. The kids could have been having chicken fights and he would not have noticed. As far as I could tell, my father was 650 miles and 60 years eastward sitting in a pew in a famous New England church with the girl he loved, encountering awesome beauty of Jesus Christ sung about him by angelic voices. I wished that he could stay there for longer than the odd five minutes of the hymn. I envied him. For a time he was through the looking glass or had tumbled through the fur coats of the magic wardrobe that I often hope to find but rarely do.

You would think that it would be easier to have that type of heavenly experience than it usually turns out to be. I had hoped for a trip back through the years to simpler times on the family excursion we took to a Cleveland Indians game last Friday night. Nicholas, Natalie, Stephen and I made the trip, but it didn’t turn out quite as I had planned. First of all I was very tired, having worked some early and long days on Monday through Thursday completing a project that we had begun almost a month before. Things were also progressing well with our house purchase. It seemed like a good chance for some family-style rest and relaxation. Also the Tribe was having a dollar hot dog night promotion with a fireworks show as a nightcap. Our plan seemed all in order.

Like a good father, I had wielded the proposed trip as a motivating sledgehammer thought the preceding week. Stephen, for instance, because of his illness, habitually complains about small or imagined injuries like blackouts and falling out of bed on a near continual basis. The last week he had added mysterious arm stiffness to his list of hypochondriac symptoms. Whenever I offered to delay our trip until he felt better, his maladies made an immediate improvement. Stephen is gravitationally attracted towards quality meat products at entirely too reasonable a price-point. He is not above taste testing gas station sushi so dollar hot dog night is right up his alley.

Natalie was also on her best behavior throughout the week. She was quite excited on Friday night when I arrived home from the boomerang ride of my Youngstown round trip. That is when the threads of my carefully woven plan began to unravel. I had arrived home early and, unfortunately, exhausted, hoping to catch a quick cat-nap before H hour. Unbeknownst to me, Nicholas had committed me to driving over to my brother’s house to pick up Abby’s car for which my father was paying to have a stereo installed as a birthday present. I stayed awake for the mini-excursion that set us off our Cleveland bound time schedule by about an hour. We would be significantly late. Strike one.

Still, we were a happy bunch as we drove towards the RTA Station on Shaker Blvd (RTA is Cleveland’s BART.) Natalie and I sat together. Nicholas and Stephen sat separately as Stephen had acquired a case of oppressive halitosis that he attributed to dry mouth from his medication. Natalie and I talked quietly until our train came to a kerchunking halt at an interchange station for us. Natalie, Nicholas and I assembled in column formation in the aisle. I looked over to Stephen to see why he was not following. I could see that he had adopted a posture to arise, but was stuck in place. He was frozen and I could tell that he was experiencing a focal seizure, the malady that he had been reporting to the disbelieving me for the last several weeks. I had watched Pam have hundreds of focal and full seizures during the period of time between her two brain surgeries. Like my dad’s trip back to Boston, I was transported to another place and time as I watched my son struggle to stand, a time that I had hoped never to visit again. Father Groeschel would describe that location as a point on the pathway inclining up a hill called Calvary.

Because he finally stood after a few dozen seconds and showed no ill effects, we decided to proceed to the game despite the scare. I think I am glad we proceeded; it was an excellent and terrible outing all at once. We got there late, but the seats were the best that I have ever bought – that’s what happens when Nicholas goes to the box office with my credit card. Interestingly we discovered that Natalie despises hot dogs, but will eat three in close succession when she is starving and Nicholas is buying American sausages like he is feeding Slimer from the movie Ghost Busters. Stephen had another focal seizure with a similarly quick recovery when one of the Indians unexpectedly knocked a hanging curve into the bleachers to tie the game late. It was an Indians game, though, so they lost in the ninth inning on a home run to a Twins outfielder that is old enough to have been in high school while I was in college. Happy that Stephen had made it through the game without a more significant medical incident we headed home without waiting for the fireworks.

So it is Tuesday, as I write this. I am in the ER with Stephen to get his condition checked out. He seems to be OK, but without a local doctor, the ER seemed the quickest alternative to get blood work, a CAT scan and access to medical specialists without the bureaucracy of referrals. Frankly, I don’t care to be in another hospital, ever, but I realize that this is a necessary trip. I would feel better if Father Luke from St John Vianny in Walnut Creek would happen in soon to anoint Stephen and pray with us, but I think we are out of his jurisdiction. John Muir was tough to revisit for Nicholas’ treatment, anyway, but it was also seemed as comfortable as an old shoe, albeit with the possibility of a chance meeting transporting me back to a good or bad place in another lifetime.

Today things turned out well with no bad news in either Stephen’s scans or labs. I drove him home later after discharge thankful that he is relatively healthy. We stopped on the way back at Arby’s and at one of the parishes that we might eventually choose as our own to visit Jesus in Adoration. On the road again towards Streetsboro, I reconsidered again why all this inconvenience might have happened knowing that Stephen’s actual health remains largely the same. Sure it was good to get him checked out, discover a good hospital and get assigned a family doctor for a follow-up visit, but why was I put through this dry run of worry and fear for the umpteenth time. Was God holding me back a grade for some lesson that I should have learned one, two or three years ago?

Then I remembered the conversation that I overheard among the doctors at the nursing station from my perch by the door of Stephen’s transient ER suite. They were preparing to inform a patient and family that multiple unexplained lumps had been discovered throughout the lungs in some other poor patient’s scan. Thoughtfully, I removed the mini rosary that I had received at Emmaus from its place on my dashboard and prayed a Divine Mercy Chaplet for another family that got bad news while Stephen and I received our discharge paperwork.

It is known to all that the public transport scenario is not the brightest with overcrowding, lack of vehicles under the system and uncomfortable journeys contributing to a common man shifting to availing benefits of the Taxi Industry.

The initial set-up investment may be large and daunting but the future returns are promising as the industry is lucrative in the long run. Here are a few factors from the legal point of view that are essential to the management of a Taxi Business in India and mind you, you cannot afford to forget these.

Business Structure

As an owner of a taxi-business, you must first decide what type of a business structure you want to opt for. This decision has huge legal implications as it affects your personal liability, taxation, paperwork of the business, etc. A taxi business is no different from any other type of business, and as an owner, you have 5 choices – sole proprietorship, partnership, limited liability partnership or a private limited company. Mostly, owners of tours and travel company taxis opt for the private limited company because of the amount of credibility and possible outside funding.

Commercial driving license

It is a well-understood fact that before you drive a vehicle, you must obtain a driving license which will permit you to do so. If you go ahead and drive the vehicle without obtaining a license, the chances are that you may soon find yourself embroiled in a legal mess. A driving license is issued by the Regional Transport Authority (RTA) or Regional Transport Authority (RTO) of a particular state, and it is absolutely necessary to have the license, as per the Motor Vehicle Act.

How to get a Commercial driver’s license for driving a taxi

Now, a commercial driving license is one which is awarded to those drivers who wish to drive commercial vehicles. Taxi drivers, falling under the ambit of commercial drivers, must opt for a commercial driving license.

Criteria for obtaining a commercial driving license

Driver must be of minimum 18 years of age. In some states, the minimum requirement of age is 22.

Driver must be at least educated up to Class 8. It must be ensured that the driver possesses enough intelligence to read and understand road signs

A learner’s license is necessary. Before obtaining a commercial driver license, the driver must learn how to drive and pass a written test to obtain a learner’s license.

Training from a Government Motor School is essential.

Section 66

Section 66 in the Motor Vehicle Act, 1988 makes it compulsory for the owner of a transport vehicle, whether it is transporting goods or people, to obtain a permit from the Regional or State Transport Authority. Both driver of the vehicle and owner can be held liable and be punished under Section 192A of the Motor Vehicle Act if the vehicle is operated as a transport vehicle without obtaining a permit.

Section 73

Section 73 in the Motor Vehicle Act, 1988 deals with ‘contract carriage permit’ and mandates a taxi owner to submit an application to the Regional Transport Authority to grant a permit to carry passengers under a contract to a fixed destination within or outside the state. The authority can decide through this permit the specific routes or roads on which the taxi may ply, the maximum number of passengers and luggage that may be loaded to the taxi, specific rates or fares that may be charged, provision of a taximeter in the taxi, etc. The 5 seater local taxis which you notice plying on the roads have to apply for this permit to the Regional Transport Authority.

Section 84

Section 84 of the Motor Vehicle Act, 1988 spells out all the conditions that are necessary to justify the grant of permit to a taxi. For instance, 84(c) states that a taxi driver with a permit must only charge fares as fixed by the State Government. He may also not drive at a speed exceeding the prescribed speed limit in the Act. If provisions of Section 84 are not fulfilled, the permit may be revoked by the Regional Transport Authority.

Taxi owners can choose to obtain an All India Permit under which, there is the All India Tourist Permit (AITP). An application must be made to The Transport Authority along with the prescribed legal fee. A vehicle granted such a permit must have “Tourist Vehicle” painted on both sides of the vehicle and a board stating that the vehicle has an AITP must be hung above the number plate. Such taxis can only carry tourists and not common commuters. The judgment in the case Satish N vs. State Of Karnataka clearly laid down that if a vehicle with an AITP was found to be carrying common commuters, the vehicle would be detained. The following documents must be submitted along with the application to The Transport Authority:

Registration Certificate for the vehicle.

Fitness Certificate of the vehicle.

Insurance Certificate for the vehicle.

Proof of payment of tax for the current Quarter to the Home State.

For the issuance of all these permits, one may visit either the State Transport Authority or the Motor License Officer of your city, with the required permit fee and application. The permit granted could be local or natural thus deciding the applicability of the permit in the country. Every local permit has a period of applicability, usually 5 years, after which, reapplication is required.

Motor Vehicle Act, 1988

Section 39 – Registration of vehicle

This section makes it mandatory for every motor vehicle to register his motor vehicle before driving it. It also implies that if the owner of the vehicle lends or rents it out to someone for the purpose of driving, he must ensure that such motor vehicle is registered. Owner of the motor vehicle will be prosecuted even if he wasn’t the one driving it. This makes it clear that owners of taxi businesses, if not owners of the cars under their business, must ensure that such cars are registered before letting them ply on roads.

Section 56 – Fitness Certificate

The authorized testing station is basically a service station which could be private or public. The certificate is valid throughout India.

Section 146 – Insurance against third party risk

This section necessitates insurance of the motor vehicle in use against any third party risk. Insurance is necessary to keep your business running smoothly. This insurance will prove to be a safeguard for circumstances where the owner of a motor vehicle accidentally causes harm, damage or even death to a third party. The third party does not actually include the passenger in the owner’s vehicle. But, since taxis are public vehicles, the passenger in your taxi will be a third party and hence, securing insurance for the vehicle is necessary. Do it, because, your taxi is not just your vehicle but also your livelihood.

Taxation norms

Before GST came into force, service tax was applicable on radio taxis and AC buses. Radio taxis are taxis which are in two-way communication with a central control office and are enabled for using GPS or GPRS tracking system.

This essentially includes cab aggregators like Uber and Ola. The same practice continues now that GST has come into force; metered taxis will not be liable to GST. If you are an owner of a cab aggregation in India, then, 5% GST is to be charged on the fare from the passenger.

Before the emergence of GST, the service tax was 6% on the fare. It must be noted that if you have leased cars and for your business and are not the true owner, then, the driver will have to pay 28-43% of tax along with the rent of the vehicle.

This goes on to show that GST and the new taxation norms pose numerous problems to taxi companies and drivers due to the large increase in the lease payments.

This, in turn, increases the costs incurred by a taxi company, forcing drivers to look for employment elsewhere.

Environmental regulations

As a taxi business owner, you must ensure that you’re aware of all the norms imposed in the city/state with regards to the environment. For instance, in the city of Delhi, only taxis running on CNG are allowed to ply on roads. It is very important to run taxis as per the environmental regulations to not run into a legal dilemma.

You may want to expand your business by buying more cars, or you may be a driver who is interested in buying a car and operating it as a taxi. Different from the traditional taxis, the general public can commute in a radio taxi by a) making a request on a phone call by dialing their phone numbers b) by hiring the taxi from a designated location c) by stopping the taxi on the road. Online orders cannot be made.

Only a registered company under the Companies Act, 1956 or a society registered under the Societies Registration Act, 1860 can register under this scheme.

The State Transport Authority (STA) provides the permit

Permit is initially granted for 5 years

The radio taxis will be allowed to ply within the territorial jurisdiction of the municipal corporation for which the permit has been obtained.

The licensee must be financially sound to run the radio taxi operation and must have sufficient experience of transport business.

The licensee must ensure sufficient parking space for all taxis and possess adequate office space for control of radio communication.

The licensee should also have a minimum fleet of radio taxis. This requirement is different for different states. For instance, UP requires a fleet of 10 taxis whereas Delhi-NCR requires a fleet of 500 taxis, within 1 year of commencement of operations.

Working hours of drivers must be in accordance with the rules laid down in the Transport Workers Act, 1961

Cab aggregators fall under the taxi industry but are very different from the traditional taxi companies or radio-taxi companies. Let’s divide taxi businesses into two for better understanding, and through this division, we will answer one important question which is, ‘Do taxi companies own the taxis?’

Taxi business where taxis are owned by the company

An outdated and traditional model, this particular business is facing a setback due to its scalability. For instance, Meru Cabs, India’s first radio taxi service company in India, when established in 2007 owned its own fleet of cars. Soon, Meru Cabs changed its strategy, and now, over 50% of its cars are owned by the drivers, themselves, and not Meru. The drivers are salaried employees in this model of business. Large costs are attached to this model in the form of car loan EMIs, high maintenance costs, driver strikes, etc.

Taxi businesses where taxis are owned by the drivers

This model is highly scalable and prevalent in most countries, including India. Ola, for instance, started with this model in India, where small fleet owners or even single car owners could just put the company brand on its car and get registered with the company.

The model is better known as taxi/cab-aggregation. Drivers have to pay a fixed commission for every ride they undertake because of the company.

The model, as evident, includes very low capital expenditure and maintenance costs. These companies don’t particularly want to be governed by the provisions of the Motor Vehicle Act, 1988.

As their bookings are made online, they wish to be governed by the Information Technology Act, 2000 (IT Act). The City of Bidhannagar in Kolkata is the only city in India that has permitted online taxi aggregators to be governed by the IT Act. The Delhi Government too amended the Radio Cab Scheme to include these taxi aggregators within its purview and allowed these taxis to ply.

Conclusion

There are various other factors such as choosing wise drivers, investment in the business, garage facilities, etc. that play an important role in the establishment of a taxi business. But, without fulfilling these legal requirements, the business is bound to fail.

Criteria for obtaining a commercial driving license

Driver must be of minimum 18 years of age. In some states, the minimum requirement of age is 22.

I am currently working a temporary job away from home in another state not my permanent residence (I am living there for the term of the employment). While there I bought another vehicle and registered it in that state and when insuring it moved my other car to the policy not realizing this could cause a problem. Now on my first vehicle, which was registered in my home state, the home state has refused to renew the registration because it carries out of state insurance. However, I also don't own the first vehicle, it is owned by my parents who are a resident of my home state, I just use it and pay the insurance. MySentry — A New Category of Diabetes Device

Right after the first of this year, Medtronic Diabetes announced FDA approval of mySentry, a remote monitoring and alarm system for their Revel CGM-enabled (continuous glucose monitoring) insulin pump. D'Mine Columnist and Correspondent Wil Dubois, also author of the award-winning CGM handbook Beyond Fingersticks, has been field testing one of these new systems for the last month. Game changer is an understatement. Paradigm shift is too clichÃ©. Revolutionary comes close. Oddly, there's really nothing that special about the technology. Nevertheless, I believe it's the biggest thing to hit pediatric diabetes in 95 years — the biggest thing since the invention of insulin.

With FDA approval of mySentry, the stage is set for a whole new category of diabetes devices that beam information — CGM data, pump status, alarms and more — to remote systems in real time. But beyond this, which is no small achievement, just what is mySentry? How does it work? What are its limitations? Who can benefit from it? Is it worth the cost, and just how much did you say it was?!

What it is

mySentry captures a ton of data from a CGM-enabled pump, and relays that information, along with blood sugar readings, up to 100 feet away. mySentry has two components: an alarm clock-sized monitor, in the form of a table-top viewing screen; and a small companion "signal booster," or data transmission device, called the Outpost. The beauty of it is that a caregiver in another room can glance at the monitor's color screen and see all the key metrics of the linked pump; and if the pump sets off an alarm, that alarm is relayed to the monitor.

What it isn't

mySentry doesn't turn your home into a CGM wireless hotspot. For mySentry to function, the pump has to be within six feet of either the monitor itself or the Outpost signal booster. It's no damn good if the kid with diabetes is running around all over the place. But for nighttime and naptime, it rocks the house as a way for parents to keep an eye on the diabetes status of their little type 1s when they're most vulnerable.

How well does it work?

Damn well. I've been using a mySentry unit on myself for the last five weeks. I guarantee you it's well thought-out and well-engineered. It's accurate. It merges all the key pump and CGM data into one place and uses a graphical interface that makes it intuitive and visual. To me, it's like a diabetes dashboard. I glance at it and know how fast I'm going, what road I'm on, how much fuel is in the tank, and if there's any road construction ahead I need to worry about. And if I'm not paying attention, it still is — Revel's predictive alarms sniff out trouble well in advance, and the system gives me and my family a head's up before the you-know-what hits the fan. My wife has given it rave reviews, too. While I was down with stomach flu recently, she used it to keep tabs on my blood sugar while I was sleeping.

Most importantly to me, its alarms are loud enough, a major weakness of the Revel pump itself. mySentry makes a musical xylophone-like alert tone that can be set very, very LOUD, indeed. Or as I like to say, "loud enough to wake the dead so that you don't join them."

It's easy to set up, easy to use, and requires no official training. After you take it out of the box, you can have it up and running in under 15 minutes. And while I've had some well-documented trouble with the Revel pump itself, the mySentry system has performed flawlessly.

So who's it for?

mySentry is really engineered for caregivers, most especially the parents of type 1 kiddos. If you're a type 2, or an adult dx'd type 1, you probably don't know this—but most parents of little type 1s get up several times a night (or at least once at 3am!) to check their children's blood sugar. Every night. Night after night. Week after week. Month after month. Year after year. For years. Why? Because nocturnal hypoglycemia is a real, persistent, common, and dangerous threat to type 1 kids. Which means the worst time for the parent of a little type 1 is when the sun sets and all the mythical fears of the night become very real.

In a study published in The Journal of Pediatrics, Dr. MÃ rta BeregszÃ szi and her colleagues estimated the prevalence of nocturnal hypoglycemia in type 1 children and adolescents is a whopping 47%; and nearly half the incidents were asymptomatic—meaning the children felt no symptoms of the low. Another study by Dr. Alexandra Ahmet places the prevalence as high as 68% and notes that 75% of all severe hypos in kids occur at night. And if that doesn't chill your blood, consider Dr. Francine Kaufman's 167-night CGM study of young boys that found in a full 27% of the nights, the boys dropped below 40 mg/dL in their sleep, and that the length of time they spent low was longer than previously believed.

Dollars and sense

mySentry is being offered at an introductory price of $2,400, until the end of this month, and then goes up to $3,000. That's just for the monitor and the signal booster, which only work with a Medtronic CGM-enabled Revel pump. At least mySentry has no consumables—so once you buy it, your only ongoing cost is the electricity to run it.

It's a price tag that's caused a lot of anger in the trenches, but didn't strike me as unusually high for a first-in-category device. Let's face it, mySentry is an add-on product to a developing category that's still losing money. Thinking about it that way, I don't think it's fair to accuse Medtronic of price gouging.

Wait a second, won't our health insurance pay for it?

Whether or not mySentry will be covered by your health insurance remains an open question. Medtronic created a tool kit that outlines the hoops you'll need to jump through to try, but even with this help, I think it will be an uphill battle to get mySentry covered. There's no doubt in my mind that having a mySentry in the house of a type 1 child will greatly reduce the wear and tear of the child's diabetes on the parents — but, frankly, that's really not the insurance company's problem. They're only interested in whether or not it will reduce the health care cost of the child, and that's a harder case to make.

Medtronic is being realistic about the long odds, too. They've also included a sample appeal letter in the kit, and have warned parents to be ready for a cumbersome process requiring multiple appeals.

So is it worth it?

Every child is different, and calculating the value is a formula that each and every family has to work out on their own. But two things are certain:

First, a whole new category of diabetes device has been born, the final evolution of which we can only dare to imagine.

And second, if nothing else, for many parents of type 1 kids, Medtronic just introduced the cure for the epidemic of grey hair and sleep deprivation that plagues them.
