A collection of “what if elves had Prima Nocta” ideas
1) Finwe was not in fact married twice. Miriel wasn’t his wife, she was engaged to someone else. Finwe thought she was beautiful, and used his authority as to have her.
Neither he nor her husband were expecting her to get pregnant, and they certainly weren’t expecting her to die.
Miriel’s son is not legally related to the king, only to her and her husband. But her husband can hardly stand to look at the baby, with all the tragedy he represents. Finwe adopts his own bio-kid, and names the boy after himself.
2) Prima nocta applies not just to the king, but to the head of the family. Nolofinwe could have taken Elenwe's virginity, if he chose, but didn’t wish to intrude on such an intimate moment for the new couple.
Feanor thinks of it differently.
Maedhros and Fingon are engaged, and planning the wedding, when Maedhros finally brings it up.
“You know my father is a bit of a traditionalist, and he expects us all to put duties to our House above personal matters. This is awkward, but he’s going to expect certain things from you before we can leave for our honeymoon...”
3) This is a large part of why Curufin got married. Nerdanel had been frosty to Feanor for years, but Feanor wants a larger family. And to get his cock wet, despite her refusing his advances.
Curufin finds a woman who he isn’t extremely attracted to, but is exactly Feanor’s type. He courts her, and wins here, and makes very clear to Feanor that Curufin has plans to spend his wedding night in a completely different set of rooms from his bride, have fun!
4) Russingon comedy version.
Fingon says, “So this is awkward, but I have a confession to make. I found out from my father a somewhat awkward fact about my parentage.”
Maedhros says, “Rest assured I will love you even if you’re not of noble birth.”
“That’s not the problem, though we aren’t actually half-cousins. My father explained that Finwe, as king, has the right to lay with his subjects on their wedding nights.”
Maedhros nods. “Prima nocta, I’ve heard of it.”
“Yes. Well, it turns out that Finwe used that right on my parent’s wedding night. And then I was born exactly a year later, though my father and mother didn’t have relations for several more weeks.”
“Oh. That is certainly a change of perspective.”
“I asked, and the king using prima nocta makes no legal difference at all to inheritance! Legally, I am the son of Nolofinwe, and we’re still half cousins, even if this were to be announced in the town square. And legally, half-cousins can wed. Just, by blood I’m your uncle. Not that I care, or see you in any way as my junior, just if you-”
Maedhros cut him off. “I don’t see us as any closer related than we were yesterday. I mean, what tie could be closer than fiance? But I should probably admit something myself.”
   “What’s that?”
“I never mentioned it simply because it didn’t seem important to our relationship, only to my parents’ past. My father always made sure I knew he loved me just as much as my brothers, and that my difference from them was as honor, not a demerit. But a secret honor, like standing firm in the face of temptation, not one to be proclaimed for all to hear. And when I grew old enough to understand the details, I realized it was such an incredibly intimate thing -”
“Please just say it, all this dancing around is more worrying than whatever your parents did could possibly be,” Fingon interrupted.
“My father explained that as king, Finwe had a duty to the Noldor to uphold a certain role. And that part of that role was to have a queen, and to create children with her, to show the safety of his kingdom. But Finwe was not content to only have sex and produce children out of duty. He wanted a lover who sparked passion, and children who existed for no purpose but to be loved. He did so once with Miriel, and though his passion overwhelmed her, he loved their son. And when that son came of age, Finwe saw that Feanor’s bride also sparked that passion in him-”
“Wait are you saying Grandpa Finwe is your father too?!”
“By blood, yes. Though he’s never treated me as closer than a grandson, and Feanor’s the one who raised me and taught me, and Feanor’s sons are my brothers-”
“But we’re half-brothers. By blood, at least.”
“I guess?”
Fingon sat very still for a minute, then shrugged his shoulders. “I suppose nothing’s changed really, we just know now.” He leaned in to kiss Maedhros.
“What, just like that?”
“Do you think of me as your brother?”
“No!”
“Then there’s no harm.”
“But if someone were to find out...”
“How? Nobody knows but us.”
“Our parents know.”
“And the man who raised me barely speaks to the one who raised you. Do you really think Feanor will bring it up?”
“Well, no. Will Nolofinwe?”
“No. He thinks it’s an embarrassing secret, and only told me because I’m of age to get engaged and he didn’t want me surprised if Grandpa shows up on my wedding night.”
“Grandpa knows.”
“He can’t stop us.”
“He’s the king, he definitely can.”
“Fine, if Grandpa Finwe makes a royal decree that we have to break up, there will be a problem. But he can’t forbid us as a parent because legally he isn’t.”
“You’re taking this very well.”
“I already accepted one shocking revelation of our kinship this week and decide I still wanted you, a second isn’t a big change.”
