14 avril : l’anniversaire du Dr Ambedkar, l’un des fondateurs de l’Inde actuelle
C’est le 134e anniversaire de Babasaheb Ambedkar et son aura n’a cessé de grandir ces dernières années. Cet homme, né dans un milieu défavorisé et qui sera l’un des premiers intouchables à faire des études supérieures, à bénéficier d’une bouse pour étudier aux États-Unis et à Londres, et à se hisser au plus haut niveau de l’État indien dont il a participé à la fondation. Il fut député, ministre de la Justice, du Travail… On lui doit pour l’essentiel la constitution indienne, notamment les articles sur la laïcité, la lutte contre les discriminations. Très jeune, il a lutté contre le système des castes et, une fois au gouvernement, il a mis en place une discrimination positive.
Bhimrao Ramjo Ambedkar est né le 14 avril 1891 à Mhow (appelé aujourd'hui Ambedkar Nagar) dans le Madhya Pradesh. Son anniversaire a été fêté publiquement pour la première fois à Pune en 1928 par ses partisans. Mais il a fallu attendre 1990, à la veille de son centenaire, pour que le Dr Ambdekar reçoit à titre posthume le Bharat Ratna, la plus haute distinction civile indienne. En outre, la période 1990-91 avait été déclarée « Année de la justice sociale ». Certains État de l’Inde célèbrent le 14 avril une journée de l’équité. Babasaheb Ambedkar (son surnom) est particulièrement vénéré par les intouchables qu’il appelait les datits, et basses castes dont il était (car sa famille était de la la caste des Mahars) ; mais aussi des bouddhistes, car un an avant sa mort, en 1956, il s’était converti au Bouddhisme pour protester contre le maintien de l’esprit des castes (pourtant abolies par la constitution) et la sur-représentation des hautes castes au sommet de l’État. Il avait entraîné avec lui la conversion en masse de plusieurs centaines de milliers d’intouchables.
Ambedkar Jayanti n'est pas une fête nationale en Inde. Mais, c'est un jour férié dans 25 États et territoires de l'Union indienne (sur 36) , dont Andhra Pradesh , Bihar , Chandigarh , Chhattisgarh , Goa , Gujarat , Haryana , Himachal Pradesh , Jammu-et-Cachemire , Jharkhand , Karnataka , Kerala , Ladakh , Madhya Pradesh. , Maharashtra , Odisha , Pondichéry , Pendjab , Rajasthan , Sikkim , Tamil Nadu , Telangana , Uttarakhand , Uttar Pradesh , Bengale occidental…
Ce sont ces deux dernières décennies que le culte d’Ambdekar a pris de l’ampleur. Le jour de son anniversaire, les gens se rassemblent devant les statues et les mémoriaux du Dr Ambedkar pour lui rendre hommage. Les autorités indiennes ont fini par s’y plier et à déclarer, localement, la journée du 14 avril comme fériée. Les écoles et les universités organisent des séminaires, des conférences et des discussions pour informer les jeunes générations sur la vie, les philosophies et les contributions d'Ambedkar. Les processions et rassemblements publics sont très courants dans le cadre des célébrations. On organise chaque année un marathon, « Run for Ambdekar » , des spectacles de danse et de musique traditionnelles illustrant les thèmes de l'égalité et de la justice sociale ajoutent une dimension culturelle aux célébrations. On prononce des discours et organise des débats sur des questions liées à la justice sociale et à la discrimination de caste.
Il n’est pas vraiment dans la droite ligne de l’Inde de Narendra Modi mais son culte n’a cessé de grandir ces dernières années. On célèbre aussi l’anniversaire de sa mort, chaque 6 décembre, Mahaparinirvan Diwas.

Who is an aggrieved person to lodge an FIR in cases of conversion of religion in UP
As required under the #UPProhibitionofConversioofReligionAct2021 only aggrieved person can lodge #FIR. #Aggrievedperson has wider connotation as per the Act aggrieved person means person himself or his/her parents, brother, sister or any other person, who is related to him/her by blood, marriage or adoption. Here an FIR was lodged by Zila Mantri BJP at #AmbedkarNagarDistrict alleging that alleged accused Jose Papachen & Sheeja are engaged in #conversionofreligion by giving various allurement amongst the communities of #ScheduledCaste and #ScheduledTribe. Both were arrested on 24.01.2023 and were sent to jail. Bail application was moved before Special Judge SC/ST and it was rejected on 03.03.2023. #allahabadhighcourt #scstact

Background
Special Judge S.C./ S.T. Act, Ambedkar Nagar, rejected the Bail Application of the appellants vide its order dt.03.03.2023. Aggrieved by the rejection of their bail Criminal Appeal was filed before Hon’ble Allahabad High Court.
After going through the records and submission of the Counsels of either side Hon’ble Court allowed the Criminal Appeal and set aside the order of Special Judge S.C./S.T. Act, Ambedkar Nagar, in Bail Application for offence under Section 3 and 5 (1) of Uttar Pradesh Prohibition of Conversion of Religion Act, 2021 and Section 3 (1) (Dha) #SC/STAct, Police Station Jalalpur, District Ambedkar Nagar.
Appellants Jose Papachen & Sheeja were enlarged on bail with conditions to follow.
Allegations against the Appellant
Primary allegation against the appellants is of having contravened the provisions of Section 3 of the Act of 2021, which prohibits conversion or attempt of conversion either directly or otherwise from one religion to another by use of practice of misrepresentation, force, undue influence, coercion, allurement or by any fraudulent means.
Submission of the Counsel of the appellant
1.     FIR is lodged for gaining his political goodwill amongst the members of society.
2.     Zila Mantri is not the aggrieved person as required under UP Prohibition of Conversion of Religion Act 2021.
3.     Appellants are not involved in any activity of conversion.
4.     Statement of villagers recorded also shows that the appellants are involved in good teachings encourage them to get their children educated organize Bhandara teach to live peacefully instruct villagers to not enter into altercation, not to consume liquor & even distribute Holy Book Bible
Submission of the Additional Government Advocate for the State
1.     State Counsel opposed bail submitting that the appellants are allegedly using psychological pressure for forceful conversions, as part of their plan to set up an Christianity state.
2.     the present case concerns mass religious conversions within the State of Uttar Pradesh from Hindu religion to Christianity through illicit means.

Observation of the Court
1.     There does not appear to be any material to show that appellants had used any undue influence or allurement to the villagers for mass conversion.
2.     Providing good teachings to children and promoting the spirit of brotherhood amongst the villagers does not amount to conversion by use of force.
3.     The FIR was not lodged by the Zila Mantri of the ruling party. Complainant is not an aggrieved as required U/s 4 of the Uttar Pradesh Prohibition of Conversion of Religion Act 2021
4.     The words "any aggrieved person", if taken by themselves are extremely wide.
5.     Aggrieved person would be a person but is personally aggrieved by his or her fraudulent conversion be it an individual or in a mass conversion ceremony.
6.     Under the said circumstances the first information report dated 24-01-2023 was not lodged by a competent person.
Grounds considered by Court for granting Bail
1.     There is no likelihood of conclusion of trial
2.     No convincing material to indicate the possibility of tampering with the evidence by the appellants.
3.     Complainant has no locus to lodge the present F.I.R. as required under Section 4 of the Act, 2021.
4.     Submission of the Appellant’s Counsel that providing good teachings, distributing Holy Bible books, encouraging children to get education, organizing assembly of villagers and performing “Bhandara” and instructing the villagers not to enter into altercation and also not to take liquor does not amount to allurement
5.     Submission of the Appellant Counsel that the appellants are not involved in any activity which amounts to attempt to convert, either directly or otherwise, from one religion to another by use or practice of misrepresentation, force, undue influence, coercion, allurement or by any fradulent means.
6.     The complainant is Zila Mantri of a ruling party and is neither the aggrieved person, his/her parents, brother, sister or any other person, who is related to him/her by blood, marriage or adoption, as provided under Section 4 of the Uttar Pradesh Prohibition of Unlawful Conversion of Religion Act, 2021
7.     The complainant is not competent to lodge the present F.I.R.
8.     Appellant’s are in jail since 24.01.2023 and has by now had undergone a substantial period of detention.
9.     Court below has failed to appreciate the material available on record, the impugned order passed by the trial court is liable to be set aside.

On Monday, the Uttar Pradesh Anti-Terrorism Squad (UP ATS) interrogated Seema Ghulam Haider, a resident of Pakistan, and Sachin Meena, her husband from India. They were questioned by the ATS in Noida at an undisclosed location, according to a senior official of the UP Police.

"ATS is investigating the possibility of espionage and the woman's passage through Nepal to India. To determine if the woman is a "spy" or not, they are being questioned. But they were not detained," the senior official said.

The Intelligence Bureau (IB) and the Uttar Pradesh Anti-Terrorism Squad (UP ATS) were requested in a previous letter by the Gautam Buddha Nagar police to look into the evidence they had gathered so far.

In accordance with Sections 14 of the Foreigners Act, 120B and 34 of the Indian Penal Code, as well as Sections 3, 4, and 5 of the Passport Act of 1920, Seema (age 27) was detained on July 4 along with Sachin Meena (age 22) and his father (age 59) for entering India "illegally" and giving the woman shelter.
Every single one of the three received a 14-day court order. On July 7, they were later granted bail.
Officials claimed that Seema and Sachin had their first in-person encounter in March and had stayed in a hotel in Kathmandu for seven days. With her four children, Seema visited Nepal once more. Later, she traveled to Mohalla Ambedkar Nagar in Rabupura, Greater Noida, where she has been residing unlawfully since May 13.

Seema stated that she wants to live with Sachin after being let out of prison. Three years prior, Seema met Sachin while playing PUBG and the two immediately fell in love.
“I started playing PUBG in early 2020… I liked how Sachin played the game, so I initiated a conversation and we became friends. Slowly our friendship turned to love and we looked into the possibility of meeting. Sachin didn't have a passport, but I did. After learning that Indian citizens could visit Nepal without a visa, we made the decision to meet there. In an earlier interview, Seema stated, "We first met in March and later got married at the Pashupatinath Temple in Kathmandu before returning to our respective countries. My kids stayed at my uncle's house in the interim.
Justice Nazim Akbar, Jewar Civil Judge (Junior Division), who granted bail to Seema, Sachin, and Netrapal, had stated that the case is punishable with imprisonment up to five years; therefore, in light of orders from the Supreme Court and the rules of the Allahabad High Court, the bail application is eligible to be accepted.

He was speaking on Thursday after approving the conversion of 128 temporary positions of medical professionals in Delhi government hospitals into permanent positions.
This will allow 76 positions at Dr Baba Saheb Ambedkar Medical College in Rohini, 40 positions at Guru Teg Bahadur Hospital in Dilshad Garden, 9 positions at Maulana Azad Medical College near Delhi Gate and 3 positions at Lal Bahadur Shastri Hospital in Khichripur positions are staffed with permanent staff. Some of these po
sitions have been vacant since 2011 or 2012, with people being temporarily hired and laid off. These positions include Assistant Professor of Orthopedics, Senior Radiology Resident, Surgeon, Dentist, implant specialist hospital hyderabad Junior Resident, Nurse Nurse, Clinical Instructor, and Radiologic Technologist, among others.
Since the new L-G took office, he has approved 918 new positions in different categories for the newly opened Indira Gandhi Hospital in Dwarka.
Over the years, disputes with the government have led to delays in appointments and job placements as the L-G is in charge of personnel in Delhi.
Saxena has directed officials to quickly address all vacancies and escalations that have been pending for years.
On Friday, AAP's Durgesh Pathak, the newly elected MLA of Rajinder Nagar, visited Sir Ganga Ram Hospital on the occasion of National Doctors' Day.
He praised the service provided by the hospital and said he would take on the unfinished work to expand Entrance and exit roads to the hospital and expansion of Sir Ganga Ram Hospital Marg. He also assured Dr D S Rana, chairman of the hospital's management committee, that the composting plant near the hospital would be relocated - implant dental clinic.
