Eric Courtney Harris part 2 Smolen told the Tulsa World that Clark's ruling was "premature and ill-advised," challenging a report that Harris was "uncooperative and combative" as firefighters attempted to administer aid. "Robert Bates has no current affiliation with the Tulsa Police Department and has not had any in 50 years," TPD said in a press release. "Additionally, Mr. Jim Clark, a consultant for the Tulsa County Sheriff, does not represent the Tulsa Police Department nor has the Tulsa Police Department conducted an assessment of this incident." Later that week, The Tulsa World reported supervisors at the Tulsa County Sheriff's Office were ordered to falsify Deputy Bates' training records. Sheriff's spokesman Shannon Clark later said the documents wouldn't matter because Bates, a major donor to Sheriff Glanz's re-election, was granted special exceptions. The sheriff's deputy that certified Bates has moved on to work for the Secret Service, Sheriff Stanley Glanz said during an interview with a radio station, while the Maricopa County Sheriff's Office denied providing Bates with the training he claimed. Chief Glanz resigned as a result of the scandal around Bates' lack of qualification. In 2016 he pled guilty for failing to release information that showed the department knew Bates to be unqualified. The Oklahoma security guard and reserve police officer who pulled out a gun and shot a fellow security guard during a weekend gun show is now facing charges – despite the victim insisting he did not want to file charges.

Brian Pounds, an appraiser at the Tulsa County Assessor’s Office as well as a reserve police officer for the Collinsville Police Department, was charged with reckless conduct of a firearm, a misdemeanor.

However, he claims it was all an accident when he pulled out his gun and fired towards former Tulsa County Sheriff’s Sergeant Rick Treadwell, striking him in the finger.

The video shows it was hardly an accident, but a deliberate act of negligence and stupidity.

Pounds, who is married to Tulsa County Sheriff’s Sergeant Judy Pounds, was also a reserve deputy for that same department from 2002 to 2005 under former Sheriff Stanley Glanz, according to Fox 23 News.

The Tulsa County District Attorney’s Office received reports today regarding the recent discharge of a firearm at the Tulsa Fairgrounds.  We reviewed those reports and filed a misdemeanor charge of Reckless Conduct with a Firearm.  The law presumes that every person charged with a crime is innocent until a judge or a jury determines otherwise.  That same standard applies to Mr. Pounds.

There are occasions in which a person is identified as the victim of a crime.  The State may take into consideration the wishes of the victim, but ultimately the decision to file is based upon the law and the evidence.  I personally spoke with the identified victim in this case before a decision to file was made.

The strongest piece of evidence is the video below, which begs the question, who the hell is training these guys? This guy is not only married to a deputy, but he’s been a reserve officer for at least two agencies where he is handed a badge and a gun.

A federal jury awarded $10.2 million to the family of an Oklahoma Army vet who died after spending days in a Tulsa jail cell with a broken neck.

On Monday afternoon, jurors sided with the estate of Elliott Williams, whose final moments were captured on surveillance video. The footage, which garnered national attention, showed a paralyzed Williams, lying naked on his back and grasping for food and water that detention officers dropped out of his reach.

Jail employees believed Williams, who was African-American, was “faking” paralysis despite his pleas for help, and they placed him in a video-monitored cell to catch him moving, according to trial testimony and an internal probe by the Tulsa County Sheriff’s Office.

The verdict came after 10 hours of deliberations that began on Friday afternoon and ended Monday. Jurors ordered Tulsa County to pay $10 million and former sheriff Stanley Glanz to pay $250,000 in punitive damages to Williams’s estate.

Don Smolen, an attorney for Williams’s estate, had asked jurors for $51 million in compensatory damages—or $1 million for every hour Williams was “left suffering in his cell.” (The surveillance footage of Williams’s death was 51 hours long.)

Smolen asked for “$1 million for every hour that Elliott Williams was left suffering in his cell, covered in feces and urine, suffocating as his lungs began to collapse slowly over the course of several days, unable to feed himself, unable to drink, begging for water, and begging for help that never came.”

Outside the courthouse, Kevin Williams told reporters he was “satisfied” with the jury’s decision but believes someone at the sheriff’s office should have been charged criminally over his brother’s death.

“Somebody should have been charged. I’m not satisfied fully but I’m content with the decision,” he said.

Still, by several accounts, the Tulsa jail was described as a big house of horrors. Former staffers testifying for Williams’s legal team described it as a place where deputies allegedly punished prisoners by pouring water on their meals or placing inmates on suicide watch when they weren’t suicidal.

And it’s a place where a doctor administered injections through inmates’ jugular veins, according to a 2012 internal memo presented in court. That document showed the jail’s psychiatrist had expressed concerns over the use of saltwater placebos for one patient and methadone for another prisoner, who was pregnant.

Jailers also allegedly performed CPR on dead inmates. A former director of nursing testified that detainees “weren’t allowed to be pronounced dead until after they left the jail” to prevent bad publicity and crime scenes inside the facility.

African-American employees were allegedly troubled by the jail’s practices, too, and filed racial discrimination suits against the department. Those cases, settled in 2011, cost Tulsa County nearly $1 million, the Tulsa World reported.

As The Daily Beast previously revealed, Sheriff Glanz testified that he was OK with deputies calling black suspects “n*gronoids” or “n*groids.”

Another attorney for Williams’s family, Daniel Smolen, told The Daily Beast that he learned of the department’s alleged use of the racist terminology after discovering a 2006 memo with the letters “N” or “W” marked next to employees’ names.

When Smolen asked Glanz about the memo, the ex-lawman testified he “didn’t have any problem” with the terms “because when I was a young police officer, the FBI designated races by the term ‘coin,’ Caucasian, oriental, Indian and N*groid.”

 Und ich würde ihr weiter raten, wenn Harry, der offensichtlich in sie verliebt ist, sie immer noch heiraten will, um auf ihrer Seite zu bestehen, als eine Bedingung dafür, dass er ihr nicht in die Quere kommt, weiter und unabhängig zu arbeiten Unterstütze dich selbst, wie sie es immer getan hat, indem du das tust, was sie liebt, und folge damit all diesen, mir bedeutungslosen und pathetischen sogenannten königlichen Pflichten. Das House of Windsor ist eine der am meisten gestörten Familien nicht nur in Großbritannien, sondern global, kollektiv sowie in Bezug auf die überwiegende Mehrheit seiner Mitglieder. Und wenn es in ganz Großbritannien nicht an der Spitze dieser irrationalen Schicht der sogenannten Überlegenheit stünde, würde sich niemand die Mühe machen, es einen zweiten Gedanken zu machen, und würde es dementsprechend behandeln, wie es ganz gut verdient. Aber ebenso wie Großbritanniens tief verwurzeltes Klassensystem und das Ausrotten seiner idiotischen Plebejer und sozialen Aufstiegshelfer, haben wir in Großbritannien eine völlig auf den Kopf gestellte Situation.

 Für Elizabeth Windsor, alias die Queen, und Philip Mountbatten, ihre Gemahlin, die von all diesen Cap-Doffing-Nerds lächerlicherweise verkündet wird, dass er seit 70 Jahren der Inbegriff der Treue zu Elizabeth ist und umgekehrt sie mit ihm - gib mir eine verdammte Pause wirst du, wie ich in der realen Welt lebe - Ja! Und mit dieser Fantasie existieren der rationale Weihnachtsmann und seine Rentiere wirklich, wenn Sie auch so denken.

 Elizabeth und Philip, was auch immer unaufrichtig, lächerlich oder Lügenmist, den die Schnickschnackfeindlichkeit zu Ihnen sonst erzählen könnte, sind ein klassisches Beispiel von Doc Martins Eltern. Dieselben Bananen, die heute und in manchen Fällen noch heute üblich sind, werden auf dem Fußballplatz auf schwarze Fußballspieler geworfen. How the Internet Kept Humming During 2 Hurricanes

At one node of the industrial backbone that keeps the internet running, employees sheltered from the worst of Hurricane Irma in a stairwell of a seven-story building in downtown Miami. When the power had gone out, diesel generators instantly kicked in to keep the lights on and prevent the internet from going down.

In Houston, at another of these nodes, called data centers, Hurricane Harvey pushed waters so high that a live fish flopped in a loading dock, but the physical defenses held.

Yet another data center, west of Houston, was so well prepared for the storm--with backup generators, bunks and showers--that employees’ displaced family members took up residence and United States marshals used it as a headquarters until the weather passed.

“It wasn’t Noah’s ark, but it was darn close,” said Rob Morris, managing partner and co-founder of Skybox, the company that runs the center.

For all their seeming immateriality, the internet and the cloud rely on a vast industrial infrastructure consisting of data centers linked through a sprawling network of fiber optics. The facilities are stacked with servers--boxlike computers that crunch the data for everything from hospitals, law enforcement agencies and banks to news websites, email and weather reports--that cannot be without electricity and cooling for even a fraction of a second.

Yet even as millions of people lost power across Florida, and thousands of homes and businesses were flooded out in Miami and Texas, the heavy digital machinery at the heart of the internet and the cloud held firm.

Though the storm disabled some cellphone towers and local connections, Jeff Eassey, a manager for Digital Realty who hunkered down in the Miami building, said the center never stopped processing and transmitting data. It lost utility power around 8:30 a.m. on Sunday, Sept. 10, but supplied its own electricity with the generators.

When the storm eased and he walked outside, Mr. Eassey said, he immediately saw the effect that Digital Realty and other data centers had by keeping the servers going. “Everyone was talking on their phones, searching on their phones, and commerce that uses the internet to do their business was up and running,” he said.

A list of Digital Realty’s top customers shows why those operations are so important: Clients include IBM, Facebook, CenturyLink, Oracle, Yahoo, Morgan Stanley, AT&T and JPMorgan Chase, among others.

Inside the centers, the drill during a natural disaster can be overwhelming. One company, EdgeConneX, lost utility power for three days at a Miami data center, two days at a center in Jacksonville, Fla., and two days at an Atlanta location. But Rich Werner, director of operations at the company, said that backup generators turned on and service was never interrupted.

“Data center operations, to me, is 362 days of boredom,” Mr. Werner said. “And then you get these hurricanes coming through, and it’s three days of pulling your hair out.”

There are no legal standards for data centers unless they house servers for clients like government agencies, which require special protections.

But a professional organization, the Seattle-based Uptime Institute, rates the facilities on four tiers of resiliency for events like storms, earthquakes and run-of-the-mill power failures--possibly one reason the internet performed creditably during the hurricanes. The institute’s engineers “go to the site and pull the plug,” said Mark Harris, senior vice president of marketing, “and to be certified, it has to keep running.”

“So when a hurricane or a tornado or an ice storm happens, the entire data center has been designed to withstand these external factors,” he said.

During Harvey and Irma, those measures seemed to work, said Doug Madory, director of internet analysis at Dyn, a web performance company with servers at a Miami data center. “I’m not aware of any core internet services going down,” he said.

One necessity is building above the 500-year floodplain, according to Gary Wojtaszek, president of CyrusOne, whose facilities include a data center in the mostly flooded Galleria area of Houston. The water stopped a few feet short of the building, which ran on backup power for several hours, Mr. Wojtaszek said. He added that “practically every single large oil and gas company in the world” operates servers in its data centers--an indication of how commerce of all kind relies on the facilities.

Depending on local conditions, some centers got off easier than others. In Houston facilities run by Data Foundry, automated systems worked so well that employees pooled resources and watched the Floyd Mayweather-Conor McGregor fight on pay-per-view, said Edward Henigin, the company’s chief technology officer. When everything is working, he said, “what else are they going to do?”

Everyone in the business says that extensive preparation is critical. James M. Palmieri, Digital Realty’s vice president for data center operations, said that as Irma approached the building in Miami, engineers topped off diesel generators, called Mr. Eassey down from Atlanta to direct operations and waited to see how strong the hurricane would become.

“The storm got worse,” Mr. Palmieri said, adding that at that point, “the real issue is, how do we make sure that our employees are protected?”

Mr. Eassey said that about 14 people in the building--including employees, customers and security personnel--met in a sixth-floor conference room that Friday morning and realized that the worsening conditions, heavy traffic and overcrowded shelters in the area meant it was too late to leave. With reinforced concrete walls and heavy glass, the building was the safest place to be, they decided. The mood was calm.

“Most of these guys are seasoned Miamians,” Mr. Eassey said. “I was the out-of-towner. I would be exaggerating if I said anyone was nervous or panicked.”

The peak of the storm passed over the weekend, and when the power went out, the center was ready with diesel generators and a 10,500-gallon diesel tank on the site.

In Houston’s so-called energy corridor, the Skybox campus stayed above water, Mr. Morris said. Utility power never went down. But the site was stocked with thousands of gallons of diesel fuel, as well as food and water, emergency medical kits, showers, bunk rooms and flares.

The site, which Mr. Morris calls a “modern-day fortress,” began hosting not only employees but several of their families, whose houses were flooded. Then, Mr. Morris said, the building doubled as an emergency response center for the United States marshals. He said that roughly 50 people used or stayed on the campus at one point or another during the storm.

Asked if there were anything in his operations that he would change before the next storm hit, Mr. Morris did not hesitate. “We’ve decided to purchase a washer and dryer to keep on site,” he said.

A paralyzed and mentally ill veteran is left on the floor of a county jail. Guards watch for days until the prisoner dies. A death row inmate violently convulses on the gurney as prison officials experiment with an untested cocktail for execution.

Added up, the facts evoke a social breakdown across the board. Not only does Oklahoma lead the country in cuts to education, it’s also number one in rates of female incarceration, places second in male incarceration, and also leads in school expulsion rates. One in twelve Oklahomans have a felony conviction.

Rosa Brooks of Georgetown University Law Center wrote in an essay that states begin to fail when the contract between citizens and public institutions breaks down. States “lose control over the means of violence, and cannot create peace or stability for their populations or control their territories. They cannot ensure economic growth or any reasonable distribution of social goods.”

It may be hard to believe, but entry-level employees with a high school diploma at the popular convenience store QuikTrip make more than teachers in Oklahoma.

For four years running, the state has led the nation in tax cuts to education, outpacing second-place Alabama by double digits. Years of tax cuts and budget shortfalls mean that Oklahoma has fallen to 49th in teacher pay. Spending per pupil has dropped by 26.9% since 2008.

Things have become so bad that the Cherokee nation, a tribe systematically cheated out of its land allotments in the creation of the modern state of Oklahoma, recently donated $5m to the state’s education fund.

Lisa Newman, a high school teacher from El Reno, for instance, recounts a history of cutbacks, increases in class sizes, and her stagnant salary. She takes in less than $1,000 a month after all her bills are paid.

Newman, who recently moved back into her parents’ house at age 39, contemplates a declining standard of living while she raises two boys and works about 50 hours a week.

Shelby Eagan, Mitchell elementary school’s 2016 teacher of the year, decided she’d had enough after a referendum to raise teacher pay through an increase in state sales tax was defeated in last November’s election.

“I would like to have kids some day,” she says. But that’s unlikely for now: her rent has gone up. She also buys her own supplies for her classroom.

Eagan is originally from Kansas City but she loves Oklahoma. She found her calling teaching in an urban elementary school. She teaches the children “how to tie their shoes, blow their nose, have superhero fights that don’t turn violent”, among other things. All of her students are on free or reduced-fee lunch programs.

After the referendum defeat of SQ 779, Eagan decided to look elsewhere for a better gig. Eagan found a job in the area that would increase her salary by $10,000 right off the bat.

Eagan’s decision to leave was mirrored in May by the 2016 Oklahoma teacher of the year, Shawn Sheehan, who wrote in an op-ed: “Teaching in Oklahoma is a dysfunctional relationship.”

At Oklahoma Policy Institute, a progressive thinktank, the policy analyst Carly Putnam says education is only one part of the state’s dysfunction. Putnam cites the example of a popular support program for developmental disabilities which gave families of limited means resources to take care of their loved ones. It takes roughly 10 years just to get on a waiting list to be considered for the support waiver to help a disabled person, meaning applications filed in 2006 are just now being considered. Many of the disabled patients have died by the time their files are being considered.

The case of Elliot Williams is a stark example of how Oklamhoma’s public institutions is failing its citizens. Williams, who had been honorably discharged from the army, had a diagnosed bipolar condition. After he experienced a few nights of insomnia at his parents’ house in Owasso, relatives brought him to a hotel.

Williams threw a soda can in the lobby and walked into a door. Hotel staff called police. An officer who arrived at the scene found Williams “rambling on about God and eating dirt”. The officer and the staff concluded that Williams was suffering from “some kind of mental breakdown”.

They escorted him out of the hotel and called his parents. At some point, while outside the hotel, Williams threatened to kill himself. A cop ordered him to stay seated on a curb. Williams got up and moved towards a police officer, who pepper-sprayed him.

Police arrested Williams, charging him with obstruction. The small town jail of Owasso wasn’t equipped to deal with a case like Williams’s. Instead of a suitable mental health facility, Williams wound up Tulsa County Jail.

It was Williams’s bad luck to be transferred to a jail that only weeks earlier, federal agents had faulted for “a prevailing attitude of indifference”.

The jail was run by Sheriff Stanley Glanz, who would become infamous as the man who assigned his friend, Robert Bates, an insurance agent with no police training, to a violent crimes task force.

Tulsa County jail was certainly no place for a man with a bipolar condition. And yet, with Williams in the midst a breakdown, he was tackled and body-slammed to the ground by an officer. Williams had difficulty walking. He was transferred to a holding cell, where he rammed his head against a wall.

Seeing Williams unable to move, the head nurse allegedly told him to “quit fucking faking”. He defecated on himself and officers dragged him to a shower. He still didn’t move. To prove that it was an act, an officer put a small cup of water just outside Williams’s grasp. He never reached it.

For three days, jail officials – guards and medical staff – expressed “concern” about Williams but never called 911 or requested a hospital transfer. He was left in a medical cell, where a video camera recorded him lying there, unable to eat or drink. Five days after he was put in the Tulsa County jail, Williams had died of complications from a broken neck and serious dehydration.

Audits and inspections of the Tulsa County jail revealed decades of indifference to sexual abuse, overcrowding and overt racism. From one angle, the Tulsa County jail is par for the course of the American criminal justice system. But from another – and in the opinion of the jury that ultimately sided with Williams by awarding his estate $10.25m – Tulsa had seriously failed.

Shane Matson is a geologist whose family has been in the Oklahoma oil business for three generations. For Matson, the discovery of new reserves in Oklahoma is a good thing. The “dark outlook about the future of energy” is gone, he says. Cheap oil and gas are now abundant.

Matson fought Obama-era regulations in Osage County, where he was exploring for oil. But his industry’s political influence has now reached untoward extremes, he thinks. Chesapeake Energy, Devon Energy and Continental Resources have lobbied to lower the state’s gross production tax, citing competition from other states. They’ve gotten their way, with Oklahoma’s oil and gas production taxes now significantly below those of its rival Texas.

One of the state’s richest men and its most renowned philanthropist, George Kaiser, has been urging an increase in the gross production tax for years. And there’s reason to believe it’s not necessarily a partisan issue. Until recently, North Dakota had been able to expand its education system with a 6.5% gross production tax.

And despite the tax cuts, the Tulsa-based Newfield Exploration moved most of its staff to Houston.

Industry leaders, not surprisingly, see the issue through an entirely different lens.

Chad Warmington, the president of the Oklahoma Oil & Gas Association, says that about a quarter of the state’s tax revenue comes from oil and gas while the industry employs about 13% of the state’s workforce. Dependence on taxes from oil and gas “has left the state unprepared for inevitable price downturns of a cyclical industry”, Warmington says. The current downturn, then, “has led many to question the state’s management of the tax dollar”.

The Oklahoma Policy Institute calculates that the current regime of tax breaks and refunds costs around half a billion dollars in decreased revenue ever year. That figure, if correct, would cover the current $220 million budget gap in education but would still not be enough to make up for the state’s entire budget shortfall.

Of course, many would not recognize their state in this description. One of the most respected bloggers in Tulsa, Michael Bates, said the whole idea of Oklahoma as a failing state was “hysterical and overwrought”.

After all, downtown Tulsa and Oklahoma City are thriving. The cities have been rated by Kiplinger among the “best cities in America to start a business”. Tulsa has rolling hills, parks and delicious barbecue: Tulsa People enumerates the city’s private schools. Affordable housing prices are the envy of the nation and suburban school districts boast gleaming new facilities. And yes, some conservatives think the four-day week is good for “traditional” families, allowing for more time with the kids. For affluent families, the extra day can be spent on college prep or sports. But for middle- and working- class parents, it means lost wages or added expenses for childcare.

And for poor families, like those of Eagan’s students, who rely on the free lunch program, it means hunger. Local food banks have to pick up the slack and deliver meals when the kids aren’t in school.

Nearly everyone I talked to for this story – regardless of political affiliation – was startled by the downward spiral of basic social services.

There is something deeply ingrained and unyielding in the state’s conservatism.

When I was in elementary school, I remember seeing my mother struggle with hundreds of thousands of dollars of unpaid medical bills after my dad died of heart disease. She was suddenly a single mother with an incomplete college education, no professional training, and a mountain of debt. We depended on the generosity of friends and family to get by.

I recently asked her why she never went on welfare or food stamps while she worked as a daycare teacher and raised me.

“Welfare is for poor people,” she said. “We weren’t them.”

If you rely on the progressive account, it’s easy to think Red America is dominated by a majority of angry racists lighting a match to liberal democracy. And people in the hipper areas of Tulsa seem to want the city to divorce the state.

But there are signals that some Oklahomans want a change of direction. David Blatt, the executive director of Oklahoma Policy Institute, and someone who’s happy to work with “reasonable” Republicans, points to three referenda widely expected to be voted down that actually won.

Oklahomans voted to reclassify certain drug possession crimes from felonies to misdemeanors, bucking the “law and order” line of the Trump campaign. They also voted to deny public funds to return a Ten Commandments monument to the state capitol, and against a bill to rewrite the state’s constitution that would have made it harder to regulate big agribusiness. All this in a state that gave Trump the third-widest margin of victory in America.

Meanwhile, facing another budget meltdown and a teacher exodus, the state raised cigarette taxes to cover the shortfall only to have the supreme court rule the law unconstitutional.

“Our situation is dire,” Oklahoma finance director Preston Doerflinger said. “To use a pretty harsh word, our revenues are difficult at best. Maybe they fall into the category of somewhat pathetic.”

Governor Mary Fallin had an answer: prayer. The governor issued an official proclamation making 13 October Oilfield Prayer Day. Christians were to gather in churches and hope for a little divine intervention targeting falling worldwide oil prices. Fallin quickly back-pedalled when it was pointed out that her proclamation only included Christians. “Prayer is good for everyone,” she reasoned.

Prayer Day came and went. The price of oil has barely budged since. Three weeks after Prayer Day, however, the earth shook. A 5.0 magnitude earthquake hit the town of Cushing, a place whose claim to fame is the “Oil Pipeline Crossroads of the World”.

Maybe God had something to say about Oklahoma after all.
