Kerala Micro Small Medium Enterprises Act 2019 has overriding effect over The Kerala Panchayat Raj Act, 1994.
Civil Appeal Jolly George & Anr. v. George Elias And Associates & Ors.
The appeal is filed by the people of the locality.
Facts:
George Elias and Associates, the original writ petitioners, were engaged in undertaking road works in different parts of the State of Kerala.
They purchased Hot Mix Plants for carrying out the road works for which they bagged contracts for road work in Cherthala Aroorkutty.
Within a few months, the Kerala MSME Act came into force and hence the writ petitioners obtained an Acknowledgement Certificate.
Writ Petitioners submitted an application on 05.02.20 to the Kalloorkad Panchayat for the grant of a license, for installation of the Hot Mix Plant.
On 04.03.20 Kerala State Pollution Control Board granted “Consent to Establish”.
No response was received from the Panchayat so the Writ Petitioners claimed the benefit of deemed provision as provided in the Rules of Kerala Panchayat Raj.
Objections were raised by the members of locality.
Kalloorkad Panchayat rejected the application of the Writ petitioners for establishing Hot Mix Plant vide its order dt.12.05.20.
Rejection order was challenged before the Kerala High Court. Interim Stay was granted against the order of Panchayat.
A second Writ Petition was filed for declaration that when Acknowledge Certificate id obtained under Kerala Micro Small and Medium Enterprises Facilitation Act, 2019 than license under the Kerala Panchayat Raj Act, 19943 is not necessary.
Decision of Single judge of Kerala High Court:
The Hot Mix Plant of the writ petitioners was a portable equipment and that it does not fall within the definition of the word “building” under the Rules of 2019.
The learned Single Judge also held that after the grant of “Consent to Establish” by the Pollution Control Board, permission of the Panchayat was only formal.
Order of Single Judge affirmed by Division Bench: This view was also confirmed by the Division Bench of the High Court.
Contention of the objectors:
Panchayat has a public duty to safeguard the areas and persons within its jurisdiction against environmental pollution and that the precautionary principle requires to be applied.
Rule 3 of the Kerala Micro Small Medium Enterprises Facilitation Rules, 2020, requires all persons seeking Acknowledgment Certificate under Section 5(3) to furnish a duly filled self-certification in Form-I.
This form contains an undertaking from the applicant to comply with the Kerala Panchayat Building Rules, 2019 and hence it is contended that the writ petitioners cannot avoid the requirement of permission from the local Panchayat.
Observation of the Apex Court
Neither Single Judge nor Division Bench of the Kerala High Court had gone into the overriding effect of Kerala Micro Small Medium Enterprises Act, 2019.
Section 10(2) of the Kerala MSME Act makes it clear that the provisions of the Kerala Panchayat Raj Act, 1994 shall be read as amended to be in conformity with the provisions of the Kerala MSME Act. Therefore, the Rules framed under Kerala Panchayat Building Rules, 2019 cannot annul the effect of the statutory provisions.
Section 10 of the Kerala MSME Act does not override the provisions of any of the pollution control laws such as Environment (Protection) Act, 1986, Air (Prevention and Control of Pollution) Act, 1981, Water (Prevention and Control of Pollution) Act, 1974. The Kerala MSME Act overrides the 1994 Act and a few other local enactments.
Writ Petitioners have taken “consent” from the Pollution Control Board. Once consent is taken from the Pollution Control Board, the necessity for reading down Section 10 of the Kerala MSME Act, for the purpose of protecting the environment, does not arise.
The argument that Panchayat being the grassroot institution, has the right of participation in decision making, is again misconceived. All Panchayats want motorable roads
But if they do not want road construction materials to be manufactured within their Panchayat, we do not know where from these materials can be imported.
Decision: The Division Bench of the Apex Court comprising Hon’ble Mr. Justice V Ramasubramanian J Hon’ble Mr. Justice Pankaj Mithal J vide their order dt.12.04.2023 dismissed the appeal of the objectors and allowed the Writ Petition of the Respondents.

Proximity to Necessities: Prioritize proximity to schools, hospitals, markets, and places of worship that are important to your lifestyle. This minimizes travel time and ensures convenience.
Connectivity and Infrastructure: A well-connected plot with easy access to major roads and public transportation is crucial. Look for areas with good infrastructure development, including proper drainage, sewage systems, and electricity supply.
Peaceful Environment: Consider the overall ambience of the locality. Do you seek a bustling neighbourhood or a quieter, more serene environment? Think about noise levels, traffic flow, and proximity to commercial areas.
Future Development Plans: Research upcoming infrastructure projects or development plans in the area. These can significantly impact property values. A plot near a planned IT hub or shopping mall might be a wise investment.
Understanding Plot Types and Sizes
Plots in Mysore come in various types and sizes to suit diverse needs and budgets:
Plot Size: Standard plot sizes range from 1200 sq. ft. to 2400 sq. ft. When choosing, Consider the size of your dream home and future expansion plans.
Corner Plots: Corner plots offer additional space and better ventilation. However, they tend to be pricier.
East-Facing Plots: Plots facing east receive the morning sun, are considered auspicious in Vastu Shastra, and provide natural light. These plots may command premium Plots in Mysore.
Legalities and Documentation: Ensuring a Smooth Transaction
Before finalizing a Plots in Mysore purchase, ensure all legal and documentation aspects are in order:
Clear Land Titles: Verify the seller has clear ownership of the plot and all necessary approvals. Ask for a copy of the sale deed, conversion certificate (if applicable), and other relevant documents.
Permissions and Approvals: Ensure the plot has approvals for construction from relevant authorities like the Mysore Urban Development Authority (MUDA) or local gram panchayats.
Registered Plots: Plots are preferred to be registered with MUDA or a reputable developer. This provides greater legal security and transparency.
Understanding Plots in Mysore Costs and Financing Options
Plot prices in Mysore vary depending on location, size, and development status. Here’s a breakdown of factors affecting cost:
Locality: Plots in prime localities with superior infrastructure naturally command higher prices.
Development Status: Developed areas with existing amenities will be costlier than developing areas with potential for future development.
Size and Type: Larger plots and corner plots typically cost more.
Financing your plot purchase is crucial. Explore these options:
Home Loans: Several banks and financial institutions offer home loans for purchasing plots.
Personal Loans: Consider personal loans for smaller plots, but be aware of higher interest rates.
Savings: A significant down payment strengthens your negotiation position and reduces your loan burden.
Beyond the Basics: Additional Considerations for a Savvy Buyer
While location, legalities, and cost are essential, consider these additional factors for a well-rounded decision:
Developer Reputation: If purchasing from a developer, research their track record and completed projects.
Soil Quality: Conduct a soil test to understand the suitability of the land for construction.
Water Table Levels: Knowing the water table level helps determine foundation design and future well-drilling needs.
Future Expansion Plans: Consider potential additions or modifications to your home when choosing plot size.

Congress vs BJP As Hanuman Flag Removed In Karnataka, Situation Tense
In Keragodu village of Karnataka's Mandya, a controversy over a Hanuman flag has led to political confrontations, protests, and police intervention. The incident took place last week when a group of men erected a 108-foot flagpole and raised a Hanuman flag.
Tumblr media
Prohibitory orders under Section 144 have been issued in the village because of the tense situation.
The village panchayat had granted permission for the installation of the flagpole, but complaints were filed against it, prompting officials to request the removal of the Hanuman flag. Villagers, however, stood firm in their decision, accusing a few individuals of attempting to politicise the matter. A large police contingent was deployed, and members of the BJP, JD(S), and Bajrang Dal joined villagers in protesting against the removal.
Protests escalated on Saturday when villagers closed their shops in defiance. Yesterday, Gram Panchayat officials visited the village to remove the flag, leading to a gathering of villagers chanting slogans of 'Go Back' in protest against the officials.
The controversy took a political turn when banners of local Congress MLA Ravi Kumar were vandalised during the protests. In response, police presence was heightened in the region, anticipating further unrest.
BJP leaders and Hindu activists strongly condemned the removal of the flag. The BJP announced plans to hold protests in all districts of Karnataka, with a specific protest scheduled at Mysuru Bank Circle in Bengaluru today.
To quell the unrest, police resorted to lathi charge and replacing the Hanuman flag with the national flag on the flagpole. Official sources revealed that the flag post's installation was funded by residents of Keragodu and 12 neighboring villages, with the active involvement of BJP and JD(S) workers.
Opposition parties criticised the Congress-led government for the police intervention, with BJP leader R Ashoka condemning the government's "anti-Hindu stance." He argued that the Hanuman flag was raised with the gram panchayat's approval, questioning the sudden removal by the Congress government.
Chief Minister Siddaramaiah responded to the situation, expressing concern that a 'bhagwa dwaja' (saffron flag) had been raised instead of the national flag.
"It is not right. I have asked (the authorities concerned) to hoist the national flag."
The District In-charge Minister N Cheluvarayaswamy clarified that the flagpole's location falls under the panchayat's jurisdiction, and permission was initially obtained for hoisting the national flag on Republic Day.
"There may be politics behind it (the installation of the Hanuman flag replacing the National Flag). I don't know who is behind it …This country works under democracy and the Constitution. Tomorrow they may say they want to hoist the flag (saffron flag) in front of the DC's office. Can it be allowed? If it is permitted at one place, it will extend to other places. This is the only reservation," he said.
"We are not here to hurt our youth. I have spoken to officials, police and youths. We are ready to install the Hanuman flag at a private place or near a temple. We will support them. We too are Rama Bhaktas," he added.

"Boundary Breach: The University's Intrusion into Collegiate Affairs"
University of Calicut v. K P Ameen Rashid & another
Writ Appeal 50/2024
High Court of Kerala at Ernakulam
Tumblr media
Heard By Hon’ble Mr Justice  A Muhamed Mustaque J & Hon’ble Madam Justice Mrs Shoba Annamma Eapen J
Order pronounced on 14.02.2024 dismissing the Writ Appeal of the Calicut University. The Bench observed that the role of the University in Private Colleges is limited to the extent of ensuring that University regulations are followed or not. The University cannot assume the role of the Principal and direct the College Principal to act on their direction. There is no merit in this writ appeal. The writ appeal fails, and it is accordingly, dismissed.
This is a case that began from a complaint by a Research Scholar, C H Amal, in the Department of Physical Education from Calicut University against a student, KP Ameen Rashid, of BA (Economics) from the SEEDAC College of Arts in Palakkad District & affiliated with Calicut University enrolled for the Academic Session 2022-2025
The complainant questioned the election of Rashid as a Senate Member while being a regular student of SEEDAC College & his working as a Project Assistant with Thachanattukara Grama Panchayat.
The University enquired with the Panchayat with regards to the engagement of Ameen. Panchayat confirmed that Ameen was engaged from 9/12/2021 till 12/4/2023 as a Project Assistant.
The Vice-Chancellor heard the complainant C H Amal and student Ameen Rashid. Based on the hearing, the Vice Chancellor on 25.07.2023 directed the Principal of SEEDAC College to remove Ameen Rashid from the rolls as he had not attended class on a single day in the first semester and cancel his admission and report the same to the University.
Abiding by the instructions of the Vice Chancellor the Principal of SEEDAC College cancelled the admission of Ameen on 14.08.2023.
Ameen Rashid challenged his cancellation of admission through Writ Petition before the High Court of Kerala at Ernakulam and submitted that the University of Calicut granted affiliation to SEEDAC College in Economics quite late and to compensate for the academic loss, the College was directed to provide extra classes as well as online classes. He has attended all the online classes along with other students and his attendance is there on record of the College. And with regards to his working as a Project Assistant, it is on a daily wage basis on Holidays and he is doing work at night.
The Single Judge of the High Court set aside the order of the Principal of cancellation of Admission of Ameen Rashid & observed that out of the 9 students enrolled for the regular classes, none attended the regular classes why Ameen Rashid is singled out which is legally unsustainable.
Aggrieved by the order of the Single Judge, Calicut University went in Appeal before the High Court.
Observation of the High Court in Writ Appeal
1.      The role of the University providing affiliation to the college is confined only to the supervisory nature, and the authority to determine the factum of absence from classes lies with the Principal of the College.
2.      The Principal has no case that Ameen Rashid did not attend the classes. The Principal cannot surrender his freedom to take action against a student, to the University.
3.      If conducting classes online is not permissible, the University will have to take action against the College and not against the student who attended the classes online. If the College had conducted classes online and allowed the students to attend classes online, we do not understand why the University is showing undue interest in this matter.
4.      The complaint was concerning the first semester and the University itself had allowed Ameen to write the first semester examination. The University subsequently can’t raise any complaint while allowing Ameen to write the first-semester Examination.
5.      The University in a proceeding challenging the selection of the student in an election matter, cannot collaterally decide a question on non-attendance and decide against the student. At best, the University could only have ordered the Principal to provide a report regarding the actual attendance of the student to the University.
6.      The Principal of the College in its counter filed in Writ Petition had certified that Rashid had sufficient attendance and he had attended all the online classes.
7. The University on its own jumped from the student being elected as senate member to the inquiry regarding the attendance of the student. Attendance of the student is a regular day-to-day administrative matter falling within the domain of Principal of the SEEDAC College. It is difficult to understand why the University was taking undue interest in the matter of Ameen Rashid. When none of the 9 students enrolled for BA Economics didn’t attend the regular class and all attended the online class. The University needs to be concerned about the standards of education but not in a way of chasing a wild goose.

How to file RTI Application?
Tumblr media
What is RTI?
The full form of RTI is the Right to Information, which is governed by a revolutionary law namely, the Right to Information Act, 2005. The main objective of RTI Act is to promote transparency in government institutions in India.
Until the RTI Act gave the common man the right to seek information from the government, only members of Parliament had the privilege of accessing this information. If you are concerned about your business or as a citizen who wants to know anything about any activity of any government department then RTI is a useful tool to get information from the government department. That information can be used constructively for your purposes.
This law is very comprehensive and covers almost all matters of governance. The law has a broad reach, applying to all levels of government — central, state and local — as well as to recipients of significant government funding.
How to file an RTI application?
Get the address of the Public Information Officer from the website of the organization.
Write the RTI application form in English/Hindi/state official language addressed to Public Information Officer and ask your questions clearly.
Write your full name, contact details and the address where you want your RTI information/response to be sent.
There is no prescribed format of application for obtaining information. The application can be made on plain paper.
The recipient need not state the reasons for seeking the information.
Steps for RTI Application Online
Department of Personnel and Training has launched a web portal called RTI online for all Union Ministries/Departments with URL www.rtionline.gov.in.
It is a facility for Indian citizens to file RTI applications and first appeals online to all Union Ministries/Departments.
The prescribed RTI fee can be paid online as well.
Reply to RTI applications and first appeals received online can also be filed online by the concerned PIOs/FAAs.
What is fee and modes of payment of fee for RTI application?
A citizen who wants to get some information from a public authority can send a demand draft or banker’s check along with the application or Rs. 10/- (Rupees Ten) Indian Postal Order, payable to the Accounts Officer is required. of a public authority as a prescribed fee for obtaining information. The fee can also be paid by cash to the Public Authority or Assistant Public Information Officer, against proper receipt. Payment of fees to Central 8 Ministries/Departments can also be made online through State Bank of India Internet Banking or through Master/Visa Debit/Credit Card.
The following are the modes of payment of fees for online applications:

MasterCard/Visa Credit/Debit Card.
Note: It should be noted that as per the RTI Rules, 2012, the RTI fee is not required to be paid by a citizen living below the poverty line. However, the BPL applicant must attach a copy of the appropriate government issued certificate in this regard with the application.
What is the period for information supply?
Generally, the information will be provided to the applicant within 30 days of receipt of the application by the public authority. If the information sought relates to the life or liberty of a person, it shall be provided within 48 hours.
What Government bodies that are covered under the RTI Act are RTI information?
All government agencies, whether under the state government or the centre, come under the ambit of the Act.
Municipal Corporations, PSUs (Public Sector Units), Government Departments, Ministries at State and Central Levels, Judiciary, Government Owned Companies, Government Universities, Government Schools, Construction Departments, Road Authorities, Provident Fund Department etc.
Not only governments and their departments, but even smaller units like your city corporation or village panchayat come under RTI.
