I was wondering, what are the rules about different types of cases lawyers can take, and what types can Matt do? I know he’s a defense attorney officially, but can/does he take on different cases? Could he work as a prosecuting attorney, or in another area (like custody law or criminal prosecution)? What even are the different areas lawyers work in (past just civil/criminal)?
Also, for criminal trials I was wondering if the victim pays anything. Like if a victim is robbed and presses charges, do they have to get a lawyer to prosecute or does the state appoint one? And do they have to pay for this lawyer or does the state pay? (I think for civil everyone pays but criminal is different)
Thank you in advance ☺️
These are great questions!
So lawyers can take on different cases as long as they remain ethical - and as long as they can get hired. ;) The main ethical rules that would apply (as far as I know...my knowledge of the ethical rules is more limited to criminal law nowadays) are the rules that relate to: 1) a conflict of interest; and 2) competence.
The conflict of interest rules mean that a lawyer can't take on a case that is in conflict with a case they already have. So say Matt is functioning as a criminal defense attorney for Client A; he can't simultaneously represent Client A's co-defendant, Client B unless both Client A and Client B waive the conflict of interest because you never know when Client A's defense might clash with Client B's defense.
(A common example is drug possession cases, where A and B are both found in a vehicle with drugs. A might say "The drugs belong to B!" and B might say "The drugs belong to A!" and the same defense attorney can't argue both positions.)
Or say Client A is a criminal defendant charged with battery against Client B, and Client B is suing Client A in civil court over the same incident. Matt could represent Client A in both criminal and civil court, but he couldn't represent Client A in criminal court and then turn around and represent Client B against Client A in civil court.
The other ethical rules at play are those relating to competence. It is unethical for an attorney to take a case that they aren't competent (or couldn't reasonably become competent) to handle. If Matt knew absolutely nothing about, say, wills and trusts, it would be unethical for him to agree to draft someone's will or trust. This also goes to just...time management. If Nelson & Murdock have too many cases, there hits a point where they can't ethically take more cases because they wouldn't have the time to competently handle them.
Not even gonna comment on how this relates to the Frank Castle trial because I'm pretending that trial never happened.
And Matt could never be a prosecutor while working as a criminal defense attorney. He could stop practicing criminal defense and switch over to prosecution, but he can't do both simultaneously. The conflict of interest is just unavoidable, and besides, no prosecutor's office would hire him if he were still doing criminal defense work.
That said, in canon, we see Matt take on many cases, both criminal and civil, simultaneously. Aside from his criminal cases, we also see him handle the following types of civil cases:
Property (as when he represents Elena Cardenas against her landlord);
Employment (and possibly immigration?) (as with Ms. Jacinto in S2E1);
Standard negligence (I think? I think Mr. Marino is being sued for negligently handling his dog by allowing his dog to "defile" the statue in S2E1?); and
Products liability (as with the Aaron James case).
Other areas of law that I imagine he could handle would be family law (divorce, custody, child support, etc.), other negligence claims (like a company that negligently leaves their floors slippery, and someone gets hurt, commonly called a "slip-and-fall" case) (there are literally so many types of negligence claims oh my gosh), and intentional torts (which often have criminal analogs, like assault and battery).
He can do all of these while still handling criminal defense cases, as long as there's no conflict of interest, and as long as he's competent.
As for victims: you're right that it's different between civil and criminal law; in civil law, the (alleged) victim has to pay for their attorney unless the attorney takes the case pro bono.
But in criminal law, it's very important to note that victims don't have attorneys. This is because, although the victim is one victim of the crime (obviously), the other victim of the crime is actually the state.
So for example, if Frank were prosecuted for shooting Grotto...then yeah, Grotto is the victim of Frank's violence, but so is the entire State of New York. That's why criminal cases are labeled "State vs [Defendant]."
Therefore, prosecutors represent the State - they do NOT represent the individual victim. The reason this is so important is because the victim and the State may actually have different interests...or, at least, think they have different interests.
The clearest example of this is domestic violence. Say you have a guy who's been abusing his wife for years, but she, for myriad reasons, doesn't want to leave him. Nor does she want him to be prosecuted. Maybe this is because she loves him, or thinks she loves him. Maybe this is because she's afraid of what will happen to their kids if he's incarcerated. Maybe she relies on him for money, and she needs him to stay out of prison so he can keep providing. There can be so, so many reasons.
However, the State does want this guy prosecuted. The State wants this guy to, at minimum, be put on probation which would require him to get a domestic violence evaluation (which would assess mental health concerns and factors that might exacerbate his behavior) and, based on the evaluation, court-ordered domestic violence counseling. The State may or may not also want a No-Contact order between the guy and his wife, and possibly between the guy and his kids, unless and until he gets better at controlling his violence and/or addressing whatever underlying issues he may have.
A good prosecutor will listen to the victim and hear them out, but the prosecutor does not represent the victim, and the victim does not decide what happens in the criminal case. And so, at the end of the day, the prosecutor is not required to dismiss a case even if that's what the victim wants.
And yes, that is one of the hardest and heartbreaking parts of being a prosecutor.
That said, a victim in a criminal case can also bring a civil case against the defendant. This is important because although a criminal conviction can impose certain penalties (like probation, jail time, and court orders like the aforementioned counseling), criminal convictions can't give the victim any money except for basic restitution.
So for example, if a defendant beats someone up, they'll have to pay for medical bills and things like that. But the defendant won't have to pay for additional damages (like for the pain and suffering experienced by the victim, or for counseling the victim might need to cope with the experience) unless the victim brings a civil case against the defendant. And as I said before, the victim would generally have to pay for that.
Okay I feel like this was kind of a rambly answer...does this make sense?

The Great Pro-Wrestling Adventure Hour presented by The Ring - 032 12/21/23 Defy TV 4:00 PM - 5:00 PM EST Filmed at WCPO TV Studios in Cincinnati, Ohio
Tumblr media
- Daphne Oz, Veda Scott, Sam Leterna, and Alyssa Marino of The Ring opened the show with Daphne explaining that unfortunately Santa Claus will not be appearing on today's program. Apparently a lot of children on the naughty list have seen the error of their ways and Santa is working overtime to get their presents ready in time for Christmas. The hosts said they would like to take this unexpected opportunity to shed some light on an important issue. They had met an unhoused man that had been living by the studio, despite his circumstances he still dresses in a Santa outfit every day and tries to bring joy to the young wrestling fans that line up before our tapings. They brought in their special guest for the day, Sylvester Carroll.
Tumblr media
The TrustBusters (Sonny Kiss and Trench) vs. Piper and Prima Donny The TrustBusters defeated Piper and Prima Donny via submission with the inverted full nelson from Trench on Piper.
- Daphne Oz said that oranges and clementines are popular presents this time of year, but how often have you received the gift of clementines for Christmas and you just can't finish the entire bag before they go bad? Daphne shared some recipes you can make using clementines, including clementine pound cake, clementine sugar cookies, a white chocolate and clementine yule log, and clementine granita. Sylvester Carroll was seated at the head of the table and enjoyed a serving of each.
Tumblr media
Starboy Charlie and Marcus Mathers vs. Alex Taylor and Ricky Morton Starboy Charlie and Marcus Mathers defeated Alex Taylor and Ricky Morton with the Gotch piledriver from Starboy on Morton.
- It was time for the hosts of The Ring to open their presents as special guest Sylvester Carroll continued to snack on Daphne Oz's clementine sugar cookies. Sam Leterna opened her gift first, an oversized faux-mohair scarf. Veda Scott opened the next present, and they received a classic cable knit beanie and matching mittens. Alyssa Marino was up next, and she was gifted a lovely poncho style cardigan. Daphne Oz opened the final gift, a plush fleece loft blanket. As thrilled as the hosts were with their gifts, they couldn't help but turn their attention on Sylvester Carroll. One by one our hosts gathered their presents and gifted them to Sylvester, who was overwhelmed by the gesture and thanked them for showing the true spirit of Christmas.
folkstyle (Shaw Mason and Tim Bosby) vs. Hunter Holdcraft and Giant Baba Yaga
Tumblr media
- folkstyle tried to double team Holdcraft, but a big boot from Giant Baba Yaga sent Shaw Mason through the ropes and to the floor. Baba Yaga followed Mason to the outside, but a masked man appeared from the crowd and attacked Baba from behind. Holdcraft noticed the sneak attack and seemed poised to help, but Bosby grabbed Hunter from behind and pulled him into the rip cord lariat. folkstyle defeated Hunter Holdcraft and Giant Baba Yaga with the rip cord lariat from Bosby on Holdcraft
Tumblr media
- The masked man removed his hood to reveal former amateur wrestling star at Kent State, Nic Nemeth. Nemeth, Mason, and Bosby celebrated their victory and demanded the match against 2023 Trios Kingdom winners The 37KAMIINA on Christmas night in Bethlehem.
- The Ring Crew said their farewells to special Christmas guest Sylvester Carroll who insisted that he be on his way despite the hosts inviting him to stay. Sylvester, his arms full of the gifts he had received left the set. As the hosts returned to their desk, Veda Scott realized that Sylvester had forgotten his bindle, but as the four ran outside after him they saw he was gone. The Ring Crew returned to the studio and when Veda set the bindle down it teetered over and four presents spilled out, all wrapped and labeled, with each gift addressed to one of the hosts. As the four unwrapped their presents they found the same exact gifts they had unwrapped earlier. The four were amazed by this, and as they tried to find the words to describe what had just transpired we went to commercial break.
SHIMMER Tag Team Championship Tournament - Semi-Finals:
Tumblr media
Queen Aminata and Raychell Rose vs. Hyan and Kylie Paige - Kylie Paige went for the Code Red on Queen Aminata, but Raychell Rose broke it up with a spear. This sent Paige to the mat while Aminata rolled through into a cradle pin. Queen Aminata and Raychell Rose defeated Hyan and Kylie Paige with a rolling cradle from Aminata on Paige.
- Sonny Kiss and Trench came down to ringside to mock Hyan and Kylie Paige about their loss. Aminata and Rose stood up for their opponents, and Kiss and Trench seemed ready to fight until Big Dan Champion and Joshua Bishop also made their way to ringside.
- Daphne, Veda, Sam, and Alyssa were still trying to make sense of what happened earlier with Sylvester Carroll. Veda asked, "you don't think he was the real…" before in unison the four dismissed the idea. Just then sleigh bells could be heard from outside the studio followed by the sounds of reindeer hooves. The four ran to the stage door and looked up into the night sky only to hear a loud "HO! HO! HO!" somewhere in the distance.

Joann Villeneuve: ‘Gilles was ruthless but very conscious of the dangers’
A new documentary charts the Canadian’s rivalry with his Ferrari teammate Didier Pironi that ended tragically in 1982
Giles Richards @giles_richards Tue 21 Mar 2023 18.43 GMT
If the death of Gilles Villeneuve at the Belgian Grand Prix at Zolder in 1982 left Formula One traumatised, it was infinitely harder on his wife Joann. More than 40 years on and the emotion still runs high as she recalls the controversial events of that season. So raw have been the wounds, it is only now she has felt able to address them and time has not assuaged the strength of her feelings.
Villeneuve, his wife and family and his former Ferrari teammate Didier Pironi are the subjects of Villeneuve Pironi: Racing’s Untold Tragedy, the newly released film on Sky Documentaries and Now TV. It is a superb feature, telling the gripping but tragic story of the two drivers whose relationship fell apart over the course of one race in 1982 at Imola shortly after which Villeneuve died and Pironi’s career ended in an horrific accident at Hockenheim. The documentary is even-handed and does its best to put both drivers’ sides of the story, but making it brought back the emotions of the time for Joann.
“It was just too difficult to tell the story before,” she says. “But when I decided this was the time, you realise that the emotions you had at the time are still the same. That the facts are the facts and you can’t change them. Emotions go with those and the biggest one was the betrayal. Sometimes you think: ‘Maybe I overreacted at the time’ but then you realise no, it’s still how I see it today.”
The Lotus-Renault of Ayrton Senna leads the Williams-Honda Nelson Piquet at the Hungaroring during the 1986 Hungarian Grand Prix.
The film contains a wealth of footage, much never before seen from a different era of racing. In 1982 the turbo engines had become both reliable and fearsomely quick and before the season began Ferrari appeared to have mastered it with the 126-C2 expected to lead the field, pitting Villeneuve and Pironi in a fight for the title.
Villeneuve, 32 and already acknowledged as one of the greats, was in his fifth year in F1 and with Ferrari. His fierce but fair fight with René Arnoux at the 1979 French GP remains one of F1’s finest battles. Enzo Ferrari personally had gone after Pironi and signed him from Ligier in 1981. He was the considered driver to Villeneuve’s more swashbuckling style but they made a formidable team and in 1981 they enjoyed a friendly, if competitive relationship.
It did not last. In the fourth round in 1982, the San Marino GP at Imola, the two leading Renaults retired leaving Villeneuve and Pironi holding a one-two. They vied thrillingly with one another until Ferrari issued their “Slow” order – which remains at the heart of the controversy.
Villeneuve, leading, contended that the order meant to hold station to ensure a one-two. Pironi argued that it meant exercise care but did not restrict overtaking. He duly attacked and passed Villeneuve on the final lap going into the Tosa hairpin to take the win.
Ferrari teammates Gilles Villeneuve and Didier Pironi racing at Imola in 1982Ferrari teammates Gilles Villeneuve and Didier Pironi at Imola in 1982, the race when their friendship ended. Photograph: Hoch Zwei/Corbis/Getty ImagesVilleneuve was furious. “Before this, our relationship had always been good and I trusted him,” he said. “But I won’t make that fucking mistake again.”
This was the betrayal Joann cannot forgive. “For Gilles, loyalty was such a strong thing that he never imagined it could happen,” she says. “The anger he felt was mixed up with the disappointment he felt at having been deceived by Didier.”
It is impossible to ignore the air of sadness in her voice, that her husband’s reaction was so intense because it was an affront to his inherent sense of fair play.
“Gilles was ruthless as a driver but on track he was very conscious of the dangers,” she says. “Gilles was a fair and honest driver, everyone saw that with Arnoux in Dijon, they were banging wheels but they still had enough respect for each other. That’s what racing was for him, not going against team rules to win.”
At the next round at Zolder, with Pironi just ahead of his teammate in qualifying, Villeneuve went out again to try to beat him in the final 10 minutes. At the Terlamenbocht corner he came up on the slow-moving March of Jochen Mass, who went right, off-line to give Villeneuve room, but the Canadian also went right. They touched wheels and Villeneuve’s car was launched into the air, before cartwheeling into the ground. Villeneuve was thrown from the cockpit and suffered a neck fracture. He died in hospital later that day.

Photograph: Grand Prix Photo/Getty ImagesFor decades speculation has surrounded the event, focused largely on whether Villeneuve was trying too hard on the lap, his judgment clouded by his smouldering anger at Pironi. As Alain Prost notes pointedly in the film: “In motor racing emotion is dangerous.”
Forty years on, Joann asserts her belief this was certainly not the case. “He was still angry but when Gilles was in the car he was in a bubble and nothing else could enter it. He was in a racing mode and whatever was happening outside did not really affect the driving. The accident was really a misunderstanding with Jochen. Jochen was trying to get out of the way, Gilles thought he would stay there, it was just a stupid mistake by both of them, it wasn’t really anyone’s fault. It might have happened anyway without the Imola event.”
The sport was left shaken, as was Pironi. At the Canadian GP, he stalled on the grid. Behind him the rookie Riccardo Paletti ploughed into his car at high speed and Paletti was killed. By August at the German GP, Pironi was in with a shot of the title but some were questioning his judgment since the death of Villeneuve. He had already secured pole but during a practice session testing new wet-weather tyres he pushed the car at breakneck speed in the rain.
Unsighted by spray he hit the rear of Prost’s Renault and was launched into the air in an accident similar to Villeneuve’s. He survived but the damage to his legs was such that he would never return to F1. Five years later in 1987, having taken to powerboat racing, he was killed, aged 35, in an accident in the Needles Trophy race on the Solent. He left his girlfriend, Catherine Goux, pregnant with twins. She would later name them, with Joann’s permission, Gilles and Didier. Gilles now works for the Mercedes F1 team.
Today, Joann does have sympathy for Pironi in that she believes he bore a burden after her husband was killed. “I think he was taken aback by Gilles’ reaction,” she says. “I think he thought he could fix it but then with Gilles passing he could not fix it. It was a heavy load he had to carry also.”
But what about her, after all these years, revisiting the events and feelings now? Has it been hard to deal with?
“I feel it’s all part of your bag of memories, some are good, some are bad,” she says, after a thoughtful pause. “Some are wonderful, some are intense. Everything you go through good or bad stays with you and builds you, you can’t throw anything out, it’s all there.”

Tumblr media Tumblr media
Prediction(s): All Quiet on the Western Front/Top Gun: Maverick
It's usually a war/military movie or a musical that wins the Sound award. Topgun: Maverick seems to be a strong competitor because of the Action-filled dogfighting scenes and final combat in the climax. Western Front is also a strong contender because of the battle scenes.
Best Production Design
Nominees:
All Quiet on the Western Front – Production Design: Christian M. Goldbeck; Set Decoration: Ernestine Hipper
Avatar: The Way of Water – Production Design: Dylan Cole and Ben Procter; Set Decoration: Vanessa Cole
Babylon – Production Design: Florencia Martin; Set Decoration: Anthony Carlino
Elvis – Production Design: Catherine Martin and Karen Murphy; Set Decoration: Bev Dunn
The Fabelmans – Production Design: Rick Carter; Set Decoration: Karen O'Hara
Tumblr media
Prediction: Elvis
From the 1950s to the 1970s, the sets well-exhibit the story of the King of Rock n Roll - from his home to the carnivals to the stadiums to the TV and recording studios to the lavishing hotels of Las Vegas.
Best Cinematography
Nominees:
All Quiet on the Western Front – James Friend
Bardo, False Chronicle of a Handful of Truths – Darius Khondji
Elvis – Mandy Walker
Empire of Light – Roger Deakins
Tár – Florian Hoffmeister
Tumblr media
Prediction: All Quiet on The Western Front
It's because the camera work of James Friend captures the horrors of the First World War. The fighting in broad daylight is realistic and gives chills every time you see it.
Best Makeup & Hairstyling
Nominees:
All Quiet on the Western Front – Heike Merker and Linda Eisenhamerová
The Batman – Naomi Donne, Mike Marino, and Mike Fontaine
Black Panther: Wakanda Forever – Camille Friend and Joel Harlow
Elvis – Mark Coulier, Jason Baird, and Aldo Signoretti
The Whale – Adrien Morot, Judy Chin, and Anne Marie Bradley
Tumblr media
Prediction: Elvis
Is it possible to make a movie on Elvis Presley without his puffed hair and sideburns? Hairstyles play a crucial role in his era of the 1950s-70s.
Best Costume Designing
Nominees:
Babylon – Mary Zophres
Black Panther: Wakanda Forever – Ruth E. Carter
Elvis – Catherine Martin
Everything Everywhere All at Once – Shirley Kurata

The film is all about colors, nostalgia, and costumes of the Presley years.
Best Film Editing
Nominees:
The Banshees of Inisherin – Mikkel E. G. Nielsen
Elvis – Matt Villa and Jonathan Redmond
Everything Everywhere All at Once – Paul Rogers
Tár – Monika Willi
Top Gun: Maverick – Eddie Hamilton
Tumblr media
Prediction: Top Gun: Maverick
The editing of the sortie scenes and the final aerial battle is what makes the Top Gun sequel the ultimate winner of the editing award.
Best Visual Effects
Nominees:
All Quiet on the Western Front – Frank Petzold, Viktor Müller, Markus Frank, and Kamil Jafar
Avatar: The Way of Water – Joe Letteri, Richard Baneham, Eric Saindon, and Daniel Barrett
The Batman – Dan Lemmon, Russell Earl, Anders Langlands, and Dominic Tuohy
Black Panther: Wakanda Forever – Geoffrey Baumann, Craig Hammack, R. Christopher White, and Dan Sudick
Top Gun: Maverick – Ryan Tudhope, Seth Hill, Bryan Litson, and Scott R. Fisher
Tumblr media
Prediction: Avatar: The Way of Water
Cameron's film can become the first sequel to win the same award in this category. The beautiful visuals of the world of Pandora would surely take the trophy home.
