New Jersey can sue the gun industry under a “public nuisance” law, a federal appeals court ruled Thursday, handing a major victory to the state after last year’s U.S. Supreme Court decision loosening public carrying restrictions.
The Third Circuit Court of Appeals’ dismissal of a challenge brought by the National Shooting Sports Foundation last year comes as New Jersey and other states look for novel ways to balance public safety with gun rights under the high court’s June 2022 ruling in New York State Rifle & Pistol Association, Inc. v. Bruen.
New Jersey’s public nuisance law, signed by Democratic Gov. Phil Murphy a month later, may offer a template to other states following Thursday’s ruling, which said the shooting foundation “jumped the gun” in its challenge and did not justify the court’s intervention. Other blue states, such as Delaware and California, have enacted similar measures designed to open the gun industry to legal action.
“Because the Foundation’s case is not yet fully formed, we will vacate the preliminary injunction and remand with instructions to dismiss this action for lack of jurisdiction,” the court wrote.
Judge Zahid N. Quraishi had temporarily blocked the law from taking effect earlier this year, saying it appeared at odds with the federal Protection of Lawful Commerce in Arms Act of 2005, which shields the gun industry from lawsuits when their products are used during the commission of a crime. However, the ruling said that the foundation’s theories of the law’s harm to its members “fail” because they offered vague allegations, and it did not show a substantial threat of the law’s enforcement.
The sports foundation disagreed with the decision and noted that it did not say the state law doesn’t violate the federal commerce act, but “it clearly does.”
“Should New Jersey’s attorney general attempt to enforce the law, we will immediately refile our complaint,” Lawrence G. Keane, senior vice president and general counsel for the foundation, said in a statement.
The Murphy administration signed the public nuisance law as part of a series of gun reforms. It is a relatively new approach that would allow the state to sue the firearms industry over public nuisance violations for the “sale, manufacturing, distribution, importing, or marketing of a gun-related product.” The state attorney general, Matt Platkin, created a new office “with the specific mandate of bringing civil enforcement actions against firearm companies.” Platkin said New Jersey’s was the first such office in the country.
“Our law never should have been enjoined, and now it will be back in effect in its entirety,” Platkin said in a statement. He called the law “an important public safety tool” and the new office is “dedicated to holding accountable those whose unlawful conduct causes bloodshed, and fuels the gun violence epidemic, for the sake of their bottom line.”
Murphy said he is “thrilled” by the ruling and his administration “will always fight for the safety of New Jersey residents, even when it means taking on gun sellers that put profits above innocent lives.”

SpaceTime is Australia’s most popular and respected astronomy and space science news program – averaging over two million downloads every year. We’re also number five in the United States.  The show reports on the latest stories and discoveries making news in astronomy, space flight, and science.  SpaceTime features weekly interviews with leading Australian scientists about their research.  The show began life in 1995 as ‘StarStuff’ on the Australian Broadcasting Corporation’s (ABC) NewsRadio network.  Award winning investigative reporter Stuart Gary created the program during more than fifteen years as NewsRadio’s evening anchor and Science Editor.  Gary’s always loved science. He studied astronomy at university and was invited to undertake a PHD in astrophysics, but instead focused on his career in journalism and radio broadcasting. He worked as an announcer and music DJ in commercial radio, before becoming a journalist and eventually joining ABC News and Current Affairs. Later, Gary became part of the team that set up ABC NewsRadio and was one of its first presenters. A federal judge on Wednesday blocked California’s attorney general from enforcing a new law that allows residents, the state and local governments to sue members of the firearms industry that manufacture or sell “abnormally dangerous” guns.
U.S. District Judge Andrew Schopler in San Diego sided with a firearms industry trade association in finding that part of a gun control measure signed into law by Democratic Gov. Gavin Newsom in 2022 was likely unconstitutional.
That law, the Firearm Industry Responsibility Act, was enacted shortly after the conservative-majority U.S. Supreme Court issued a landmark ruling in June 2022 concerning the U.S. Constitution’s Second Amendment that significantly expanded gun rights.
Newsom, in signing the new state firearms restrictions into law in July 2022, called them necessary to ensure makers of deadly firearms could be held accountable in court and could “no longer hide from the mass destruction that they have caused.”
But in a lawsuit filed in May, the National Shooting Sports Foundation (NSSF) argued California’s restrictions violated several provisions of the U.S. Constitution including the Second Amendment, which protects the right to keep and bear arms.
Schopler, an appointee of Democratic President Joe Biden, did not address the Second Amendment issue in Wednesday’s ruling and instead found the law likely violated the Constitution’s so-called dormant Commerce Clause, which restricts states from interfering with interstate commerce.
For example, he said, a Tennessee company that manufacturers guns that are legal in its state but that meet California’s definition of “abnormally dangerous” could still face liability under the law even its products were shipped to nearby Arizona and used later to commit a crime in California.
“Because the ‘abnormally dangerous’ firearm rule reaches beyond California’s borders and directly regulates out-of-state commercial transactions, it likely runs afoul of the dormant Commerce Clause,” Schopler wrote.
He issued a preliminary injunction barring California Attorney General Rob Bonta, a Democrat, from suing NSSF’s members while the lawsuit moves forward. Bonta’s office did not respond to a request for comment.
Lawrence Keane, the NSSF’s general counsel, in a statement welcomed the ruling, saying the law “attempts to use the real threat of liability on commerce beyond California’s border and impose its policy choices on other states.”
The judge dismissed other parts of NSSF’s lawsuit challenging other provisions of the law, citing a lack of standing, though he allowed NSSF to amend its complaint to try to address those issues.

May 24th, 2022 was awards day at Robb Elementary School in Uvalde, Texas. Fourth grader Mayah Zamora won three of them – in math, robotics, and for making the honor roll. Not long after the ceremony, an 18 year-old walked into the school with an AR-15 style Daniel Defense rifle and started shooting.
Nineteen children and two teachers were killed. Zamora was airlifted to the hospital and has had more than sixty surgeries in the year since. Zamora's mom, Christina, says her daughter had been a fearless child before the shooting.
"Mayah shows a fear of this world that she had never shown before," she says. "Someone unexpectedly knocking on the door is a scary trigger for her."
Last year, the Zamoras became the second family to file a lawsuit against law enforcement, the school district, the gun store, and the maker of the weapon, Georgia-based Daniel Defense.
Federal law protects the firearms industry from lawsuits if their products are misused. But the law has exceptions, and the lawsuits allege that Daniel Defense can be held liable for what happened because of how they market their products.
"We need to speak up, for our daughter, for our family, for children in the future, maybe this will make a change," Christina Zamora says. "Nineteen children died. They were massacred. By an 18-year old boy. There's something wrong there."
In 2005, Congress granted broad immunity to gun manufacturers. But some legal experts believe exceptions allow gunmakers to be held partially responsible for these mass shootings if they deceptively marketed their products in violation of the law.
Georgia State University Law Professor Timothy Lytton, an expert on health and safety regulation, says Daniel Defense is notorious for its provocative marketing.
The lawsuits argue that the company violated federal trade law by unfairly marketing its products to civilians as tools for offensive, military-style operations.
"And they also allege that the placement of this AR-15 style weapon in video games allowed young men in particular to fantasize about use of this weapon in a way that would simulate the kind of violence that we saw in Uvalde," Lytton says.
After the Sandy Hook school shooting, some families of the victims made a similar argument in the Connecticut courts against the gunmaker Remington, which was in bankruptcy. And while the families won a seventy-three million dollar payment, it didn't create a sea change.
"It's not like a manufacturer came to the table and said, 'We admit liability here for the carelessness of our marketing practices.' This was a bankruptcy in which bankruptcy creditors paid out in order to get the company back into business," Lytton says.
The U.S. Supreme Court declined to take up the case on appeal. So while gun control supporters cheered the settlement, the litigation left many legal questions unresolved. One big question is whether violations of the Federal Trade Commission Act even apply to the exceptions allowed under that sweeping immunity law. As a result, the Uvalde lawsuits against Daniel Defense could be the biggest test yet of the extent of the firearms industry's liability protections.
The cases have been filed in federal court in Texas, with the help of Everytown Law, an arm of the group Everytown for Gun Safety.
Daniel Defense didn't respond to an interview request, but has called the lawsuit politically-motivated and legally unfounded.
Mark Oliva is managing director of public affairs for the National Shooting Sports Foundation, a trade association for the firearms industry.
"Trying to sue a firearm manufacturer for the crimes committed by a remote third party would be the same thing as trying to sue Ford and Annhauser Bush for the deaths caused by drunk driving," Oliva says.
Even if the Uvalde cases clears the stringent immunity law and are allowed a trial, the courts would still have to consider another set of thorny questions, like whether the company's marketing is protected by the first amendment.
But Lytton says whatever happens, these liability cases put more focus on gunmakers.
"You only need one or two lawsuits to win to transform the whole industry," Lytton says. "If it got planted in Connecticut, and it flowers in Uvalde, that might be enough. And if it never takes root there, it's likely to pop up in Chicago. Or California."
Some states are passing laws that would make it easier to file these suits against gunmakers, but Oliva says the industry is pushing back.
"Are we going to bend to the idea that we're going to suffer death by a thousand cuts? I think your answer to that is we're challenging the law in New York. We're challenging the law in New Jersey. We're challenging the law in Delaware," Oliva says.
Back in Texas, the Zamoras want to make Wednesday's anniversary as normal a day as they can. Right now, they're focused on their daughter's recovery.
But they hope accountability will come, too.
