So, in Brazilian police brutality news, outgoing president Jair Bolsonaro has just pardoned the cops responsible for the massacre of 111 prisoners.

The last Christmas pardon signed by President Jair Bolsonaro (Liberal Party), published this Friday (December 23th, 2022) in the "Official Gazette" of the Union, brings an unprecedented article that grants pardon to all the 74 military police officers convicted of the Carandiru massacre, which took place in 1992, in Sao Paulo.
"A Christmas pardon will also be granted to public agents who [...], in the exercise of their function or as a result of it, have been convicted, even if provisionally, for an act committed more than thirty years ago, counted from the date of publication of this Decree , and not considered heinous at the time of its practice", says article 6, non-existent in previous pardons."
The pardon is oddly specific even though it doesn't directly mention names or events. The Carandiru massacre was only considered heinous in 1994, two years after its occurrence. Furthermore, all the responsible cops were all on work — and thus, as a result of their duties — and the case goes beyond the 30 years cited.
The presidential pardon was one of the last hopes left for the police officers convicted of the massacre, as the Superior Court of Justice and the Supreme Federal Court had already analyzed the police officers' appeals and decided on a final and unappealable decision. It remained for the Court of Justice of São Paulo to analyze the penalties – called dosimetry – to assess whether or not they are appropriate.
The police officers ran the risk of immediate arrest after the analysis of the sentences, because there are no more appeals available to the higher courts, according to prosecutors and judges heard by Folha.
The cops were sentenced to sentences ranging from 48 to 624 years. The convictions relate to 77 murders with firearms. The Public Prosecutor's Office excluded 34 victims from the total because there was doubt as to whether they had been targeted by the police or attacked by the prisoners themselves, such as those wounded by a bladed weapon.

Carandiru prison massacre closer to resolution

Supreme Court Justice Luís Roberto Barroso on Thursday ruled as final and unappealable two decisions related to the convictions of the police officers who carried out the Carandiru massacre in 1992, the deadliest case of prison violence in Brazil’s recent history.
The ruling means that the case will receive no further decisions at the Supreme Court level.
The Supreme Court’s press office clarified to The Brazilian Report that Justice Barroso’s rulings are final, but the same is not true for the convictions themselves. The case is sealed, and the documents are not public.
In October 1992, inmates at the Carandiru prison in São Paulo staged a riot that was brutally quelled by law enforcement, with 111 men killed in just 30 minutes. The officers claimed self-defense, but the murdered men were unarmed and several had bullet wounds in the back of their heads, a clear sign of execution.
