"Taylor-made deals: how artists are following Swift’s rights example"

Prince and George Michael are bleak warnings from history, but the moves by Swift, Rodrigo and others can stand as roadmaps for the future. It also means the music industry has had to adapt away from contracts based on ownership. There are two kinds of rights at stake here: the rights to the master recordings of an artist’s work, and songwriting rights, known as publishing. One senior music publishing executive says their part of the business was ahead of the curve, explaining that publishing deals tend to work on exclusive licensing terms or retention periods. “Publishers pivoted from a rights-ownership business to the servicing of rights,” they say. Those retention periods are getting shorter, they add, down from about 25 years three decades ago to between 12 and 15 years today.
David Martin, CEO of the Featured Artists Coalition, says there is “a propensity towards owning rights” for artists, but some acts are still prepared to sign away ownership for what they think might be their only shot at the big time. “We have members who are still signing major label deals,” he says. “Some of the terms in some of those deals are terms that we’d expect artists to be thinking very carefully about.”
Message [,Brian - a partner at Courtyard Management] says he steers acts away from ownership-based contracts. “We have a default position that we won’t advise our artists to do life-of-copyright deals,” he says. “It’s not that we wouldn’t do them, but our strong advice would always be to come up with a licence arrangement of some description.”
This is the ideological underpinning of BMG and AWAL (Artists Without a Label), which is now under the ownership of Sony Music Entertainment. “The philosophy is flipping the relationship,” says Alistair Norbury, president of repertoire and marketing at BMG UK. “There had to be a fairer and more transparent way to work with the creative community.”
Acts on BMG’s roster – notably Kylie Minogue, Suede, Sigur Rós and Louis Tomlinson – are on licensing or assignment deals, so ownership of the recordings eventually reverts to them. “They want to be with a record label where they have creative control and ownership coming back to them at some point,” says Norbury.

Norbury believes that, with more choices for acts, music companies have to repeatedly prove their worth and think about mutual gains rather than offering one-sided deals that are land grabs for all the rights. He says, “You want something successful in a longterm partnership rather than owning something that failed.”

Hi Daisie, BMG only release Louie's music? Louis has no label? And is it possible that not having a label justifies the reason why Louis's streams are low? this mean that BMG doesn't provide Louis with any funds for recording music? Louis make music and mv at his own expense? Sorry for so many questions , I'm a little confused about how Louis do these thing without any label.
Hi dear,
I don't think we can know all the intricacies of Louis' contract at all unless we read it, and we can't. So all we have is whatever they release to the press and educated opinions.
Louis is technically an independent artist. He signed a deal with BMG, specifically a global partnership, for FITF, which means BMG act as his label for this album release and cycle. As far as we know, that includes everything a regular record deal would give an artist, such as development, promotion, distribution, tour etc etc. He's not using his own money, the label is paying for studio, song writers, producers, promo, video and photo editors, online marketing, music video production, distribution of CDs and the album, promo interviews and appearances, album-related travel, etc etc.

 Louis Tomlinson's Faith In The Future, his first album with BMG, has soared to Number One in the UK, his best solo chart performance yet.
In the UK, the album, Tomlinson's second solo release, sold more than twice as much as its predeccor Walls. Additionally, internationally, the album debuts at number two in Germany and Australia.

His vision for his music has been front and centre, and we have been very focused on backing that vision. Faith In The Future has been a passion project for the singer who reveled in taking his time to get his sophomore album just right. The album is a collection of songs designed for the live environment. The first single to be released was the crowd-pleasing ‘Bigger Than Me’, quickly followed up with 'Out Of My System', and the third and final single ahead of the album release, 'Silver Tongues'. Speaking on the release of the latest pop-punk single, Tomlinson said it is “the song I'm most proud of on the record."
In 2020, Tomlinson released his million-selling smash debut solo album Walls which hit the Top Three in the UK and Top 10 in the USA. A lyrically personal album that proved he had found his feet as a solo artist, the album produced a clutch of acclaimed singles including the emotive first release ‘Two of Us’, the raucous ‘Kill My Mind’, and the reflective ‘We Made It’.

BMG is taking direct control of its streaming business in a move the company describes as the biggest change to its recorded music strategy since launch 15 years ago. 
BMG and its current distributor, Warner Music Group’s ADA, have agreed to part ways, enabling both companies to focus on growing their businesses and margins.
It will see a phased in-sourcing of distribution to all major streaming platforms, beginning at the end of this year with Spotify and Apple Music. BMG will continue to outsource physical distribution in a new deal expected to be announced shortly.
BMG CEO Thomas Coesfeld said: “This is a new chapter for BMG and marks a significant milestone for the music industry more generally as BMG becomes the first new global-scale full-service music company to emerge in the past two decades which controls its key routes to market. Taking direct control of our relationships with streaming services is a major leap forward in our mission to offer artists the most effective and efficient service. The new set-up will enable us to better market, service and advise our great artists and will further improve BMG’s relationship with key digital and physical partners.”

Daisy help me please. Is Simon Johns PR related to/ under Sony? Like Columbia is a sub company I mean…
I am asking because the other day he tweeted Bigger Than Me promo and I am still trying to process WHY.. I had thought with walls era ending and BMG coming in to the picture, Louis’ former team is now done. Including Simon J.
Now I am wondering if the stuff around this single and Louis right now is another illusion (like how Harry was shown as “free” with HS1 dropping).
Is BMG the managing company or just a distributor for FITF?? (Because I feel like their method of promo is more the type of a distributor than a management company). You know what I mean?

Hi dear,
Simon Johns PR is a PR company - they have been the publicity company Louis has used for years. I believe they also did 1D PR back in the day, and they worked with many Syco artists.
That is a separate thing from a record label. Columbia is a record label under Sony Music. Harry has PR companies he works with for his own PR.
All artists also have in-label PR, so Louis benefits from BMG PR, and has Simon Jones for things outside label-related activities.
I don't know why Louis still works with SJ PR, it could be due to an ongoing contract or perhaps his team likes working with that firm, since they've worked with them for several years.
BMG is a record label. That's separate from a management company. Louis' management company is still the same, Seven 7 Management and Three Six Zero Group. They're what makes up Louis' team.
BMG is a record label, and they have a deal with Louis for production, distribution, licensing and marketing. His music is published under his own record label, 78 Productions, so he owns the rights to it, and BMG has exclusive distribution rights to his music, same deal Harry has (his record label is Erskine Records).
So, 3 separate things:
Record label
Management company
PR firm
