Q1. Please introduce yourself. What genre of music do you mainly create?

A1. I'm lallaworks, a composer who mainly creates BGM (background music). I had a turning point in my life five years ago due to health issues, which led me to start making music. In the early stages, I uploaded music to SELLBUYMUSIC.

Q2. How did you become familiar with SELLBUYMUSIC?

A2. I had experience creating YouTube videos, so I was aware of the existence of such platforms. While searching for ways to monetize my music, I came across a blog post about SELLBUYMUSIC and decided to check it out.

Q3. Do you have any artists or songs that inspire you?

A3. Even during a period of life when I was quite distant from music, I loved "Joe Hisaishi - Merry-Go-Round of Life”, which resonated strongly with me compared to now. As a reference, I'm constantly creating songs like "Story: cinematic bgm" and "sad love: cinematic bgm" among my own compositions.

A4. I always strive to make it "a little more innovative!" Rapidly changing and vast, I believe that in order to grow, music representing such a world should be slightly more fresh.

A5. I particularly like "Space Exploration," and the cover art I drew for it. Most of all, this song holds a special place in my heart because it made me realize that I could share my music with others. It's a story of exploring the unknown world of the universe and overcoming challenges, which resonates with my own journey. Whenever I listen to it, I gain energy.

A6. Diversity. It encompasses various genres and moods, and it will continue to expand in the future! 😊

Q7. Is there a moment in your daily life when you find musical inspiration?

A7. Every moment. I try to jot down ideas no matter what. It usually starts with contemplation, but the most focused moment is when I sit down to work. It's a very interesting time when all the gathered thoughts and ideas come to fruition.

A8. I want to be known as an artist with anticipation. Someone who makes people curious about what kind of music they will create next and when they listen, they can't help but say, "Ah, it's them again!" I want to become a versatile artist.

Greetings! It's Sellbuymusic, and I recently stumbled upon an intriguing thought: "Does North Korea have a copyright law?" Naturally, my curiosity got the better of me, and I immediately embarked on a quest for answers. Today, I'm thrilled to share what I've discovered about North Korea's copyright law with all of you. Brace yourselves, because the answer is a resounding "yes"! In April 2001, during the 10th session of the 4th Supreme People's Assembly, North Korea adopted its very own copyright law. Let's delve into the details and unravel the fascinating aspects of this legislation!

North Korea's copyright law, comprised of 6 chapters and 48 articles, explicitly states that "The copyright holder shall possess personal and property rights to their work" (Article 13). Additionally, it establishes that the copyright of a work created by an individual is owned by the creator (Article 16), and that copyright holders can transfer or inherit their property rights wholly or partially (Article 21), highlighting the emphasis on individual authors' rights.

Notably, in January 2003, North Korea joined the Berne Convention—an international treaty safeguarding intellectual property rights for literary, scientific, and artistic works. This demonstrates the country's recognition of personal and property rights within the copyright framework, including the right to personal ownership of works and the ability to transfer and inherit property rights.

One particularly intriguing aspect is the ability to grant third parties the right to use a work, provided there is an agreement with the copyright holder or a designated time period. The differences in protection periods are also worth noting: works enjoy copyright protection from the time of publication until 50 years after the creator's death, whereas in South Korea, it extends to 70 years. Equally fascinating is the involvement of the pricing organization (country) in determining the price of a work.

As an editor, while reviewing these articles, I couldn't help but ponder whether I should use North Korean works with permission. Surprisingly, South Korea has "legal" grounds for protecting North Korean works, thanks to constitutional provisions and international treaties. In fact, North Korea has taken steps to raise copyright awareness by establishing a Copyright Office in 2004.

A1. Hello, I'm composer Kim Moon-jeong, who wants to create warm music. 😊 I mainly focus on composing music for short films, and personally, I enjoy creating orchestral and piano pieces.

A2. While I was doing YouTube for a long time, I used to create music to include in my videos. I received a recommendation from acquaintances that SELLBUYMUSIC is a great site to sell my music.

Q3. If there are any artists or songs that inspire you, who are they or what songs are they?

A3. I still frequently listen to the La La Land soundtrack. Just by enjoying the music, it stimulates my imagination to the point where I can envision scenes from the movie. I have a song called "MOON LAND," which I created by capturing the feeling of visiting a amusement park in Dangjin.

I strive to maintain musicality and persuasiveness because I want to create more songs that are worth using. 😄

A5. I love the song titled "The Time I Think of You" the most. This song was an attempt to express my feelings of uncertainty through music. Although it's not perfect yet, it's a song that brings back the emotions of that time when I listen to it personally.

 A7. There are moments when my heart is moved. It could be when I see something beautiful or cute, when I listen to a good song, or when I watch an emotional movie or drama. Those moments accumulate and lead me to a state where I can create music. However, the greatest inspiration came from experiencing the emotion of love from people, and it had a more impactful effect. 🥰

Understanding Copyright : Can I Sell/Produce Fan Made Merchandise?

Have you ever had the experience of purchasing unofficial merchandise of celebrities or anime characters? If you're a fan, it's hard to resist being interested in Merchandise (MD or Goods). Today, I would like to discuss whether it is permissible to create and sell fan-made merchandise (including for personal collection).

First of all, what is "Merchandise"?

"Merchandise" refers to promotional products released by specific brands or celebrities. They are produced in relation to dramas, animations, fan clubs, and the like. That's what we call goods!

Now, how does copyright relate to MD?

When it comes to featuring the face of a famous individual, it may involve the right of publicity, and if names or group names are used, it may infringe upon trademark rights. Therefore, if you want to create MD, you need to obtain a license from the relevant company! How can you obtain a license?

It may vary depending on the company, but typically, licenses are granted based on a certain percentage of quantities, sales revenue, or profits. Moreover, there are many companies in Korea that hold licenses, so if obtaining a license from a company is difficult, it's also a good idea to check with companies that have already been granted licenses. One more thing to note is that creating similar characters or logos does not infringe upon copyright.

So, does copyright infringement also apply to personal collections?

Article 30 of the Copyright Act states:

"If an individual uses a publicly disclosed work for personal purposes without any commercial intent, within the limits of personal or domestic use or similar limited scope, the user may reproduce it."

In other words, it means that if a user personally or within their household uses a work, it does not constitute copyright infringement. However, if someone else reproduces it on their behalf, it would be considered copyright infringement.

Now, a question may arise here! Can free distribution also be considered copyright infringement?

Yes, that's correct.

Even if no profits are generated, if you use copyrighted material, it would still be considered copyright infringement. Therefore, even in the case of free distribution, it is essential to obtain permission from the copyright holder.

When creating MD, it is crucial to remember that you must verify the copyright. Don't ever forget this fact!
