If an inventor would like to obtain a patent, he or she must apply to the United States Patent and Trademark office. The Patent Office charges a fee for its services and these fees were originally meant to totally defray the cost of processing patents. The Patent Office, however, does not even have enough physical space to house all of its employees and subsequently, a good number of its staff works at home or off premise. The Patent Office cannot invest in new office space, because all money collected by the Patent Office is automatically deposited into the United States Treasury. The budget of this agency has remained flat for years, even though the fees it has collected have skyrocketed. Since the fees collected have little to do with the budget allowed by Congress, the Patent Office struggles while its increased fee volume is used in other governmental areas. This situation is called office fee diversion.
Office fee diversion means exactly what it seems to. The fees generated by one governmental agency are diverted to one or more separate departments. Thus, the agency responsible for the original collection of the fees may be strapped for operating money, even tough it is generating a lot of cash!
This predicament has been allowed to occur because Congress has allowed it to happen. Many feel that Congress deliberately uses the Patent Office as a ready source of cash.
