Electric Skateboard and Hoverboard: This applies to road traffic
E-skateboards and hoverboards are fun. But are they allowed? We will explain where you can ride the electric boards, whether insurance is necessary and who pays for damage after accidents in this article.
Electric skateboards are steered by shifting your weight. Accelerate and brake using a radio remote control or an app. Hoverboards are two-wheeled vehicles without handlebars. It is also controlled by shifting your weight. A so-called gyroscope, also known as a gyro stabilizer, prevents the electric boards from tipping over while driving.
Where are they allowed to drive?
Both may only be moved in "delimited non-public traffic" - for example in separate or locked courtyards or on your own property. The reason: Motorized means of transport faster than 6 km/h require an operating permit. But since they don't have a seat, handlebars, brakes and lights, they don't get them. Public paths and streets are therefore taboo for them.
Do you need liability insurance?
Electric boards actually require motor vehicle liability insurance when used on public roads because they drive faster than 6 km/h. However, such insurance is not offered. The companions may not be moved on public transport without an operating permit. If damage occurs as a result of unauthorized use, the driver must be held privately liable.
Anyone who is caught with such a device on public roads without the necessary insurance cover is liable to prosecution.
Before using the vehicle on restricted, non-public roads, you should urgently check whether your private liability insurance will cover you if you cause damage. In most cases this should not be the case. Therefore, there is a high risk that the driver will have to pay out of his own pocket for damage to property or personal injury.
Is a driver's license required for hoverboards?
Yes. Only: The legislature did not have hoverboards and Co. in mind when determining the current driver's license classes. It is therefore not possible to say which specific driving license class would be required to legally move a hoverboard on public roads. The companions could fall under the classes AM, A1, A2, A, but also under the car class B.
Important: If you drive a hoverboard on a public road without the required driver's license class, you are also liable to prosecution under Section 21 StVG (driving without a driver's license).
