It can be an extremely emotional time for parents like you who need to separate themselves from their spouse. If you are a parent of a child with a disability then it can be even more of a challenge.

There are so many factors to consider for a person in your position compared to a parent going through a divorce in most circumstances. With monthly, weekly or even daily medical attention needed for your child you may be concerned with whether or not you will be able to have any say-so in the decision making surrounding this subject.

On a practical level, is your child able to travel safely between your home and wherever your spouse ends up living? Is it going to be a difficult logistical situation to allow your child to get into a vehicle to make the drive? Sometimes the exertional requirement of getting up out of the house and into a vehicle can be too much on certain days. The last thing you want to do is put your child through any undue stress or hardship.

Finally- related to the medical treatment that we discussed earlier- are you going to be able to afford all of the necessary medical expenses associated with caring for your child now that you will be in a single income household? What if your spouse is not as willing as he or she has always been to this point as far as paying medical bills and providing transportation? How will this work out once your divorce has completed?

I can tell you that while your concerns are certainly heartfelt and legitimate, you are not the only parent who is worrying about these things right now. Today’s blog post will discuss some concepts for you to think about as you move toward divorce. Worrying is one thing- but to worry and not plan is another. My hope is to assist you in planning for life after your divorce bearing in mind the specific needs of your child.

Getting a divorce means getting orders from a judge regarding custody and other subjects

The end result of a divorce is that you and your spouse will both sign a Final Decree of Divorce that contains all of the provisions associated with your children and your property. These are the marching orders that you and your spouse will abide by once your divorce has become finalized. Visitation, a possession schedule, orders regarding child support as well as specific provisions for your disabled child will need to be included in the decree.

Child Support needs to be considered as especially important when it comes to your disabled child

Let’s assume that you are named as the primary conservator of your child during the divorce. This means that you are to be awarded the right to designate the primary residence of your child and able to receive child support payments from your ex-spouse. While this is a common set up for parents after a divorce you should start to think now about what you would like your final decree to read in terms of your ability to care for your disabled child.

For instance, most child support orders stop once your child graduates from high school or turns 18, whichever occurs later in time. However, your child may need financial assistance and support for the entirety of their adult life or at least for a period of time after the age of 18. As a result you need to negotiate for and obtain an order that allows you to receive child support for whatever period of time you believe is necessary to meet your child’s minimum basic needs. In a perfect world your ex-spouse would readily agree to this based on a mutual understanding that your child needs it and is in their best interests. Unfortunately this is not always the case you need to be prepared to push for this and negotiate for it in mediation.

Additional costs that your child will incur due to their disability will need to be factored into the specific amount of child support that you receive. In most situations, 20% of your ex-spouse’s net monthly income will be paid as child support. However, this may not take into consideration the sum total of your child’s needs and continued care. If you cannot negotiate for a higher than guidelines level of support then you should know that if you present sufficient evidence to warrant it a judge can award this in a trial. This is something that you and your attorney determine is worth going to trial over.

Handling custody agreements with a disabled child

What custody refers to, generally speaking, is a combination of visitation and possession of your child. A custody agreement discusses where your child will live primarily. Also, and this is just as important, the agreement will dictate which parent will be able to make decisions for your child in terms of their medical care and education.

Typically, parents like yourself will share in the decision making responsibilities. This is relevant to you because your child will likely require changes and updates to their treatment regimen with regularity. Some of these changes can only be arrived at after thoughtful discussion. Are you going to have as much say-so as you believe is necessary to protect your child’s best interests? If your child were to be diagnosed with a new condition you would likely want to make sure that you are able to select their care schedule and physician. This portion of your divorce decree concerns those topics.

Finally, many custody agreements place restrictions on where your child can live. For example, if your divorce is in Harris County then it is common to have a geographic restriction that limits your child to being able to live in Harris and its contiguous counties (counties that border Harris). That geographic restriction is lifted if you choose to live outside the area after your ex-spouse has moved. The restriction is important for your family in that caring for your child will likely be a team effort rather than something that you do on your own.

What is a parenting plan?

A parenting plan details what is necessary for your child’s daily care and goes into some detail on how you and your ex-spouse will “co-parent” your child after the divorce. For many parents this is a section that is included in the decree and not given much thought to after that. For you, as the parent of a child with a disability, this section should have special meaning since you will want to ensure that your child receives consistent and reliable care no matter which parent he or she is with.

You can be as detailed as you would like and I recommend that you do so. If you are more comfortable including special instructions on how medical equipment works, how often a particular medication needs to be administered, or how to utilize a particular assistive device like a walker then it is your prerogative to include that in the parenting plan. Your divorce decree should not be cookie cutter. It should take into account your specific circumstances. Remember that all of your efforts are being undertaken in order to help your child live their best life.

However, some forthcoming iCIMS data, shown below in our news headlines, offers a varying data set and hope — that things aren’t getting too, too bleak — yet. US Dept of Labor (DOL) has created much buzz after issuing a Notice of Proposed Rulemaking (NPRM), to revise the regulations governing the calculation of the regular rate of pay under the Fair Labor Standards Act (FLSA). What is this? The proposed regulations, (released in reams of detailed electronic documents) outline multiple shifts in long-standing (+50 years) legal conceptualizations that constitute current regular rate of pay. OTHER HEADLINES in Talent Acquisition Capterra reports how TA software costs may be an even larger consideration than previously thought. Replacing “ease of use,” price of TA Software now stands as a considerable variable in this $12 billion industry. While this may be more confirming vs. eye-opening for those vending such products, some hefty reassurance for sales and marketing tenacity is reflected in Capterra’s data: Talent Management software users are satisfied 80% of the time with their purchasing choices. Another significant data finding: half of these software users spend at least 10 months searching for their ultimate software choice. What significant weight does this study have for TA Software firms? Multiple pass-throughs may be necessary with clients when pitching/proposing software benefits and ROI. Yes, while products may bring virtue, balancing patience with sales savvy of software vendors will be a viable soft skill to bring to initial marketing and negotiations/follow-up. Ceridian, a global human capital management (HCM) technology company announces the launch of Dayforce Payroll, enhancing industry-leading payroll capabilities to the Australian market. Ceridian states that Dayforce Payroll offers customers with Australian operations a single solution to develop, schedule, and pay employees in one application, that allows on-demand access to employee information. With their product launch; Ceridian intends to mitigate Hanover Research findings: How approx 61% of Australian employees surveyed report levels of unsatisfaction with their employer in areas such as timeliness and accuracy of pay. iCIMS reports this week how a February hiring activity slowdown may be only a radar blip: US employers’ hires rose 1.6% and new job openings rose 4.5% on a seasonally-adjusted basis in March. Results are tabulated using iCIMS’ Monthly Hiring Indicator, a leading economic indicator drawing upon an iCIMS database of more than 75 million applications and 4 million hires yearly. According to tracking data, the March jump in new job openings may signal an overall rise in hires within the proceeding 2-3 months., as seen below:

And of course, this means that with the US labor market at near full employment, TA will remain a busy place heading into the summer season. Need more proof? Says Josh Wright, chief economist at iCIMS, “The job market still looks strong and the weak February payroll report appears to have been in an air pocket…It’s going to be hand-to-hand combat among employees for the best candidates, especially with wages rising.”

Illinois companies and organizations, statewide, now face the prospect of legalization of recreational marijuana use. Despite his predecessor opposing such legal measures, new Gov. J. B. Pritzker now says he supports the legalization of marijuana. Lawmakers plan to consider legislation this year. If lawmakers succeed, Illinois would join 10 other states, and the District of Columbia, that have already legalized recreational marijuana. Medical marijuana is already legal in Illinois. Protocol Communications, Inc. has settled an Americans with Disabilities Act (ADA) lawsuit with the US Equal Opportunity Commission. The suit was settled for $31,000. The suit was filed after an employee with dyslexia filed a complaint alleging how a director of Human Resources stopped her training, denied accommodation and terminated the employee upon learning of her disability. The employee, training to be a telemarketer, alleged that her request to take home a script, for practice, led company officials to query if the employee had a disability. Upon confirming a disability existed, the employee was told that continued training had “no point,” denying the request for the script practice accommodation. Protocol agreed, according to EEOC settlement terms, to a two-year consent decree that obligates equitable relief to fully resolve the suit. Specifically, the company must provide all current and newly-hired employees with disclosure documents, outlining policies and procedures that prohibit disability discrimination and that also address reasonable accommodations. In addition, the company agreed to provide more ADA training to managers, supervision levels and HR staff. Randstad Sourceright has released a report on how the healthcare market continues to face tightening talent pools, supporting anecdotal evidence of this hypothesis. Says Randstad Sourceright, a booming 85% of human capital leaders, (among 800 international leaders queried) report talent scarcity as one of their greatest remaining concerns. Other eye-catching data include how: over half (52%) also cite AI and robots as ways to optimize recruitment a stunning 89% reveal how TA should be driven by value creation vs cost savings. Skiing and snowboarding may not always seem like high-octane, adrenaline-fuelled extreme sports. But even those sauntering down a green run can get caught up in an accident and injure themselves while on holiday.

Here’s what to do if it happens to you.

“This might seem like an obvious tip, but I always advise anyone who is going on a winter sports holiday to take out a suitable level of travel insurance cover,” Paul McClorry, head of travel litigation at specialist injury lawyers Hudgell Solicitors, tells The Independent.

“Don’t just buy the cheapest or most basic policy, always make sure it’s the right fit for you and your holiday. Otherwise, you may find you’re only covered up to a certain amount or not covered at all in some circumstances.”

He advises travellers to remember that in most cases, travel insurance will only cover associated medical costs; insurers won’t pay out compensation for pain or suffering, or loss of earnings as a result of injury.

Seek medical care

Broken legs are one of the most frequent injuries McClorry sees when dealing with snowboarding and skiing accident claims. Head injuries, knee injuries, dislocated joints and broken arms are also common.

It’s highly likely that you’ll need medical assistance for any of these injuries, so contact the resort’s emergency service – you’ll usually find the number on a piste map.

“Should you have suitable travel insurance or an EHIC, you won’t need to worry too much about medical costs,” says McClorry.

“However, if you don’t, you or someone acting on your behalf will need to contact the Department for Work and Pensions’ Overseas Healthcare Team to apply for a Provisional Replacement Certificate. This proves you’re entitled to an EHIC and can be used to get the same cover.”

Gather evidence

Writing a detailed account of what happened can be helpful for claiming on insurance.

McClorry says: “It might not always be possible if you are incapacitated on the slopes, but get a member of your party to gather as much evidence as possible, whether it’s noting down names and contact details of witnesses or taking pictures of the accident site and your injuries.

“If possible, write up what happened to cause your injury in as much detail as you can, and include details like snow conditions, visibility, markings, signs and location.

“Remember to keep records of when you visited a doctor, clinic or hospital, and keep hold of any receipt for accident-related expenses.”

Report the incident

If you are on a package trip, McClorry advises reporting any accident directly to the tour operator or via the resort.

“After you have established the facts of the accident, you will need to decide whether or not you report it to the local police,” he says. “As well as this, you should contact your travel insurance provider at the earliest possible point. They will advise about your medical and legal situation.”

He adds that it’s important to never admit liability for the accident or engage in any correspondence without the advice of a qualified solicitor or lawyer that specialises in this area of law.

When you get home

The full impact of an injury suffered on holiday might not become apparent until you arrive home. Some injuries can leave people unable to work and facing potential loss of earnings; sometimes further expenses can be incurred through extra treatment such as physiotherapy.

“If your accident was caused by someone else’s negligence, such as another skier, a hidden obstruction, unsafe teaching techniques or faulty equipment, then you could be eligible for compensation,” says McClorry. “I would advise speaking to a solicitor that specialises in this area of law as soon as possible to find out if they’re able to help you.”

Will this advice change after Brexit?

Much will depend on the final terms of any Withdrawal Agreement – there’s still plenty of uncertainty surrounding post-Brexit travel.

If a deal is agreed then the EHIC scheme should still be effective during the originally planned transition period (29 March 2019 – 31 December 2020). If a deal is agreed, some similar form of reciprocal healthcare arrangement should still exist after 31 December 2020, as the government has introduced The Healthcare (International Arrangements) Bill, which would hopefully allow the EHIC scheme to continue.

“Travel insurers, understandably, are still carefully considering the terms of the policies they will provide post-Brexit,” says McClorry. “We will need to wait and see what the Brexit outcome is but holidaymakers will need to carefully consider whether the travel insurance policy they are taking out actually covers them for their specific holiday.

“Depending on the terms of any Withdrawal Agreement, if any, the ability for an English domiciled individual to bring any claim for injuries and consequential losses in England could be affected.”
