GM for a Day: Royals 2023 Edition #1
My favorite MLB team, the Kansas City Royals, is in rebuilding mode, for the fifth straight season. They are struggling with their current, mostly high-drafted, young players in their 2nd or 3rd whole or partial season and their farm system is ranked 29 or 30 in most rankings. In comparison, the Baltimore Orioles have young players thriving in their 2nd or 3rd season and their farm system is…

One reason you should root for every baseball team. Partially because I'm bored, partially because @ijustlovehockey
Arizona Diamondbacks- Their logo is sick and also I don't think I have ever acknowledged them
Atlanta Braves- Max Fried is pretty, Freddie Freeman is a ray of sunshine, and something else
Baltimore Orioles- watch this
Boston Red Sox- Mookie Betts I guess??
Chicago Cubs- Anthony Rizzo is the Brady Skjei of baseball (via @say-hey-kid), Javier Baez is funny, and Kris Bryant.
Chicago White Sox- the Chicago team that is less talked about which I take as a good thing
Cincinnati Reds- they don't exist.
Cleveland Indians- Don't.
Colorado Rockies- Why?? But tge all star game is being hosted here, they have beautiful Jerseys, and Joshua Fuentes.
Detroit Tigers- I guess their name, but they don't exist.
Houston Astros- Jose Altuve is short, and people hate us so it's funny. Oh also Zach Greinke exists.
Kansas City Royals- People talk about the city a lot around me.
LA Angels- I saw Mike Trout on a pretzel box once.
LA Dodgers- For some reason people simp for Clayton Kershaw
Miami Marlins- Sick logo bro
Milwaukee Brewers- This team only reminds me of an ad I saw featuring a photo of Christian Yelich that I never want to see ever again as long as I live. Can a brewers fan help me here?
Minnesota Twins- lol minnesota
New York Mets- They're the better New York team
New York Yankees- They don't have last names on the back of jerseys for some reason.
Oakland A's- You can shorten their name so easily and also green is a cool color
Philadelphia Phillies- They have philly phanatic the mascot
Pittsburgh Pirates- @pitchburgh help
San Diego Padres- They take every team's favorite player -_-
San Francisco Giants- So there's this guy name Tim Lincecum-

Summer Dreaming
Tumblr media
At this time of year, the sight of some battered bird-built structures can trigger summer dreams. Consider the Baltimore Oriole nest dangling from a linden branch above a Flagstaff Hill sidewalk in Pittsburgh’s Schenley Park.  Watch the bundle of plant fiber and ribbon scraps sway in a cold late winter wind and you might be able to imagine the nest partially concealed by bright green leaves and periodically visited by a bird with goldfish-orange feathers.
Tumblr media
Baltimore Oriole pair in CMNH Bird Hall with nest and nest cross-section.
Such out of season thoughts are far from original. One hundred and sixty-one years ago, and some 500 miles northeast of Pittsburgh, naturalist Henry David Thoreau used a different common name for the species when he referenced the bright and melodic warm season residents in a winter journal entry.
What a reminiscence of summer, a fiery hangbird’s nest dangling from an elm over the road when perhaps the thermometer is down to -20, and the traveler goes beating his arms beneath it! It is hard to recall the strain of that bird then.
Henry David Thoreau – journal entry                                                                                                           December 22, 1859

MLB Trade Rumors and News: Cub throw no-hitter, Josh Bell to undergo MRI
Tumblr media
The MLB Daily Dish is a daily feature we’re running here at MLBDD that rounds up roster-impacting news, rumors, and analysis. Have feedback or have something that should be shared? Hit us up at @mlbdailydish on Twitter or @MLBDailyDish on Instagram.
It is always nice to start the day with some good news and Cubs fans woke up to fuzzy feelings all around as Chicago used four pitchers including starter Zach Davies and closer Craig Kimbrel to no-hit the Dodgers. Kimbrel looked like the Kimbrel of old and lets not understate how difficult it is to shut down that Dodgers offense. Really impressive.
The Nationals suddenly find themselves surging in the NL East and right in the thick of the race for first place. Unfortunately, Josh Bell, whose hot hitting had helped propel Washington up the standings, is headed for an MRI on his right side which is never great news.
There was a bit of news coming out of the NL East last night on the eve of the series finale between the Braves and Mets. For the Mets, it was good news as Michael Conforto was activated from the injured list after dealing with a hamstring injury for a month or so. The news was less good for the Braves as MVP candidate Ronald Acuna Jr. ended up being a late scratch from the game due to tightness in his lower back.
MLB’s routine foreign substance checks for pitchers, which began on Monday, got a little weird on Tuesday night. Nationals ace Max Scherzer lived up to his “Mad Max” nickname, rolling his eyes and throwing his hands in the air during an early routine check. Then when Phillies manager Joe Girardi requested that he be checked for a third time during the middle of an inning, Scherzer threw down his hat, unbuckled his belt, and looked like he was about to take off his pants before being discouraged from doing so. As it turned out, Scherzer walked so Sergio Romo could run, as the veteran A’s reliever threw down his hat, glove, and belt before dropping his pants during a foreign substance check.
The Rays promoted top prospect Wander Franco, and he immediately made his presence known on Tuesday night, hitting a game-tying homer for his first major league hit while also collecting a double and a walk. At Triple-A Durham, the 20-year-old was slashing .323/.376/.601 with seven home runs in 173 plate appearances.
The Mets’ rotation sustained a pair of blows on Tuesday, as the team announced that lefty Joey Lucchesi will undergo Tommy John surgery, then right-hander Marcus Stroman exited his start early with left hip soreness. While they have a comfortable lead in the NL East, the Mets continue to be dealt an incredible amount of adversity, so it’ll be interesting to see if they can stay afloat.
The Blue Jays have signed veteran reliever John Axford, reports Jamie Campbell of Sportsnet. The 38-year-old hasn’t seen a major league mound since 2018 and had been working as an analyst on the Jays’ pre and postgame shows before being asked to pitch for them again. The bulk of his career came with the Brewers, as he played in Milwaukee from 2009-13, but now the Ontario native will embark on his third stint with Toronto.
The Tigers have released Wilson Ramos, per a club announcement. The 33-year old signed a $2M deal with Detroit at the beginning of this year, and he looked like he was really giving the Tigers the most value for their buck after going yard six times in his first nine games. Unfortunately that took a turn in early May, when a back injury completely derailed the 12-year major league veteran. Should he be able to heal quickly enough for a late season renaissance, he could make a great extra backstop for a team in contention. Posting a 105 wRC+ for the Mets in 2019, he’s still got some gas left in the tank for whatever team is willing to take the risk.
Astros third baseman Alex Bregman is going to be out for an extended period after suffering a quad injury trying to beat out a double play last week.
Rays ace Tyler Glasnow’s season is in jeopardy after he suffered a partially torn UCL and flexor strain in his right arm. He’ll initially try to rehab the injuries rather than immediately opting for Tommy John surgery. In an interesting crossover with the biggest story being discussed around baseball right now, Glasnow said MLB’s crackdown on foreign substances contributed to his injury, as he stopped using a mixture of sunscreen and rosin, and as a result he began gripping the baseball so hard that he injured his elbow.
A lot has been made in recent weeks about the proliferation of foreign substances used primarily (but certainly not exclusively) by pitchers to get better grip on balls to have better command as well as to generate greater spin. It has been clear that MLB was going to crack down on the practice and now it looks like it has landed on its chosen punishment, as it was announced that players found to be using such substances will receive a 10 game paid suspension.
The Cleveland Indians received some pretty rough news about the reigning 2020 CY Young Award winner as Shane Bieber landed on the IL with a strained shoulder. Cleveland’s pitching staff has struggled to stay healthy and/or effective for most of the season and with the loss of their best pitcher in Bieber for a few weeks at least, their quest to try and run down the division-leading White Sox just got that much harder.
It is fair to say that the 2021 season has been a particularly weird one. Teams that we all thought would be good haven’t been and teams that were thought to be afterthoughts have been anything but. Our own Andersen Pickard broke down the five most surprising teams from the 2021 season so far.
It’s the most glorious time of the year: here’s your 2021 MLB Draft primer for notable players, draft order, and more.
The Twins are dragging their feet for extension talks with Jose Berrios, SKOR North’s Darren Wolfson reports. Berrios has one last year of arbitration eligibility before he’s free to sow his wild oats and hit the market in the 2022-23 offseason. And as of now, the Twins have done little to nothing to stop him. Could that be because the NL Central 4th place team is looking to use him as a lucrative trade chip come this year’s deadline? The 27-year old could bring a significant return for Minnesota, but is it enough to risk for them losing him? He’s having another strong season this year, with a 3.49 ERA and a 26% strikeout rate. Either way, as the trade deadline gets closer, we’ll see what moves the Twins are thinking of making.
After going 5-24 in the month of May, the Arizona Diamondbacks are reeling and are already buried in an NL West where even a good season would not guarantee a playoff berth. In order to try to stop the bleeding and try to get back to some level of decency, Arizona fired hitting coaches Eric Hinske and Darnell Coles. Sadly, given the breadth of that roster’s issues, it seems like that they will still end up as one of the league’s worst teams.
Baseball’s draft is slowly transitioning more and more to how drafts are run in other sports which is definitely a good thing. While the MLB draft has certainly been covered as an event, there were not a lot of players present during the draft festivities because of the conflict with the college season and the pre-draft workouts were largely private and lesser in number, again, because of conflicts with games being played. The league appears to be trying to change that as they announced a draft combine with over 100 players scheduled to attend towards the end of June.
Designated hitter Khris Davis, the 2018 major league home run and an imposing slugger for the last half decade, has been designated for assignment by the Rangers after slashing .157/.262/.333 in 22 games with Texas. Davis, who was acquired from Oakland for Elvis Andrus in February, will now look to latch on with another club, though he may have trouble finding another opportunity considering that he’s no longer a viable option in the outfield.
Yankees starter Gerrit Cole, long suspected to be one of baseball’s most prominent sticky substance users, delivered an extremely uncomfortable minute-long answer when asked by the New York Post’s Ken Davidoff whether he’s ever used Spider Tack while pitching. Cole did not provide an explicit yes or no, saying “I don’t know quite how to answer that, to be quite honest” and suggesting the shady practice was the fault of veterans who had passed it down to younger pitchers.
Outfielder Jarred Kelenic, widely regarded as one of baseball’s top prospects and the potential savior of the Mariners organization, was optioned to Triple-A Tacoma after getting into an 0-for-39 slump. Kelenic, who played just 28 games in the upper minors (21 at Double-A in 2019 and seven at Triple-A this year) before reaching the majors, has an .096 batting average and .378 OPS in 23 major league games.
The Orioles have placed John Means on the injured list for a strain in his throwing shoulder, which yes, is totally a bummer from any standpoint. While an MRI revealed no structural damage, reports Roch Kubatko of MASN, Baltimore isn’t taking any chances exacerbating his shoulder. He’ll be reevaluated after seven to ten days and the team will have a clear decision on what to do from there. In the meantime, Zac Lowther has been recalled from Tripe-A Norfolk to take his place.
The Nationals really needed Stephen Strasburg to look like the Stephen Strasburg from their World Series run in order to be consistently competitive during the 2021 season. Unfortunately, that hasn’t been what we have seen from Strasburg as he has lost some velocity and his stuff is not as crisp. Now, the Nats got even worse news after Strasburg was forced to leave his start against the Braves early as he was placed on the 10 day injured list with a neck strain that is causing nerve irritation.
The Mets had been hopeful to get Noah Syndergaard back in their rotation soonish to try and hold off their division rivals in what has been a surprisingly bad National League East. Unfortunately, they will have to wait a good bit longer, as Syndergaard’s rehab hit a setback, and elbow inflammation will keep him out until at least August.
Mickey Callaway has been awaiting his official fate from the league in the wake of some some serious and troubling allegations regarding his treatment of female members of the media. Well, MLB announced the results of their investigations where they found that Callaway had engaged in lewd and inappropriate conduct regarding his sexual advances towards journalists. He is now suspended through at least the 2022 season, and the Angels immediately fired him upon the decision being made.
The Rays have traded Willy Adames to the Brewers in a four-player deal. Trevor Richards was also dealt to Milwaukee in exchange for relievers Drew Rasmussen and J.P. Feyereisen. The 25-year old Adames was arguably the core of the Rays’ young lineup last season, though he had struggled this season before being dealt. He will be taking over as the shortstop for that Brewers, who have been starved for consistency at the position and in desperate need of an offensive boost.
Perennial MVP candidate Mike Trout probably won’t win the AL MVP Award in 2021, as he’s going to spend the next 6-8 weeks on the shelf recovering from a calf strain. Even though Trout had slumped in May, he still led the majors with a .466 OBP and 1.090 OPS due to the ridiculous .425/.523/.781 slash line he posted in April, and his loss is as massive as can be for an Angels team that was already struggling to stay above water in the AL West.
The Dodgers signed veteran slugger Albert Pujols to a major league deal, less than a month after he was designated for assignment and released by the Angels. For a moment there was a rumor floating around that the 41-year-old might sign with the Cardinals so he could play out his career with the team he made his name with. But clearly the Dodgers believe he has some fuel left in the tank, despite the .198/.250/.372 slash line he posted with the Angels this season.
Remember when the league and MLBPA got in a very public back and forth that resulted in MLBPA essentially calling the league’s bluff and calling for a shortened slate of games with the idea that the players were going to file a grievance? Do you remember that Manfred tried to one-up that by saying no season was going to happen at all unless the players waived the right to file a grievance? That was fun…and that grievance has arrived as MLBPA formally accused the league of negotiating in bad faith on the terms of the 2020 season.

Trey Mancini gets standing ovation in return from cancer
Trey Mancini gets standing ovation in return from cancer
Baltimore Orioles first baseman Trey Mancini missed the pandemic-shortened season last year as he was battling colon cancer. Mancini is now cancer-free, and he returned to the diamond on Sunday for the Orioles’ first Grapefruit League game of spring training.  The 28-year-old was initially given a partial ovation after warmups concluded and received a full standing ovation at Ed Smith Stadium…

Custom Bobble Heads
The sixties produced the first bobblehead boom into popular culture. It was a period when the U . s . States was seeing a different sort of athlete appear in the Baseball Scene. Stars like Mickey Layer showed up and the sport was larger than ever. For more information about bobbleheads, visit our website today.
It isn't just baseball that used these bobbleheads to advertise the sport. American football and ice hockey were close fans too, so when made, the models usually covered all the teams in the professional leagues.
The teams which were covered in the first production run of the baseball league bobbleheads created in 1961 and 1962 were: the Anaheim Angels, Baltimore Orioles, Boston Red-colored Sox, Chicago Cubs, Chicago Whitened Sox, Cincinnati Yellows, Cleveland Indians, Detroit Tigers, Houston Colt 45's, Houston Astros, La Angels, La Dodgers, Might Athletics, Milwaukee Braves, Minnesota Twins, Mineapolis Twins, New You are able to Mets, New You are able to Yankees, Philadelphia Phillies, Pitsburg Pirates, St Louis Cardinals, Bay Area Titans and lastly the Washington Senators.
Not every these bobbleheads were created alike. For instance, certain teams had mascot bobbleheads, namely the Orioles, the Cubs, the Yellows, the Indians, the Tigers, the Braves, the Pirates and the Cardinals.
Of the lengthy listing of teams created, the rarest bobbleheads today are regarded as individuals of the Anaheim Angels, that have a paper label over the La Decal, the Ontario Twins and the boy of the Baltimore Orioles.
Other curious particulars include the cowboy hats worn by the bobbleheads of the Colt 45's and the Astros, the whitened or eco-friendly base selection of the Cleveland Indians and the Detroit Tigers, and the dark or light uniform option for the New You are able to Mets collectible figurines.
To create matters much more complex, there have been two separate series created at the same time. One of these is called the small number of baseball bobbleheads (by the way, the term bobbing mind is much more popular in these vintage models) and the other is termed as the whitened base series.
Finally each team comes in two different versions, either holding a ball or perhaps a baseball softball bat.
Both of these series incorporated the first couple of professional baseball gamers to become symbolized as bobbleheads, Mickey Layer and Roger Maris, although all collectible figurines really looked the same and individuals of Layer and Maris really didn't resemble the gamers.
Aside from a mind that bobbles, these vintage bobbleheads hold little resemblance of the ones we have seen made today. To begin with the material these were made from in the beginning was really paper mache.
The design seemed to be considerably different. The body is made with hardly any detail and in no sports pose. It had been rather a lot more like just one block with a few nuances around the braches and even though all the body models would look identical before painting, great care was come to precisely represent each team's uniform. This partially describes why you will find such enthusiastic enthusiasts chasing after after them today, and trying to carry all bobblehead models.
The production technique resulted in each bobblehead was most likely made, and surely colored manually. The colors themselves frequently have a pearlescent finish and therefore are frequently glossy. Including the finish of the face, which coupled with the boyish appearance created a cherub-like result on many of them.
The insufficient focus on the body carving, and no work in precisely representing anyone star signifies that the attention in those days ended up being to promote the team, and considering that these bobbleheads were built with a magnet under the base, these were certain to be happily shown on many vehicle dashboards back in individuals days. You will find, dashboards were metallic in those days, in situation you were wondering!
After the Layer and Maris bobbleheads produced, another two stars adopted rapidly after, that have been Roberto Clemente and Willie Mays. Obviously individuals bobbleheads did not look similar to Clemente or Mays either. Bobbleheads make amazing gifts especially when you have paid attention to detail to make them unique and special to the person you are gifting. Visit personalized bobblehead and create your custom bobblehead gift today.

Live Coronavirus News Updates and Analysis
A national teachers’ union says its members can strike to ensure schools reopen safely.
The second-largest teachers’ union in the United States announced on Tuesday that it would support its 1.7 million members if they choose to strike in districts and states that move to reopen classrooms without adequate health and safety measures.
The union, the American Federation of Teachers, said strikes should be a “last resort.” But the resolution approved by the organization’s executive council gives educators and their union representatives additional muscle in negotiations over what would constitute adequate protection for teachers and school employees.
The union is pushing for schools to wait to reopen classrooms until coronavirus transmission rates in a community fall below 1 percent and average daily test positivity rates stay below 5 percent — something that very few places have achieved. A recent New York Times analysis found that only two of the nation’s 10 largest school districts could reopen under the latter threshold.
The union also wants effective contact tracing in place in regions that reopen schools, mask requirements for students and teachers, updated ventilation systems in school buildings and procedures to maintain six feet of distance between individuals.
“We will fight on all fronts for the safety of our students and their educators,” the union’s president, Randi Weingarten, said in a speech at the organization’s annual convention, which is being held online this week. She said that if the federal government can support the cruise industry and hedge funds during the coronavirus crisis, “they sure as hell can help working families, and can help educators ensure our kids get the education they need.”
Some online activists have been pushing for even stricter guidelines than those recommended by the A.F.T., with some educators demanding that schools stay shuttered until there are no new cases in a region for 14 days.
Education leaders have said they need hundreds of billions of dollars to implement measures that would allow schools to reopen safely. On Monday, Senate Republicans introduced a stimulus package that fell far short of what Democrats and organized labor have proposed. The legislation would provide $70 billion for K-12 education, but condition two-thirds of that money on schools reopening at least partially in person, a priority for President Trump, who sees it as key to reviving the nation’s economy by allowing parents to work.
The A.F.T.’s authorization vote leaves it up to local chapters to make the decision on whether to plan a strike. The Florida Education Association has already sued Gov. Ron DeSantis and other officials to prevent school buildings from reopening in that state, where virus cases are surging. On Tuesday, Florida again broke its daily record for deaths, reporting 186 fatalities. It also reported 9,230 cases.
Senate Republicans, under pressure from the White House to embrace an obsession of President Trump’s, have included in their latest emergency pandemic aid proposal $1.75 billion for the construction of a new F.B.I. headquarters in downtown Washington, D.C.
The proposal drew outrage from Democrats, who charged that it was an attempt by Mr. Trump to use the economic stabilization package — meant to help struggling Americans weather a pandemic and a recession — to enrich himself.
They have long charged that Mr. Trump intervened to make sure the F.B.I. scuttled plans to erect a new headquarters in suburban Washington and instead chose to refurbish its existing building, in order to make sure that the site was not redeveloped with a project that would compete with his company’s luxury hotel across the street. The Justice Department’s top investigator last year launched an inquiry into the decision.
“They managed to have enough money for $2 billion for the F.B.I. headquarters that benefits Trump hotel, and they say they have no money for food assistance?” Senator Chuck Schumer, Democrat of New York and the minority leader, said on Monday. “What the heck is going on?”
Some leading Senate Republicans, who included the F.B.I. building money in the $1 trillion recovery package they rolled out on Monday, appeared not to know themselves.
Senator Mitch McConnell of Kentucky, the majority leader, at first said he did not believe the funding had been included in the measure, and then told reporters to ask the administration “why they insisted on that provision.”
Asked about how the construction of a new F.B.I. building related to the pandemic, Senator Richard C. Shelby of Alabama, the chairman of the Appropriations Committee, said, “Good question,” and stressed that it was “an administration proposal.”
The line item is just one of a long list of differences between Republicans and Democrats who are staring down a Friday deadline to strike a compromise on a new round of federal virus aid before enhanced jobless benefits expire.
Mark Meadows, the White House chief of staff, and Steven Mnuchin, the Treasury secretary, planned to go to Capitol Hill on Tuesday to begin negotiating with Democrats, who are pushing a $3 trillion aid bill. Speaker Nancy Pelosi is scheduled to hold another meeting with the two men and Mr. Schumer in her Capitol Hill suite at 4 p.m. Tuesday, the third such meeting in the last two weeks.
The Yankees’ game against the Philadelphia Phillies on Tuesday has been postponed, according to a person familiar with the matter who was not authorized to speak publicly before the official announcement.
The teams’ game on Monday night was also postponed following news of an outbreak within the Miami Marlins, who had played three games at the Phillies’ Citizens Bank Park over the weekend. Phillies’ players and staff members received additional testing on Monday but the results of those tests has not yet been announced. The visiting clubhouse at the ballpark was also being disinfected.
On Monday, the Marlins’ scheduled games against the Baltimore Orioles for that day and Tuesday were also postponed. The Marlins have at least 18 confirmed positive cases among their players and coaches, according to another person familiar with the matter who was not authorized to discuss the results.
The Yankees, who arrived in Philadelphia on Monday, have been sequestered in their hotel and were not allowed to go to Citizens Bank Park on Monday. To stay active, some worked out indoors.
But after Tuesday’s postponement, the Yankees plan to leave town. They were expected to return to New York on Tuesday afternoon and work out at Yankee Stadium. The last time they played was on Sunday in Washington, defeating the Nationals, 3-2.
Hajj during the pandemic: Sterilized pebbles, bottled holy water and no kissing the sacred stone.
In any other year, Muslims undertaking the hajj, the annual pilgrimage to the holy city of Mecca that observant Muslims are obligated to perform at least once, would drink from a holy well. They would kiss the Kaaba’s sacred black stone as they thronged the Grand Mosque. Before they left Mecca, they would collect pebbles to ritually stone the devil.
During the virus edition of the hajj that begins on Wednesday, the black stone is off limits. Authorities in Saudi Arabia are issuing bottled water from the Zamzam well instead of letting pilgrims drink from cups at the source. Also in the pilgrim packages: sterilized pebbles to hurl at the devil, personal prayer rugs and other items intended to prevent an outbreak from marring the hajj.
But the chief public health measure the Saudi government has taken is to limit attendance, shrinking one of the world’s most famous crowds to a select few. About 2.5 million Muslims from around the world performed the hajj last year; this year, Saudi Arabia said it would allow just 1,000 pilgrims, all of them from within the kingdom, though it has not released the final number.
Across the Middle East, celebrations for Eid al-Adha, the festival of sacrifice that marks the end of the hajj this weekend, will likewise be paler this year.
In Oman and Bahrain, where the unchecked spread of the virus among low-paid foreign laborers living in crowded conditions has contributed to two of the world’s worst outbreaks, officials have urged residents to forego the large celebrations that usually mark Eid, and Oman has reinstituted a domestic travel ban and curfew. In Egypt, new cases have fallen as the country resumes normal life, but a live broadcast will replace communal Eid prayers.
In the United Arab Emirates, where it is common for residents to buy sheep or other livestock to sacrifice and donate during Eid, the authorities were encouraging people to use apps to reduce crowding at slaughterhouses and markets.
Countries across the region are reopening despite lingering hot spots. While Persian Gulf countries including Oman and Bahrain continue to struggle with large outbreaks, smaller ones in Yemen and Syria — where years of war have decimated health care systems and mired the population in deepening poverty — are rapidly metastasizing.
Trump shares a video containing misinformation about hydroxychloroquine. Social media platforms respond.
Mr. Trump shared on his Twitter account Monday night a viral video containing a series of false or misleading medical claims about the coronavirus, as social media companies scrambled to halt the video’s rapid spread.
Facebook and YouTube removed versions of the video, and Twitter later removed the post shared by the president. At least one version, which was shared on Facebook by the right-wing Breitbart news site, had garnered over 13 million views before it was removed. Other versions of the video, including shorter, edited clips, were still online Monday night.
The video featured what appeared to be a group of doctors in white coats, standing in front of the Supreme Court building in Washington, D.C., in what appeared to be a news conference. The doctors made a series of misleading claims, including that hydroxychloroquine could be taken as a preventive measure.
The use of the drug to treat or prevent coronavirus has been widely disputed by the medical establishment. The Food and Drug Administration revoked its emergency authorization in June after deeming it “unlikely to be effective” while carrying potential risks, and the National Institutes of Health halted clinical trials of the drug in June. But Mr. Trump repeatedly boosted the drug in the early months of the crisis, and said in May (not in June, as an earlier post said) that he was taking it himself.
It was the most recent example of misinformation that has spread about the coronavirus, at times being shared by Mr. Trump and others in the White House. A YouTube spokesman said in a statement that the video had been removed for “violating Covid-19 misinformation policies.”
On Tuesday, Twitter put limits on the account of Donald Trump Jr., the president’s oldest son, after he also shared the widely circulated video. Twitter said he was required to delete the tweet with misinformation, and the platform said it would also limit his account’s functionality for 12 hours.
“The tweet you referenced was in violation of our Covid-19 misinformation policy,” a Twitter spokesman, Ian Plunkett, said. “We are taking action in line with our policy here.”
The Venice Film Festival announced the lineup on Tuesday for its 77th edition, setting out precautions including temperature checks and new outdoor screening sites for one of the first large international festivals held since the pandemic began.
The festival will run from Sept. 2 to Sept 12, with a reduced schedule. Between 55 and 60 films will be screened, as opposed to last year’s 80.
“The show must go on and the world must go on,” said Roberto Cicutto, the president of La Biennale di Venezia, which runs the festival, in a phone interview, adding that it was important “to watch and to discuss movies together, to live this art the way we used to live it.”
Films in contention for the festival’s top prize, the Golden Lion, include Chloé Zhao’s “Nomadland,” starring and produced by Frances McDormand; Mona Fastvold’s “The World to Come,” starring Vanessa Kirby and Casey Affleck; and “Pieces of a Woman,” directed by Kornel Mundruczo and starring Shia LaBeouf.
Screening in the festival’s nonfiction section will be “Salvatore Ferragamo: The Shoemaker of Dreams,” a documentary directed by Luca Guadagnino, as well as “City Hall” from Frederick Wiseman, a look at Boston’s administrative center.
Though Shanghai’s international film festival went ahead in July, the pandemic has forced the cancellation or postponement of most of the gatherings that traditionally structure the year for filmmakers in Hollywood and elsewhere in the West, including Cannes and the Tribeca Film Festival.
Here are other developments from around the globe:
Spain’s prime minister said that Britain had made “an error” by imposing a quarantine on everyone arriving from his country, a decision that blindsided British vacationers and dealt another blow to Spain’s tourism industry. Prime Minister Pedro Sánchez, in an interview with the news outlet Telecinco on Monday, said that Britain should have taken into account the regional divergences in Spain’s coronavirus cases and not issued a blanket order.
Data released by the United Nations World Tourism Organization on Tuesday showed that leisure travel fell by 98 percent during the first five months of the year, compared with 2019. The group said that globally 300 million fewer people traveled, representing a loss of $320 billion for the tourism industry.
Vietnam suspended domestic flights into and out of the tourist destination of Danang for 15 days after discovering at least 14 coronavirus cases, according to Reuters. International travel was halted months ago, but domestic tourists still traveled to Danang, a coastal city. About 80,000 people, mostly tourists, were ordered to evacuate on Monday after the discovery of the country’s first local transmissions in 100 days.
China recorded 68 new virus infections on Monday, its National Health Commission said on Tuesday, including six in Liaoning Province and 57 in the northwestern region of Xinjiang, where a flare-up since mid-July has shown little sign of abating. As China battles the surge, the authorities in the northeastern port city of Dalian, in Liaoning, have said they will test all 6 million residents after an outbreak. Samples have been collected from about 1.68 million Dalian residents as of Sunday night, the official Xinhua news agency reported.
Kenya’s president, Uhuru Kenyatta, closed all bars and banned the sale of alcoholic drinks in restaurants for 30 days to try to curb the spread of the virus. In a speech Monday, Mr. Kenyatta said recent reopening measures had given “some Kenyans false comfort that this is not a serious health risk to them and their families.”
A concert in the Hamptons is being criticized for a lack of social distancing.
A charity concert Saturday night in the Hamptons that featured performances from the chief executive of Goldman Sachs and the D.J. duo the Chainsmokers drew outrage and a state investigation after video footage showed attendees appearing to ignore health precautions.
The concert, called Safe & Sound, was supposed to involve guests sitting outside near their vehicles in spaced-out areas to watch the performances, including one from the chief executive of Goldman Sachs, David M. Solomon, also known as D.J. D-Sol.
Tickets cost up to $25,000, according to Billboard.
The event generated angry social media posts and on Monday, criticism from state officials. In a letter to the supervisor of Southampton, where the concert was held, New York’s health commissioner, Howard A. Zucker, wrote that he was “greatly disturbed” by reports of thousands of people standing close and “generally not adhering to social-distancing guidance.”
“I am at a loss as to how the Town of Southampton could have issued a permit for such an event, how they believed it was legal and not an obvious public health threat,” Dr. Zucker wrote.
The town supervisor, Jay Schneiderman, who was also listed as an opener for the concert, did not immediately respond to requests for comment on Monday night. The event organizers did not answer questions about whether they knew that people were breaking the rules.
Several people who went to the concert told Buzzfeed News that they felt safe and that people were social distancing.
Elsewhere in the New York area:
New York, grappling with how to prevent another large outbreak, will now require travelers from Puerto Rico, Washington D.C. and 34 states to quarantine for 14 days, Gov. Andrew M. Cuomo said Tuesday. The new states added to the list are Illinois, Kentucky and Minnesota.
Long Beach Island, a popular summertime destination along the Jersey Shore, is now a different kind of hot spot.
Thirty-five lifeguards from two boroughs on the barrier island — Surf City and Harvey Cedars — recently tested positive, the island’s health department announced on Monday.
Public health officials said that half of the lifeguards had mild symptoms and the rest had none. None were hospitalized, the officials said.
The outbreak was traced to two gatherings on July 12 and July 14, according to the Long Beach Island Health Department, which said it dispatched nurses to investigate cases and issue quarantine orders.
“Based on our investigation so far, the workplace was not the source of transmission and practices likely prevented additional cases,” the Health Department said in a news release. “The youth and young adults should recognize they are not immune to this virus.”
During his briefing on Monday, Gov. Phil Murphy of New Jersey mentioned the outbreak on Long Beach Island and said he was troubled by reports of large gatherings of young people.
“This is among us, folks,” Mr. Murphy said. “Any of us who thinks we can just put our feet up and relax and let this take its course is not paying attention, particularly congregating inside, in close proximity, poor ventilation, without face coverings. You’re looking for trouble. You’re absolutely looking for trouble, no matter how old you are.”
Germany, an early model for containing the virus, is confronting a surge. Its top health experts urge masks.
The German federal agency in charge of disease control sounded an alarm on Tuesday over a rising number of cases across the nation.
Lothar Wieler, the leader of the agency, the Robert Koch Institute, urged Germans for the first time to wear masks outdoors if a distance of 1.5 meters, or about 5 feet, cannot be maintained.
Germany reported 633 new cases on Monday, and four deaths. Though Germany’s daily death count has been in the single digits for most of this month, there have been more than 3,000 new cases over the past week.
“The new developments in Germany make me very worried,” Mr. Wieler said, adding, “The rise has to do with the fact that we have become negligent.”
When the virus began spreading in March, Germany imposed one of the strictest lockdowns in Europe. It was seen as a model for other countries. Since it began reopening, there have been flare-ups that have spurred local lockdowns, including one in June.
But on Tuesday, Mr. Wieler said he wondered if this latest uptick was a harbinger of something more.
“We don’t know if this is the beginning of a second wave, but of course it could be,” he said. But he added, “I am still optimistic that we can prevent this.”
‘Not sparing anyone’: A Texas funeral home sees the toll of the virus all around.
Johnny Salinas Jr., the owner of Salinas Funeral Home typically handles five funerals a week. But on a recent day, with the virus tearing through his community, he saw that many grieving families in a single day.
A sixth family was waiting, too. His own.
Mr. Salinas changed from a polo shirt into a crisp black suit and left his office for the chapel next door. The light blue coffin of his great-uncle, who died of Covid-19, sat at the front of the room, adorned with white flower arrangements and a wooden crucifix.
“The virus is not sparing anyone,” Mr. Salinas said. “Not even my family.”
In the Rio Grande Valley of Texas, funeral homes — like hospitals — are overloaded and struggling to carry out basic services and keep up with the expanding crisis. Local funeral homes, officials said, have not experienced such demand in decades.
About one in 60 residents of Hidalgo County is known to have had the virus, and about one of every 2,000 people has died from the virus, a New York Times database shows. Hidalgo County now has one of the highest per capita death rates in the state.
At the start of July, fewer than 50 deaths in Hidalgo County had been attributed to the virus, according to the database. By Saturday, there had been more than 450.
“It’s like a bad dream,” said Linda Ceballos, a co-director of Ceballos Funeral Home in McAllen. “You want to wake up, but you can’t.”
The death toll is forcing funeral directors to bypass traditional services like velorios, viewings that sometimes last for days and are filled with prayers, hugs and sorrowful Spanish-language songs. Instead, many funeral homes are shortening viewing times and limiting attendance. Some have ordered large refrigerator trucks to store bodies until they can get to them.
When the virus engulfed New York, it pummeled the transit work force: So far, 131 transit workers have died from the virus and more than 4,000 have tested positive, making the Metropolitan Transportation Authority one of the hardest-hit government agencies in New York.
For many, the pandemic has left an indelible mark. Pan Chan, a bus driver, moved out of his family’s home for months to shield his wife and children. Sally Lutchman, a train conductor, worried that she might have infected her husband, who was hospitalized with Covid-19 for months. Cesar Torres Jr., a second-generation bus operator, watched his father die.
Now, as riders trickle back, these workers are facing the prospect of a second wave, even as they are coping with the trauma from the peak of the outbreak.
The advertising industry may see permanent cuts after marketing budgets have dwindled during the pandemic. Agencies will likely be smaller, and work could start going to part-time contractors.
The tightening industry has already led to simpler and more practical ad campaigns, and more clients have asked that their ads be made by and feature a more diverse group of people, while also demanding more evidence that the ads are effective. Agencies have also experimented with digital tools to help brands stay relevant, such as a “tension map” that analyzes online conversations around the country.
“There’s a big correction — a lot of these teams have gotten too big and too bloated,” said Gaston Legorburu, founder of the Florida-based ad agency Glue IQ. “They’re now having the realization that they can do twice as much with half as many people.”
In 2020 and 2021, agencies will shed 52,000 jobs, and half of these will not return, predicted Jay Pattisall, an analyst with the research firm Forrester.
The pandemic takes an extra toll on families with special needs.
Missing social contacts and altered routines can be particularly intense for children with developmental challenges. Disturbed sleep and eating habits, too, can make life more challenging for the children and their families. Here are some strategies to cope better.

What was most popular the last time the Chiefs and 49ers won a Super Bowl
Tumblr media
The last two times these two won the Lombardi Trophy, things were pretty different.
It’s been quite a long time since the Kansas City Chiefs won a Super Bowl. In fact, it’s been a whole 50 years — the Chiefs won Super Bowl IV in the 1969 season. Kansas City had the fourth-longest active drought without a Super Bowl appearance until it earned a bid this season.
The San Francisco 49ers, on the other hand, have won a championship more recently. Their last Super Bowl win came in the 1994 season, when the Steve Young-led 49ers defeated the San Diego Chargers in Miami.
This year’s Super Bowl is also in Miami, but that’s about all that remains the same. A lot has changed in the world since the last time these two won championships.
Let’s take a look at what was happening in sports, TV, movies, pop culture, and technology the last time the Chiefs and 49ers won the Super Bowl.
1969 vs. 1994 in sports
1969
The New York Mets won the World Series, 4-1, over the Baltimore Orioles. Nicknamed the “Amazin Mets,” the victory was one of the biggest upsets in World Series history. The Mets it had a losing season each year before that.
The Boston Celtics were the NBA champions, as they defeated the Los Angeles Lakers in seven games. We saw the Celtics-Lakers rivalry heat up during this decade, and the two played in the finals six times — Boston won them all.
In college football, the Texas Longhorns won the national title, beating Notre Dame, 21-17, in the Cotton Bowl, and thus, Texas was truly back. What’s also interesting about this season is after the Longhorns defeated No. 2 Arkansas in December earlier that season, President Richard Nixon presented Texas with a plaque claiming the Longhorns to be the No. 1 team in the land.
1994
Major League Baseball strike: 1994 was a chaotic year for the MLB. Owners wanting to implement salary caps led to a players’ strike in August. It didn’t end for 232 days, the longest stoppage in MLB history, and there was no World Series. The strike cost management close to $1 billion, and players lost millions. It effectively ended Michael Jordan and Bo Jackson’s MLB careers, too.
The Nebraska Cornhuskers won the college football national championship by beating then-No. 1 Miami in the Orange Bowl. It marked head coach Tom Osborne’s first national title, though he’d go on to win two more in the 90s.
The Houston Rockets won their first-ever NBA championship, taking the seven-game series against the New York Knicks.
The O.J. Simpson chase: During Game 5 of Knicks-Rockets, NBC’s telecast was interrupted for the police chase of Simpson in his white Bronco:
youtube
Tonya Harding won the U.S. Figure Skating Championship. As you probably know, that was before she was later stripped of her title for her role in the attack on her competitor, Nancy Kerrigan, which happened that same year.
1969 vs. 1994 in music
1969
The Billboard No. 1 song in 1969 was “Sugar, Sugar,” by a cartoon band named The Archies, from the animated TV show The Archie Show. Yes, this is incredibly weird to me, too.
youtube
Other big hits during this year included “Honky Tonk Women” by the Rolling Stones, “Aquarius/Let The Sunshine In” by the 5th Dimension, and “I Can’t Get Next To You” by the Temptations.
The Woodstock music festival was held in August 1969. More than 400,000 people gathered on a farm in New York to see artists like Jimi Hendrix, The Who, The Grateful Dead, and Janis Joplin.

The festival is known as one of the biggest and most important music events in history, lasting four days (it was originally supposed to be only three) while heavy rains caused delays of several acts.
The Beatles recorded their final album together, Abbey Road, which included classics like “Here Comes the Sun” and “Come Together.” That year, the group gave its final live performance, which took place on the roof of Apple Records.
1994
The No. 1 Billboard single for 1994 was “The Sign” by Ace of Base, which was the title track of the Swedish group’s debut album. This one was an absolute banger:
youtube
Other hits like “Don’t Turn Around” and “All That She Wants” were on this album.
Some other popular songs from this year included Sheryl Crow’s “All I Wanna Do,” and Boyz II Men’s “I’ll Make Love To You.” This year Mariah Carey released her Christmas album, which is the greatest holiday album in history. I’m not 100 percent sure about that fact, but I’m right, OK? Hootie and the Blowfish’s Cracked Rearview Mirror album was released, though it became more popular the following year in 1995.
This was a pretty big year for debuting artists. Some of the more notable ones, to name a few: Weezer, Outkast, Beck, Notorious B.I.G., and Oasis.
Nirvana lead singer Kurt Cobain sadly died in April 1994.
1969 vs. 1994 world events
1969
One of the biggest moments in both the U.S. and the world history was the Apollo 11 mission, which successfully put the first-ever man on the moon. The mission, led by Neil Armstrong and Buzz Aldrin, launched on July 11, 1969, and landed on the moon on July 20.

On July 18, 1969, U.S. Senator Ted Kennedy drove his car off of a bridge in Chappaquiddick, which resulted in the death of Mary Jo Kopechne, a former campaign worker of Robert Kennedy’s. Although the news made headlines in the beginning, it ultimately was largely overshadowed by the Apollo 11.
President Richard Nixon was inaugurated on Jan. 20, 1969, for his first term.
On Dec. 1, 1969, a draft lottery was reinstated, for the Vietnam War. It was the first since World War II.
1994
Bill Clinton was sued for sexual harassment by Paula Jones while serving his first term as the President of the United States. The accusations Jones brought forward were allegedly from when Clinton was the governor of Arkansas in 1991. Judges allowed Clinton to avoid trial for the lawsuit until after he left office. Jones later settled her lawsuit in November 1998 after Clinton won the 1996 election.
The Republicans took control of the House of Representatives after Newt Gingrich’s Contract with America. Before Republicans took control. Gingrich signed the contract which laid out legislation that would be passed within the first 100 days of Congress.
Nelson Mandela was elected as South African’s president, in the country’s first-ever democratic election. The elections marked the end of apartheid in South Africa, and Mandela later established a commission to investigate human rights and political violations that happened during apartheid. Beyond his time in office, which lasted until 1999, Mandela is considered to be one of the greatest champions of peace and social justice, both in South Africa and around the world.
1969 vs. 1994 television and movies
1969
The No. 1 grossing movie was Butch Cassidy and the Sundance Kid, starring Paul Newman and Robert Redford. It later won four Oscars, including for Best Original Screenplay.
The children’s television show Sesame Street debuted on PBS in 1969. Sesame Street is still airing new episodes on TV to this day!
Rowan & Martin’s Laugh-In was the most-watched TV show, a sketch comedy show hosted by comedians Dan Rowan and Dick Martin. The show featured actresses like Lily Tomlin and Goldie Hawn as performers, too.
1994
Seinfeld was the most-watched television show, while Friends and ER premiered this year. Nearly 22 million people watched the Friends premiere, and ER had over 23 million viewers. All three shows were the anchors of NBC’s Must-See TV lineup.
Disney’s The Lion King was the top-grossing movie that year, and other greats like Forrest Gump, Shawshank Redemption, and Pulp Fiction were released.
Frasier won its first Emmy for Outstanding Comedy Series. It went on to win 112 Emmys until it last aired in 2004.
1969 vs. 1994 celebrities
1969
Celebrities born this year included: Brett Favre, Renee Zellweger, Jennifer Aniston, Paul Rudd (who’s a huge Chiefs fan), and Jennifer Lopez, who coincidentally is performing the halftime show at Super Bowl LIV.
Dwight D. Eisenhower and Judy Garland passed away. Eisenhower died of congestive heart failure. Garland was just 47 when she died of a barbiturates overdose.
John Lennon and Paul McCartney both got married this year, McCartney to Linda until her death in 1998, and Lennon to Yoko Ono until his assassination in 1980.
1994
Lisa Marie Presley married Michael Jackson. The marriage lasted two years before the couple filed for divorce.
Time to feel old! Celebrities born this year include Justin Bieber, Harry Styles, Dakota Fanning, Giannis Antetokounmpo, and Joel Embiid.
Richard Nixon and Jackie Kennedy both passed away. Nixon was 81, and he died after suffering a stroke. Jackie O passed away of non-Hodgkin’s lymphoma at just 64 years old.
Billy Joel and Christie Brinkley divorced after 10 years of marriage. Brinkley was said to have partially inspired Joel’s hit “Uptown Girl.”
1969 vs. 1994 Technology
1969
The first-ever ATM was installed in the U.S.: On Sept. 2, 1969, the ATM became available to the public at Chemical Bank in Rockville Center, New York.
Tumblr media
This one could only give customers cash, though more ATM advancements came soon after.
Televisions looked a lot different!

1994
DirecTV’s first satellite digital television service launched. That year, there were just 320,000 subscribers.
Something called “Netscape Navigator” was the leading web browser at the time. I am 27 years old, and have no idea what this thing is:

There have been many changes in the 25 years since the 49ers last won a Super Bowl, and in the 25 years before that, when the Chiefs last earned the Lombardi Trophy. Fans of both teams are hoping they won’t have to wait as long to see them play in the Super Bowl again. But if they do, one thing’s for sure: the world will look a lot different.

Nats Beat O's In New York Court: Proskauer's Role Was At Issue
The broadcast rights dispute between the Baltimore Orioles and Washington Nationals has resulted in a Nats win in the New York Appellate Division for the First Judicial Department
Pursuant to the negotiated terms of the parties' written agreement, the subject arbitration, governed by the Federal Arbitration Act (FAA) (9 USC § 1 et seq.), was initiated before the Revenue Sharing Definitions Committee (RSDC) of Major League Baseball (MLB), to resolve a contractual dispute over telecast rights fees between TCR Sports Broadcasting Holding, LLP d/b/a the Mid-Atlantic Sports Network (MASN) and the Baltimore Orioles, and the Washington Nationals. For the reasons stated herein, we find that the arbitration award issued by the RSDC on June 30, 2014 was correctly vacated based on "evident partiality" (9 USC § 10[a][2]) arising out of the Nationals' counsel's unrelated representations at various times of virtually every participant in the arbitration except for MASN and the Orioles, and the failure of MLB and the RSDC, despite repeated protests, to provide MASN and the Orioles with full disclosure or to remedy the conflict before the arbitration hearing was held. However, even if this Court has the inherent power to disqualify an arbitration forum in an exceptional case, on the record before us there is no basis, in law or in fact, to direct that the second arbitration be heard in a forum other than the industry-insider committee that the parties selected in their agreement to resolve this particular dispute, fully aware of the role MLB would play in the arbitration process.
Contrary to the view of the dissent, there has been no showing of bias or corruption on the part of the members of the reconstituted RSDC, and the Nationals will use new counsel at the second arbitration. Speculation that MLB will dictate the outcome of the second arbitration by exerting pressure on the new members of the RSDC does not suffice to establish that they will not exercise their independent judgment or carry out their duties impartially, or that the proceedings will be fundamentally unfair.
The broadcast agreement was a result of the move to D.C. by the Montreal Expos, then owned by Major League Baseball. The marriage has been an unhappy one.
In 2012, after negotiations failed and the parties waived mediation before the AAA or JAMS, the matter proceeded to arbitration before the RSDC, which was to be comprised of representatives from the Tampa Bay Rays, Pittsburgh Pirates, and New York Mets. In accordance with customary practice, the arbitration was administered by MLB staff, who also provided analytical and legal assistance to the RSDC.
The Nationals were represented by Proskauer. Because Proskauer served as MLB's longtime outside counsel, in January 2012, the Orioles' counsel sent separate emails to MLB's then-Senior Vice President and General Counsel and its then-Executive Vice President, Labor Relations and Human Resources (Robert D. Manfred, Jr.), inquiring about Proskauer's representation of MLB and MLB Clubs, including those with representatives on the RSDC. In reply, counsel was told that Proskauer had been MLB's principal labor counsel for years, represented MLB in the Los Angeles Dodgers bankruptcy matter and other matters, assisted in a small number of seminars/conference calls for club counsel about ADA and DOJ enforcement, and possibly did salary arbitration work for the Rays. Counsel was advised to contact the clubs directly for further information concerning their relationships with Proskauer.
The Orioles objected to Proskauer's participation
The record shows that Proskauer, while representing the Nationals in the arbitration, had an extensive relationship with the clubs that comprised the RSDC and/or their representatives, and with MLB, which administered the proceeding. Discovery in the vacatur proceeding revealed that
(i) the Proskauer attorneys representing the Nationals represented the Pirates in Senne v Office of the Commissioner of Baseball, No. 14-00608 (ND Cal) and Garber v Office of the Commissioner of Baseball, No. 12-03704 (SD NY). Proskauer had also represented the Pirates president, who was its representative on the RSDC, in Phillips, et al. v Selig, No. 1966 EDA 2007 (Pa Super Ct), and advised the Pirates on Americans with Disability Act matters.
(ii) Proskauer represented the Rays in Senne and four separate salary arbitrations, one of which occurred during the arbitration; and
(iii) Proskauer defended the father of Jeffery Wilpon, the Mets chief operating officer and its representative on the RSDC, and the father's company, in a class action arising out of the Madoff Ponzi scheme, which was ongoing during the arbitration. Proskauer also represented the Mets in Senne.
Proskauer also concurrently represented MLB, its executives and closely-related entities in approximately 50 engagements. Although MASN and the Orioles repeatedly protested Proskauer's involvement and requested complete disclosure so they could assess the extent of the potential conflicts, MLB and the arbitrators undisputedly failed to provide full disclosure or seek to conduct the proceeding with arbitrators who had no prior relationships with Proskauer. While the arbitrators aver in this proceeding that they have no recollection of MASN's and the Orioles' disclosure requests or objections, the record establishes conclusively that MASN and the Orioles reiterated their objections in their written submissions to the RSDC before the merits hearing was held and at the hearing itself.
The evidence that the same lawyers in the same firm were representing interests of the arbitrators and MLB at the same time as they represented the Nationals in the arbitration is an objective fact inconsistent with impartiality. The arbitrators had a duty to, but did not, investigate or disclose their relationships with Proskauer, and MLB failed to exercise what power [*9]it had to ensure confidence in the fairness of the proceedings in light of MASN's stated concerns (see Applied Indus. Materials Corp., 492 F3d at 137 [where "[a]n arbitrator
. . . knows of a material relationship with a party" but fails to disclose it, "[a] reasonable person would have to conclude that [the] arbitrator who failed to disclose under such circumstances was partial to one side," even where the award itself was not clearly favorable to the other party]; Morelite, 748 F2d at 84 [vacating award based on "a father-son relationship between an arbitrator and the President of an international labor union," without any suggestion that the father was sitting in some representative capacity]).
MASN did not waive its evident partiality challenge by failing to move for the disqualification of the arbitrators. MASN demonstrated its belief that it was improper for Proskauer to represent the Nationals given its role as MLB's outside counsel, its representation of MLB clubs, including one club that had a representative of the RSDC panel, and MLB's role in administering the proceeding and appointing the RSDC arbitrators, who might also have relationships with Proskauer. Particularly, in a February 13, 2012 email, Manfred stated that the Orioles and MASN's objections should be separately documented to him. On February 14, 2012, counsel for the Orioles and MASN complied, asking Manfred whether anything more was needed.
Thus the arbitration cannot be sustained
the circumstances cited by the dissent do not warrant the removal of the RSDC. While the dissent waxes poetic about the purity of the game of baseball, MLB is first and foremost a business, governed by its constitution and innumerable agreements and contracts. Because arbitration is a matter of contract, "the parties to an arbitration can ask for no more impartiality than inheres in the method they have chosen" (National Football League Mgt. Council v National Football League Players Assn., 820 F3d 527, 548 [2d Cir 2016]) and the FAA permits parties to select arguably partial arbitrators, if doing so serves their interests...
But the Nats win
The motion court's decision vacating the award was based solely on Proskauer's conflicts, a defect that has been remedied in that the Nationals have retained new counsel. MASN and the Orioles have not and cannot show that the agreement is unenforceable under general contract principles. Everyone was aware that the RSDC was composed of MLB owners, or their designees, and of the inherent conflicts the panel's relationship with MLB created. MASN and the Orioles have not established that MLB, whose staff are required to treat each Club "fairly and equitably," would wield any improper or unforeseen power over a newly constituted RSDC arbitration panel. Nor has it been shown that the new RSDC members (the principal owner of the Milwaukee Brewers and executives of the Toronto Blue Jays and Seattle Mariners) have any bias against MASN or the Orioles.
Under these circumstances, to compel the parties to arbitrate before a body other than one to which they knowingly agreed, just because MASN and the Orioles are dissatisfied with the result, would violate the Nationals' right to assert their contractual rights under the agreement and create undue uncertainty within this industry, and others, that have chosen to use panels composed of industry insiders, with specialized expertise, to arbitrate complex disputes.
From the dissent of Justice Acosta
Part of what makes baseball such a beloved sport is its rules, which preserve the integrity and popularity of the game (see Office of the Commissioner of Baseball, Official Baseball Rules [2016], available at http://ift.tt/23h1XHY [accessed June 29, 2017]). Players take the field with the expectation that the umpires are not predisposed to apply those rules in favor of one team over the other. The players win or lose each game based on their own skills and the fair application of the rules - not the influence of some outside force, such as partial umpires or illegal betting. In short, the game is fundamentally fair, a concept that is equally important in arbitrations. An arbitration, like most sports, requires that adversaries begin on a level playing field, with ground rules that are applied fairly to both sides, and without decision makers who will prejudge the matter. Otherwise, there would be no integrity or trust in the process. Unfortunately, in this case, we are confronted with a fundamentally unfair arbitration that was conducted by Major League Baseball and involved a dispute between two baseball clubs.
I cannot recall having previously encountered such a confluence of factors that call for judicial intervention in an arbitration: Not only does the entity administering the arbitration (Major League Baseball [MLB]) have significant influence over the arbitrators, including the power to marshal evidence and draft arbitral award decisions, but it also made a bet on the outcome of the arbitration by loaning one of the parties $25 million to be repaid after an award in that party's favor. And, more egregiously still, the Commissioner of Baseball who controls the arbitration process made public statements during post-award litigation indicating a position on the merits of the case. Under these unique circumstances, a rehearing by the same arbitral forum that conducted the initial arbitration under the purview of the Commissioner's office would be all but guaranteed to yield the same result. Therefore, to effectuate the intent of the parties as expressed by their contractual choice to arbitrate the dispute before a panel of experts, I would hold that it is necessary and appropriate to exercise our inherent equitable power to reform the contract and refer the matter to a neutral arbitral forum, one that is possessed of expertise relevant to the specific issues involved, to conduct a fundamentally fair arbitration...
At bottom, MLB's pervasive bias and unfair conduct has infected the RSDC so as to frustrate the parties' intent to submit their dispute to a fundamentally fair arbitration. Even if the parties' initial choice to arbitrate before the RSDC was not a choice for a totally neutral forum, we must assume that they intended to arbitrate in a forum that offered at least a reasonable level of fairness and impartiality. Because that intent has been frustrated, reformation of the agreement to require a rehearing not administered by MLB or the RSDC is warranted. Therefore, we should substitute our discretion for that of the motion court and direct the parties to submit the subsequent arbitration to the AAA.

Celebrating MLB Opening Day 2019 with a glance at how taxes affect America's Pastime
Hope springs eternal for MLB fans on Opening Day. I'm looking forward to this season bringing another World Series pennant to join the 2017 one in the Houston Astros' Minute Maid Park. (Photo by me, taken at the 'Stros' championship celebration with fans at their home opener on April 2, 2018)
Today is a holiday in our house. It's Opening Day for Major League Baseball.
Our formal celebration of the sport's first games of the year began when we lived in the Washington, D.C. area. In those days, there were no Nationals. The Baltimore Orioles ruled the MidAtlantic baseball world, which was fine with us since we lived in the Maryland suburbs and were Birds' partial season ticket holders.
Even better, my boss for our early years in the National Capital area was a big baseball fan himself. As such, he closed the office on MLB's Opening Day.
That meant as a group we all, even the few who weren't really fans of the game, headed up the road to Baltimore's now-gone Memorial Stadium. (Tickets were courtesy of the boss. We were on our own for concessions.)
Honoring baseball tradition: Back then, tradition held that each new MLB season began in Cincinnati.
Shortly after the toss of that baseball in the Red's National League park, the American League's first pitch was thrown out at the Orioles' game. And the hubby and I along with my boss and colleagues were there, cheering on the O's.
Even after I changed jobs, we continued to celebrate Opening Day, taking a vacation day to go to Orioles' games in person.
After our eventual move from the D.C. area, our MLB season opening tradition continued, although that now means usually watching the games on TV or listening via radio.
Expanded 2019 Opening Day: Nowadays, MLB is more egalitarian, at least with the start of this new season.
For the first time in the professional game's history, all 30 MLB teams will play on Opening Day 2019.
That means our baseball holiday festivities will officially start today, March 28, the earliest opening day ever for MLB, at noon Central Daylight Time with the Orioles in the Bronx to take on the New York Yankees in the first of ESPN's MLB Opening Day tripleheader.
At 3 p.m. CDT we'll mute the TV and turn on the radio to listen to our Houston Astros begin their quest to take back the championship in Tampa against the Rays. (Don't get me started on MLB's fan unfriendly TV blackout rules and my TV provider's lack of 'Stros' sports channel coverage.)
Then it's back to TV for the defending World Series Champion Boston Red Sox at the Seattle Mariners.
So as soon as this post is published, I'm done with work for the day!
Baseball and taxes: Of course, I couldn't leave the blogosphere without at least touching on baseball's connection to taxes, or vice versa.
I give you links below to earlier Don't Mess With Taxes posts on how taxes touch the America's Pastime and sports in general:

Tax effects on recent MLB player moves: Also, I've got to mention the frantic last few days of Spring Training and, of course, taxes.
Late March was when teams finally locked down the games' biggest free agents — Bryce Harper (now part of the Philadelphia Phillies; sorry, Washington Nationals fans) and Manny Machado (the former Oriole now with the San Diego Padres after a brief stint last season with the Los Angeles Dodgers), as well as some of MLB's biggest stars — Mike Trout's historic contract with the Los Angeles Angels [at Anaheim] and Houston Astros' extensions for All-Star third baseman Alex Bregman and future Hall of Fame pitcher Justin Verlander.
Taxes may have been a factor in Bregman's and Verlander's deals. Sure, it's not a bad idea for those players to stick with a team that's likely to be a World Series contender for at least a few more years. Plus, all their Houston home games are in no-state-income-tax Texas.
Other players, however, do have to think about, as the following items note, income taxes on their new, high-dollar contracts.

The Machado and Trout signings apparently ignored conventional tax wisdom, with both players (and their agents) deciding to make California, one of the highest income tax states, their homes.
City as well as state tax tolls: But Harper's move up I-95 to Philly also will cost him when the city taxes are counted.
Sean Packard, tax director at OFS, a financial planning firm dedicated to working with professional athletes, notes in his column for Forbes:
Pennsylvania is one of the few states that includes a true signing bonus as allocable income, meaning a portion of that income is taxable to the state. Philadelphia, which has a higher tax rate than Pennsylvania, also includes signing bonuses as allocable income.
All told, Harper will pay a 6.5267% state income tax to Pennsylvania and Philadelphia on all of his allocable wages; $603,109 of that is on his [$20 million] signing bonus.
Throughout the life of his contract, Harper will pay Pennsylvania and Philadelphia nearly $9.3 million in taxes. The Nationals — whose home base, Washington, D.C., is not allowed to tax non-residents — reportedly offered Harper 10 years and $300 million on the last day of last season. Harper and [his agent Scott] Boras turned that offer down.
Another tax expert, however, thinks that in the grand scheme of ginormous athlete deals, players (and their agents) tend to be aware of potential taxes.
"Athletes more and more are taking the state and local tax considerations into account when they're calculating and comparing different offers," tax lawyer Stephen Kidder told the Philadelphia Inquirer.
That's good advice for us all, regardless of our line of work.
Root, root, root for the home team: It's also worth noting that rooting interests could have affected Packard's and Kidder's differing takes on taxes and Harper's new deal.
Packard is a Nationals fan. I totally understand the tendency to look for a something that doesn't bode so well for a player who's jilted my favorite team.
Kidder, meanwhile, represents, the MLB Players Association, as well as Kidder represents the professional athletes' groups for the NFL, NBA, NHL, and major-league soccer. He's naturally going to lean toward supporting the moves those players make.
Yep, rooting interests always play a role, be it in sports or how we view tax decisions.
And with that, I'm outta here! Here's hoping your team wins today, unless your team is the Yankees or Rays!
