The bill's focus on rectifying perceived defects in Muslim law while ignoring similar issues within Hindu family laws has raised concerns about bias and selective application. “Majorly, it seeks to introduce changes in the provisions that are perceived as defective in the Muslim law, such as unequal inheritance, polygamy and the practice of halala ( by which a person can only remarry his divorced spouse after she has married someone else, consummated the marriage and thereafter obtained a divorce). In one sense the Bill has terminated the application of Muslim family law and has further criminalised the Muslim man and woman. Ironically, the Bill has not incorporated positive and progressive aspects of Muslim law such as the compulsory payment of mehr by the husband to the wife which provides financial security of the wife, nikahnama (marriage contract) which allows for the spouses to add legally binding conditions that are mutually acceptable, and a 1/3 limit rule for willing away property. Had the intention of the Bill genuinely been to bring about gender justice, such provisions could have been extended to women of all communities,” an excerpt from the statement reads.
Furthermore, the bill's silence on critical issues such as custody, guardianship, and adoption of children, as well as the rights of queer and transgender persons within families, has been deemed unacceptable by the women's groups. They argue that the bill's failure to address these issues reflects a lack of inclusivity and consideration for marginalised communities. Of particular concern is the retention of archaic provisions, such as the restitution of conjugal rights, which has been challenged for its constitutional validity. Critics argue that such provisions perpetuate gender-based violence and undermine fundamental rights, including the right to live with dignity and freedom of choice. The groups also maintain that this law denies or takes away fundamental rights.
Even the existing provision of women's right to reside in their matrimonial homes has been taken away. “Thus rights to equality, right to live and livelihood and to live with dignity, right to freedom of speech and expression, freedom of conscience and right to freely profess, practice and propagate religion, have become casualties under this Bill,” the statement reads.

Former Pakistan cricket team captain Shoaib Malik astonished the sporting world when he released photos of his wedding to actress Sana Javed. A dispute emerged just before Shoaib’s wedding to Sania in 2010, when a woman named Ayesha Siddiqui from Hyderabad claimed to have married Shoaib in 2002.
While Shoaib rejected the charges, Ayesha, also known as Maha Siddiqui, decided to submit a police report and exhibit video evidence of their wedding.
According to reports, the two came to an agreement in which the Pakistani cricketer agreed to divorce Ayesha and pay her INR 15 crore in alimony.

The most intriguing aspect of Shoaib and Ayesha’s marriage was that it was a ‘telephonic nikah’. In an interview with the Times News Network, Shoaib discussed conducting a telephonic nikah without even seeing his bride. The player, who was only 20 years old at the time, had only a few photos of Ayesha with him, and the two spoke on the phone on a regular basis. But, not long after, Shoaib was duped into marrying Ayesha, who was not even the girl he saw in images.
While Ayesha kept making excuses and refusing to meet Shoaib, she told the cricketer in 2002 that she wanted to marry him right away because the news of their relationship was all over the media, making life tough for her family.
“This episode took place in 2002. Ayesha encouraged us to marry. I wanted to marry her, but I didn’t want to rush into it. For starters, I had never met her. She proposed that we do a telephone nikah immediately away. I couldn’t tell my parents about a telephone nikah because it was not how they intended me to marry.
I was only 20 years old at the time, and Ayesha was putting a lot of pressure on me to marry because she said her family was losing face in Hyderabad since word had spread that we were dating. One morning in June 2002, I strolled out of my house, went to a friend’s shop, and called. “I got a nikahnama and signed it, thinking the girl I was marrying was the one in the pictures,” Shoaib stated in the interview.
Shoaib realized in August 2005 that the female he was talking to on the phone was not the same as the one he had seen in images. When he challenged Ayesha about it, she also revealed the truth.
Shoaib considered distributing the pictures he had with him, but Ayesha advised him not to do so because the girl in the photographs was already married. Malik opted not to disclose the images because she feared it would ruin her life.

She suggested that we could do a telephone nikah right away. There was no way I could tell my parents about a telephone nikah, because it's not the way they wanted me to get married. I was just 20 then, and under a lot of pressure from Ayesha to get married as she was saying that her family was losing face in Hyderabad as word had got around that we were courting. I walked out of my house one morning in June 2002, and went to my friend's shop and called from there. I got a nikahnama, signed it, thinking the girl I was marrying was the one in the photographs," Shoaib said in the interview.
It was sometime in August 2005 that Shoaib got to know that the girl he was talking to on the phone, wasn't the one he had seen in pictures. When he confronted Ayesha about the same, the woman also told him the truth.
Shoaib even thought of releasing the pictures he had with him but was asked not to do so by Ayesha as the girl in the photographs was already married. Thinking the release of pictures would ruin her life, Malik decided against doing so.

Background
1.    This is a WP filed under Article 226 of the Constitution of India Read with Section 482 Cr P C for directing Respondent 2 & 3 to provide protection from thee Respondent 4 (#father) and Respondent 5 (#Uncle of the petitioner.)
2.    The pertioners got married on 06.10.2023 according to #Muslimrites and #ceremonies. The #Nikahnama was #registered by a Qazi in accordance with Muslim law. It is alleged that since the marriage was solemnized #against the #wishes of the #parents so they are #threatening of #direconsequences.
Observation of the Court
1.    The #right to #marry is an #incident of #humanliberty.
2.    The right to marry a person of one’s choice is not only #emphasized in the #UniversalDeclarationofHumanRights, but is also an #integralpart of #Article21 of The Constitution of India.
3.    The #petitioners in the present case are #bothmajor and are well within their rights to marry each other.
4.    When the parties here are #twoconsentingadults who have chosen to willingly agree to join hands by way of marriage, there can hardly be any impediment on the way, be it from the parents/ relatives or the Society at large or the State.
5.    There is nothing left for anybody to #interfere in the lives of the parties herein.
6.    The respondent nos.4 and 5, though family members of the petitioner no.2, cannot be allowed to threaten the life and liberty of the petitioners, who do not require any social approval for their personal decisions and choices
7.    Article 21 of The Constitution of India gives Protection of Life and Personal Liberty to all persons whereby it is the inherent right of every individual to exercise personal choices, especially in matters relating to marriage.
Order
1.    The petitioners are entitled for protection under Article 21 of The Constitution of India.
2.    The petition is allowed and the petitioners shall be free to call or get in touch with either the SHO or the Beat Constable of PS: Jahangirpuri, Delhi, as and when required.
Direction to SHO & Beat Constable
1.    The SHO and the Beat Constable of the concerned Police Station is directed to take all possible steps to provide adequate assistance and protection, as and when needed, to the petitioners, in accordance with law.

On June 9, the victim, whose family shifted to the area recently, was stopped by the cleric Javed. The accused told her to come to the Madrassa to fill some forms.
At the Madrassa, Javed raped the victim and threatened her with consequences, if she spoke about it.
Under arrest, Javed confessed he had sexual relations with the minor but said he had nikah with her first. He also claimed she wasn't a minor.
However, her parents showed a birth certificate that proved she was born on March 19, 2004, which makes her 15 years old.
"We are being accused of framing Javed for money. No one is supporting us," the victim's father said. The indifference has forced the family to move out of their home.
In 2015, a sessions court in Ahmedabad acquitted a Muslim man accused of raping a 15-year-old as he produced a nikahnama. The girl was pregnant and DNA report confirmed the accused was the father.
Nikahnama is an Islamic prenuptial agreement. It is a formal, binding contract considered an integral part of an Islamic marriage, and outlines the rights and responsibilities of the groom and bride or other parties involved in marriage proceedings.
