MOOSE JAW, Sask. — Burton Cummings used to play some of the loudest rock in Canada, but now he’s trying to get a neighbouring dance studio in Saskatchewan to turn down its tunes.
Kyra Klassen owns Dance Fitness With Kyra in downtown Moose Jaw where people gather to sweat to music-filled fitness classes.
She says Cummings, the former lead singer for The Guess Who, lives in a residential building next to her studio and has been coming into classes to complain about the noise.
She says Cummings has called police several times and even gone to city council to get a zoning bylaw changed.
Klassen says she has tried meet with the rocker to find a compromise, but he always declines.
A manager for Cummings told The Canadian Press he has no comment about the situation.
“I’m trying to co-exist and operate and run a business while being next to him,” Klassen said Friday. “It’s kind of become an ongoing issue that’s escalated quickly.”

Klassen moved into the building last April. She said the studio operated without issue for awhile, with its wide windows open, music bumping and participants celebrating when they completed a tough workout.
Klassen said she’s not sure what happened, but after five months she began getting messages, complaints and visits from police and from Cummings himself.
She said she has never been issued a ticket and is confident she’s not breaking any bylaws.
Klassen said she has worked with her landlord to add soundproofing to the studio and has even done sound tests, which show a peak volume of 74 decibels — about the same sound as running a vacuum cleaner.
“The moods in my classes are said to be energetic and positive … and with being so concerned about the volume and ladies cheering or clapping when a song is done, that’s definitely changed,” Klassen said.
The fitness instructor was shocked to learn a petition has started to have a city bylaw changed.
During a council meeting Monday, a motion was unanimously approved to prepare a report re-evaluating how business licences are issued in areas of the city’s commercial district where there are also residential properties.
“There is a current dispute between a business owner in the commercial district and neighbouring residents,” Mayor Fraser Tolmie said in an emailed statement.
“The matter is being sorted out through the legal system and the city will respect that process. However, this issue has exposed the fact that we do not have a current bylaw that addresses activity in mixed use (business/residential) buildings.”
Klassen said the mayor as well as two city councillors have reached out to try and find a solution that works for both the fitness studio and the rocker.
“Best case definitely would be that we could both work and operate and live peacefully,” she said.
“We both love the spaces we are in.”

Bones co-stars Emily Deschanel and David Boreanaz have landed a massive payday after winning more than $179 million in their lawsuit over profits from the hit show.
The actors, who featured on the comedy/drama series for 12 seasons until it ended in 2017, sued production officials at 20th Century Fox TV and Fox Broadcasting back in November 2015, alleging that they, along with fellow plaintiff, writer/executive producer Kathleen Reichs, had not received a cut of profits from the distribution of the long-running show for years.
In legal papers filed in a Los Angeles court at the time, the stars explained they had hired an auditor to determine roughly how much they had missed out on, with the financial consultant estimating they had been “cheated out of more than $100 million in gross revenues”, while being “overcharged many additional millions of dollars in alleged expenses”.
They sued for breach of contract, fraudulent concealment, and intentional interference with contract, and sought damages and a jury trial, just a week after another executive producer, Barry Josephson, filed a similar complaint about accounting.
The cases appear to have been combined and ended up going to arbitration, but Peter Lichtman, the private official overseeing the dispute, recently found in the plaintiffs’ favour, accusing Fox executives of purposefully lying about finances and defrauding the stars out of profits.
The figure awarded to the foursome includes $128 million in punitive damages, and is now the second-largest payout in TV industry history, according to The Hollywood Reporter.
Only Disney bosses have been forced to pay out more – $319 million back in 2011 following a dispute over profits for hit game show Who Wants to Be a Millionaire.
Celebrating the news as it was made public on Wednesday, Emily released a statement which reads: “We are so proud of the hard work we did on Bones for 12 seasons and only ever wanted Fox to live up to its promises and contractual obligations.”
“It’s clear that what we were saying all along was true: we were owed additional compensation for our work,” adds David. “Now I can only hope that Fox is made to settle its obligations to us without further delay.”
However, the group may have to wait to receive payment as attorneys for Fox have already filed a motion challenging the decision.
“The ruling by this private arbitrator is categorically wrong on the merits and exceeded his arbitration powers,” a network representative states to TMZ. “Fox will not allow this flagrant injustice, riddled with errors and gratuitous character attacks, to stand and will vigorously challenge the ruling in a court of law.”

FORT LAUDERDALE, Fla. — The panel investigating the Florida high school massacre recommended Wednesday that teachers who volunteer and undergo extensive background checks and training be allowed to carry concealed guns on campus to stop future shootings.
The Marjory Stoneman Douglas High School Public Safety Commission voted 13-1 to recommend the Legislature allow the arming of teachers, saying it’s not enough to have one or two police officers or armed guards on campus.
Florida law adopted after the Feb. 14 shooting that left 17 dead allows districts to arm non-teaching staff members such as principals, librarians and custodians — 13 of the 67 districts do, mostly in rural parts of the state.
Pinellas County Sheriff Bob Gualtieri, the commission’s chairman, pushed the measure at the Tallahassee meeting. He said most deaths in school shootings happen within the first few minutes, before officers on and off campus can respond.
He said suspect Nikolas Cruz stopped to reload his AR-15 semi-automatic rifle five times, all of which would have been opportunities for an armed teacher to shoot him.
“We have to give people a fighting chance, we have to give them an opportunity to protect themselves,” Gualtieri said. He said there aren’t enough officers or money to hire one for every school, but even then officers need backup. “One good guy with a gun on campus is not enough.”

The state teachers union and PTA have previously expressed opposition, saying teachers are hired to educate, not be police officers.
Commissioner Max Schachter, whose 14-year-old son Alex died in the massacre, cast the lone vote against the motion. He said the state should focus on hiring more police officers for campuses and allowing non-teaching staff to carry guns.
“We do need more good guys with a gun on campus — nobody understands that and wishes we had more at Marjory Stoneman Douglas than myself,” Schachter said. But arming teachers “creates a host of problems.” The father and wife of other victims, who are not on the commission, also spoke against arming teachers.
After the shooting, Florida law was changed to allow school districts to train and arm employees other than teachers except those who are former or current police officers, current members of the military or Junior Reserve Officer Training Corps instructors.

Currently, teachers in 28 states can carry firearms, according to the Crime Prevention Research Center, a conservative non-profit organization. District approval is required in most states and restrictions and training requirements vary.
The 15-member commission, which has been meeting periodically since April, will present a report to Gov. Rick Scott, incoming Gov. Ron DeSantis and the Legislature by Jan. 1.
The commission includes law enforcement, education and mental health professionals, a legislator and the fathers of two slain students.
Also Wednesday, a judge rejected former Stoneman Douglas campus deputy Scot Peterson’s contention that he had no obligation to confront Cruz.
Refusing to dismiss a lawsuit filed by the parent of a victim, Broward Circuit Judge Patti Englander Henning found after a hearing that Peterson did have a duty to protect those inside the school. Video and other evidence shows Peterson, the only armed officer at the school, remained outside while shots rang out.
The negligence lawsuit was filed by Andrew Pollack, whose daughter Meadow was killed. Pollack said it made no sense for Peterson’s attorneys to argue that a sworn law enforcement officer with a badge and a gun had no requirement to go inside.
“Then what is he doing there?” Pollack said after the ruling. “He had a duty. I’m not going to let this go. My daughter, her death is not going to be in vain.”
Peterson attorney Michael Piper said he understands that people might be offended or outraged at his client’s defence, but he argued that as a matter of law, the deputy had no duty to confront the shooter. Peterson did not attend the hearing.
“There is no legal duty that can be found,” Piper said. “At its very worst, Scot Peterson is accused of being a coward. That does not equate to bad faith.”
The commission voted Wednesday to condemn Peterson’s actions, calling him “derelict” in his duties.
Cruz, a 20-year-old former Stoneman Douglas student, has pleaded not guilty, but his lawyers have said he would plead guilty in exchange for a life sentence. Prosecutors are seeking the death penalty.
