The U.S. Supreme Court on Friday agreed to review a decision that revived a long-running lawsuit by the Navajo Nation, which claims that the U.S. Interior Department has a duty to develop plans to provide the reservation with an adequate water supply. The high court granted two petitions for certiorari – one by the federal government, one by Arizona and other states -- challenging last year’s decision by a three-judge panel of the 9th U.S. Circuit Court of Appeals. The 9th Circuit said “an irreversible and dramatically important trust duty” was implied by 175 years’ worth of treaties and court decisions. The challengers, however, say implied rights are unenforceable. “The federal treaties with the Navajo Nation…do not address water at all,” and the doctrine of implied water rights “cannot justify imposing such a fiduciary duty,” lead counsel Rita Pearson Maguire argued in the states’ cert petition. The Interior Department, represented by Solicitor General Elizabeth Prelogar, added that the 9th Circuit’s approach would replace national policy decisions with “a regime of general judicial oversight of the United States’ relationship with Indian tribes.” The Navajo Nation, represented by Shay Dvoretzky of Skadden, Arps, Slate, Meagher & Flom, defended the 9th Circuit’s decision and urged the high court to deny certiorari. The Interior Department declined to comment on Friday. Maguire and Dvoretzky did not immediately respond to requests for comment. The Navajo Nation filed suit in 2003. It wants the Interior Department to determine whether the Little Colorado River, which runs through the reservation, is sufficient “to fulfill the Reservation’s purpose of establishing a permanent homeland for the Nation” – a standard known as Winters rights, from a 1908 U.S. Supreme Court decision. If not, the Nation says the government must develop a plan to supply water from other sources. A federal judge in Prescott, Arizona,

This week 175 years ago, back in 1848, the Irish flag was first unveiled and hoisted on the Mall in Waterford, Ireland.
Created by Thomas Francis Meagher a skilled orator and statesman who later went on to become the first acting governor of Montana.
Often represented as green, white and gold the Irish flag is in fact green, white and orange - in Meagher's own words: "The white in the centre signifies a lasting truce between the 'Orange' and the 'Green', and I trust that beneath its folds the hands of the Irish Protestant and the Irish Catholic may be clasped in generous and heroic brotherhood."
The 7th of March 2023 marks 175 years since the Irish flag was first flown.

New N.B. law allows supported decision-making for intellectually disabled residents
Dianne Cormier Northrup has helped her son and daughter, who both have intellectual and physical disabilities, communicate their key life decisions for years. Soon, her support role in that process will have a legal foundation.
New Brunswick's lieutenant-governor gave assent Friday to the province's Supported Decision-Making and Representation Act, which will allow people with intellectual disabilities to appoint those who will assist in important choices they make.
In a news release, Inclusion New Brunswick said the province "has become one of the few jurisdictions in the world" to implement a court-recognized, supported decision-making process.
The new system will allow for a person with intellectual disabilities -- who may have difficulty understanding and conveying information -- to make decisions using the assistance of others who are appointed by the person or the courts. The Attorney General's office still has to provide details on how the new Bill will be administered.
Sitting with her children, Rob and Lynn Chamberlain, who have a neurological condition called autosomal familial spastic quadraplegia, Cormier Northrup -- who is 75 -- says the legislation gives her a sense of security that she and others can give voice to the siblings' personal and financial choices.
"All of us are happy about the law because supported decision making is how we've always been doing it anyway. Now it's for real, and we can use it," she said during a zoom interview from Robert and Lynn's home in Bathurst, N.B.
During the zoom call, Robert, 55, and Lynn, 52, who cannot speak, vigorously nod their heads to show they agree with the legal changes.
Robert confirms with a slight movement of his head that at times it is hard to have others understand his decisions, and then nods vigorously and makes a sound similar to "Yes," when asked if he likes to have his mother assist others in understanding.
He also smiles and nods in affirmation when asked if his mother is "a good talker," and the family shares a laugh.
When Lynn wants to add a point, she sometimes vocalizes sounds that suggests to her mother that there's further information her daughter wants to get across.
During the interview, she indicated to her mother she wanted to make clear there are others in her support-decision making circle. The mother confirms, with Lynn nodding, that her aunts, Jeannine Duguay and Marie Meagher, along with her cousin Laurie Jean, will be among those authorized to assist in making decisions.
Inclusion Canada spokesman Marc Muschler says there are elements of supported decision making in other jurisdictions across Canada, but the New Brunswick law is more comprehensive in that it allows for a broader group of people to make use of decision making supports.
He said it also provides a two-track process for the appointment of decision making supporters: one for people who can appoint their own supporters, and one that allows for someone to apply to the courts to become an "decision-making supporter."
Danny Soucy, a community planning advisor with Inclusion New Brunswick, says his son Daniel Soucy, 31, communicates through gestures and body language that he understands due to all of their years together.
"He can express his desires and we can translate his wishes," said the father during a phone interview from his home in Grand Falls, N.B.
Soucy said under the old law, if there was a significant decision to be made and Daniel couldn't directly convey his wishes to a health provider or bank, "we would have had to have him declared incompetent to make a decision for him."
"With this new law we'll be able to help and interpret what he wants and have the right decision for him made," he said.
The Bill says a person is capable of making decisions if they're able to understand information "relevant" to the decision, and appreciate the "reasonably foreseeable consequences" of a decision, "with the assistance that is available."
"A person is presumed to have the capacity to make a decision, unless the contrary is demonstrated," it reads.
Soucy does not see himself as an active decision-maker for his son, who has Down's Syndrome. Rather, he says he tries to "provide my son with the right information, allowing him to ask questions."
"As a supporter you're not making decisions, you're helping people make decisions for themselves," he said.

Cork Lifelong Learning Festival | Mayfield Library

The Cork Lifelong Learning Festival was back with a bang this year with over 300 amazing events with approximately one third of these being hosted by your local library service!
Today we take a brief look at a number of the events organised by Mayfield library for this years festival.
“Rebels, Writers & Merchants” was a heritage walk conducted from Mayfield Library by Brendan Goggin for the Lifelong Learning Festival on Saturday, April 1st. Brendan led 50 local history aficionados along a trail encompassing Ashburton, Gardiner’s Hill, Ardnalaoi and finishing up at the Montenotte Hotel. Along the way listeners were enthralled by the exploits of local Republicans a hundred years ago, the life and times of Daniel Corkery and the pioneering ideas of John Holland on submarine engineering.
In the modern Ardnalaoi housing estate they saw the incorporated high walls of what was once the estate of the Quaker merchant family, the Carrolls. The walk finished up at the Montenotte Hotel which very generously provided tea and pastries to assist in continuing historical discussion and aid the recovery of tired legs. It was here Thomas Francis Meagher, Waterford, would visit the residence of his young Murphy friends (the distilling family) and, replete with revolutionary ideas from Paris 1848, outline his design for the tricolour that eventually became our national flag.

The Mayfield Lifelong Learning Expo returned this year and was held at the Mayfield Sports Complex on Wednesday, March 29th. The event was officially opened by Lord Mayor Deirdre Forde, who wished all the day’s participants continued success. EXPO 2023 showcased the activities run by the Mayfield Learning Neighbourhood and a whole host of social, community, educational and service providers in the area. All came together on the day to organise and promote learning and lifelong participation in learning. Mayfield Library’s stand was tended in rotation by branch staff and experienced a high level of engagement with local schools, local organisations and the general public.
Staff were kept busy throughout the day explaining library services and how they can be accessed. Combining on-the-spot tutoring and support literature, the public learned about downloadable book borrowing (BorrowBox), digital magazine access (Libby), languages and hobbies (Universal Class) as well as the more traditional library materials and activities available within the branch. Particularly fascinating to some was learning that Ireland’s public libraries are now linked up and taking membership with one allows use of all.

Chehalem Ridge Nature Park grand opening
Metro unveils its newest park in a day of free food, guided tours, hands-on activities, and a ribbon cutting ceremony. The park is outside of the Cornelius/Forest Grove area, and free shuttles will take visitors from the designated parking area at Centro Cultural, 1110 N. Adair St., Cornelius. There will be no public parking at the park itself. Chehalem Ridge offers 10 miles of trails and more than 1,200 acres with views of the Tualatin River Valley and the Coast Range.

Open Space Dance welcomes a world premiere by international choreographer Kellan Whitmore exploring the archetype of “The Hero,” organizers say, while including inspiration from ancient creation mythologies. Whitmore has performed with the Alonzo King LINES Ballet and Tanz Theater Munster of Germany. Regional Dance America presented him with the National Choreographic Recognition Award in 2005. Zoo Nights
Come take a stroll through the Oregon Zoo at night. Portland Revels spring performance
Portland Revels returns to in-person performances with “Un Pajarito Canta” (A Little Bird Told Me), an original production featuring original songs, dancing and storytelling. Written by Yasmin Ruvalcaba Saludado, the story draws on traditional Mexican culture as well as Mayan mythology and modern sources. The story unfolds as a small town comes together to help a new community member find her voice and share her story.
