5 Tips for HR When Handling Redundancy

Most HR departments will concede that one of the most stressful and complex challenges they face is handling redundancies amongst employees. Apart from the emotional stress this can cause for all parties involved, there are logistical and legal implications to consider. Also, the need to ensure that the employee is adequately supported during the leaving process – for their sake and for the organization's reputation. 
What is redundancy, and how is it managed in UAE Labour law? 
Redundancy refers to an employee’s dismissal because of a reduction in the business requirement for that employee’s services. 
According to the UAE Labour Law, redundancy regulations are covered under Ministerial Resolution 279 of 2020. Employers must provide their employees with sufficient notice (usually 30 days), notice pay (if the employee has completed probation), and the right to end of service payment (assuming one year of service). 
Employees also have the right to compensation for accrued and untaken annual leave, repatriation flights, and any other elements stipulated in the contract. The actual employee rights in each case are dependent on the fixed rules specified in their employment contract. 
Under the Resolution, employers must consider putting an employee on unpaid leave, on which both parties must agree. If an employee is made redundant, employers must continue to provide benefits (except salary), including housing, transport, and medical insurance, until the employee leaves the UAE or is employed elsewhere. 
This article provides you with five tips you can follow to help you manage the process effectively.  
1. Identify the criteria for selecting employees for redundancy 
It is vital that you put time into selecting which groups of employees are to be made redundant. There are several ways of grouping people depending on the reason for the redundancy, such as: 
Employees in similar roles; 
Employees in specific departments or sections; 
Employees based in a particular location; 
Employees whose work has stopped or been reduced (or is likely to stop soon). 
Some of the options listed are easier than others. If an entire department or physical location is closing, then everyone involved is impacted. However, if there are people in different departments or teams doing similar roles, it can be challenging to identify who should be selected. 
2. Determine whether you can offer voluntary redundancy 
It may make the process easier to offer voluntary redundancy rather than make the selection centrally. This approach will depend on circumstances but can enable employees to feel more of a sense of control and fairness in uncertain times. 
Often voluntary redundancies will be enough to manage the company’s issues. However, sometimes it will be necessary to make selections if the uptake has been too high or too low. Employees who volunteer for redundancy are considered legally redundant and have the same rights as anyone facing compulsory redundancy. 
3. Make sure you meet affected employees face to face 
Meeting employees to explain redundancies, outline the process to be followed, and discuss individual employee concerns is a critical element of handling redundancies effectively – but it is arguably the most difficult due to the emotions involved. 
This process has b for these meetings to be successful, the HR representative must be well prepared with facts and be ready to handle employees with empathy and care when they may be angry, hurt, or upset. Several meetings will likely take place during the process as the employee gets closer to leaving. Frequent meetings are likely in organizations with a large expatriate workforce, where issues such as end-of-service benefits, visa cancellation, repatriation and impact on family sponsorship are additional steps to consider. 
4. Support employees in looking for alternative internal or external roles 
If there is any possibility of reallocating the employee to another position within the organization, this should be explored. Issues can be faced in finding roles with similar grades and benefits packages. Still, most organizations widen the search to a grade below if feasible to give the best opportunity possible. 
In an expatriate labor market, benefits packages can be a deal-breaker in transferring internally, as elements such as education allowances can make reduced packages unworkable. 
It is essential that organizations also seek ways to support employees to find work in the broader external marketplace. Support may include various activities such as structuring CVs, providing training allowances for a period of skills development, providing paid time off for job search and interviewing, posting CVs on job boards and using contacts in other organizations, for example. 
5. Easing the Final Days 
No matter how well the process has been planned and executed, the final few days of leaving for any employee are fraught with emotions. They are losing tangible benefits such as their income, but they also lose their colleagues and the sense of belonging to an organization. These feelings can be exacerbated when there has been a long service duration. 
It is essential to show empathy and support the employee in whatever way they feel most comfortable. Some want a get together with colleagues, while others prefer to leave quietly with little public acknowledgement.

How many golden visas does the US hand out?
The US issues just 10,000 EB-5 visas per year, including those given to family members of investors.
As of last year, when the programme was renewed for another five years, 20 per cent of these visas are set aside for projects in rural locations. These target areas with fewer than 20,000 residents or with high unemployment rates.
Each country is allocated a maximum of 7 per cent of all EB-5 visas each year.
Which nationalities apply for the most US golden visas? The EB-5 visa is by far the most popular with people from China. In 2022, over 6,000 US golden visas were issued to Chinese nationals, with those carried over from the COVID-era partially accounting for the high number.
Due to the popularity of the scheme and the restrictive quota, Chinese investors currently face a decade-long wait for their green cards.
However, the waitlist is far shorter with the new rural scheme because it is considered a new category. This has led to fresh interest in the scheme.
India came next with 1,381 EB-5 visas in 2022, followed by Vietnam (815), South Korea and Brazil (336 each).
Which other countries offer golden visas?
Golden visas are becoming increasingly controversial in Europe. Many countries are eliminating or toughening up their schemes to avoid potential security risks, with Portugal the latest country to pull the plug.
The European Commission has warned that these schemes could be used for money laundering, tax evasion and organised crime.
Nevertheless, Austria, Italy, Greece, Malta, Spain, Switzerland and Turkey still have golden visa schemes in place.
Elsewhere, Singapore, the UAE and various Caribbean islands also offer golden visas. Although Canada does not have a countrywide golden visa scheme, some provinces do offer them.

What is VAT?
The VAT tax is levied and imposed on the exchange of services and goods applied at every stage in the supply chain. The Government of UAE sets this indirect tax at a nominal rate of 5 percent on most businesses and interests. However, food, education, and healthcare items are exempt from VAT.

Vat liability refers to the gap between the output tax to be paid (VAT applied to supplies of services and goods) and the tax on input (VAT paid on purchases) which is recoverable for a particular tax time.
If the output tax exceeds the input taxes, they must be paid to FTA. If there is excess input tax above output tax, the taxpayer must recover the extra tax and apply it to future payments due to FTA.

Since it was announced that UAE implemented VAT on Value Added Tax (VAT) 1 January 1st, 2018, business owners must follow the rules, which include UAE VAT Registration and tax filings.
Businesses operating in UAE should ensure that VAT is collected correctly and adequately accounted for so they can pay the Federal Tax Authority (FTA).
UAE VAT registration means that government officials recognize your business as a legitimate business to take VAT from your customers and then transfer this to the government.
As a business owner, you must know all the essential aspects of VAT in the UAE.

What is VAT?
The VAT tax is levied and imposed on the exchange of services and goods applied at every stage in the supply chain. The Government of UAE sets this indirect tax at a nominal rate of 5 percent on most businesses and interests. However, food, education, and healthcare items are exempt from VAT.
VAT Registration UAE

After your UAE VAT Registration is approved, your registered company will receive a unique Tax Registration Number (TRN). The VAT invoices on all VAT invoices will include the Tax Registration Number.
UAE mainland businesses, as well as free zone businesses, are taxed on VAT. The only ‘designated zones’ designated by Cabinet members are outside the UAE VAT taxation. The transportation of goods within the zone is exempt from tax.

VAT Return Filing
VAT-registered companies (taxable individuals) must file an annual VAT return to the FTA.
A VAT return summarizes the supplies and purchases of a taxpayer during the tax year to calculate the tax liability of VAT.
You can file your VAT return online every month or every quarter by visiting FTA’s official website – https://www.tax.gov.ae/.
Tax returns should be filed on time, usually by the 28-day deadline. The tax period is the time in which taxes are due and due. The tax period:
* Monthly for businesses with annual revenues over Dh150 million or greater. * Quarterly rate for companies with an annual turnover of less than Dh150 million
VAT Liability
As with other business revenues, the VAT you collect from customers is not an element of your business’s revenue. The VAT that is collected is known as VAT liability, & it has been paid back to the government of the UAE.
Vat liability refers to the gap between the output tax to be paid (VAT applied to supplies of services and goods) and the tax on input (VAT paid on purchases) which is recoverable for a particular tax time.
If the output tax exceeds the input taxes, they must be paid to FTA. If there is excess input tax above output tax, the taxpayer must recover the extra tax and apply it to future payments due to FTA.
Documents Required for VAT Registration in UAE
You’ll need to provide duplicates of these documents to be eligible for UAE VAT Registration.
· Certificate of registration or incorporation;
· Trade license
· Passport and visa, or Emirates ID of director/manager
· The partnership agreement or memorandum association, or another document that provides information on the business’s ownership;
· The profile of the Director of the company who was appointed;
· Bank account details;
· Contact details;
· Physical office space;
· List of partners or directories of business in the UAE over the last five years
The Federal Tax Authority would also need to declare the following:
· The actual or estimated value of financial transactions;
· Business activities that the applicant has registered;
· Information on the anticipated revenue of the company for the next thirty days;
· The turnover of the business over the previous twelve months (supporting documents are required);
· Information about the business’ anticipated exempt supply;
· Information about the company’s Exports and imports;
· Customs Registration Details;
· The business activities that take place in the GCC
The taxpayer or VAT-registered company is also required by the tax authorities to keep the following records:
· Tax invoices and any other document pertinent to the receipt of products or services.
· Notes on the tax credit, along with any other documents that the company receives about the acquisition of products or services
· Record of tax-deductible materials received or made
· Tax invoices, as well as any other document that is issued concerning services or goods;
· Credit notes for tax purposes and any other type of document issued to purchase items or services
· Documents of services or goods that are disposed of or used by the company for purposes not connected with the business, as with taxes paid in connection with such;
· Record of the imports and supply of goods or other products;
· Record of adjustments or corrections made to tax invoices or any other account;
· Documents of goods or other products exported to any other country
Tax records must be kept by a tax-paying individual and include the following details:
· Taxes recoverable on imports and supplies;
· Taxes that are recoverable after adjustment or correction of error;
· Tax due following adjustment or modification of error;
· Taxes owing on all tax-deductible items

England vs India:  England spinner Rehan Ahmed to return home for personal reasons

Young England leg-spinner Rehan Ahmed will not take any further part in the five-Test series against India as he is returning home to address some urgent family matters.
The 19-year-old picked up 11 wickets at an average of 44 in the first three Tests of the series, including a six-wicket match haul in the second match in Visakhapatnam.
"Rehan Ahmed will return home for personal reasons with immediate effect from England Men's Test tour of India. He will not be returning to India," England and Wales Cricket Board (ECB) said in a statement on Friday.
"England will not be replacing Ahmed for the rest of the tour."
England on Friday replaced Ahmed with Shoaib Bashir in their playing XI for the fourth Test.
There is just one game remaining in the five-Test series and England have another spinner in their squad in left-arm tweaker Tom Hartley, who is their highest wicket-taker so far in the tour with 16 scalps.
Earlier this month, Ahmed, who is of Pakistani descent, had faced visa issues after arriving from the UAE for the third Test.
He had a single-entry visa that expired once he left for a mid-series break to the UAE, and was initially stopped at the Rajkot airport upon arrival before it was resolved due to the intervention of the Indian government and the BCCI.
India are leading the five-Test series 2-1.
England had won the opening Test by 28 runs but lost the next two matches by 106 runs and 434 runs respectively.
