WHAT HAPPENS DURING STENTING?

The stenting procedure takes place in a catheterization laboratory. To the patient, the “cath. Lab.” may resemble an operating room with its many monitoring devices, video displays and x-ray cameras. The patient will lie down on a table under an x-ray camera. He or she will be given a mild sedative and remain awake but relaxed for the duration of the procedure. Once the patient is comfortable, heart monitoring begins, an intravenous line (IV) is established and the area where the sheath is to be inserted is made sterile and locally anesthetized. The majority of stent procedures are performed via the femoral artery in the groin. However, the brachial artery in the arm or the radial artery in the wrist can be utilized as well. The injection of the local anesthesia may result in discomfort. An anticoagulant is then administered through the IV to prevent blood clot formation within the artery during the procedure. The guiding catheter is then advanced through the sheath to the heart and is positioned near the origin of the coronary artery. The physician will inject dye (contrast medium) through the catheter. The dye can be seen on a special x-ray (fluoroscope) and serves as a road map for the procedure. The physician and other attending medical staff may ask the patient to perform tasks such as coughing, turning the head, taking a deep breath or not speaking for a while. Guide wire is then passed through the catheter into the coronary artery and to the narrowing of the coronary artery. In most cases, the physician then performs a balloon angioplasty. Stenting is then performed. Equipped with a premounted stent, a balloon-tipped catheter is advanced to the target area. The balloon is inflated for several seconds to several minutes, expanding the stent, which adheres to the wall of the artery. The balloon catheter is removed while the stent remains permanently fixed to the artery.

REBLOCKAGE WHY DOES IT OCCUR?        

Over 1 million balloon angioplasty and stenting procedures are performed worldwide each year. While these procedures have a high rate of initial success, the chronic problem of restenosis develops in a large percentage of patients. Let’s examine the mechanisms that underlie the process of restenosis.

In standard angioplasty, a balloon is inserted into a coronary artery and inflated until the plaque is compressed and the lumen is enlarged.

The first mechanism of restenosis during angioplasty is “elastic recoil”, where the walls of the artery tend to spring back immediately after the procedure.

A second mechanism of restenosis is “chronic remodeling”. In remodeling, the vessel wall slowly contracts as it heals, producing a smaller lumen.

The third mechanism of restenosis involves excessive growth of smooth muscle tissue known as neointimal hyperplasia. Neointima consists of smooth muscle cells and surrounding matrix that proliferate in the vessel wall and migrate into the arterial lumen.

Now let’s see what happens when a stent is used during balloon angioplasty. The balloon delivers and expands the stent at the lesion, where it remains in place as a permanent scaffold. The stent is strong enough to prevent elastic recoil and chronic remodeling, but neointimal hyperplasia continues to be a problem because stents do not stop smooth muscle cell proliferation.

MECHANISMS

While true in-stent restenosis (ISR) represents a neointimal proliferative response to the implanted stent,’pseudo ISR’ may be due to a variety of mechanical factors, including acute recoil of neointimal tissue bck into the lumen, missing the lesion, stent crush, having the stent stripped off the balloon, and stent under expansion. Unlike restenosis after PTCA which is caused by a combination of acute elastic recoil, intimal hyperplasia, and negative vascular remodeling, ISR is almost exclusively the result of neointimal hyperplasia (growth of new cells). The placement of a stent leads to chronic, prolonged damage resulting in more exaggerated intimal growth and greater late lumen loss, compared with PTCA. In some individuals, contact allergy to certain ions released from stainless steel stents (eg nickel, chromat, and molybdenum) may potentially trigger ISR.

After the initial damage by the angioplasty balloon, ISR progresses through four distinct phases: thrombosis, inflammation, proliferation, and vessel remodeling. Focal thrombosis is universally observed after stent implantation, usually within the first 1 to 3 days, and is proportional to the depth of injury of the artery wall by the stent struts. Platelets and macropahges (body’s defence cells in blood) are believed to secrete a variety of growth factors, notably platelet-derived growth factor, which induce a brisk inflammatory reaction at the site of injury and encourage smooth muscle cell migration and proliferation, leading to the formation of the neointimal hyperplastic (excessive new cell growth) lesion. There is evidence from animal and human studies that the degree of inflammation and subsequent neointima formation is proportional to the degree of penetration of the vessel wall by the stent struts.

DRAWBACKS OF SURGERY

The cardiologist entered the examination room with a grim look on his face. After exchanging a few formalities, he came to the main reason for the consultation. “Mr. Rahul Sharma, I’ve reviewed your angiograms again, and there is no option. You will need to have a bypass surgery.” Rahul was clearly shaken. “But doctor, are you sure? I nearly died on the operating table the last time I had surgery. Are there no other operations? What about the balloon procedure, or new medications?”

“Rahul, I am really sorry. I know how much you dread the thought of surgery but there is simply no other option.”

Dialogues like this take place thousands of time each year. In spite of reblockages surgeons still perform bypass surgeries. The darling of heart specialists today, however, appears to be coronary angioplasty. Often referred to as the “balloon procedure” in lay circles, this technique opens up blocked heart arteries by forcibly opening a sturdy balloon inside the clogged vessels. The balloon inside the clogged vessels. The balloon flattens out the obstructing fatty deposits, and thus allows more blood to pass through the previously narrowed area. If the cardiologist believes there is a high likelihood of repeat closure of the artery, a stainless steel wire mesh circular tube, called a “stent”, will be placed where the angioplasty was performed to decrease the possibility of short-term repeated clogging.          

Many lay persons today have become so familier with both bypass surgery and angioplasty that they might think that Rahul is a bit childish to fear such well known therapies. Yet, experts who recognize the results of these common procedures would likely share Rahul’s sentiments. One of the greatest concern with these methods is that they do not address the underlying disease process. The disease causes a slow but steadily increasing blockage of major arteries. Bypass surgery and angioplasty do nothing to change this gradual accumulation of fatty deposits throughout the body. These high-tech procedures only “buy time” by addressing what are often the most life threatening areas of blockage- the blood vessels nourishing the heart. If the process of atherosclerosis is not addressed, the arteries that have been bypassed will again clog up; the vessels that have been angioplastied or stented will again be obstructed with fatty material.

This afternoon, I was at a gas station and I backed my 2003 Pontiac mini van into a concrete barrier very hard. Anthem Blue Cross Dental Net I was referred to an oral surgeon by my primary care dentist since I have to have 6 teeth and 2 residual root tips extracted in advance of getting a full upper denture. All the extractions including the root tips have to be done during one visit, which necessitates the use of IV sedation. My general dentist cannot perform any of this work. Anthem Blue Cross Dental Net denied the original pre-authorization request, and subsequent appeal stating that my general dentist can perform the services being referred. Which is absolutely not the case. I even spoke with a customer service rep who indicated that the extraction of residual root tips is definitely a referable service and it clearly states that in their Dental Net Provider Contract. She has no explanation for why the appeal was denied. My primary care dentist has even provided Anthem Blue Cross Dental Net with his specific reasons for referring this work to an oral surgeon and I still can't get anyone at Anthem Blue Cross to re-evaluate the original denial and the appeal and authorize the necessary work. Ok, so this is a little complicated... Oct 2008 I had a car accident. My car was written off. My car was towed to a garage and was held there while the insurance company evaluated the damage. THAT WAS THE LAST TIME I SAW MY CAR. Because the size of my excess (800) and the amount of damage matched the value of the car (800) I was advised it would be pointless to claim on the insurance and it was written off. The accident was my fault and I held my hands up and admitted it and the other party walked away with everything sorted. No suggestion of fraud and certainly nothing fraudulent on my part. Towards the end of 2008 my insurance company started falling off the radar, not returning my calls or my emails, letters etc. I repeatedly asked what I was supposed to do next (I'd never had an accident before and the whole process confused me because they kept giving me conflicting info) and where my car was. I was ignored (or given incorrect info). In the end I declared a SORN on the car and had so much going on in my personal life, I forgot about it, knowing the car was off the road. Standard Club Web Alert: Cargo Ships Issues Amid Hurricane Irma

The disruption to cargo vessels recently caused by Hurricane Irma has raised a number of legal issues. The following is intended as general guidance to members on some of the issues commonly encountered.

Given the number of charterparties and bills of lading that are governed by English law, the guidance is given from an English law perspective.

Deviations from route

Where cargo-carrying vessels have deviated from their planned route to avoid and/or shelter from hurricane conditions, this will give rise to the late delivery of cargo and to potential losses to cargo receivers.

Cargo receivers who have incurred such losses, however, will not be entitled to recover where their cargo has been carried under bills of lading that incorporate the Hague or Hague Visby Rules, both of which state in Article IV Rule 4:

‘Any deviation in saving or attempting to save life or property at sea or any reasonable deviation shall not be deemed to be an infringement or breach of this convention or of the contract of carriage, and the carrier shall not be liable for any loss or damage resulting therefrom’.

The above provision may also protect the owners of vessels from claims from their charterers for losses arising from deviation where, as often happens, the Hague or Hague Visby Rules have been incorporated into the charter terms.

Bills of lading – changing the place of discharge

If it is not possible for cargo to be discharged at the place of discharge named in a bill of lading, the terms of the bill of lading may entitle the carrier to discharge the cargo elsewhere.

If the terms of the bill of lading do not entitle the carrier to discharge elsewhere, it may nonetheless be possible for the carrier to agree with the holder of the bill of lading that the cargo is to be discharged at a substitute place of discharge.

If such an agreement is entered into, the carrier will need to engage with its P&I club to ensure that the carrier has P&I cover for carriage to the substitute place of discharge.

Also, if such an agreement is entered into, all bills of lading naming the original place of discharge will need to be surrendered by the bill of lading holder and destroyed. If they are not, the carrier will run the risk of an original bill of lading being used to sell the cargo, the carrier being liable to the buyer for non-delivery of the cargo at original place of discharge, and the carrier not being insured for that liability under the terms of the carrier’s P&I cover.​

Voyage charters -​ named load and discharge ports

Where the terms of a voyage charter name a port and/or berth at which cargo is to be loaded, or at which cargo is to be discharged, and it is not possible for cargo to be loaded (or discharged) at that place, further terms in the charter may give a right to the owners of the vessel to load or discharge cargo at a substitute place.

For example the very commonly used Gencon 1994 voyage charter form states at Clause 1:

‘The said vessel shall proceed to the loading port or place stated in Box 10 or so near thereto as she can safely get and lie always afloat, and there load a full and complete cargo…and being so loaded…the vessel shall proceed to the discharging port or place stated in Box 11…or so near thereto as she may safely get and lie always afloat…’

Similar ‘or so near thereto as she can safely get’ clauses are also sometimes found in bills of lading (see above).

Such clauses should, however, be viewed cautiously and legal advice taken before they are acted upon. The best practical approach, where loading or discharge of cargo at a contractually specified place is not possible, is likely to be an agreement between the owner and charterer of the vessel as to where and how cargo is to be loaded (or discharged as the case may be).

Frustration of contracts

If it is not possible to load or discharge cargo at an agreed place of loading or discharge specified in a contract of carriage (eg a bill of lading or a charterparty) and there is no term in the contract permitting a substitute place to be used, the contract may be viewed as frustrated.

If a contract is frustrated, the parties will no longer be obliged to perform it, and neither party will be able to recover from the other for any losses arising from non-performance.

However, identifying whether or not a contract of carriage is frustrated as a result of prevailing circumstances, can be a very difficult exercise. It may depend upon how long the circumstances have prevailed, how long they are likely to prevail, whether the cargo being carried is perishable, and various other factors.

Force majeure

Under English law there is no general concept of force majeure, or general right to declare force majeure as a way of avoiding or limiting contractual obligations. However, where terms in a charterparty or bill of lading specify what is to be considered force majeure (including perhaps various weather conditions), and set out what rights and obligations the parties are to have if force majeure occurs, those terms will be effective.

Time charters – unsafe ports and berths

Time charterers of vessels are under an implied obligation to order the vessel only to ports and berths that are safe, and not to ports and berths that are unsafe.

A port or berth is unsafe for a vessel if, in the course of reaching or using or returning from it, the vessel is exposed to dangers which good seamanship cannot avoid. If a vessel is damaged at a port or berth due to an abnormal occurrence, however, this will not place the time charterer in breach of its implied obligation.

However, what dangers can be avoided by good seamanship, and what will constitute an abnormal occurrence in any given circumstances, may be open to debate.

Where the time charterer of a vessel has ordered the vessel to a port or berth that is unsafe, there is an obligation upon the time charterer to name a substitute port that is safe.

If the time charterer refuses to order the vessel to a substitute place of discharge that is safe, the owner of the vessel may treat the charter as repudiated and claim damages from the charterer for any losses that the owner has suffered.

Again, however, the owner of the vessel should approach the situation cautiously. The wrongful repudiation of charters can cause huge losses, recoverable in damages from the party that has wrongfully repudiated the charter.

Time charters – payment of hire

Under time charters, hire continues to be payable for a vessel unless circumstances have arisen which bring the vessel ‘off hire’ as defined in the charterparty terms.

Whether or not delays caused to vessels by Hurricane Irma will have brought time chartered vessels off hire will therefore depend upon the charter terms agreed for each vessel, which may need to be scrutinised closely by the owners and charterers concerned.

Cargo damage

If cargo-carrying vessels have been unable to avoid the effects of Hurricane Irma, with the result that cargo on board has become damaged, the carriers of the cargo may have a defence to claims for that cargo damage under Article IV Rule 2 of the Hague and Hague Visby Rules which states:

“Neither the carrier nor the ship shall be responsible for loss or damage arising or resulting from:

…… (c) Perils, dangers, and accidents of the sea and other navigable waters..”

The above defence will only be available, however, to carriers who have exercised due diligence to make their vessel seaworthy before and at the beginning of the voyage (as required by Article III Rule 1 of the Hague and Hague Visby Rules).

Further guidance

The above notes are intended only for the general guidance of members. If members have disputes connected with damage or delays caused by Hurricane Irma they are advised to take legal advice, not least because the wording of contracts of carriage (bills of lading, charterparties and other contractual arrangements) will vary widely.
