Order pronounced on 14.02.2024 dismissing the Writ Appeal of the Calicut University. The Bench observed that the role of the University in Private Colleges is limited to the extent of ensuring that University regulations are followed or not. The University cannot assume the role of the Principal and direct the College Principal to act on their direction. There is no merit in this writ appeal. The writ appeal fails, and it is accordingly, dismissed.
 This is a case that began from a complaint by a Research Scholar, C H Amal, in the Department of Physical Education from Calicut University against a student, KP Ameen Rashid, of BA (Economics) from the SEEDAC College of Arts in Palakkad District & affiliated with Calicut University enrolled for the Academic Session 2022-2025
The complainant questioned the election of Rashid as a Senate Member while being a regular student of SEEDAC College & his working as a Project Assistant with Thachanattukara Grama Panchayat.
The University enquired with the Panchayat with regards to the engagement of Ameen. Panchayat confirmed that Ameen was engaged from 9/12/2021 till 12/4/2023 as a Project Assistant.
The Vice-Chancellor heard the complainant C H Amal and student Ameen Rashid. Based on the hearing, the Vice Chancellor on 25.07.2023 directed the Principal of SEEDAC College to remove Ameen Rashid from the rolls as he had not attended class on a single day in the first semester and cancel his admission and report the same to the University.
Abiding by the instructions of the Vice Chancellor the Principal of SEEDAC College cancelled the admission of Ameen on 14.08.2023. 
Ameen Rashid challenged his cancellation of admission through Writ Petition before the High Court of Kerala at Ernakulam and submitted that the University of Calicut granted affiliation to SEEDAC College in Economics quite late and to compensate for the academic loss, the College was directed to provide extra classes as well as online classes. He has attended all the online classes along with other students and his attendance is there on record of the College. And with regards to his working as a Project Assistant, it is on a daily wage basis on Holidays and he is doing work at night. 
The Single Judge of the High Court set aside the order of the Principal of cancellation of Admission of Ameen Rashid & observed that out of the 9 students enrolled for the regular classes, none attended the regular classes why Ameen Rashid is singled out which is legally unsustainable.
Aggrieved by the order of the Single Judge, Calicut University went in Appeal before the High Court.
Observation of the High Court in Writ Appeal
1.      The role of the University providing affiliation to the college is confined only to the supervisory nature, and the authority to determine the factum of absence from classes lies with the Principal of the College.
2.      The Principal has no case that Ameen Rashid did not attend the classes. The Principal cannot surrender his freedom to take action against a student, to the University.
3.      If conducting classes online is not permissible, the University will have to take action against the College and not against the student who attended the classes online. If the College had conducted classes online and allowed the students to attend classes online, we do not understand why the University is showing undue interest in this matter.
4.      The complaint was concerning the first semester and the University itself had allowed Ameen to write the first semester examination. The University subsequently can’t raise any complaint while allowing Ameen to write the first-semester Examination.
5.      The University in a proceeding challenging the selection of the student in an election matter, cannot collaterally decide a question on non-attendance and decide against the student. At best, the University could only have ordered the Principal to provide a report regarding the actual attendance of the student to the University.
6.      The Principal of the College in its counter filed in Writ Petition had certified that Rashid had sufficient attendance and he had attended all the online classes.
7. The University on its own jumped from the student being elected as senate member to the inquiry regarding the attendance of the student. Attendance of the student is a regular day-to-day administrative matter falling within the domain of Principal of the SEEDAC College. It is difficult to understand why the University was taking undue interest in the matter of Ameen Rashid. When none of the 9 students enrolled for BA Economics didn’t attend the regular class and all attended the online class. The University needs to be concerned about the standards of education but not in a way of chasing a wild goose.

One nation, one election: Committee recommends two-step approach to simultaneous elections
New Delhi, March 14: The High level Committee (HLC) on Simultaneous Elections constituted under the Chairmanship of Ram Nath Kovind, former President of India, met President Droupadi Murmu, and submitted its report.
The Report, comprising 18,626 pages, is an outcome of extensive consultations with stakeholders, experts and research work of 191 days, since its constitution on September 2, 2023.
After careful consideration of all suggestions and viewpoints, the Committee recommended a two-step approach to lead to the simultaneous elections. As the first step, simultaneous elections will be held for the House of the People and the State Legislative Assemblies. In the second step, elections to the Municipalities and the Panchayats will be synchronised with the House of the People and the State Legislative Assemblies in such a way that Municipalities and Panchayat elections are held within 100 days of holding elections to the House of the People and the State Legislative Assemblies.

Prime Minister to Embark on Nationwide Outreach Campaign
Mumbai, India – Prime Minister Narendra Modi will embark on a two-month nationwide outreach campaign, the Viksit Bharat Sankalp Yatra, beginning on November 15, 2023. The yatra will focus on showcasing the achievements of the Central Government and creating awareness about various welfare schemes.
The yatra will commence on Birsa Munda Jayanti, celebrated as Janjatiya Gaurav Diwas, in Jharkhand's Khunti district. Prime Minister Modi will flag off IEC (Information, Education, and Communication) vans during the event. Over 2,500 such vans will cover 2.5 lakh gram panchayats and 3,700 urban local bodies across the country.
The primary objective of the yatra is to engage with people directly, particularly in tribal areas, and provide them with information about various government initiatives, including sanitation, financial services, electricity connections, LPG access, housing, food security, nutrition, healthcare, and clean drinking water.
The government also plans to enroll potential beneficiaries through details ascertained during the yatra.
Yatra Postponed in Poll-Bound States
The yatra was initially planned to cover all states, but it has been postponed in five poll-bound states – Madhya Pradesh, Chhattisgarh, Telangana, Rajasthan, and Mizoram – until after the elections. The decision was taken to avoid any potential misuse of the yatra for political purposes.

The Viksit Bharat Sankalp Yatra is expected to have a positive impact on the lives of millions of Indians. By creating awareness about government schemes and initiatives, the yatra can help empower people and improve their access to essential services.

The counting of votes for the West Bengal Panchayat Election 2023 is on, with the ruling Trinamool Congress (TMC) taking a strong lead across the state in the early trends. The counting process began at 8 am and is expected to continue for the next two days. There are around 339 counting venues spread across 22 districts, manned by armed state police personnel and central forces. Prohibitory orders have been imposed outside the counting venues under Section 144 of CrPC to maintain law and order. There are a total of 767 strongrooms across the districts. Supporters of various candidates have gathered at the counting centers to ensure a fair and accurate counting process. The elections have been marred by violence, with 42 people reported dead and incidents of vandalism and ballot tampering. A high voter turnout was recorded on Saturday, and repolling was conducted on Monday in 696 booths where violence and tampering were reported. The decision for repolling was made to address the issues raised and ensure a fair electoral process. As per the latest declarations by the State Election Commission, the TMC has won in 12,518 gram panchayat seats and is leading in 3,620 seats. The BJP has won in 2,781 seats and is leading in 915 seats out of a total of 63,229 seats. The Left Front has won in 959 seats, with the CPI(M) winning 910 seats. The Congress has won 625 seats and is leading in 276.

Fact:
This is a case where the petitioner was asked by the husband of the Sarpanch - Turechhada Gram Panchayat to show the presence of 30 job Card holders under the MGNREGA, even if those job Card holders had not performed their duties.
The Petitioner being the Gaan Saathi turned down the request of the husband of the Sarpanch.
The petitioner was serving as Gaan Saathi since 2007 to 2021 at Turrechchada Village under Chhapria Gram Panchayat.
Thus Petitioner became the victim of vindictiveness as the husband of the Sarpanch had asked him not to perform the duty of the Gaan Sathi in the Panchayat -Turechhada Village under Chhapria Gram Panchayat.
Petitioner approached the Collector & submitted a Representation narrating that the husband of the Sarpanch is not allowing him to perform the duty of Gaan Sathi.
But the Collector has been sitting over the representation for a very long time.
The husband of the Sarpanch though has no power but he was acting as Sarpanchpati.
It is submitted in the Writ Petition that the proxy Sarpanch had hijacked the role, responsibility and function of the Sarpanch.
It was also submitted that the petitioner is bound to obey the order of Sarpanch but not of proxy sarpanch.
The Sarpanch Pati here is playing a very important role in the appointment and termination of the Gaon Sathi, while wielding the actual political and decision-making power behind his spouse who is an elected Sarpanch.
Observation of the Court
The genre of Sarpanch Patism defeats the purpose of reservation for women in the Panchayati Raj Institution.
The Panchayati Raj and Drinking Water Department is duty bound to protect the sanctity of the reservation of women in Panchayati Raj system in the State.
Since the proxy Sarpanches are managing the Gram Panchayats especially where women are Sarpanches, the Government through appropriate Department has to deal with such matter seriously or else, the grassroots of the democracy would be in peril.
Direction issued by the Court
The Secretary, Panchayati Raj Department is directed to file a reply as to what action has been taken against such proxy Sarpanches and what steps have been taken to give women Sarpanches proper capacity building training.
Further, the Secretary Panchayati Raj Department is to file an affidavit stating the availability of the provisions of complaint/grievance redressal mechanism at the district level against such erring proxy Sarpanches.
Interim Order passed by the Court
Petitioner be permitted to discharge his duties as GAAN SAATHI in respect of Chhapria Gram Panchayat under Golamunda Block in the district of Kalahandi, till the next date of listing i.e. 05.12.2023.
