Tapeten-Kartell: Hohe Bußgelder wegen illegaler Preisabsprachen

Das OLG Düsseldorf hat gegen Mitglieder des sog. Tapeten-Kartells mit Urteil vom 12. Oktober 2017 Geldbußen in Höhe von insgesamt mehr als 19 Millionen Euro verhängt (Az.: V-2 Kart 1-3/17).

Der 2. Kartellsenat des Oberlandesgerichts Düsseldorf kam nach 20 Verhandlungstagen zu der Überzeugung, dass die Kartellanten verbotene Preisabsprachen getroffen haben. Demnach sollen sie im Jahr 2005 eine Preiserhöhung für Tapeten in Deutschland in der Größenordnung zwischen 5 und 6 Prozent vereinbart haben. Einem der Tapetenhersteller sei dabei als Marktführer eine herausragende Rolle zugekommen, so der Senat. Eine weitere wettbewerbswidrige Absprache habe darüber hinaus im Jahr 2008 zu einer weiteren Preiserhöhung in Höhe von ca. 5 Prozent auf dem deutschen Markt geführt.

Mit den verhängten Geldbußen von insgesamt rund 19 Millionen Euro ist das OILG Düsseldorf zum Teil deutlich über die vom Bundeskartellamt verhängten Geldbußen hinausgegangen. Entscheidend dafür war, dass der Senat den weltweiten Umsatz der betroffenen Unternehmen zu Grunde gelegt hat. Das Bundeskartellamt hatte bereits 2014 Geldbußen wegen verbotener Preisabsprachen in Höhe von rund 17 Millionen Euro verhängt. Zwei der Tapetenhersteller hatten gegen diese Entscheidung jedoch Einspruch beim OLG Düsseldorf eingelegt – wie jetzt klar ist, ohne Erfolg. Allerdings ist auch das Urteil des OLG Düsseldorf noch nicht rechtskräftig.

Die betroffenen Tapetenhersteller können die Angelegenheit noch nicht zu den Akten legen. Denn neben den verhängten Bußgeldern können nun auch noch Schadensersatzforderungen von Großkunden, die durch die illegalen Preisabsprachen geschädigt wurden, auf sie zukommen, erklärt die Kanzlei GRP Rainer Rechtsanwälte. Im Kartellrecht erfahrene Rechtsanwälte können prüfen, ob Schadensersatzforderungen begründet und durchsetzbar sind.

Wettbewerbswidrige Preisabsprachen sind ein offensichtlicher Verstoß gegen das Kartellrecht. Allerdings können Verstöße auch ganz unbewusst geschehen und trotzdem hart sanktioniert werden. Schon kleine Details in Vertragsklauseln können beispielsweise zu Verstößen gegen das Kartellrecht führen. Daher empfiehlt es sich, Verträge auch im Hinblick auf kartellrechtliche Bedenken von erfahrenen Rechtsanwälten prüfen zu lassen.
