Scotland Yard could be called in to investigate an alleged breach of the Princess of Wales’s private medical data.
The world-renowned London Clinic in Marylebone where the Princess of Wales underwent abdominal surgery in January, launched an investigation amid allegations staff attempted to access her private medical records.
After The Mirror’s world exclusive was picked up around the world this week, sources have said tonight that “up to three people” could be involved in the alleged accessing of Catherine’s medical records.
In a further bombshell, it can be revealed that the alleged breach took place after the future queen was discharged from hospital on January 29, as social media exploded with outlandish and hurtful conspiracy theories relating to her surgery.
Sources said the criminal investigation, described as “unprecedented” and now being run by the Information Commissioner's Office (ICO), could run alongside an additional probe by the Metropolitan Police.
Tumblr media
Accessing someone’s medical records without cause or consent can be a criminal offence.
If the ICO investigates and finds evidence that medical records were accessed illegally, it can take action, including prosecuting and fining the person responsible in court.
The development came amid a new statement from the CEO of the The London Clinic, who said:
“There is no place at our hospital for those who intentionally breach the trust of any of our patients or colleagues.”
A source said:
“This is such a unique case that a police investigation could run alongside one by the Information Commissioner's Office.
The IOC will deal with anything as a criminal matter, which could end up in a Magistrate’s Court, but if there were further claims of wrongdoing such as a conspiracy to distribute illegally accessed information, then that could be a matter for the police.”
Scotland Yard has also been urged to launch an immediate investigation, alongside the IOC probe, over fears of a potential royal blackmail plot.
Dai Davies, the former chief superintendent and head of the royal protection unit, said:
“Anyone accused of this most serious breach of trust should be interviewed under caution at the earliest opportunity.
The implications for the royal family are far and wide, and there must be a full probe by Scotland Yard to determine if any further crimes have been committed.”
Tumblr media
The Met Police said it had not yet received a referral, but Health Minister Maria Caulfield said today that she understood “police have been asked to look at it.”
Speaking to Sky News, she said it was "pretty serious stuff to be accessing notes that you don't have permission to."
She added:
"I say this as someone who's still on the nursing register, that the rules are very, very clear for all patients.
That unless you're looking after that patient, or they've given you their consent, you should not be looking at patients' notes.
So there are rules in place and the Information Commissioner can levy fines, that can be prosecutions, your regulator.
So as a nurse, my regulator would be the NMC (Nursing and Midwifery Council), can take enforcement action….and can strike you off the register if the breach is serious enough.
So there are particularly hefty implications if you are looking at notes for medical records that you should not be looking at."
Tumblr media
Asked if the police should look into the matter, she said: "My understanding is that police have been asked to look at it - whether they take action is a matter for them.”
Fears that the King’s private medical information had also been compromised were dismissed tonight, after Charles spent three nights at the hospital during the same period as the Princess of Wales after undergoing an operation for an enlarged prostate.
Sources confirmed bosses at the hospital had informed Buckingham Palace that the alleged breach being probed did not involve the monarch.
Charles and Catherine were discharged separately just hours apart on January 29.
The King was subsequently diagnosed with “a form of cancer,” announced by Buckingham Palace on February 5.
Senior bosses at the hospital notified the IOC within 72 hours of the alleged breach of Kate’s records, in accordance with the watchdog’s guidelines.
Despite global speculation over the nature of the princess’s surgery, which has sparked wild conspiracy theories across social media and international news outlets, Kensington Palace has gone to great lengths to protect her privacy.
The palace said when Catherine was admitted that she would spend two weeks in hospital and not return to royal duties until after Easter as she continued her recovery at home.
Sources suggested the princess may decide to join the royal family on a scheduled walk to church on Easter Sunday, but no decision had yet been taken.
As the crisis intensified today following The Mirror’s revelations, Al Russell, the CEO at The London Clinic, added:
“Everyone at The London Clinic is acutely aware of our individual, professional, ethical and legal duties with regards to patient confidentiality.
We take enormous pride in the outstanding care and discretion we aim to deliver for all our patients that put their trust in us every day.
We have systems in place to monitor management of patient information and, in the case of any breach, all appropriate investigatory, regulatory and disciplinary steps will be taken.”
The General Medical Council (GMC), which regulates doctors, also said patients must have confidence that their personal information is protected "at all times."
A spokesman for the Prime Minister said:
“Clearly there are strict rules on patient data that must be followed. I think we all want to get behind the Princess of Wales and Prince of Wales and we wish her the speediest of recoveries.”

Chelsea striker and Australia captain Sam Kerr is set to face trial after being charged with racially aggravated harassment of a London police officer.
The 30-year-old pleaded not guilty to the offence at a court hearing on Monday, the Crown Prosecution Service said.
Kerr is scheduled to appear at Wimbledon Magistrates Court on 1 February 2025.
It follows an alleged incident in January 2023.
"The charge relates to an incident involving a police officer who was responding to a complaint involving a taxi fare on 30 January 2023 in Twickenham," a Metropolitan Police spokesperson said.
Kerr was charged on 21 January this year "with a racially aggravated offence under Section 4A [of the] Public Order Act 1986", they added.
However, she denied the charge at a plea and trial preparation hearing at Kingston upon Thames Crown Court on Monday.
The striker is currently sidelined after sustaining an anterior cruciate ligament injury at the club's warm weather training camp in Morocco in January.
She has scored 99 goals in 128 matches since joining Chelsea in 2019, and is her country's all-time record goalscorer with 64 goals in 125 games.
Speaking to media in Adelaide on Tuesday, Football Australia chief executive James Johnson said the federation had learned of the "very serious allegations" in the news that morning.
"There is no place for racism in our sport," he said. "At the same time Sam has rights, natural justice rights, procedural rights that she has to work through and we will respect that."
Asked if Kerr - arguably Australia's biggest sports star - should be stood down as the national team's captain until the court case has played out, Mr Johnson said the governing body needed to "establish the facts" before deciding its "next step".
"We are trying to get to the bottom of it at the moment... we've got to find out what actually happened," he added.
"I haven't spoken to Sam other than a text message to check in on her wellbeing."
Matildas coach Tony Gustavsson told reporters in Sydney he was "surprised" by the allegations but could not say anything further.
During her time at Chelsea, Kerr has won four Women's Super League titles, three FA Cups, two Women's League Cups and the Women's Community Shield.
She has also been nominated for the Ballon d'Or Féminin - the top prize in women's football - every year since its inception in 2018, placing second last year.
Chelsea have declined to comment.

Laurence Knight, 33, was arrested in July last year.
A serving Metropolitan Police officer has been charged with rape following an alleged incident on Brighton beach.
Laurence Knight, 33, was arrested on July 28 last year, after a woman reported being raped on the beach 11 days earlier, and was released on bail.
On Friday he was summoned to appear at Brighton & Hove Magistrates’ Court on June 23, Sussex Police said.
The sergeant, attached to Met Detention, has been suspended from duty.
Scotland Yard said he was off duty at the time of the alleged offence.
Chief superintendent Pete Gardner, in charge of Met Detention, said: “We know people will rightly be concerned to hear about this very serious charge against a serving police officer.”
He also thanked his Sussex colleagues for the specialist support provided to the alleged victim.
Mr Gardner added: “The Met’s Directorate of Professional Standards are fully aware and misconduct matters will be dealt with once the criminal proceedings have concluded. The officer is suspended from duty.”
Scotland Yard made a referral to the Independent Office for Police Conduct, who determined the misconduct investigation should be led by the Met.

"Guillaume Budé":
The painting “Guillaume Budé” was painted in 1536 by Jean Clouet. The painting is oil on a wooden canvas which was a popular combination at the time. The art style is very realistic which is a key characteristic of the French renaissance style paintings. The subject of the painting is Guillaume Budé who was the librarian to King Francis I (The Metropolitan Museum of Art). Guillaume Budé is painted as if he is being interrupted (The Metropolitan Museum of Art). Guillaume Budé lived from 1467-1540 and was very successful within his lifetime. Besides being librarian to the king he also was an ambassador, the chief magistrate of Paris, and even founded the college of France in 1530 (The Metropolitan Museum of Art). He was also very well known by scholars of the time for his literature due the interest in the Greek language it brought about (The Metropolitan Museum of Art). Not much is known about the painter Jean Clouet except that he came from a long family of painters and his son was also a successful painter (The Metropolitan Museum of Art). Jean Clouet became King Francis I’s personal painter and chief painter soon after (The Metropolitan Museum of Art). Some artwork that is claimed to be his are suspected to not be painted by him and possibly by his son instead (The Metropolitan Museum of Art). The painting also includes a book and a quill pen which was very common at the time. The use of blue within the painting represents wealth (Figes, 2019). While it is not ultramarine blue which was popular in the Italian renaissance style of paintings it shows that French art was impacted by Italian art (Figes, 2019). The painting resides in The Metropolitan Museum of Art in New York City, NY. Millions of people visit The Metropolitan Museum of Art each year and lay their eyes upon this painting.

Veteran actor Rajasekhar and his wife Jeevita have been sentenced to one year in prison along with a fine in the age-old case. Shocking details of this surprising case are as follows: It was the time when Rajasekhar and Jeevita used to malign Chiranjeevi and his PRP continuously and at one time, the celebrity couple made TV programs to accuse Chiru of selling blood in his Blood Bank. Ace producer Allu Aravind, who manages the Blood Bank registered a defamation case in 2011 against the couple. After a decade-long investigation, the 17th Additional Chief Metropolitan Magistrate Court in Nampally declared its verdict the other day. The court found nothing illegal happening in Chiranjeevi’s Blood Bank and clearly felt that Rajasekhar and Jeevita intentionally defamed the organization. So the Magistrate sentenced one complete year of Jail along with an imposed fine of 5000 rupees. However, they got immediate bail by paying the impositions.  The veteran hero and his director wife however decided to appeal the decision of the court and they are very less likely to get away from this case. However, the experts opine that the damage was already done to Chiru and PRP back then as all the accusations did cost him invaluable votes back then when the megastar was in Politics.

Wrestlers' sexual harassment case: Delhi court summons Brij Bhushan on July 18
Taking cognisance of the charge sheet, Additional Chief Metropolitan Magistrate Harjeet Singh Jaspal directed Singh to appear before the court on July 18.
Tumblr media
NEW DELHI: A Delhi court on Friday summoned BJP MP and outgoing WFI chief Brij Bhushan Sharan Singh in a case of alleged sexual harassment of women wrestlers and said there was sufficient evidence to proceed against him.
Taking cognisance of the charge sheet, Additional Chief Metropolitan Magistrate Harjeet Singh Jaspal directed Singh to appear before the court on July 18.
The court also summoned Vinod Tomar, suspended assistant secretary of the Wrestling Federation of India.
It directed the SHO of Connaught Place Police Station to execute the summons against both the accused.
The judge said he was giving a short date, noting that both the accused reside in Delhi.
Delhi Police had filed the charge sheet against the six-time MP Singh on June 15 under sections 354 (assault or criminal force to woman with intent to outrage her modesty), 354A (sexual harassment), 354D (stalking) and 506 (criminal intimidation) of the IPC.
Tomar was charged with offences under sections 109 (abetment of any offence, if the act abetted is committed in consequence, and where no express provision is made for its punishment), 354, 354A and 506 (criminal intimidation) of the IPC.
Besides the present case, another FIR was filed against Singh pursuant to the allegations made by a minor wrestler which was registered under the Protection of Children from Sexual Offences (POCSO) Act.
She was among the seven female grapplers who had accused Singh of sexual harassment.
Both the FIRs mentioned several alleged instances of sexual harassment like inappropriate touching, groping, stalking and intimidation by Singh at different times and places over a decade.
In the minor’s case, the court had on July 4 sought a response from the girl and the complainant on the final report filed by Delhi Police seeking cancellation of the case against Singh for alleged sexual harassment.
Delhi Police had on June 15 submitted the report seeking cancellation of the FIR filed with regard to the allegation of sexual harassment against Singh.
A cancellation report is filed in cases where police fail to find corroborative evidence after due investigation.
In a startling admission, the father of the minor wrestler had told PTI that he and his daughter had filed a “false” police complaint of sexual harassment against Singh because they wanted to get back at him for perceived injustice against the girl.
Singh has been questioned by the police twice so far, and on both occasions, he denied all the allegations against him and claimed he was “framed”.
The cause of the women wrestlers was taken up by decorated grapplers like Olympic medallists Bajrang Punia and Sakshi Malik, and Asian Games champion Vinesh Phogat.
The protest by celebrity grapplers drew support from a host of opposition parties and farmer organisations.

Fundamentals of Natural Justice and the Criminal Procedure Code
The acronym "CrPC" stands for "criminal procedure code," another name for the Code of Criminal Procedure. The law was passed in 1973, and its provisions began to take effect on April 1, 1974. The criminal process code governs trials in criminal cases. It explains how to file a complaint, how a trial and an order are conducted, and how to appeal a final decision.
The primary goal of CrPC is to ensure that an accused individual is afforded a fair trial and in accordance with the notion of natural justice. The purpose of this code is to standardize how a crime committed under any criminal legislation is investigated, inquired into, and tried in a court of law. However, its acts are different from IPC Bare Act.
The 37 chapters of this law are divided into 484 individual sections. No specific statute or local law, or the authorities or procedures specified by any such law, conflicts with CRPC.
Applications of Criminal Procedure Code:
Fair Trial:
An unbiased and independent court of law must hear all cases, and everyone has the right to a fair trial. A defendant enjoys the presumption of innocence unless proven guilty. Every defendant is guaranteed the opportunity to hire the attorney of his choosing. Each defendant has a right to due process, and the ex-parte order should not be issued without first hearing their side of the story.
High Courts oversee Judicial Magistrates:
State High Courts oversee all Judicial Magistrates. The governor, public service commission, and high courts choose a first-class judicial magistrate. In each district, the high courts can designate a first-class judicial magistrate as chief. High courts can appoint more chief metropolitan magistrates for metropolitan courts.
The structure of India's criminal courts:
The Criminal Procedure Code (CrPC) establishes a system of criminal courts with consistent jurisdiction, powers, and functions across the Indian territory. Separation of powers ensures that the judicial system may function without political interference from either the legislature or the executive branch.
Legal protections for the accused:
If an accused person cannot afford legal representation, that person is eligible for free legal aid services. A guilty plea and payment of the fine by mail as directed on the summons are acceptable alternatives to personal appearance in small claims court. A defendant has the right to seek medical attention to bolster his defense.
Trial Process:
Unless something else happens, the hearing process will be the same for both summary cases and summons cases. The High Courts and Sessions courts have revisional jurisdiction. Warrant cases involve offences punishable by death, life imprisonment, or more than two years in jail, while summons subjects involve lesser offences. The court can also immediately punish perjurers.
Conclusion:
The criminal procedure law guarantees defendants a fair trial by an impartial and neutral Tribunal. However, the Hindu succession act doesn't include in CrPC. The main difference between the CrPC bare act and the IPC is that the IPC spells out the rules for all crimes and the fines for them. The Code of Criminal Procedure tells how charges are made, while the Code of Criminal Procedure tells the charges for each offence.

Special Team Formed To Probe Sex Harassment Claim On Wrestling Body Chief
The submission was made before Additional Chief Metropolitan Magistrate Harjeet Singh Jaspal in response to the court's earlier order directing the police to file a status report.
Tumblr media
New Delhi: The Delhi Police on Friday informed a special court that a Special Investigation Team (SIT) has been constituted to probe the allegations of sexual harassment levelled by women wrestlers against WFI president Brij Bhushan Singh.
The submission was made before Additional Chief Metropolitan Magistrate Harjeet Singh Jaspal in response to the court's earlier order directing the police to file a status report.
"Considering the seriousness of the case we have formed a SIT. The SIT will be investigating the case," public prosecutor Atul Srivastava told the court, stating that a status report has been filed in the matter.
He requested that the report must not be shared with anyone considering the nature of the case. The report has been filed by the Delhi Police in a sealed cover. After the submission, the court posted the matter for further hearing on May 27.
The judge had issued notice to the Delhi Police on a plea moved by the wrestlers seeking monitoring of the investigation and recording of the statement of the alleged victims before the court.
The wrestlers have been demanding the arrest of Singh, accusing him of sexually harassing several women wrestlers, including a minor.
The Delhi Police has filed two FIRs, including one under section 10 of POCSO Act against the BJP MP, who has denied all the charges.
