'One biscuit less in pack': TN consumer forum directs ITC to pay Rs one lakh as compensation

TIRUVALLUVAR: The district consumer forum here has directed ITC Ltd Food Division to pay a sum of Rs one lakh to a consumer for alleged unfair trade practice after he complained that packets of the corporate’s biscuit brand Sunfeast Marie Light had one biscuit lesser than that advertised on the wrapper.
The District Consumer Disputes Redressal Forum, in a recent order, also directed the company to “discontinue the selling of the disputed biscuits ‘Sunfeast Marie Light’ in Batch №0502C36 with the specific endorsement.”
It dismissed the company’s submission that the challenge made with regard to weight of biscuits would not apply.
Complainant P Dillibabu of Chennai alleged there were only 15 biscuits inside the packets as against the advertised 16.
“It is argued by the learned counsel for the 1st opposite party (the company) that the product was sold only based on the weight and not on number of biscuits. Such arguments could not be accepted as the wrapper clearly provides the information to the buyers/consumers to purchase the product only based on the number of biscuits.”
“The potential consumer would only see the wrapper to decide the purchase of the product as the product information available on the packing influences the consumer’s buying behaviour and the product information available on the wrapper or label plays a significant role in customer satisfaction,” the order said.
In the present case, the paramount allegation is only with regard to a lesser number of biscuits.
“Thus we answer the point accordingly holding that the 1st opposite party being the manufacturer and marketer had committed unfair trade practice and deficiency in service in misleading the consumers and that the complainant had successfully proved the same by sufficient admissible evidence,” it said.
While Dillibabu sought to impose Rs 100 crore fine on the company and the store that sold it and Rs 10 crore as compensation for the alleged act of unfair trade practice and deficiency in service, it said the reliefs sought by the complainant was exorbitant.
The 2nd opposite party being the shopkeeper had no role to play with respect to the reduction in the number of biscuits. “Hence, complaint dismissed against him,” it said.
The consumer forum subsequently directed that Rs one lakh be given as compensation to Dillibabu by the company and another Rs 10,000 towards litigation expenses to be paid by it to him.
In its defence, ITC submitted that there was no deficiency or defect in the 76-gram biscuit packs of Sunfeast Marie Light in terms of the quantity that the packs were required to maintain under law.
Citing Legal Metrology Rules 2011, it contended that if a pre-packaged commodity has a declared net quantity between 50 gram to 100 gram, then a maximum permissible error in excess or in deficiency of 4.5 gram of the declared quantity was allowed on such items.
As per the rules, a package that has a declared weight of 76 g was permitted to weigh between 71.5 g to 80.5 g, it said.

IIT Madras calls application for BS (Electronic Systems) Program 
Four-year BS program in Electronic Systems will be in a position to serve multiple industries such as Automotive, Consumer Electronics, Mobile, Medical Electronics and Defence.

CHENNAI: To keep pace with the fast-emerging demands of the indigenous electronics manufacturing sector, IIT Madras has called applications for BS (Electronic Systems) program, which is a 4-year course designed to meet industry-specific requirements and skill sets. The curriculum is curated in consultation with industry experts.
This newly launched program had received a great response in the first round of applications, which closed on June 25, 2023. Over 1,800 applications were received from all over the country. Out of these, close to 1,200 are regular entry-based candidates and the remaining are from JEE entry mode. The regular entry-based candidates will have to go through a Qualifier process, whereas those qualified for JEE Advanced can get direct admission to the program.

Prof Boby George, faculty, Department of Electrical Engineering, IIT Madras, and Coordinator, BS in Electronic Systems program, IIT Madras, said, “Admission to the program is through an in-built qualifier process; JEE is not a requirement to join the program. Candidates who apply will be provided access to four weeks of content taught by IIT Madras faculty and the qualifier exam will be based on this content alone. Sufficient support will be provided to candidates in this period in the form of discussion forums and live sessions.”
The course content will be offered in online Mode and hence, it is open to all students. Those who have completed Class 12 with physics and mathematics can apply irrespective of age, role or geographical location. Content, tutorials, doubt-clearing sessions and assignments will be online, while quizzes, exams and labs will be conducted in-person. The lab courses will be in-person at IIT Madras campus.
The program aligns with the India Semiconductor Mission to make India a global hub for electronics manufacturing and design. The semiconductor industry is a major contributor to the global economy, employing millions of people and generating billions of dollars in revenue each year, and is emerging as a key industry in India.

What is the structure of the civil court system?
The Supreme Court of India is the apex court exercising original, appellate and advisory jurisdiction, followed by the high courts established in different states and union territories of India.
All high courts exercise appellate jurisdiction over subordinate courts established in different districts with the exception of five high courts (being the high courts at Mumbai, Delhi, Kolkata, Chennai and Himachal Pradesh) which are the first courts of instance in addition to their appellate jurisdiction.
Jurisdiction of the courts is mainly based on subject matter, territory and value of claim. Specialised courts and tribunals have been constituted under certain laws that have jurisdiction to decide matters pertaining to specific subject matters. For example, consumer forums have been established at various levels to entertain complaints under the Consumer Protection Act 1986; the National Company Law Tribunal and the Appellate Tribunal have been constituted to adjudicate on all cases arising out of the Companies Act, 2013 as well as the Insolvency and Bankruptcy Code, 2016.
Ordinarily, appeals from district courts lie before the high court in the same state and appeals from the high courts lie before the Supreme Court of India.
A Supreme Court bench usually comprises two judges in ordinary cases and larger benches are constituted for identified cases. In the high courts, the bench usually comprises a single judge or two judges. All lower court benches comprise a single judge except in the case of the Presidency Small Causes Court, where the division bench hears the appeal from a trial court’s orders.
In 1993, specialised Debt Recovery Tribunals were established for speedy disposal of the recovery cases filed by lenders against borrowers under the Recovery of Debts and the Bankruptcy Act, 1993.
In 2015, the Commercial Courts, Commercial Division and Commercial Appellate Division of High Courts Act, 2015 was enacted, under which commercial courts in district and high courts were constituted to adjudicate disputes classified as ‘commercial disputes’.
Alternately, parties to a dispute can opt for lok adalat, which is a formal alternative dispute resolution mechanism in India. It is a forum where parties to the dispute pending before a court can settle the dispute by compromise. Awards pronounced by such forum are deemed to be decrees of the court and are binding on parties.

But whereas Katrina was a Category 3 when it made landfall southwest of New Orleans, Ida is expected to reach an extremely dangerous Category 4 hurricane, with top winds of 140 mph (225 kph) before making landfall likely west of New Orleans late Sunday. “This will be a life-altering storm for those who aren’t prepared,” National Weather Service meteorologist Benjamin Schott said during a Friday news conference with Louisiana Gov. White House More Than Doubles Its Inflation Forecast in New Update (WSJ) The White House more than doubled its forecast for annual inflation in new projections released Friday, as supply-chain disruptions stemming from the Covid-19 pandemic continue to put upward pressure on prices. Of course, the water crisis has to do a lot with the policies of the government & government agencies. 
Yet, the role of the citizens cannot be underrated or undermined as they are equally responsible for tackling the water crisis. Water preservation & conservation assumes a greater role in these times of climate change. Nature never fails to give us water & in fact it gives in abundance, but our sheer negligence & shortsightedness makes sure that we don't utilize nature's merciful gift. 
Urbanization process in Cities like Chennai has consumed a whole lot of water bodies which include the lakes, ponds & wells and other water body forms. Systematic destruction of water bodies causes man made disasters like deluge & floods. And in the process, we also fail to gather & collect the excess water as we lack storage capacities. Many times we have seen water going into the Ocean without being stored. Water crisis needs a very strong attention, both from the government & citizen sides, as the future looks bleak if the situation persists in the current form.
Let's look at the role of the governments (largely state) and civic bodies -
The responsibility of conservation, preservation & restoration of the water bodies squarely lay with the state government & civic bodies. Government & civic bodies need to work in tandem to restore & reclaim the lost water bodies which are the victims of land mafia in the name of urbanization. Many of the newly sprouted residential localities sit on the water bodies & those localities face the brunt of deluge even when the rains are normal. 
It's high time the government agencies make serious efforts to reclaim the lost water bodies which have been natural buffers for excess water for ages. The water bodies also formed the part of a wonderful eco-system giving lease of lives to flora & fauna. Chennai, for example, had a wonderful set of water bodies which included rivers, lakes & a man made canal which formed a wonderful eco-system helping the humans & other species in the process to thrive on them. Government with all seriousness should restore the dead rivers & canals to augment water storage capacities and also to provide a natural buffer to absorb excess waters.
Role of the citizens -
The primary role of the citizens is to be "AWARE" that we are in a crisis. Many of us hardly realize the perils of a water crisis as we are not exposed to such a scenario in the past. But people should realize we are heading into a water crisis in the coming years. As the urban habitat is on a constant expansion, whatever water bodies remain will be under threat of being encroached. Citizens need to be vigilant on these issues which eventually fall upon them in case of a crisis. 
People should also be responsible while handling the water by way of reducing the usage, minimizing the wastage and using the water judiciously for their personal purposes. More than the adults, the kids should be aware of the crisis as they would be the ones who face the brunt when a water crisis strikes. Citizens should also work with the government & civic bodies to constantly put pressure on these issues through various forums.
Nature has always been benevolent through various ways & means. And water is one such resource which has been given to us graciously by nature. It is our responsibility to treat water with utmost respect & value and make every effort to preserve and conserve through our initiatives. If we fail to do so, the perils are waiting at our doorstep to strike. Better late than never perfectly applies to our impending water crisis and today is the day to start our efforts to avert the crisis. Science may have alternatives to every other thing, but there is no alternative to water we use.
