Child Pornography Laws in California

California has its own state laws that prohibit certain activities in connection with child pornography. This is in addition to the even stronger federal laws that have higher penalties. California’s child pornography laws prohibit a broad range of conduct in connection with this material. What Is Prohibited by Child Pornography Laws in California?

California child pornography laws prohibit the following:

Sending, transporting, producing, or duplicating child pornography

The Laws Require Knowledge, Which Is the Same as Intent

What You Should Know as an Employee About Workplace Harassment

We are often contacted by potential clients who tell us that my boss is bullying me and wanting to know whether they can file a lawsuit. There is a fine line between poor management skills and workplace harassment that could lead to financial compensation. The key is in knowing when bad behavior crosses a line and gives you a right to sue.

Being a Jerk Is Not Illegal, But Workplace Harassment Is

Workplace bullying would not necessarily give you a legal cause of action. Bullying is rude, wrong, and debilitating, but being a jerk is not necessarily illegal. 61% of U.S. employees know of abusive conduct in the workplace. When it happens to you, it can keep you from living a normal life, even outside of work. However, when we hear from people, “my boss is bullying me,” we cannot always give them the answer that they want.

This does not mean that we will tell potential clients that there is nothing that they can do about it. We will ask more specifically about your boss or any other employee’s behavior because federal and state law does create circumstances where bullying can be illegal. It all depends on the focus of the bullying.

If your boss does not like your job performance, or if they are taking out their frustrations on you, the chances are that you cannot do anything about it. They are completely in the wrong, but it is only a moral transgression. The issue is when your boss’ treatment is based on you being a part of a protected class.

Federal and California Law Makes Workplace Harassment Illegal

Federal laws are aimed at preventing discrimination in the workplace. You cannot be harassed at work on the basis of the following:

Race

Religion

Gender

National origin

Ethnicity

California law adds even more protected categories, including sexual orientation.

In some cases, bullying will cross the line when it is on any of these grounds. For example, if you were subjected to constantly being degraded based on your status in a protected class or were the target of frequent jokes, this would be workplace harassment. It would not matter if it were your boss that was bullying you or other co-workers. Any type of workplace harassment based on the above classes is illegal no matter where it originates.

If Nobody Else Is Being Bullied, Something May Be Wrong

In addition, if you are a member of a protected class, and your boss treated you far differently than they did anyone else, it could be evidence of workplace harassment. Again, there is nothing that requires bosses to be decent, and the law does not prohibit berating employees. However, if you find yourself constantly singled out for things that other people get away with, it could be evidence of workplace harassment.

Discriminatory intent is a category of discrimination cases where the employee is treated worse by their employer because they are a member of a protected class. Your boss does not have to explicitly say that they are singling you out because of your membership in that class. However, the fact that people who are not part of protected classes do not experience that treatment can serve as evidence of intent.

Keep a Log of Everything That You Have Experienced

Since the line between poor supervisory practices and harassment is a very fine one, you should have as much evidence as possible to back up possible workplace harassment claims. It is important to document as much as you can about your boss’s conduct. The best way to do this is to keep a daily journal where you list what your supervisor said. You should keep a special list of things that they do and say that can relate to your protected class. Your entries should go beyond just that my boss is bullying me.

Fraudulent Industry Schemes Related to Covid-19 Vaccines

COVID-19 has had quite an impact on our lives in many different ways, but there has been an increase in fraud when it comes to the Covid vaccine. The past twelve months have been filled with complaints to the federal government regarding Covid vaccine fraud. With people eager to receive their vaccine, it has become easy to be fooled with Covid vaccine fraud. Even legal cases are on the rise, with over 100 cases in motion to combat people that are capitalizing on this opportunity. Vaccine fraud has been occurring from the beginning of the pandemic with vaccine trial fraud, and the FBI continues to receive complaints on an ongoing basis. From fake websites advertising the opportunity to receive the vaccine to false information regarding the vaccine, it has become difficult to decipher what is real and what is vaccine fraud worth reporting.

In the State of New York, there is an ongoing investigation relating to the attorney general’s office and Covid vaccine fraud. There was a healthcare provider located in Orange County that contacted state health officials to obtain doses of the COVID-19 vaccine. They chose to misrepresent themselves using Covid vaccine fraud practices to obtain these doses by way of Covid vaccine fraud, and then Parcare Community Health Network chose to vaccinate people who were not yet eligible to receive the vaccine.

Governor Andrew Cuomo announced that this type of Covid vaccine fraud and vaccine trial fraud could be penalized with a fine of up to $1 million.

There is a federal case pending in Maryland that targeted websites that claimed to be representing various biotechnology companies. They were developing their own vaccine trial fraud information to get people’s attention. Those people were then asked to provide their personal information to be put on a waiting list for the vaccine. Warnings have since been issued that ask people to keep an eye out for the request for tests and procedures, representatives that don’t seem quite right, and the request for money. The federal government is providing the COVID-19 vaccine free of charge to people in the U.S., so paying out of pocket isn’t something people should be encountering at this point in time.

To date, the United States has had more than 21 million cases of confirmed coronavirus. Over 357,000 people have died, according to data provided by John Hopkins University. The United States is lagging in its vaccine response, with less than 4.7 million doses have been administered. There are over 15 million doses that have been distributed, according to the Centers for Disease Control and Prevention. Vaccine trial fraud warnings have been issued by the Federal Trade Commission, FBI, the Drug Enforcement Administration, and many medical offices across the U.S. As vaccine fraud has become a focus for the U.S. Justice Department, attention is being paid to those who are submitting fraudulent applications for government aid, vaccine distribution, loans for small business, price gouging for PPE, money laundering and much more.

People come to the rescue of those in need and help those who are suffering. The COVID-19 pandemic has brought out the best in people as everyone faces hardships and tragedies from this virus. Sadly, these events also tend to bring out those who would defraud those in need. The fraud plays on the fears and needs of those affected. COVID-19 is not any different. Ever since governments around the world started approving the COVID-19 vaccines, vaccine fraud schemes started to emerge.

Rollout Plan of Vaccine – Who Gets the Vaccine First

There are over 7 billion people on this planet, and if we had to wait for 7 billion doses of vaccine to be made before distribution, it could take months or years before the first shot is given. So, to protect those at the highest-risk and start building immunity to this virus, the government has established a plan to distribute the vaccine to groups of people. As more vaccines become available, the number of people eligible for the vaccinations will also increase. All of these vaccines are available for free – vaccine payments are not required in any way when you get the shots from an authorized provider.

So What Is The Vaccine Fraud Taking Place?

There is no list managed by the federal government that dictates who will get the vaccine and what order.

Robocallers and some direct calling companies located outside of the United States have begun “selling spots” on the vaccine waiting list. They offer people a chance to get bumped up in the line by paying a fee to get put on a “government list.” This has been the most common vaccination scam seen at this time. There is no such thing. Some states and counties have used an online registration process so that only the amount of people arrive each day for the available amount of vaccines. This eliminates long lines and disappointment and helps to avert vaccination scams.

Another vaccine fraud that has started to crop up is “self-administered” vaccines. The companies are offering to ship you the vaccine directly for a fee so that you can self-administer the dose and skip the lines and waiting list. This is very dangerous. If the fraudulent company actually sent a “vaccine” for you to self-administer, you would not know what it is or what it could do to you. The real vaccine must be kept under strict temperature control, and anything you would receive from this vaccine fraud is most likely tainted or dangerous.

Authentic COVID-19 Vaccinations – Avoid Vaccination Scams

To avoid vaccine fraud, the only places you should obtain a COVID-19 vaccination are from a health department sanctioned provider. Most states are currently distributing the vaccine wither through healthcare workers that arrive at a nursing home facility or community centers and fairground settings so that people can drive-thru and get a vaccination safely. The state in which you live will announce where sanctioned vaccine distribution will take place. They will also announce if there will be any registration required or if it is a wait-in-line situation. The federal government is covering the expense of all vaccines in an effort to encourage everyone to get vaccinated. Vaccine payment is not required from anyone.
