You would think that there being no legal precedent for being a wrongly appointed Prime would mean there can't be a criminal sentence for "stealing the Primacy" but that doesn't have to be the case, especially if the "stealing the Primacy" thing is an old law that isn't relied on much at all.
To give an IRL example, some places have laws against "wandering children", with "wandering" being completely subjective — a "wandering" child was one, who in the opinion of a Truant Officer, was walking aimlessly. But if you stop and think about it, "wandering" is not illegal in of itself, and so suggesting that any child who is walking without a purpose is committing a crime is absurd.
It's also very legally uncertain, because if wandering as a child — not as an adult, mind you — is a criminal act, then how can people regulate their behaviour to follow the law?
Back to the prompt, now: Magnus could easily win by arguing that the offence of "stealing the Primacy" is legally uncertain — if the Prime is appointed, then how the hell can he steal the office of his appointment?
I do feel that would fail (because this has to be politically motivated in some way c'mon!), and that's when Magnus realises that he needs to do more digging.
Truth be told, tis is actually so ... legally interesting to me? The suggestion that Primes are an office which is appointed is intriguing — it implies that (1) there are protections for this office to carry out its duties safely and w/o pressure and (2) the office-holder can only be removed for just cause (misconduct, or "too old", usually)
Not to mention ... if the Matrix exists, then is the Office of Prime only one that's recognised if you are appointed? There's so much to build here!
Can totally see a possibility where they really want to remove Orion but they have no legal right to, so they're chucking things and hoping they stick — which is how you get that "stealing the primacy" charge.
(223) It's pre-war Cybertron. Newly admitted lawyer, Ultra Magnus, has been called upon to offer a legal defence to Orion Pax, a wrongly appointed Prime — which Ultra Magnus didn't even know could happen, as there's no precedent. He has been accused of incitement to violence, sedition and, worst of all, stealing the primacy. This last carries the death sentence.
"It's a formality," the primal guards assure him, when Ultra Magnus is assigned the case. At the time, he believes them. "He's definitely guilty. It'll be an easy first case for you. High profile, too."
"I am," says the former Orion Pax serenely, when Ultra Magnus finally gets to meets him after three denied requests. He seems like a gentle sort, despite his heavy new frame. Ultra Magnus believes him when he pauses and says: "At least I'm guilty of sedition, anyway."
"It is the right of a Prime to guide the state — or to seek to redress the wrongs of government, when it errs," growls Megatronus of Kaon, whose enormous spiky shape emerges from the shadows when Ultra Magnus is driving home too late at night. (He does not seem a gentle sort.) And, unfortunately, Ultra Magnus believes him, too, when he says: "Know this: if you fail, it will be war."
