There are many contributing factors as to why there are mixed opinions upon Ch. 137. I believe a large part of this is actually the effect of the narrative and structuring of the series. The notion of human and demonic evil will be explored in this; here’s a hint - demons being evil doesn’t excuse the utter annoyance I feel from looking at the fandom’s division upon this topic.

Sebastian is the protagonist of this series which is why we see this story from his perspective, even if it is a mostly third person narrative. This is what we’ve known from the start of the manga; in the first part of ‘Downstairs with Kuroshitsuji’ in Yen Press’ translation, Toboso and Editor K discuss “that butler story” and how “having a butler as a hero is difficult”. In addition to this, there have been numerous tweets that discuss this (x) (x) as well. This leads us to empathise with Sebastian’s character - logically, when you learn and follow someone’s reasoning, you’re more likely to take their side. Following Sebastian throughout leaves people to want to support him.

Now, when a character that you support suddenly does something controversial, this can go either way: you can decide that you disapprove of the action or see that there isn’t anything wrong with it. In Sebastian’s case, people either detest his actions or excuse them with the fact that he’s a demon. In the recent chapter, Sebastian forces Ciel into a catch-22 quagmire. Ciel is lead to believe that he is the reason for his brother’s death and thus he can either take Sebastian’s contract, gain power and lose his soul, or he can refuse and still lose his soul - there’s no way that Ciel can win. What Sebastian has done is terrible. This… is by human standards. You wouldn’t want to play a game where you lose either way. As a demon, by demonic standards, what he’s doing is normal. Demons are evil spirits. Bad. Not good. This fandom seems to forget this. There’s a thin line between thinking that something that is bad is cool and thinking that something that is bad is acceptable. Sebastian is a cool character, but that doesn’t make ragdolling a child’s corpse at all acceptable.

Upon the point of Ciel being “just as bad”, I too would beg to disagree. Ciel is a child that has been manipulated into this way of thinking. If we apply Christian demonology to this, which this series seems to follow more than any other religious demonology, “a man begins to be influenced… to commit sin, there must also be some extrinsic cause of this. And this can be no other than the devil.” (Malleus Maleficarum, P.I, Question V) Plainly speaking, of course demons are assholes and they’re going to drag you down to be an asshole as well. Sebastian’s influence has done this to Ciel, as we’ve seen from Ch. 137, he has been raised to believe that this is the right way. Many times, it’s stressed that Sebastian has “cultivated” his soul. This key word shows us that he sees Ciel like produce, only for consumption. There aren’t any ulterior motives as to saving his damn happy meal. What Ciel does, his decisions and ethics, are all as a result of being raised by Sebastian. He destroyed the children in the Circus Arc as a result of a panic attack and Sebastian co-ercing him to take action. While one may argue that Sebastian tried to stop him from killing them and simply completing the Queen’s mission, it is still Sebastian’s “parenting” that had lead Ciel to believe that it was the right thing to do. We’ve seen him before as the small child that wanted to open a toy shop to provide for the children that were sickly like him - he used to be selfless and kind. Therefore, I don’t quite acknowledge the argument of Ciel being terrible all by himself.

Sebastian deserves to be called out for his actions. The excuse that “he’s a demon so he does terrible things” shouldn’t be used as an excuse, rather it should be an acknowledgement. He is a demon - he will do terrible things. We shouldn’t let this slide by. Though I do criticise Toboso’s writing heavily, she has made it heavily clear, many times, that Sebastian doesn’t feel empathy. He “loves seeing [Ciel] grovel and suffer”. This is a character that is evil and he’s been excused for his evil actions because he’s evil; what a shitty contradictory statement. That’s how I’ve seen the Sebastian defence reactions.

This doesn’t necessarily mean that I dislike Sebastian’s character of course. It’s interesting to see someone as evil as him. However, I too am disgusted by what he’s done. If you want my honest opinion, yes, there are a dozen reasons why we should be able to talk smack about Sebastian.

“If I were in Alabama, I would run to the polling place to vote for the Democrat,” said Arizona Republican Sen. Jeff Flake on Monday. He was referring to next month’s special U.S. Senate election in Alabama, where Democrat Doug Jones is running against Republican Roy Moore, who has been accused of initiating unwanted sexual contact with two teenage girls.

We don’t necessarily expect a lot of other Republicans to endorse Jones. But a number of Republican senators have said that Moore should drop out. Some have also encouraged a write-in bid by an “establishment” Republican such as Sen. Luther Strange, who lost to Moore in the primary. Meanwhile, Colorado Sen. Cory Gardner, who heads the National Republican Senatorial Committee, has said that Moore should be expelled from office even if he wins.

With this menu of complicated and undesirable options in front of Republicans, we probably ought to ask a few questions — such as: Would Republicans really be better off if the Democrat wins in Alabama? And if not, what should they do about Moore?

Could a Republican write-in bid work? It’s not quite right to say there are no good outcomes for Republicans in Alabama. Although it’s too late to remove Moore’s name from the ballot, a Republican such as Strange could run a write-in campaign.

But the write-in campaign might not succeed — and it could split the GOP vote, making a win by Jones more likely. There’s some question about whether, even under these unique circumstances, there are enough people willing to vote Democratic in Alabama to get Jones 50 percent of the vote. But if Jones needs only, say, 43 percent to come out with the plurality — or 38 percent, or 34 percent, depending on how votes split between the other candidates — his task is easier. For instance, an Opinion Savvy poll found that a Strange write-in bid would receive only 12 percent of the vote — and would draw more votes from Moore than Jones, enough to put Jones narrowly ahead in the race.

Republicans could also hope that Moore withdraws — but that’s no guarantee that Strange would be elected. Strange isn’t especially popular and wasn’t doing any better against Jones than Moore was in polls before the allegations against Moore came to light. One can imagine extremely depressed turnout among Alabama Republicans if Moore withdrew and Strange, a candidate they’d already rejected, were foisted upon them again.

Moore would probably also get a fair number of votes even if he quit the race. When Republican Dierdre Scozzafava withdrew just days before a special election in New York’s 23rd Congressional District in 2009, she still wound up with 6 percent of the vote, after having polled at about 20 percent before her withdraw. And in my experience working with data from the presidential primaries, candidates typically retain somewhere in the neighborhood of 20 percent to 25 percent of their pre-withdraw polling average if they quit a race but their names still appear on the ballot. Since Moore is polling in the 40s in most polls, that would imply he’d finish with 8 percent to 12 percent of the vote even if he withdrew — or perhaps slightly more if some Alabamians voted for him as a protest against how he was treated by the Republican establishment.

So a successful write-in bid isn’t impossible, but it wouldn’t be easy. Therefore, let’s consider three other outcomes from the GOP’s standpoint: Jones winning; Moore winning and staying in office; and, finally, Moore winning and being expelled.

How bad is it for Republicans if Jones wins? It’s really bad. Having Jones in office would reduce the GOP margin in the Senate to 51-49, meaning that Republicans could afford only one defection on legislation such as tax reform. For example, if both Republican Sen. Susan Collins of Maine and Republican Sen. Lisa Murkowski of Alaska opposed a bill and everyone else voted along party lines, it would fail by one vote.

Moreover, whoever wins the special election will serve out the remainder of former Sen. Jeff Sessions’s term, which runs through January 2021. Having Jones in office already would make it considerably easier for Democrats to win the Senate in the 2018 midterms: With a win banked in Alabama, flipping Flake’s open seat in Arizona1 and Republican Sen. Dean Heller’s in Nevada would be enough to put Democrats in control of the Senate — provided (and it’s a big provision) that Democrats didn’t lose any of their own seats.

To play devil’s advocate: One could argue that control of the Senate in 2019 and 2020 isn’t all that high-stakes. Because there are so few Republican-held seats up for election next year in that chamber, winning control of the Senate is a tougher proposition for Democrats than is taking the House. So, if Democrats somehow win the Senate, they’ll probably already have won the House — and will already be able to block President Trump and Republicans from passing key legislation.

Another silver lining for Republicans is that Jones — looking to win re-election in Alabama — might vote with the GOP on some issues. He could behave similarly to West Virginia Democratic Sen. Joe Manchin, for instance, who has taken Trump’s position on 54 percent of roll-call votes so far.

But that would be a dangerous game for Republicans. Even if there isn’t much legislation passed, Senate control has major consequences, including for Supreme Court nominations and Cabinet picks, in the establishment of committees and commissions to investigate Trump, and in determining which party would oversee an impeachment trial against the president. Moreover, the policy positions that Jones has articulated look more liberal than Manchin’s; he might side with Republicans on some issues, but not necessarily on the most pivotal votes.

How bad is it for Republicans if Moore wins and remains in the Senate? It’s really bad. The inverse of Jones sometimes voting with Republicans is the likelihood that Moore would sometimes vote against Republican leadership. Moore’s policy positions actually aren’t all that different from Republican leadership on issues such as health care and taxes — he’s a culture warrior but not an economic populist. However, he likes to pick fights with the Republican “establishment” and might try to undermine Senate Majority Leader Mitch McConnell. (That McConnell has said Moore should get out of the race would likely only make the antagonism worse.) A good analogy might be to Kentucky Sen. Rand Paul, who has somewhat heterodox political views and is generally an unpredictable vote for McConnell.

But let’s not neglect the much greater consequence, which is that Republicans — if they didn’t expel Moore — would be seen as aiding and abetting, or at least tolerating, someone who has credibly been accused of being a serial child molester. There’s precedent for voters caring about this sort of thing: In 2006, most voters thought Republican leadership was too slow to take action against Republican Rep. Mark Foley, who sent sexually explicit messages to underage congressional pages. That was a contributing factor to a political environment that cost Republicans both the House and the Senate.

Moore’s case is potentially even more explosive. A plurality of voters already disapprove of how Republicans are handling the allegations against Moore, according to a Quinnipiac poll that was released on Tuesday. The conduct that Moore is accused of is more severe, involving physical assault. And he has a somewhat Trumpian penchant for drawing attention to himself — serving as every liberal’s worst caricature of what it means to be a Republican. Keeping one rather erratic Republican vote in place might not be worth it for McConnell if it further hurts the Republican brand and puts more House and Senate members at electoral risk next year.

How bad is it for Republicans if Moore wins and is expelled by the Senate? It’s really bad. This is the least predictable of the bad outcomes, however. There are cases in which expulsion could turn out to be relatively smooth for Republicans and others in which it would be the most disastrous option of all.

Although no senator has been expelled since 1862, the Senate probably has the constitutional power to expel Moore, which requires a two-thirds majority.2 In McConnell’s perfect world, all but a handful of Republicans would vote for expulsion, and all or almost all Democrats would come along, avoiding a protracted debate. Another special election would be scheduled, which could have an unpredictable outcome (more on that below) — but as a bonus for Republicans, Republican Gov. Kay Ivey could appoint an interim replacement for Moore, presumably Strange or another “establishment” Republican.

But that’s if everything goes relatively well — and at every stage, there’s the chance it might not. The expulsion process itself is somewhat fraught; it would probably require committee hearings at which Moore and his accusers could be compelled to testify. At a minimum, it would be a distracting political circus at a time when Republicans were hoping to pass tax reform and other legislative priorities.

Then there’s the question of whether McConnell would have the votes. For the time being, expulsion might seem like a relatively attractive option for Republicans — but there’s already some disagreement within the Republican caucus. There might be more once Moore was elected and Republicans had to consider the consequences of overriding the popular will for a senator whose alleged conduct was publicly known at the time of the vote. Democrats could play games with the process by withholding their votes, forcing the GOP to come up with more Republican votes instead. Perhaps most risky of all: Trump has yet to weigh in on expulsion, and he could use the occasion to go “nuclear” on McConnell by opposing it.

Finally, Republicans might face the same dilemma after the next special election. Moore could run again and win again. And Jones or another Democrat might also have a shot. So the worst-case scenario for Republicans is that Moore is expelled after an extremely contentious process that further poisons the relationship between the GOP base and GOP leadership — and then Moore (or Jones) wins the next special election anyway.

So, what should McConnell do? I really don’t know. But there’s an argument that all of the other outcomes are so bad that Republicans might as well try their luck with a write-in campaign.

Let’s say that without a write-in, the odds are 60 percent that Moore wins and 40 percent that Jones wins and that with a write-in, the odds are 50 percent Jones, 25 percent Moore, and 25 percent Strange. So, sure, the write-in campaign makes Jones more likely to win. But it reduces Moore’s chances by more than it helps Jones’s chances — and if you’re truly indifferent between Jones and Moore, the trade-off is worth it for you.

Then again, it wasn’t so long ago that another Republican was credibly accused of sexually assaulting multiple women just a month or so before a major election. Many Republicans legislators called for the candidate to drop out. Instead the candidate stayed in the race and won — and the claims are rarely discussed today. As was the case with Trump, Republicans may decide that the only thing worse than living with Roy Moore is living without him.

Do you think Matt is better suited as a prosecutor, or a defence attorney, as he seems to have been most of the time? Which, in your opinion, does he seem to prefer?

    This actually doesn’t come up as much as you might think, so it’s hard to point to a specific panel and say “Hah! Yes, Matt prefers ____”. There’s also not a ton of consistency, and he will occasionally jump from defense to prosecution from one case to another without explanation. But his general trend is toward defense, and since that’s the type of law he’s practiced for most of his career, we can assume that’s what he’s most comfortable with. He hasn’t shown a particular talent for one over the other either. He’s a good lawyer no matter which side he’s on, but overall, he’d rather spend his professional life keeping innocents from going to jail than throwing bad guys in jail– which is part of the reason why he does the Daredevil thing in his off-hours. That way, he is able to balance out the occasional instance of defending people he knows are guilty. And that leads right into your other question, so we hope you don’t mind if we go ahead and answer that here too…

Daredevil vol. 3 #36 by Mark Waid, Chris Samnee, and Javier Rodriguez 

    Matt is a moral guy but a very unethical lawyer, simply because he does operate on both sides of the law. Every single case he takes on is tainted in this way, because he nearly always uses his Daredevil identity and powers to gather evidence and determine guilt. At this late point in the Marvel universe (and with the exception of the period when the Superhero Registration Act was being enforced), being a vigilante doesn’t seem to be quite as illegal as it is in our world, simply because there have been so many dang superheroes around for so long. However, Matt is put on trial for vigilante activity– which we’ll be talking about later in the post– and it’s still a clear breach of legal protocol, and not what a lawyer should be doing. There’s also the factor of his powers, which he uses on a regular basis to give himself an edge, and on which he relies to an unwise degree. He hates defending guilty clients, and has gotten himself into trouble before by trying to determine guilt via heartbeat. All of this isn’t just a Matt problem, by the way– though it does tend to come up more with him than with other superhero lawyers. There’s a great issue of She-Hulk, for example, (She-Hulk (2004) #1, to be specific) where Jen loses a winning verdict because she saves the world while the trial is going on, and the judge rules that this biased the jury in her favor.    

   But Matt is the Unethical Lawyer poster child when it comes to this sort of thing, and this conflict has been a major theme in Daredevil comics, particularly within the last decade-or-so. With this in mind, we’re going to be providing just a few examples, rather than a comprehensive list of offenses.  

   The “Worlds Collide” story from volume 4 #15.1 focuses specifically on this dichotomy of legal work versus superhero work. Early in both his legal and… extralegal careers, Matt is assigned to defend a man who he apprehended as Daredevil. While spending his nights trying to ascertain whether his client is actually guilty, in court he is put in the position of arguing against the concept of superheroes.  

Matt: “What are his motives? What does he want? I want to know who this man, this ‘Daredevil’– who is, essentially, accusing my client of murder– I want to know who he is. Other than a criminal. We know he’s at least guilty of assault… and, in the case of the defendant, involuntary imprisonment. Consider the facts… An unknown man in a disguise attacks someone… tackles him to the ground… and yet it’s the person who was assaulted who gets arrested? This isn’t justice. And it’s not how the justice system is supposed to work.”

   Matt is fully aware of the irony of making this argument and yet continuing to try and determine his client’s guilt as Daredevil. He knows what he’s doing is wrong, and he cares deeply about his career as a lawyer. That’s an important point that we want to make clear. It’s not just a cover/source of intel for his secret life, as jobs occasionally are for superheroes– he genuinely loves being a lawyer and cares about the legal system. But even in this story, at this early point in his career, he feels justified in taking massive liberties with the law for the sake of ensuring that justice is actually done. It is acutely difficult for a ‘foreign’ author to break into the English-language market, where only 3% of the published works are translations from other languages. Even the world’s fourth most populous nation is struggling to have its voices heard: despite Indonesia being Southeast Asia’s most prolific literary nation, producing tens of thousands of books per year, its most renowned authors remain relatively unknown to the wider world.

Yet before Indonesians can even contemplate access to the vast English-speaking market their books need to be translated – and that is often where the problems begin.

“I think there’s a critical mass of very good writers [in Indonesia] who deserve much greater exposure, but they are only going to get that exposure if their work is translated well,” says Gill Westaway, a freelance translator and editor who lives on Lombok island, Indonesia.

Most Indonesian authors realise that the financial rewards of being translated and ‘making it’ in the English-speaking world are limited – the vast majority of Western authors also struggle to make a living solely through writing books – but the benefits of the increased status for authors and the country’s literary scene in general are incalculable.

“I think it’s very important [to get translated] because there aren’t many potential Indonesian readers compared to those who read in English,” says Ratih Kumala, an Indonesian author who has written six works of fiction, including a novel that was translated into English as Cigarette Girl. “Indonesia is a small country in the world, and nobody knows the Indonesian language unless you have lived here for a long time.”

Leila S. Chudori, an experienced journalist and author who has written several anthologies of short stories and last year had her novel Pulang translated into English and titled Home, also advocates for reaching more people but cautions against writing for the wrong reasons.

“If you think you want to write because you want to be read in America or Australia and want to be translated into 20 languages and want to win the Booker Prize… I’m afraid it will be contrived.”

Perhaps the greatest showcase to date for Indonesian authors came in October 2015, when the country was the guest of honour at the prestigious Frankfurt Book Fair, which attracts more than 7,000 exhibitors from 100 countries and up to 10,000 journalists from around the world. First and foremost, this stimulated Indonesian publishers, who realised they might be able to sell rights abroad, and it also resulted in hundreds of translations into English and German.

Yet business has reverted to something like normal. There are hundreds of publishers operating in Indonesia, most of them tiny, and it is increasingly difficult for them to survive in a market where a large print run is 3,000 copies of a book and profit from sales barely offsets production, promotion, distribution and marketing costs.

According to many Indonesian writers at the Ubud Writers and Readers Festival (UWRF), there are numerous paths to achieving the status of ‘published author’. Some had been picked up directly by a publisher, others had self-published, and many had been approached by Indonesian-speaking Westerners interested in translating their work. Meanwhile, online publishing on-demand is also becoming a key avenue for Indonesian authors, who send manuscripts directly to such a company, which then prints copies to order – whether one or 1,000.

The two publishers that stand out, particularly for authors looking to break into the English-language market, are Gramedia and Lontar. “Gramedia go for the media with a mass commercial appeal, because that is going to bring in the money – even though there is not a lot of money in it. Whereas Lontar go for a more literary bent – not necessarily trying to capture the big market. Depending on your raison d’etre, there are different criteria for which books get chosen,” says Pam Allen, associate dean at the University of Tasmania and a widely published Indonesian-to-English translator who works with Lontar.

Gemi Mohawk, an Indonesian poet who ghosts around the UWRF wearing his trademark all-black clothing and hat, had his second collection of poems published as a book titled Indonesianus by an individual benefactor who simply loved his work. Prior to this serendipitous meeting of minds, however, Mohawk had received short shrift from the local publishing industry.

“When I tried to publish my book through this major publisher, it was rejected because I hadn’t published any books before, and because I am not a famous person. But how could I publish a book if I cannot publish my first book?” says Mohawk.

According to John H. McGlynn, the American co-founder of Lontar and someone described at the festival as the “godfather” of literary publishing in Indonesia, similar problems persist for authors who wish to step onto the international stage. “Almost no foreign publisher will publish, without financial subsidies, translations of anything other than best-selling or award-winning novels,” he explains.

Nevertheless, there have been breakout stars. The current international poster boy for Indonesian literature is Eka Kurniawan, whose first novel, called Beauty is a Wound in English, has been translated into 28 languages. His second book, Man Tiger in English, was named on the 13-book longlist for the Man Booker International Prize.

Yet even Kurniawan’s route to the pinnacle of contemporary Indonesian literature was a fateful combination of many factors, including undoubted talent, perfect timing and first-rate translation – while an endorsement from legendary Southeast Asia scholar Benedict Anderson, and the presence of a noted literary agent, Pontas, did no harm either.

“Indonesian literature is kind of obscure in, say, a global literary scene, so it’s not easy,” he says, pointing out that his first two books, which have received glowing reviews in the West since being released there in 2015, were actually written 14 and 12 years ago respectively. “It took a very long time until finally there was one publisher from the UK who wanted to publish [my work].”

Jennifer Lindsay, a translator for the weekly Indonesian magazine Tempo and former lecturer in Southeast Asian literature at the National University of Singapore, says the clamour for marketable works is not only counting out certain novelists, it is creating an environment in which the very best Indonesian writers are being ignored completely.

“The novel as a form is such a European fixation, and it’s not necessarily where the best writing is. It skews what kinds of things are translated, it skews people’s view of the variety of writing in other languages,” she says. “I would say that a lot of Indonesia’s best writing, really good writing, is in short forms and also in plays… not necessarily the forms that are going to get them the big attention in the Western world.

“To turn the whole thing around, if English wasn’t the dominant language, who the hell would have translated James Joyce or any of those experimental writers? They wouldn’t. They’d think: ‘Who the hell is going to read this stuff?’”

Even for authors whose work does eventually find a home with a Western publisher, often the struggle has just begun. Any work of literature that is translated, in any language, is doomed to lose something of its original essence or meaning. However, most authors at the festival, from international success stories such as Eka Kurniawan to localised talents like Gemi Mohawk, seemed to agree – some more begrudgingly than others – that it is a price worth paying for a potentially larger audience.

Ratih Kumala remembers the deep anguish she felt over the translation of her book Gadis Kretek, which became Cigarette Girl in English. The problem, for her, lay in the treatment of the word kretek, a particular type of cigarette flavoured with cloves and intrinsically associated with Indonesia.

“I was a little bit disappointed actually,” she says. “I wanted to keep the name kretek, or clove cigarette, because this is a very special type of cigarette in Indonesia. But my editor and my translator wanted it just to be titled Cigarette Girl. Deep down in my heart, it was just – it’s not the same! It’s not the same. But in the end I had to let go.”

Perhaps the largest problem faced by Indonesian authors seeking exposure beyond their own shores, however, is that the general standard of literary translation in the country remains very low.

“A high level in the quality of translation is and will always be the single most important factor in Indonesia’s success as a source of international-quality literature,” says McGlynn. “Unfortunately, not only are translators dreadfully underpaid; by and large, their skill is rarely recognised.”

Indeed, the art of translation is massively undervalued in most cultures, and it is rarely acknowledged that a good translator needs to have literary flair of their own. Add the fact that Indonesian is far from a commonly learned language in the Western world and, suddenly, finding someone who combines the requisite literary flair in their native tongue with fluency in Indonesian – and is willing to undertake a huge task for relatively little remuneration – becomes rather difficult.

Even Gramedia, the country’s largest publisher, is struggling. One translator at the UWRF, who asked to be quoted anonymously, described the majority of Gramedia’s translations as “appalling”.

There is, however, only so much that Indonesia’s private publishers can do without concerted support from the government. Recognition of the importance of the creative industries is undoubtedly lacking in Indonesia – and even more so across the majority of its Southeast Asian neighbours.

“It needs the country’s hands there. It needs the involvement of the government, because this is serious… First, governments should think that literature is important. If you don’t think that literature is important, nothing will be done. Second, writers are important, and third, translators are important,” says Kadek Sonia Piscayanti, an Indonesian author who started her own independent publishing company. “So, if these three sit together, I believe that there are so many talented writers… [but] you cannot do it yourself; you have to be helped by a systematic structure.”

According to McGlynn, the government can take two tangible steps to promote Indonesian literature: set up a committed and long-term programme to fund translation, and ensure Indonesia is represented at overseas literary festivals and book fairs – an exercise that is prohibitively expensive for most Indonesian publishers and authors.

Until something changes, it seems that even the country’s most successful contemporary author, Eka Kurniawan, is destined to see overseas success as something of a surprise, and not readily attainable, even for a country with such rich storytelling traditions.

“I think it’s more like a bonus for me,” he says. “Of course, there are many, many readers outside Indonesia, but I still write stories, first and foremost, for Indonesians… It’s not easy to translate literary work, but I think that just because it’s not easy we cannot give up on this. It’s very important.”
